Ministry of local governance, development and the spatial planning Decree No. 2016-325 on 08 March 2016 Decree No. 2016-325 on 08 March 2016 repealing and replacing Decree No. 2009-359, April 20, 2009 amending article 12 of Decree No. 86-761 of 30 June 1986 on the organisation of Commons in districts and establishing the status of district delegates.
REPORT of PRESENTATION order No. 86-761 June 30, 1986, amended, relating to the Organization of Commons in districts and establishing the status of district delegates, determines the dcs allowances amount allocated u latter.
By Decree No. 2007-592 10 May 2007, these allowances were adjusted for delegates from the District of Dakar. Subsequently. Decree No. 2009-159 April 20, 2009, while now the compensation awarded to these delegates, has revised upward, the allocated to other delegates taking into account status and budget of the commune.
However, the rates of these allowances. Despite different operated upgradings, today, seems low because, on the one hand the high cost of life and, on the other hand, the increase in the responsibilities of these auxiliaries of the Mayor, especially with the advent of the Ade III of decentralization. Indeed, this reform, enshrining the principle of citizen participation, place the delegate's area at the interface of population and administrative power.
In the region of Dakar, in particular, the role of delegate district, the Mayor and representative of the Administration becomes more important because including dela salience and the sharpness of the questions that he is required to treat.
Also, is the present draft decree designed to align the allowances of delegates to districts of the other communes in the region of Dakar on the rate of those in the city of Dakar.
Such is the economy of the draft decree.
The President of the Republic, seen read Constitution;
Having regard to the general Code of taxes;
Having regard to the general Code of local authorities;
Considering Decree No. 86-761 10 June 1986 concerning the Organization of Commons in districts and establishing the status of district delegates, as amended;
Considering Decree No. 2003-101 of 13 March 2003 on the general regulation on public accounting. amended;
Having regard to Decree No. 2014 - 845 06 July 2014 appointing the Prime Minister;
Mindful of Decree No. 2014-853 09 July 2014 on the allocation of services of the State and control of public institutions, societies and corporations with public participation between the Presidency of the Republic. the Primaturc and departments, amended by Decree No. 2015-299, March 06, 2015;
Having regard to Decree No. 2015 - 855 of 22 June 2015 on the Composition of the Government.
On the proposal of the Minister of local governance, development and planning, decreed: Article 1. -The provisions of article 12 of Decree No. 86-761 of 30 June 1986 referred to above, are repealed and replaced as follows: 'Article 12. ((- Area delegates receive an annual allowance whose amount is fixed as follows: A) for the communes of the region of Dakar: whatever the area, unique annual rate of 600,000 CFA francs, or 50,000 CFA francs per month: B) for the communes other than those of the Dakar region:-for common area towns and cities , the. annual rate is 480,000 CFA francs, or 40,000 CFA francs per month;
-for the common departmental capitals and municipalities with a budget equal or greater than 500,000,000 CFA francs, the annual rate is 360,000 CFA francs, or 30,000 CFA francs per month;
' - for other towns, annual rate of 300,000 CFA francs, or 25,000 CFA francs per month.
S. 2. - the Minister of economy, finance and the Plan and the Minister of local governance, development and spatial planning are responsible, each in relation to the implementation of this Decree which shall be published in the Official Journal.
