We the Captains Regent of the Most Serene Republic of San Marino
Promulgate and posting following law approved by the Great and General Council
its meeting of 30 November 1979. I °

CHAPTER oF tHE jUNTA oF CASTLE
Art. 1
The territory of the Republic is divided, for the purposes of this Act, in nine administrative
called "Castles", namely:
City of San Marino, Borgo Maggiore, Serravalle, Acquaviva, Chiesanuova, Domagnano, Faetano ,
Fiorentino, Montegiardino.
Art. 2
In order to promote the participation of citizens in political life and for efficient and modern
administrative features, are reformed with the present law, the appointment system and
powers of Councils operating in each of the Castle Republic.
Art. 3
The council held in the house of the castle.
In Castelli with population greater than 2,000 inhabitants, the council consists of 21 members; in
Castles with less than 2,000 inhabitants, the council consists of 15 members.
Art. 4
La Junta Castle in office lasts four years and shall perform his duties until the election of the new council
.
The outgoing Board shall perform routine functions dministration
since the convening of the electoral meetings until the election of the new council.
In the event of resignation or removal from office, or of one or more 'of its members dead, you

Art. 5
In the 15 days following the election, unless justified delay, the members of the Juntas elected

Art. 6
The sessions of the Board of Castello are public, except for matters concerning
persons and private interests.
The quorum for sessions must be present at least half more 'one of the members.

The sessions are convened by the Captain of the castle at least once a month and whenever
necessary or requested by at least 1/3 of its members.
In the latter case, the agenda must be that shown in the meeting request.
The summons must be made with a notice of five days and must contain the agenda.
The agenda and date of the session should also be made public with posters from
post in the spaces provided.
The Board that not sitting for more 'than 4 consecutive months, or for less than 6 sessions in a year, has fallen
.
The Regency, upon verification, it declares the dec-law and ensure the convening of
electoral meetings in the Castle for the election of the new council.
The members of the Board may not be prosecuted in the courts for the views expressed within the
Junta in the exercise of their functions or to formulations votes.

CHAPTER II TASKS OF THE JUNTA OF CASTLE
Art. 7
The Castle Board is the organ and instrument for the promotion of a permanent
democratic participation of citizens in political and administrative life of the Republic and
stimulate discussion and cooperation of citizens in order to particular problems of the castle and
general interest. It may carry out any activity deemed profitable to the affected population,
identifying their aspirations and striving to achieve them.
The duties and functions of the Board of Castello are deliberative, consultative, promotional
, control and management of local services.
The decisions of the Board shall be entered by the Secretary in the minutes, which is approved by the Government
same in the next session.
Within five days of the approval, copy of the minutes must be sent to the Captain care

