Act No. 2014-24 of 1 July 2014 repealing and replacing certain provisions of Act No. 83-03 of 28 January 1983 on the special status of the personnel of the Digit




EXPOSE REASONS


Since independence, the Service du Chiffre has continued to assert itself as an administrative unit, indispensable to the security of internal and external government communications.

However, the ever-increasing development of cryptology resources and benefits, as well as the need to ensure the optimal security of national information systems, requires that efforts to equip the Encrypt National solid scientific foundations, strengthened and the administrative technical structures in place consolidated.

Also, the increase in the level of recruitment and training of the staff of the figure is essential.

In those circumstances, it appears essential to amend certain provisions of Act No. 83-03 of 28 January 1983 on the special status of the figure, in particular those concerning the methods of recruitment and training of cryptologists, of the Engineers for the work of Encryption and Encryption.

In addition, it is important to recall that under Article 4 of this Act, officials of the figure remain subject to the obligation of permanent and permanent professional secrecy.

To this end, they shall take an oath of good and faithfully perform their duties and not reveal, even after leaving their service, the secrets of which they became aware in the exercise or in the exercise of those functions. Therefore, it would be necessary to provide them with a monthly special bonus of permanent and permanent professional discretion, the amount of which will be fixed by decree.


The proposed amendments to nine (09) of the fifty eight (58) sections of the Act:

1 °) increase in the level of training of cryptologists (hierarchy A1) whose recruitment will take place on titles (doctoral ès-sciences mathematics, physics ou informatics) and by direct competition (Master in mathematics, physics or computer science);

2 °) substitution to the body of engineers of the works of the Digit (hierarchy B1), a body of the engineers of the Digit (hierarchy A3). They will be recruited from among the candidates who hold the Bachelor of Science, Physics or Computer Science degree and will be trained for thirteen (13) months of a higher level;

3 °) substitution to the body of the cipher (herarchy B4), a body of cipher (hierarchy B3). They will be recruited from the Scientific Undergraduate candidates and will be trained for thirteen (13) months of a higher level;

4 °) extension, in the interest of the Service du Chiffre, of the commission currently limited to the body of ciphers, to those of cryptologists and engineers of the Digit in order to give the agents commissioned a possibility of integration in these Body by way of professional competition;

5 °) revision of Article 14 of Act No. 83-03 of 28 January 1983 in order to take into account the permanent and permanent professional discretion premium.


This is the economy of this bill.



The National Assembly adopted, at its meeting on Friday, 20 June 2014;
The President of the Republic enacts the following legislation:



Article 1. - Articles 2, 3, 14, 46, 48, 50, 51, 53 and 55 of Act No. 83-03 of 28 January 1983 are repealed and replaced by the following provisions:

" Article 2. -The officials of the figure are grouped together in a single framework consisting of three bodies:

-the body of cryptologists;
-the body of the engineers of the Digit;
-the body of the ciphers.


The three bodies thus defined, the hierarchy to which each one is attached, the modalities of their recruitment and their indicial classification, are determined in accordance with the following table:

" Article 3. -The President of the Republic appoints the ranks or jobs of the bodies of cryptologists and engineers of the Digit. It may delegate the power of appointment to the ranks or jobs of the Body of Figures.


" Article 14. -The employees of the figure are entitled, after service, to remuneration comprising:

-treatment;
-residence allowance;
-family surcharges;
-allowances and premiums to compensate for the general requirements inherent in the figure, including the rates and procedures laid down by decree.

The pay system is defined by Order in Council. The treatment is fixed by reference to the value of the basic index of the public treatment grid.

" Article 48. -Can be commissioned in one of the figures in the framework of the figure, non-state officials who count on the figure at least two (2) years of effective services and who are able to hold a job in the numerals.


However, the number of agents commissioned in each of these bodies cannot exceed 20 % of the size of each body.

" Article 50. -Commissioned agents in one of the figures' bodies shall be subject to the provisions of Articles 4 to 10, 19 (paragraphs 1 and 2), 52 and 54 of Law No. 83-03 of 28 January 1983 and the decrees adopted for their application.

" Article 51. -Commissioned agents in one of the Bodies of the figure retain the remuneration attached to their rank or employment of origin.

However, they receive a monthly lump-sum allowance for subjection inherent in the figure for which the rate is fixed by decree.

" Article 53. -By way of derogation from the provisions of Articles 11 (3 °) and 13, commissioned officers may, for the duration of their commission, present themselves to the professional competitions organised for recruitment giving access to the bodies in which they Are commissioned. They are not allowed to run more than three times in these competitions.

" Article 55. -Candidates received in direct or professional competitions, before the date of entry into force of this Law, in accordance with Law No. 83-03 of 28 January 1983 and in the course of schooling, shall be appointed in the bodies provided for in Article 2 of the This Act in accordance with terms and conditions laid down by decree ".


Art. 2. For the initial constitution of the bodies of the framework of the figure and by way of derogation from the normal conditions of recruitment, officials of the bodies of cryptologists, engineers of the work of the number or cipher previously governed By Law No. 83-03 of 28 January 1983, respectively, and from the date of appointment of the first corresponding promotion resulting from the training provided for by the provisions of this Law and their Application decree, reclassified in the new bodies of cryptologists, engineers of the Number or ciphers under conditions determined by order of order.


Article 3. - Orders-in-council will set out the terms and conditions of this Act.


This Law shall be enforced as the law of the State.
