Discipline of the contributions of tasks and supply teachers for teaching posts in
schools of all levels in the Republic of San Marino.

We the Captains Regent of the Most Serene Republic of San Marino
promulgate and publish the following law approved by the Great and General Council
its meeting on 17 July 1979.
Art.
1 This Law is enacted in compliance with the St. lished by art. 32, third paragraph, of the Law
22 December 1972 41, and Art. 6 of the Law of May 3, 1977 # 19, and it governs only
assignment and the engagement and supply teachers for teaching posts in the
schools all levels of the Republic of San Marino existence at the time 'entry into force of Law
.
The provision of art. 2 of the Law of 25 July 1978 25, is repealed and replaced by the present
law.
Art. 2
The open-ended assignments conferred to fill the places of training for full-time or part
they are free or vacant and that is, without the owner or person in charge stabilized or other
teacher already instructed indefinitely .
The indefinite assignments are to cease nly in one of the following assumptions:
1) when, subject to the provisions of Article. 24, the new owner, who won the competition organized peril
teaching post conferred in charge, he takes service;
2) While is deleted teaching post in full or part time for which commissioned
was conferred;
3) when the charge has lost one of the requirements referred to in subparagraphs d) and e) of Art. 7.
In the circumstances mentioned in items 1) and 2) above, when teachers
could lose the job are more 'than one, ends the teacher's assignment where the assignment itself is
for less time was given and, in the case that the transfer has taken place on the same date, ceases
charge of that teacher who had been allocated a more 'high-order number in the ranking
force of the transfer.
Art. 3
Replacements are entrusted to fill the teaching positions to full or part-time whose
owners or agents are idle.
Replacements cease in each of the following circumstances: 1) when, in keeping with Art.
24, ceases the absence of the owner or person in charge for the replacement of which the substitution had been conferred;
2) When, however, it ceases the school year;
3) when the deputy has lost one of the requirements referred to in subparagraphs d) and e), art. 7.
Art. 4
The teaching posts are to full or part time, depending on whether or not to supplement the normal weekly hours
provided in the second paragraph of art. 2 of Appendix "E" of the Law
Organic and subsequent amendments.
The assignments can only be conferred to teaching posts with a time of
least two hours per week.
Art. 5
latest on 31 May of each year the Office of Personnel issued a public manifesto,
by synthesizing the current legislation, will lead to the knowledge of those concerned all the charges and various
obligations which they must fulfill for October black insertion in the rankings.
This public manifesto remains posted for at least 30 days even to valvas palatii, the rolls of

Art. 6
Those wishing to be included in the lists must submit an application on plain paper to the Office of Personnel
by 30 June each to no.
In the application the applicant shall specify the proprii name and surname, date and place of birth,
residence, address and the telephone number and must specify what the rankings in
which it intends to be included.
The application shall be accompanied by so many forms, available at the Office of Personnel,
how many lists where the applicant innde be inserted.
Art. 7
The application referred to in Article previous applicants must enclose:
a) certificate of citizenship of San Marino or, peri forensic, certificate of residence in the Republic;
B) birth certificate showing his age is not less than 18 years or for those wishing
be included in the list for the post of ass-existing kindergarten, not less than sixteen years
;
C) medical certificate issued by the Health Officer certifying medical fitness to serve in teaching posts
for which it will apply for inclusion on the list;

D) police certificate confirming that the applicant has no criminal convictions, for crimes not culpable
, involving restrictive of personal freedom penis for a period longer than
year or involving, for the same space time, disqualification from public office;
E) certificate of pending showing that the applicant has not been formally challenged
any offense for which the penalties indicated in letter d) are theoretically envisaged;
F) certificate proving the achievement of tito oo of qualifications required by Annex
"A" of the Organic Law for each post of ensign for which it requested the inclusion in
ranking, with relative vote.
The application referred to in Article Previous applicants may also attach:
g) of the family record with proof of any family expenses
released by the Institute for Social Security;
H) certificate showing the eventual achievement of itoli different study than those indicated in the
preceding paragraph to the letter f), but considered productive scoring under this
legislation;
I) certification issued by the Office of Personnel proving the achievement of any
service titles.
The certificates referred to in subparagraphs a), c), d) and g) of the preceding paragraphs shall be valid for inclusion
in the rankings only if posterior released on 30 April of year when demand
is presented; the remaining certificate attached to the applications may be presented in previous years
can be withdrawn from the d attached to the new application requesting.

