Law n ° 2016-09 of 14 March 2016 establishing an ECOWAS biometric identity card




EXPOSE REASONS



The establishment of a national biometric identity card constitutes the major decision adopted by the forty-sixth (46th) ordinary session of the Conference of Heads of State and Government of the Economic Community of African States The West (ECOWAS) held in Abuja on 15 December 2014.

On the occasion of this summit, a recommendation was also made to the Member States of the Community space to put into circulation from 2016 this biometric identity card which will also serve as a travel document within the space ECOWAS.

The aim, through the introduction of this common biometric identity card to all the member states of ECOWAS, is to facilitate intra-regional mobility by means of a secure title to combat trafficking and And to respond at the same time to the current challenges of combating the terrorist threat.

It is in order to be in harmony with this Community decision that it is necessary to replace the national digital identity card digitised currently in progress in our country and introduced by Act No. 2005-28 of 06 September 2005 and its implementing decree n ° 2005-787 of 06 September 2005, the vast majority produced in 2006 expires in 2016.

This smart ID card can serve multiple applications at the same time and, if necessary, serve as other cards.

The National Assembly adopted, at its sitting on Friday 04 March 2016,
The President of the Republic enacts the following legislation:


Article 1. - An ECOWAS biometric identity card is established based on biometric data.



Art. 2. This identity card is issued to Senegalese citizens.

It is compulsory for all citizens who are at least fifteen (15) years old and can be issued to any citizen of five (05) years of age.



Article 3. - This card is valid for ten (10) years. At the end of this period, it must be renewed.



Article 4. - The aforementioned identity card is a multi-application electronic smart card.

It may also be used for other purposes, in accordance with procedures laid down by decree.



Article 5. - The conditions for the issue and renewal of the said card, as well as the factors involved in biometrics and its effective date, as well as the expiry date of the old identity card are fixed by decree.



Article 6. - The provisions contrary to this Act and in particular those contained in Act No. 2005-28 of 06 September 2005 establishing the national identity card digitised shall be repealed.

This Law shall be enforced as the law of the State.