Castle to the Secretariat of State for Internal Affairs which will publish the resolutions
having significant interest, in accordance with Law 5 May 1979 n.
26. Each of the Board decisions must be motivated.
Art. 8
The Castle Board has authority to resolve, in lim you the Laws and regulations,
in the context of the territory and population of the Castle.
The Castle Board is competent to:
a) activate the popular question to provoke decisions of institutional bodies;
B) give opinions on programs, problems, acts, public works, social services
about the Castle;
C) carry out the democratic control over the activity of the Public Administration, after
complete information;
D) participate in the management of social services;
E) manage the budget of the Board;
F) make requests and proposals to the state bodies;
G) give mandatory opinion on each new work ubblica;
H) exercise the legislative initiative with the inoltr of bills
approval of the Great and General Council, according to the sanctioned mode of art. 12;
I) promote the referendum in the manner and within the limits that will be provided by the appropriate
popular initiative law without prejudice;
L) submit to the Election Commission's proposals for revision of electoral rolls,
proposals to be mandatorily discussed in the review of lists.
At the legislative and administrative bodies are obliged to require, subject to full information and documentation
, the opinion of the Board on actions taken pursuant to points b) and g) above.
Art. 9
The Castle Board in order to activate the popular question and provoke within terms
established, decisions of higher organisms, is competent to:
a) transmit agendas, concerns and suggestions to each entity and public body of
any topic;
B) submit interpellations, requests and proposals to the Congress of State, within 60 days of receipt
, must give a written reply to the Board;
C) invite to its sessions representatives of the State Congress, the Great and General Council, or
Entities, why refer to problems of general interest;
D) seek to confer directly with the state bodies;
E) use of the media of the various institutions or to publish its proposals, observations and
documents;
F) promoting popular assemblies;
G) promoting cultural, sporting, recreational and promotion in the civil
Castle;
H) it is forbidden to Juntas establish direct reports on any matters with government agencies and
other states.
Art. 10
All questions concerning the issuance, transfer or modification of commercial licenses and craft
to be exercised in the castle territory, except for powers that the laws
establish trade, must obtain the prior nothing authorization of the Executive.
The Councils should express themselves on questions within 30 days of receipt.
In the absence of the authorization, if the department responsible considers it appropriate to access the requested
can return the application to the council because the reconsideration.
In case of further negative opinion the request did not progress. Also Juntas, within the limits of
special budget funds, decide independently on assistance within the
Castle; the Commission of Assistance ceases the exercise of similar functions attributed with
this Act to the Board in health-care.
Art. 11
The Castle Board has the task of expressing opinions, which must be requested with
complete the documentation by the administration, about the annual budget of
State forecast for the formulation of which will be held joint meetings with
enforcement officials, in which will be analyzed on requirements of the Castle on the needs
General of the Republic and to the availability of the financial statements.
It also has the duty to cooperate with the bodies and public offices in health,
social security, public education, the culture goods, price controls and so on
regard to the public interest local.
Art. 12
The Board may submit to the Secretary of State for Internal Affairs bills drawn up in articles
, with explanatory report and indicating the expense coverage of any material, excluded
laws of amnesty or pardon , the tax laws and budget and ratification of international treaties

The Congress of State, with the assent of the Commission responsible Political Council Chamber, may,
within 60 days to the presentation, return the bill to the Council proposing,

Art. 13
The Castle Board promotes and coordinates the democratic control of the activities of the mass
Public Administration and public bodies, with particular reference to the services
Institute for Social Security.
It also has the task of:
a) exercise control on the performance of services, activities and public works in luog
of competence as well as on the implementation of the rules on the development plan of the territory;
B) monitoring the preservation and administration of the assets of the state, with particular reference to
cultural heritage, archaeological and artistic.
Art. 14
The castle council has the task of managing those s local rvices that away
will be delegated by law and by specific provisions, and in particular v rde public, leisure facilities and the time
free.
It also is responsible for managing the administration of their mobile assets.
Art. 15
In order to coordinate the activities of the Juntas is among them, both with the activity of the Great and General Council and
of the State Congress, the Regency convo at least once in the six months of his || | mandate, the captains of the Castle, together with the member of the deputy State Congress to
relationships with the committees.
In case of necessity or urgency, meetings may also take place before at the request of at least three
Captains Castle.

TITLE III OF THE CAPTAIN OF THE CASTLE 5

Art. 16
The council is chaired by the Castello di Castello Captain elected by an absolute majority of
present and by secret ballot within the Council in its first session.
The Castle Captain lasts for two years and is re-elected.
When the mandate or in the event of resignation, revocation or death, the council provides
immediately appointing a successor.
If within three months after the first session or at the end of their term or resignation,
forfeiture or death of Captain Castle, the Government does not appoint or replace,
the Regency appoints among the members of the Council, a delegate who satisfies
to all its functions Captain of the Castle.
The delegate lapses from the moment the council names a new Captain of Castle.

5 Art. 17
The Castle Captain:
- represents the council in all respects;
- Convenes and chairs meetings of the Board;
- Prepares the agenda, taking into account the proposals and requests received, made by
representatives of groups present in the council itself;
- It gives over all decisions of the Board;
- Is obliged to report to the State Congress on the problems of the Castle;
- Performs such other functions delegated by the state bodies.

Within the council, and in his first session was appointed a Secretary, who shall hold office for two years and is re-elected
.
The Secretary makes the compilation of the minutes of the meetings and fulfill the obligations of
Capitano di Castello, in the event of his absence.