Art. 8
When the qualification required in Attachment "A" of the Organic Law for the teaching post
is graduating, they are allowed at the bottom of the rankings, in assigning
supply teachers, even those who have not yet qualified as long as they have passed all
exams in their study plan for the first two years of the course.
In this case, the applicants, in place of the degree certificate, referred to in point f) of the preceding
, must produce a certificate issued by the University at which they are enrolled
proving overcoming the exams required by the approved curriculum, with relative
vote referred to in the preceding paragraph.
Art. 9
The requests, with accompanying documents, are made as soon as the Office of
staff which shall logged, and to release r cevuta indicating the date of submission and
documentation.
In the event that the applicant, for reasons beyond his control, is unable to
produce some of the documents mentioned in the foregoing articol, other than those referred to in points d), and of
' art. 7, these documents can be temporarily replaced by one made on plain paper
declaration signed in the presence of the Office Manager of Personnel, in which, under the
of the penalties provided for by art. 297 Criminal Code, the applicant certifies to be
possession at that time of the requirements that would have to be supported by the documents missing
. These documents must in any case be produced by 31 July of the year when the
application was made; failing that, the commission of art. 14 excludes automatically by
ranking the applicant when no document is one of those listed in the first
paragraph of art. 7 and shall reduce the score and to correct an applicant's order number
when no document is one of those listed in the second paragraph of art. 7.
If the situation mentioned in the preceding paragraph, the certificat referred to in paragraph 2 of art. Eight must also indicate
date of passing of each investigation.
The documents pursuant to paragraphs and previous articles are free of stamp duty.
Those who have regularly submitted the application and the documents referred to in the first paragraph
art. 7 by the closing date of the preceding articles as prescribed by this
Law have right to be included in the lists.
Art. 10

Lists for appointments and substitutions.
The Commission consists of:
1) from the Office of Personnel Manager, or another official designated by the Chief of Staff,
as President;
2) by a senior official of directors of San Marino schools designated by the State Congress;
3) two representatives of trade unions.
The Commission shall be convened by the President not later than 10 July of each year and, in the first meeting,
it elects from among its members a Secretary entrusted with the task of drafting the minutes of
meetings.
The Commission verifies the existence of the legal requirements for applicants, the
questions and the attached documentation and compliance with deadlines; It even delivers back
calculating the scores attributed to each applicant and provides more 'in general to carry
any other activities necessary for the formation of the rankings.
The member who dissents from a collective decision taken by the Commission is entitled to have
put on record their dissent and the reasons therefor.
Art. 11
By 20 July of each year the Joint Commission in the preceding Article shall
fill in the provisional rankings on the basis of what is established in the evaluation tables of the securities
attached to this law under the letters "A", "B" and "C" respectively for schools kindergartens
, for primary and secondary schools and high schools.
The rankings are formed one for each of the qualifications in Attachment "A" of
Organic Law.
Appropriate rankings are also formed for assistent of kindergartens in art. 6
Law June 10, 1974, # 40, and the teacher of Law in the High School; the title required for
study this teaching post has a degree in Law or Political Science or Economics and
Commerce.
For transfers of assignments and supply teachers for the teaching of physical education is provided
based on a single classification for access to which the application relates expected
teaching of this subject in secondary school .
Students enrolled ISEF are admitted to the ranking in the previous article under
the provisions of Art. 8 for the university students.
Art. 12
The rankings, compiled on special forms provided by the Office of Personnel, should
contain the following information:
1) in order of points, starting with the most 'high, the name and surname, date and place of birth,
residence and the telephone numbers of all those who, under this law, have
right to be included in the same list;
2) the serial number and the score attributed to us individual one of those who were placed in
ranking;
3) the analytical elements that contributed to the scoring formation and allocation of
order number of all enrolled students in gradu inquiry.
Art. 13
The provisional rankings, compiled in indicat ways in previous articles, shall be promptly published
, prepared by the Bureau of Personnel, together with the related reports, by
posting for at least 10 days to valvas palatii, at the books of the Castles, in the Office of
Personal same, in the roll of the San Marino schools and by delivery of a copy to the
Trade Unions.
Art. 14
Against the provisional rankings referred to earlier articol are open to appeal to the
Joint Commission which then fill.
I, submitted in simple card, must be d deposited with the Office of Personnel by
July 31 of each year, must contain the grounds of complaint and should be communicated
by registered letter at least the first of those immediately preceding the applicant
in the provisional rankings.
Within the next ten days, the Commission shall:
1) to examine and decide with a warrant from the ric RSI drafting the minutes to be published
by posting at least 15 days in the Office of Personnel and means transmission of copy
to the trade unions;
2) to form the basis of its decisions on complaints and on the basis of the provisions of the
2nd and 3rd paragraph of art. 9, the final lists that must be posted up on blanks
prepared by the Office of Personnel.
The final lists remain valid for the entire school year immediately following
with their training and, just drawn up, they must be promptly published by the Office of Personnel
, by exposure, the whole period of their validity, to valvas

