We the Captains Regent of the Most Serene Republic of San Marino
promulgate and publish the following law passed by the Council Great and General
its meeting of 17 March 1972. TITLE I
|| ° | Purpose - Organic - Dependencies Art.1


the Core Purpose of Rocca Uniformed Guard is instituted for the security service or the Borders
of the Republic and of honor to the Public Palace.
If necessary, with the approval of the High Command of the Militia, assists the body
Gendarmerie in all services entrusted to the latter.
Art. 2

Office of Nucleus The Office of the Core Command of the Guards Rocca is ssociato to the Corps Command of the Gendarmerie
.
Art. 3 Qualification

The staff belonging to the Core is military in effect and is subject to the rules of
Laws for Militias (Law 15 January 1867), and the Disciplinary Rules military
( law May 27, 1872), except that the same are not in conflict with this Regulation
.
Art. 4
Staff
The core comprises, in hierarchical order, as follows:
- 1 corporal;
- Two corporals;
- 7 soldiers.
During the summer period will be provided to take into service, as necessary, temporary
guards with competition issued by the State Congress, on proposal of the Commander of the Guardia di Rocca
.
Art. 5

Duties Commanders of the Gendarmerie and Fortress Guard have the complete organization of
Core.

Art. 6

C) - prove always polite to everyone and especially towards those who require news and

processing service;
F) - to pay his own work to the State even if not one of the ordinary duties;
G) - to respond to the Administration, when, through their own fault, are due to damage;
H) - always and at all times avoid pronouncing p unseemly role and act calmly and thoughtfully

I) - reside permanently in the territory of San Marino.
Art. Admission to the Core 7

Those aspiring to be admitted on the staff of the Nuc and or the Fortress Guard Uniformed in
quality graded or soldier will participate in the public competition held on the proposal of the High Command of the
militias by the State Congress.
The aspirant must submit an application addressed to the Command of the Guardia di Rocca, in paper
accompanied stamp of sottonotati documents with stamp duty which must be originals or copies certified by a notary public in compliance
:
- birth certificate;
- Criminal record;
- Certificate of good conduct;
- Certificate of citizenship of San Marino;
- Certificate of pending;
- Qualification;
- Family status.

that examines proceeding to appropriate information and sends it with the opinion of
competence to the Secretariat of State for Internal Affairs for the more 'to be practiced.
Art. 8

Requirements Applicants must meet the following requirements:
a) - not younger than 18 years and not more than to 25 years;
B) - Primary school certificate (provided they are in possession of a good general education);
C) - minimum height mt. 1.70 and visus not less than 8/10 ds;
D) - healthy and strong physique and be free of diseases and imperfections that reduce
possibility of providing wholehearted service and in particular have sufficient capacity

Aspirants will undergo a medical examination by the Medical Officer.
The winners are hired with QUALIFIED graduated or soldier on probation for one year.
Art. 9

Trial Period After the trial period of an anus, at the proposal of the Commander of the Gendarmerie and the
Commander of the Fortress Guard, the State Congress sanctions the final recruitment in

Art. 10

Art. 11

Selection Committee The Selection Committee for the appointment of these military is organized as follows:
- President: Secretary of State for Affairs of the Inter;
- V. President: an officer of the General Staff appointed by the High Command of the Militia;
- Member: Commander of the Fortress Guard;
- Member and secretary: a literature professor designated for this purpose by the President.
The list will be enforced by the State Congress.
Art. 12

When the Oath to the actual military steps must first take an oath to the Commander
Higher Militia in the formula and in the manner prescribed by the Military Rules.
Art. 13

Dependence The members of the Core of the Uniformed Fortress Guard depend hierarchically from the organs military
through the Commanders of the Fortress Guard and the Gendarmerie.
The hierarchical dependency relationship between the members of the core is the degree, with the same
grade, length of service.

Art. 14 Specific Duties

Those aspiring to the core will always dress, while on duty, uniform and from time to time
accessories prescribed by the Core Command.
Art. 15

Service The rosters are established by the Command of the Gendarmerie with the observance of the weekly rest
and are marked on a special memorial.

At the end and the beginning of the service members of the Nucleus shall report to the Command of the Gendarmerie

Art. 16

Wave The members of the Core when they are in formal duty should bow as follows:
a) - Guard needs to stand and present arms:

B) - the watchman must have the weapons:
- the Secretaries of State;
- Members of the State Congress;
- Commissioners of the Law;
- Commanders of the Officers Corps and San Marino also in civilian clothes;

- Directors;
- Military grade higher than the same sentry.
The members of the Core, in uniform, although not in service, in addition to the above authorities owe
greeting to all those citizens who challenge them for any reason.
Art. 17
Behavior in uniform
The members of the Core, in uniform, can not remain in public exercises.
Art. 18
Relations between the members of the Core
In relations between the members of the core using the "you."

