Therefore, his organization deserves special attention with regard to its impact on religious, cultural, political, social and economic plan.

That is why, following the recorded malfunctions in the Organization past editions, it seemed necessary to take measures to improve the quality of public service to pilgrims.

Indeed, activities related to the pilgrimage are numerous and complex, requiring the implementation of an appropriate organizational framework, hosted by quality human resources.

The present draft decree aims to establish a general delegation in the pilgrimage to the Holy places of Islam, structure attached to the Ministry of Foreign Affairs and Senegalese living abroad and having main missions for the preparation, coordination, supervision and control of the Organization of the pilgrimage to the Holy places of Islam.

This is the purpose of the present draft decree.



The PRESIDENT of the Republic, pursuant to the Constitution;
Pursuant to law n ° 2011 - 15 July 08, 2011 on organic law on finance laws;
Pursuant to Decree No. 2011 - 1880 November 24, 2011 on general public accounting regulations;
Having regard to Decree No. 2014 - 336, March 25, 2014 on the organisation of the Ministry of Foreign Affairs and Senegalese living abroad;
Having regard to Decree No. 2014 - 845 06 July 2014 appointing the Prime Minister;
Mindful of Decree No. 2014-853 09 July 2014 on the distribution of the services of the State and the control of public institutions, societies and corporations with public participation between the Presidency of the Republic, the Prime Minister's Office and the ministries, amended by Decree No. 2015-299 06 March 2015.
Having regard to Decree No. 2014-871 of July 22, 2014, on the powers of the Minister of Foreign Affairs and of Senegalese living abroad;
Pursuant to Decree No. 2014 - 1212 22 September 2014 on Code of public contracts;
Having regard to Decree No. 2015 - 855 of 22 June 2015 on the composition of the Government.

On the report of the Minister of Foreign Affairs and Senegalese living abroad, DECREED: Article 1. -It is created a Delegation in the pilgrimage to the Holy places of Islam (DGP), attached to the Ministry of Foreign Affairs and for Senegalese living abroad.

S. 2 - the DGP has for main missions the preparation, coordination, supervision and control of the Organization of the pilgrimage to the Holy places of Islam.

As such, it is responsible for:-registration, transport, accommodation, restoration, religious supervision and aftercare of the pilgrims quota allocated annually.
-the development of specifications related to the organisation of activities of pilgrimage to the Holy places of Islam;
-from issuance to private operators of prior authorizations to the Organization of the pilgrimage to the Holy places of Islam;
-control of compliance by private operators, the regulation on the Organization of the pilgrimage, clauses of the workbook the loads and the conventions and protocols concluded between tour operators and pilgrims;
-the application of penalties laid down for breach of the obligations of the private tour operators and pilgrims;
-from any other mission in connection with the pilgrimage.

S. 3 - the General Delegation for the pilgrimage is placed under the authority of a general delegate appointed by Decree.

He is assisted by a deputy general delegate.

The delegate-general ensures the proper performance of all the missions of the General Delegation to the pilgrimage to the Holy places of Islam.

As such, it is, inter alia, responsible for the representation of the Delegation to national and foreign authorities.

It coordinates the activity of the administrative, financial and technical services of the Delegation to which it ensures proper operation. It liaises with private tour operators.

S. 4. - by delegation of the Minister of Foreign Affairs, the general delegate is an administrator of the appropriations entered in the budget of the State for the Organization of the pilgrimage to the Holy places of Islam.

S. 5. - the Director general may negotiate and sign contracts for the organisation of the pilgrimage, on behalf of the State, in compliance with the laws and regulations in force.

S. 6. - the general delegate is supported in its mission by a permanent Secretary, placed under his authority, and appointed by order of the Prime Minister.

It can receive delegation of general delegate signature.

S. 7 - pay for the delegate-general and the deputy general delegate, as well as various benefits accorded to them shall be fixed by Decree.

S. 8 - the DGP includes the following cells: 1. the administrative and financial unit
2. the unit of medical and religious affairs;
3. the cell Communication and Public Relations;
4. the logistics cell;
5. the Legal Affairs, assistance and control unit.

S. 9. - the Organization of cells enumerated in article 9 above will be specified by order of the Minister for Foreign Affairs, on the proposal of the delegate-general.

S. 10 - is hereby established, under the authority of the general delegate, a mission to mentor and assist administrative, medical and religious pilgrims.

It includes an administrative team and a medical team, the total number may not exceed twenty (20) members. The rest of the staff consists of providers, on-site, recruited in Dakar and in Saudi Arabia.

The mission of mentoring members are appointed by order of the Minister of Foreign Affairs.

S. 11 - in regards to the related tasks, including, registration and supervision of pilgrims, both in Senegal that in Saudi Arabia, the delegate-general conducts the recruitment of temporary staff, within the limits and conditions laid down by order of the Minister in charge foreign.

Delegate general accountable to the Minister in charge of Foreign Affairs of the use of funds and initiatives taken within the framework of the Organization of the pilgrimage.

S. 12 - the DGP is subject to the control of the organs of the State.

S. 13 - the Minister for Foreign Affairs and for Senegalese living abroad and the Minister of economy, finance and the Plan shall be responsible, each in relation to the implementation of this Decree which shall be published in the Official Journal of the Republic of Senegal.