Palatii, the rolls of San Marino schools and by delivery of a copy to the Organizations
Unions.
Against the final lists are open to appeal to the Council of Twelve.
Apart from the individuals concerned, the use of cual first subparagraph may also be presented
by the Public Administration and the Trade Unions.
Art. 15
By 20 July each year, the special Joint Commission, taking into account the number of students enrolled in the
next school year and teaching on requirements, shall draw up a General Plan
of the Chairs, which, in particular, should also contain a summary of the places of
teaching full-time, or part-which, in the a no education immediately following,
for now certainly predictable definitive failure or temporary absence of the owners or agents
or for other reasons, must be covered by s assignments, and supply teachers to
ways as described in articles 2, 3 and 4.
Commission comprises:
1) by Deputy Education , or official delegated by him, as Chairman;
2) of the deans and headmasters of the San Marino schools;
3) by many representatives of the trade unions as there are members in the preceding
numbers 1) and 2).
The Commission shall be convened by the President and, at the first meeting, shall elect from among its own members a
Secretary which is responsible for the function of preparing minutes of meetings.
The Commission, consistent with the needs of practical and organizational, should
try to form the largest possible number of teaching positions to full-time and
merge the largest possible number of hours in teaching posts part time, provided
in no more 'school of three different locations, taking into account that the teaching of one subject or
of the same group of materials as part of the stes in class or section should be left to a
only teacher.
The plan and the statement referred to in the first paragraph must be remitted to the Congress of State, for
related decisions.
Art. 16
By 20 August each year, the Office of Personnel Director shall convene
meeting those who are enrolled in the last final lists for the purpose of proceeding to
assignment of tasks and substitutions.
The convocations are made by registered letter and must indicate the date, place and
set the time for the meeting of members of each list;
squad may be represented by proxy; the meetings can intervene a representative for each
Trade Union Organization.
Its meetings, which can not be set for later date to August 31, the Executive Office of Personnel
allocates to members on the list assignments and
substitutions resulting from the prospectus referred to ' art. 15
In the allocation of tasks and substitutions of the Office of Personnel Manager,
exception made for the provisions in art. 17, strictly follows the order set out in the
current final lists for the school year that must begin by assigning the first places of
teaching that presumably will last and the more 'long time.
During the meetings each member on the list, giving up to those who would
been entitled under the preceding paragraph and art. 17, can still opt for positions
or supply teachers to those who are entitled to it postponed a sequence established by
preceding paragraph and art. 17.
The disclaimers and options must be reduced to writing.
In any case to members on the list referred to 'rt. 8 teaching posts may be assigned
only by way of substitution.
Those who have already been assigned an assignment or substitution are suspended from other
rankings for the entire term or substitution; but when the teaching post is part-time
they have the right to complete the schedule with hours of teaching that may be
assigned a ranking based on the here and was made the first assignment.
To carry out the operations referred to in this Article, the Office of Personnel
Director may delegate another official in the same office.
Art. 17

If compatible with the overall timetable of the school premises, the teacher in charge who hold regular

When teachers set out in the preceding paragraphs are more 'than one, the Office of Personnel
Manager shall make the assignments in the order of seniority of employment and, at the same

