We the Captains Regent of the Most Serene Republic of San Marino
promulgate and publish the following law approved by the Great and General Council
its meeting of 30 July 1980. TITLE I

AIMS 'SCHOOL AND RIGHT TO STUDY

Art. 1
School Aims
The school promotes training and the freedom of the person through the dissemination of knowledge
, education for democratic life, preparation for work.
Along with other members of society it helps to ensure the development of the personality
according to the identity of each.
Through the study, its relationship with the work and the democratic experience school as the
citizens and prepare them to participate in the ec nomic development, moral and civil country.
In the school they are not allowed to race, sex, language, religion, political opinions
.
It therefore educates the commitment and responsibility towards themselves and others, to the critical method, the
search, comparison between different positions to build our individual freedoms, guarantees the acquisition of the tools
basic cultural, puts at the disposal of adult citizens the tools
for further cultural and professional growth, promotes areas of extra cultural interests

legislative systems of education and moral and civil conscience of pupils.
Art. 2 Right to Education

The State guarantees in the forms and within the limits of legg the right to education and the means to achieve it,
by adopting appropriate measures, giving priority to interventions in kindergarten and
in setting mandatory, in order to overcome the social conditioning and to fight
premature exclusion from the education process.
When realizing these objectives the State also prepares collective services, such as meals, transport,
educational materials and supplies also contribute, through the educational grant, the frequency
institutes and universities outside the territory.
The right to education is guaranteed to adults through lifelong learning to be realized
even with the establishment of popular culture courses, remedial courses, refresher courses
periodic, specific cultural orientation courses.
Art. 3
of students bearers of handicaps Inserting
The bearers of handicaps are entitled to attend schools of all levels, fulfilling
compulsory education and with the possibility of inserting the upper grade levels.
To this end the school, with minor service operating within the Institute Social Security, made
save the roles and specific skills, annually prepare a monitoring scheme of the students bearers of handicaps that
, taking into account the particulars of the degree and nature of disability
of each student, the school-age determination, the possibility of intervention
by the school, levels of cooperation by the specialized service, It sets the

The school guarantees the participation of the students bearers of handicaps in educational activities and educational
creating suitable conditions for the recovery.
The specialized team employed by the Social Security Institute provides advice for

The Department of Education provides its own initiative or on a proposal from the staff concerned to provide
preparation tools and updates.
Art. 4

Obligation school Compulsory education is set by 6 to 14 years of age.

TITLE II SCHOOL SYSTEM-JOINTS
Art. 5
school Sorting
The public school system is divided into the following grades:
a) kindergarten
b) elementary school
c) junior high school
d) middle school higher.
The school system realizes the purposes of art. 1 of this Act in constant contact with
vocational training, with the adult education, with public institutions and cultural communication processing
.
Art. 6

Recognition of qualifications The qualifications obtained at the schools of the Republic at the end of specific courses have
legal value.
The mutual recognition of qualifications between the Republic of San Marino and the other States
laws apply.
Art. 7
Plessi, Clubs, Institutes
The kindergarten and primary school are divided into school Plessi located in every

Art. 8

Art. 9

Art. 10

TITLE III MANAGEMENT OF THE SCHOOL
Art. 11
collegial bodies of management
The school realizes the purposes of art. 1 attr to the social management.
The collegial bodies of management of the school have the joints provided by the special regulations

The social management of the school wants to achieve the contribution of each citizen to politics

Art. 13

Teaching in kindergarten and primary schools, the presidencies in middle school and in high school

They are assisted in an advisory capacity with regard to problems of organization and coordination of educational

Art. 14
Councils of Management and
Presidency Councils The Executive Council in kindergarten and elementary school and the Board of Presidency
in middle school and high school are made by
teachers elected annually by the respective Boards of teachers.

Art. 15

Art. 16
Function technical bodies
Chairs and Educational Departments assisted by the respective President and Boards of Directors and the administrative secretary

TITLE IV PROGRAMMING TEACHING, TESTING AND EVALUATION
Art. 17

Art. 18

Art. 19

Educational Research and Experimentation The experimentation in the school of all levels can relate to:
a) as a search and realization of metodol gico- educational innovations;
B) as research and development of innovations or inamenti and existing structures.
The testing referred to in point a) is promoted by individual teachers, class councils, by
teachers 'colleges, from the circle Councils, plexus, institution, may involve more' educational areas and
perspective the whole cycle or two or three or five years.
It is authorized by the teachers should not go beyond the ambit of the school structure, involving more
'educational areas or an entire sclastico cycle.

composition of any scientific and educational committees in charge of testing, testing examination

The decision of the Great and General Council must also determine the scope of autonomy of
structures and systems and methods for the procurement and use of teaching and non-teaching staff
in the order of special lists.
Art. 20
Verification and overall assessment
The educational programs and testing are periodically subject to verification by teachers

Art. 21
Supplementary activities, elective and support

They are interdisciplinary and are organized by groups of pupils of the same class or different classes

They take place within school hours for a period of no more than 120 hours during the school year