CHAPTER IV THE ELECTION OF THE JUNTA OF CASTLE
Art. 19
The election of the Executive Directors of Castle either by consulting the entire body of the Castle electoral
to proportional representation list system.
Art. 20
are voters all adult citizens of San Marino, who have residence in the castle and that
are in any of the conditions provided by art. 2 of Law 23 December 1958 n. 36.
They are allowed to vote for the election of each council the voters registered in the electoral lists of the individual
Castelli, formed in accordance with Law 23 December 1958 n. 36 and its modifications.
The Board of Castello di Serravalle is elected by voters registered in sections of Serravalle and
Customs, which form a single constituency.
Addition to the general conditions for electors, are indispensable requirements to be eligible:
a) literacy;
B) does not play as ecclesiastical;
C) be registered in the electoral lists of the Castle where it is presented as a candidate.
Belonging to a castle council is incompatible with the office as a director; Therefore
anyone found simultaneously elected to be part of a Government or the Council Great and
General

for one of the two charges.

manifesto, edited by the Electoral State, they have prepared the certificates of registration in the electoral lists

The lists of candidates, numbering more than that of the seats provided, presented by the

voting at the segretria of the Board of Castello.
If the castle captain does not exercise the functions conferred on it by this Article, the Regency
designates, with its Ordinance, the person appointed to carry out the same functions

15 Art. 22
The convocations of campaign rallies for the elections of Township Councils can not be
within 12 months preceding or following the election policies p.
In the case of early parliamentary elections within 12 months prior to the convening of regular meetings of the Juntas
in office is extended by ggenziale Decree until the completion of the term
indicated in the previous paragraph.

15 Art. 23
For voting procedures, election campaign, the number of seats and all
related regulations, the provisions of Law 23 December 1958 n. 36 and Law 14 July 1959
n. 26 and subsequent amendments, mutatis mutandis. The election results are made public
by decree of the Regency, in which Ra s also indicates the date on which the individual
Juntas will hold the inaugural meeting for the appointment of the Castle Captain and the Secretary
.
Each council appoints three Directors in the first session with the task of providing all the consequent obligations
election results, and then validation of the elect, substitutions and
whatever.
The Chairman of the Board functions, the installation meeting, they shall be exercised by
more 'senior Director, designating for this meeting, the Secretary. CHAPTER V FINAL RULES


Art. 24
In the State Budget is expected an annual fund for the ordinary and extraordinary operation
Juntas in relation to the tasks entrusted to them.
That allocation is broken down by half in equal parts between the individual Councils and the remaining
half in proportion to the registered to vote of each Castle.
The fund for each council will be managed by the same standard.
The control over the fund's management is exercised by the Secretary-General and the Administrative
balance must be approved by the Great and General Council.
The amount of the appropriations can be aggiornat based on reasoned proposals of the Township Councils
when formulating the budget of the State Budget.
Art. 25
For the processing of the normal business of the Board, the Captain of the Castle and the Secretary must
offer their services for a time that will be determined by the same council and otherwise
is sufficient for proper operation .
For the services rendered the Captain of the Castle and the Secretary will be paid from the budget
of the Board, according to the amount that the council itself will determine.
The members of the council employees by private individuals or public bodies are entitled to unpaid leave if they need to carry out extraordinary
r lative to their mandate during business hours
work.
Art. 26
For the performance of the Giunta di Castello, where the law provides, is given the opportunity to

CHAPTER VI TRANSITIONAL AND FINAL
Art. 27
The Juntas currently appointed shall hold office until the direct election of the Juntas same
set for 25 May 1980.
To this date, the Castle of the Captains in office should convene within the terms and according to the mode || | under this law electoral meetings.
Until organization of the Office of the Secretariat of the Juntas, the submission of lists of candidates
art. 21, takes place at the Secretariat of State for Internal Affairs.
The Secretariat of State for Internal Affairs and the Electoral Office will arrange for the conduct of elections
.
Art. 28
It 'repealed the law 25 October 1973 n. 36 and the rules which contravene the provisions of this Act to
.
Art. 29
This Act shall enter into force on 1 January 1980.