Art. 18
by 5 September each year, the Director of the Office of Personnel provide for conferring
assignments and supply teachers assigned to the previous Articles by registered letter
with acknowledgment of receipt which must be indicated:
1) the subject or subjects that must be taught;
2) the number of hours of teaching a week;
3) remuneration;
4) the office or school locations at which teaching should be performed.
Within five days of receipt of the registered letter referred to in the previous paragraph
, those intending to accept assignments or supply teachers conferred on them must be
submitted to the Office of Personnel its acceptance by registered letter or by declaration
signed in the presence of an official from; in the absence of such express acceptance
assignments and substitutions are intended objected.
The transfer of tasks and substitutions must be promptly published by the Office of Personnel
, by exposure to the sites mentioned in the penultimate paragraph of art.
14 of the prospectus referred to in Article. 15, on which shall be entered particulars of those to whom
teaching positions have been transferred and who have accepted the assignment in accordance with the preceding paragraph
and means of transmission copy to the Trade Unions.
Relevant statutory provisions regulate, as' soon, the allocation of the seat of
teachers of the same order of the school and their transfer.
Art. 19
The places of training for full or part-time, that, for unforeseen or not
provided deficiencies or temporary absence of the owners or agents or alternate, or other causes,
should be covered by conferral of new assignments or temporary jobs during the school year
, conferred by the Manager of the Personnel Office in the order fixed by the fourth paragraph of Article
. 16 and art. 17 consistent with the overall timetable of the school premises.
In the allocation of tasks and substitutions referred to in the preceding paragraph, the Executive Office
Personnel must also conform to the criterion laid down in the fourth paragraph of art. 15.
The appointments indefinitely to be injected during the school year are still conferred
to the person entitled in the order established in the first paragraph, even if these covers have another teaching post
. If, however, the claimant occupies a teaching post by way of assignment or
Annual replacement, he, for the current school year, continues to serve for the teaching
already conferred in previously, while the new task is given to materially
another teacher as a replacement until the end of the school year. The award is made by registered letter with

Those intending to accept assignments or substitutions conferred on them pursuant to paragraphs earlier
, must submit a Personal Office of its acceptance within three days following the receipt of the letter
referred to preceding paragraph by registered letter or
by declaration signed in the presence of an official from; failing that
express acceptance, assignments or substitutions are intended objected.
Also made contributions during the school year are subject to the advertising
provided for in the third paragraph of Art. 18.
Art. 20
The case of urgency, the Director of Studies or Dean Institute provides for the post of

registered letter referred to in the fourth paragraph of the preceding article.
Art. 21
The rejection also unjustified assignments or substitutions do not involve any of the consequences provided
art. 13 of the Law of May 3, 1977, n.19.
Art. 22
The assignments and alternates, except as provided in paragraph and the next are
subject to the duties imposed to state employees by the Organic Law and have the rights
covered in art. 17 of the Law of May 3, 1977, n.19.
The prohibitions arising from the incompatibility provided for by Law 8 September 1967, 38 and art. 30
Organic Law levied only on the charge or alternates who have already played
teaching weekly hours than half of what full for at least two consecutive months

Art. 23
The representatives or alternate members who hold a teaching post at full time are entitled
to a salary equal to that provided by the Organic Law for the post of teaching

The representatives or alternate members who hold a part time teaching position are entitled to a salary

proportional to the number of teaching hours worked ; for this purpose are included in calculating all hours of lesson
what time provided weekly for the post of teaching, including teaching hours
not carried out for midweek holidays or suspension of classes due to causes not attributable

The representatives or alternate who held a teaching post at full-time for a
total of at least 180 calendar days during the same school year
have the right to receive his remuneration until the end of ' school year.
The representatives or alternate who played a part time teaching post for a
total of at least 180 calendar days during the same school year
are entitled to receive remuneration even in m is summer ; in this case the salary is
proportionate to the weighted average number of weekly teaching hours worked.
The representatives or alternate who receive remuneration even in the summer months, as long as
continue to receive the same pay, must remain available to the school until
to the amount of such a prescribed service for in-service teachers .
In any case include representatives or deputies are not entitled to periodic increases in art. 56
Organic Law.
Art. 24
The delegate or alternate who has continuously held a teaching post beginning
of the school year until April 30 continues to hold the post of teaching until the end
of the school year even if occur the circumstances of art. 2, second paragraph, No. 1 and
art. 3, second paragraph, 1.
In this case the teacher who won the contest and returned to service after a temporary absence
is made available to the school until the end of the school year and has right to receive
of remuneration equal to that which would be paid to the teacher if
same went for the post he is entitled.
Art. 25
The matters not covered by this law are regulated by the Law May 3, 1977,
19 and the Organic Law.
To be included in the lists referred to in this law the first subparagraph does not apply to art.
9 of the Law May 3, 1977, n.19.

Art. 26
The deadline for submitting applications for this year was set for August 10;
the term for appeals against the provisional rankings to 20th August.
The deadlines for the completion of all other modes are moved accordingly.
Art. 27
This Act comes into force immediately.