Consistent with the directions of the budget and the overall planning, the
State Congress provides the means to benefit from the areas and ttive.
At the beginning of the school year and as part of school activities in physical education
are organized, where there is sufficient staff resources specialized in special
waiting lists and an adequate number of applications from of the students, sports groups preparation
in sports activities with an international character.
The physical education teachers wishing to join the preparatory work in groups sports
may, after consultation with their respective service chiefs and in compliance with applicable laws,
organize their service hours allotting ua part in carrying out this activity.
The integration activities, support and elettiv requiring the extraordinary use of personnel
are decided by the Congress of State, taking account of existing provisions.
In junior high school or above can be resolved by individual Class Council or
course or elapsed support activities for up to 60 hours during the school year, to the outside of
' normal class schedule.
Recruitment of staff overtime for this purpose is authorized at the request of the Deans from
Chief of Staff under Law 41 of July 17, 1979.
Art. 22
Individual Pupil Assessment
In elementary school, junior high and senior high individual pupil assessment
happens for three or four months, at the decision of the Academic Board, after hearing the opinion of the Directors of
institution or plexus.
The choice of the quarter or semester must be unified for grade school.
At the end of each quarter or semester the class teachers make a judgment for
individual subjects and an overall judgment that is based on evaluation of the work and the level of
learning of each student in relation to teaching and educational programming.
These opinions are brought to the attention of the family on a special document referred

At the end of the annual course of study individual Class Council with the presence of teachers in middle schools only
lower or higher, and classroom teachers in elementary school,
formulate a reasoned judgment, admission or non-admission to the following year.
This judgment is specific to the work of the school year.
The transition from the first to the second cycle of elementary school and from one class in each grade
school is by ballot.
The admission or non-admission to licensing examinations and maturity is based on the evaluation of
all the work done by the pupil during the studies.
Average high school until entry into force of new regulations the quarterly evaluation
or four months is expressed in numerical marks. TITLE V

TESTS, TRAINING CLASS, HOURS
Art. 23

Examinations At the end of the second cycle of elementary school l 'lunno supports a licensing exam.
At the end of junior high school students take a licensing exam.

The licensing exam for middle school and high school are state exams.
Art. 24
Examination sessions, the exam timetable
The exam sessions are fixed at the end of the school year.
The Educational Coordination Committee referred to in Article. 12 of this Act shall, by 31
May each year, the exam timetable for the various types of schools.
The exam calendar must be published within the school premises by the
Presidencies and the Board of Education in elementary school at least 10 days before the session
and remain exposed until the completion of the examinations themselves.
In intermediate middle school classes Superior is expected to fall session for pupils
that should support remedial examination.
The remedial examination must be completed at least ua week before the start of the new school year

Those wishing to take a licensing exam or ripeness or fitness to the intermediate classes
as from private schools must submit an application allePr presidencies or the Education Office by March 31

The examination program must be presented to the Head of the Institute which transmits it to the Commission
examining at least 30 days before the opening of the examination session, which will be established for
intermediate classes by the Presidency or lla Education Office.
The Headmaster may refuse to accept the examination program presented by the external candidate
excluding it from the examination, where it fails to comply with established programs.
Art. 25

Training classes Each pupil is assigned to a class or section.
The assignment to classes or sections by drawing lots, taking into account the criteria suggested by the teachers'
.
The criteria for the formation of classes are established by the regulations of individual jurisdictions school
.
The framework of the classes will be approved along with the teaching plan by the Commission under Article.
15 of Law 17 July 1979 n.
41. The sections or classes which are assigned students bearers of handicaps, the number of
pupils must be provided by the monitoring scheme in art. 3 of this Act.
In determining the number of pupils in classes for sections which provides for the inclusion of pupils
bearers of handicaps should take into account the degree and nature of each disability.
Art. 26 hours of lessons

The class schedules are established by the laws on education organization.
Art.

27 Registration Registration for the kindergarten are made in June before the start of the school year
for children who will be 3 years old and there mpiano 6 years to 31 December
of the school year to come.
Their attendance at school will take place from the first day of school in January for those who commit the three years
by March 31 and the first day of pril school for those who commit the three years before 30 June
.
Accepted enrollment of children who turn three years old by March 31 and June 30
the current school year only if there is availability of reception by the school complexes
.
In elementary school enrollments to the first clsse take place in June before the school year
start for children who turn six years by 31 December of the school year to come
.
In middle school enrollment in the first grade the ffettuano in July
before the start of the school year for all students in possession of elementary school license and that
have exceeded 14 years .
in high school the inscriptions are in the month of July of the school year for
guys in possession of the middle school license.
The dates and registration procedures at the various school levels and grades must be made public in
appropriate time by the respective Educational Directorates and presidencies.
For intermediate classes of the different orders of the school Registration takes place in the days to be determined by the respective Departments
Presidencies with public communication. TITLE VI UPDATE


Art. 28
The update is a right and a duty of the school staff fundamentally.
It is expressed:
a) how to refresh linked to professionalism and specific function;
B) as a theoretical and practical training and retraining activities in relation to the school
objectives, the policy orientations of the different grades, the adaptation of knowledge, the development of science
for individual disciplines and connections interdisciplinary,
deepening methodological, looking for teaching and pedagogical innovation.

The rules on the concrete use of the possibilities referred to in a), b), c) are issued annually
with Reggenziale Decree, after hearing the Commission Education.

TITLE VII FINAL PROVISIONS AND REGULATIONS REPEAL
Art. 29
The effects resulting from the higher charge resulting art. 17 of this legislation on the current
employment of school staff will be working with the entry into force of the new legal status
.
Art. 30

Final Provisions For matters not covered by this law rules apply no rules concerning the legal systems of
different types and grades of school.
Art. 31

32 Entry into force This Act comes into force after its legal publication.