Art. 19

The monthly remuneration of the members of the core is determined as follows according to the table

Art. 20

Art. 21

Art. 22

Clearance The members of the Core have the right, in case of end of service, to a severance pay equal to many

The severance pay is not paid to the member who made less than six months of service
or was deposed.
The fractions of a year are awarded to twelfths.
Art. 23

The right to a pension belonging to the Core has the right to compulsory insurance benefit under Law 30 June 1964 n
. 37, as amended.
Art. 24 Family allowances

The members of the Core are entitled to receive child benefit according to the criteria established by
existing rules for state employees.
Art. 25

Licenses To the members of the Core is up an annual license to the following extent:
a) - no license day during the trial period;
B) - 15 days leave during the second year of service;
C) - 20-day license during the third year of service;
D) - 25 days leave during the fourth year of service;
E) - 30-day license from the fifth year of service onwards.
The license can be enjoyed in one or more 'periods consistent with the requirements of the service.
It may also be granted the following extraordinary licenses;
- 15 days in case of marriage;
- 5 days for serious family bereavement.
Art. 26

waiver of the license The licenses referred to in the preceding Article may not be waived.
The military is obliged to apply for a license on the appropriate form to the
Core Command guided by the norms of the article above.
The same command will in any case to shift according to service needs.
Art. 27

Commanders of the Gendarmerie and Fortress Guard may retain or recall his military service during
license.

Art. 28 Remuneration of non enjoyed

The fee for non-enjoyed, for reasons of service is set at 1/26 of the basic salary

Art. 29
Awards
Those in the core which are particularly deserving made in the line of duty
can be awarded as follows:
- praise of the Commander of the Fortress Guard;
- Commendation of the Superior Commander of the Militia;
- Solemn commendation of the High Command of the Militia.
Art. Leave on personal grounds 30

The member of the core, for personal reasons, may apply for unpaid leave to
State Congress, who examined the reasons, after the favorable opinion of the Commands | || Gendarmerie and Fortress Guard, will decide.

Art. 31
Settlement of death
The legal or testamentary heirs will receive the severance pay if payable to the deceased. TITLE IV

The Stability appointed permanent member of the core can be removed only after the resignation,
retirement, dismissal, removal from office.
Art. 33 Resignation

The member of the core faculty has to give at any time his resignation. They must be submitted in writing to
Command Core three months before leaving the service staff effective

The resignation shall be communicated to the State Congress through the Command of the Guardia di Rocca
, which shall take note, with the option for the same to extend the period of notice of up to twice
.
The Congress of State may suspend the liquidation of order resulting service
resignation when it is going on in the disciplinary proceedings or criminal.
It is considered resigning employee, who, s nce justification, abandon their
service for three days and did not reoccur as a result of the invitation of the Core Command.

In that case the employee will be entitled to payment of fine service reduced by one third.
Art. 34
Placing at rest
Those in the core are exempt from official service, whatever the duration of the
served, at the age of 55 years
Art. Transfers 35

If the component the Core should leave the requirements of these Regulations the Public Administration will

Art. 36

Illness In case of disease, belonging to the core, must immediately give notice to the Command
Core and within 24 hours to transmit the medical attestation disability.
At any time the above control may be carried out by means of the Tax Doctor.
Art. 37 Disability

During the incapacity due to illness on the Core component will receive the salary, unless such
disability does not exceed six months.
By overcoming the period of six months, the military will inte de unpaid leave for up to a year

The expectation ends with the cessation of the cause for which he was placed.
The Core Command may at any time proceed to appropriate health checks.
After the maximum period of leave, the soldier who is unable to resume regular

Disciplinary measures Art. 38 Species of measures

The disciplinary measures, which should be recorded on the personal folder of each guard, are
:
a) - warning;
B) - censorship, consisting of a letter of reprimand;
C) - suspension from work up to five days without pay;
D) - suspension from work for up to 15 days without pay;
E) - dismissal;
F) - dismissal.
Art. 39 yellow card

The measure referred to in subparagraph a) of Art. 38 applies to:
- negligence on duty;
- Deficiency of the accessories of the uniform;
- Carelessness in personal cleanliness;
- Omission of greeting to the superiors and civilians and the failure to return the greeting itself.
Art. Censorship 40

