In view of article 4 of the Constitutional Law no.185 / 2005 and Article 6 of Qualified Law
186/2005;
Promulgate and publish the following ordinary law approved by the Great and General Council
its meeting on 21 July 2009.

PROVISIONS GOVERNING THE ISSUE OF PASSPORTS AND DIPLOMATIC SERVICE

PASSPORT
Art. 1

1. The Secretary of State for Foreign Affairs has authorized the issuance of the passport
diplomatic and service passports, which are signed by the Captains Regent and the Secretary of
State for Foreign Affairs or, in his absence, the Director general of the Foreign Affairs Department.
2. The diplomatic passport is evens, with regard to technical requirements, the
recommendations adopted by the International Civil Aviation Organisation (ICAO).

Art. 2

1. They are entitled to the issuance of diplomatic passports:
a) Their Excellencies the Captains Regent pro tempore, their spouses and children living at the expense of
age not exceeding 18 years, corresponding to the term of validity ; if i
Captains Regent pro tempore fall in the categories referred to in points b) and c) of this article
, their previous diplomatic passport will be retained by the Department of Foreign Affairs
and returned at the end of sent reggenziale;
B) the Secretaries of State, their spouses cohabiting with validity equal to the duration of the Legislature;
C) the Great and General Council members, with validity equal to the duration of the Legislature;
D) Diplomatic Agents referred to Read September 16, 1993 n. 105 and 19 April 1979 n. 13 and subsequent
changes, regular service, and their respective spouses.
Diplomatic passport will be valid two years, corresponding to the duration of the agreement signed by them;
E) the minor children of cohabiting Diplomats agents, of which the Laws September 16, 1993 n. 105 and
19 April 1979 n. 13, as amended, actually residing in the country or at the International Organization
credited with validity equal to that of the parent
Diplomatic Agent;
F) the Coordinator of the Foreign Affairs Department, with validity equal to the duration of its term;
G) the officers of the Foreign Affairs Department, whether incorporated or not in the diplomatic career,
valid for five years.
2. In the event of termination of service before the expiry of validity of the passport, the same
must be returned to the Department of Foreign Affairs for the cancellation. 3
. In compliance with the provisions of Article 1, paragraph 2, the minor children shall not be included in the diplomatic
the holder's passport, because strictly individual document.
In their favor will be issued an individual passport.

Art. 3

1. The Diplomatic Agents can use the diplomatic passport only when
themselves they are to travel for reasons of his office or the office conferred on them.
Of this must be notified in writing to the Secretary of State for Foreign Affairs.

provided by this Act.

Art. 4

1. Diplomatic passport, even if expired, it is revoked by decision of the State Secretary for Foreign Affairs
when the holder, for whatever reason, is no longer in possession of the
requirements prescribed by this Law, the Laws 16 September 1993 n. 105 and 19 April 1979 n. 13
amended.
2. Diplomatic passport, even if expired, it is revoked by decision of the State Secretary for Foreign Affairs
to the spouses of holders referred to in Article 2 points b) and d), in case of separation provision
ie pronunciation of nullity of marriage or of
dissolution or termination of the civil effects of marriage ruling.

Art. 5

1. The diplomatic passport and service passport models are depicted in
places prototypes to the acts of the Great and General Council and reproduced in Appendix to this
law.
2. The essential features of the diplomatic and service passport and the costs related to the issuance
will be described in a special decree.

Art. 6

1. The Captains Regent and the Secretaries of State and their spouses, and the members of
Great and General Council, the diplomatic passports will be issued at the time of the functions
.

2. To diplomats and their family members you will be issued a diplomatic passport
after the formal acceptance by the country or international organization for accreditation. 3
. The diplomatic representatives available diplomatic passport will be issued at the time of engagement

Art. 7

1. The service passport, whose technical characteristics and concerning the issue
are equal to those provided for diplomatic passport, may be issued by the Secretary of State for Foreign Affairs
following a reasoned request of the person concerned or its Director or Head of service, actual
and motivated service requirements, to:
a) senior officials of the State, civil and military, in the case of appointment as a member of official delegations to conferences or visits to
'abroad or in other exceptional cases;

b) administrative staff of the Public Administration in the event of a foreign mission;
C) Coordinators and Secretaries of Department Details in the case of missions abroad;
D) consular representatives from the consular offices in actual service at Embassies and Consulates
, which are not in possession of diplomatic passports;
E) administrative personnel in actual service at Embassies and Consulates;
F) consular representatives available;
G) children living with dependents aged 18 years of Secretaries of State;
H) state drivers in the exercise of their functions;
I) spouses and children living with dependents aged 18 years of the Great and General Council members
.
2. The service passport is evens, with regard to technical requirements, the
recommendations adopted by the International Civil Aviation Organisation (ICAO).

Art. 8

1. The service passport is valid for one year.

Art. 9

1. The loss or theft of the diplomatic passport or service passport must be immediately denounced
:
a) to a Police Department Body and this informed the Department of Foreign Affairs, if
occurred in the territory of Republic;
B) Authority to the local police and informed the Diplomatic Mission or Consular
of the Republic of San Marino or the Department of Foreign Affairs, if it took place abroad.
2. The Department of Foreign Affairs, received the communication referred to in the preceding paragraph,
he declares the diplomatic or service passport lost or stolen no longer valid and will relay the information to the Passports Division
Interpol so that it is inserted in
database of lost documents / stolen ICPO Interpol. 3
. Diplomatic or service passport reported lost or stolen to be
later found to be promptly delivered to the Department of Foreign Affairs that
ensure its destruction, which is specific records.
4. Upon release of a new diplomatic or service passports at the Department of Foreign Affairs
shall cancel the previous passport valid.

Art. 10

1. The Department of Foreign Affairs - Directorate of Political Affairs - care education practices
relating to the issue of diplomatic passport and service passport and updates
the special archive.
2. The release request form that the person concerned must sign and fill in all its parts must be complemented by
:
a) birth certificate;
B) certificate of citizenship;
C) criminal record and pending charges, issued by the country of residence;
D) two recent photographs with the characteristics required for the issuance of ordinary passports.

Art. 11

1. And 'he repealed the law 10 March 1989 n. 25 and any provisions in conflict with this law

2. The diplomatic passport or service issued before the entry into force of this Act
remain in force until the natural expiration.

Art. 12

1. This Law shall enter into force on the fifteenth day following that of its legal publication
.