The measure referred to in subparagraph b) of Art. 38 applies to:
- unaccustomed delay to undertake the service;
- Sprawl and undignified in service;
- Conversation in the civil service for things not related to the service itself;
- Delay or unintentional omission of communications related to the service;
- Demeanor incorrect to superiors or to the public;
- Removal from the place of service for a period not longer than 10 minutes;
- Comments on service orders;
- Socializing in public exercises, in uniform.
Art. 41
suspension up to 5 days
The measure referred to in subparagraph c) of art. 38 applies to:
- recidivism of the offenses referred to in the previous article is about;
- Complaints disrespectful towards superiors protests;
- Breach of professional secrecy, unless it constitutes a crime;
- Any breaches of the duties under this Regulation;
- Removal from the place of service for more 'than 10 minutes;
- Non-compliance with any internal regulations, issued by the commander of the Core to
purpose of discipline or organization, even if not included in these Regulations, except that you do not fall

- Immoral conduct both in service and in private life;
- Tolerance of irregularities in the service;
- Drunken off-duty;
- Failure to comply with the usual time of service;

Art. 42

The measure referred to in subparagraph d) of Art. 38 applies to:
- recidivism of the offenses referred to in the previous article is about;
- Acts or facts that tend to create discontent or unrest among the members of the Nucleus;
- Serious abuse of authority;
- Drunk on duty;
- Sale, alteration or loan of Administration garments;
- Declaration of physical ailment, recognized by tax non-existent visit.
Art. 43 Dismissal

The measure referred to in subparagraph e) of art. 38 applies to:
- constant recurrence of the offenses referred to in articles Prev nti;
- Loss of the excellent moral conduct and civil;

- Participation in uniform in political demonstrations.
Art. 44 Dismissal

The measure referred to in subparagraph f) of art. 38 applies to:
- any willful or negligent act against smmarinese State or against foreign states;
- Any conviction for intentional crimes;
- Manifestations of strike or incitement to strike,
- any act prejudicial even non-serious nature against property of the State;
- Failure to live up to the oath;
- Insubordination to addiction.
Art. 45
For all offenses not covered by this Regulation shall apply the rules governing military
for the company of uniformed (Law 27 May 1872).
Art. 46

The measures by the letter a) in point b) it will be inflicted jointly by the Commanders of the
Fortress Guard and the Gendarmerie.
The measures by the letter c) to d) it will be inflicted by the High Command of the Militia.
The measures by letter e) to f) it will be inflicted by the State Congress.
Art. 47

Appeal Against punitive measures by the letter a) in b) are open to appeal to the written
Higher Command of the Militia, which sanctions definitively.
The applicant, however, it is responsible for the deficiencies that he would commit with the appeal.
Art. 48

2nd Appeal against the decision of the High Command of the I izie the employee may appeal to Congress
status.
Art. 49 Appeal to the Administrative Magistrate

Against the resolutions involving the dismissal or removal, the employee may
resort to the Judge of Appeal for civil cases constituted as Administrative Judge.
The appeal must be filed at the Chancellery of the Commissioner's Court within ten days ahead of his
notification of the measure.

The ruling of the Administrative Judge's decision is final.
Art. 50 Temporary suspension

At any time the Commander of the Unit may, pending the outcome of a criminal case
, to the employee's service suspension.
The temporary suspension will result in the loss of pay, unless the reintegration of
same in case of acquittal of any charge.
Art. 51

At Uniform belonging to the Core is prohibited to make any changes to the uniforms supplied, whose
characteristics are fixed by the State Congress on the proposal of the Core Command.
Art. 52

Clothing The clothing is borne by the State which provides for renewal under regulations established by the Congress of State
.
Art. 53

The Core Command must be kept for each component even temporarily, a state matriculation
with all master data and service changes.
Art. 54 Transitional rule

No matter what the age limits and provided they have the required qualifications, can remain in service
all graded and soldiers currently carrying out service in the Uniformed core
Fortress Guard.
Art. 55

Final Provision Any law or provision contrary to these Regulations shall be repealed.
Art. 56
This Regulation shall enter into force immediately.

EXAMINATION PROGRAMS

EXAMS FOR GRADUATED, GUARDS PERMANENT AND TEMPORARY
written tests: - composition of general culture
(to be determined by the Commission);
Oral tests: - conversation about military laws and on
political order, historical and adminis- trative the Republic

COMPILATION OF MERIT FOR THE SIGNING OF aforementioned soldiers
:
test written: - score from 1 to 10;
Oral test: - score from 1 to 10;
Foreign language knowledge: - 2 points for each foreign language spoken
discreetly.
The Commission may make use of qualified interpreters for the definition of the score about
foreign languages.
