Institution of the governing bodies of school management.

We the Captains Regent of the Most Serene Republic of San Marino
promulgate and publish the following law approved by the Great and General Council
its meeting on 25 September 1980. Chapter I

COLLEGIATE BODIES OF MANAGEMENT
Art. 1
Collegial bodies - Purpose
In implementation of Art. 11, dated July 30, 1980 n. 60 and in order to achieve, in accordance with the laws of the State
school and the skills and responsibilities of personnel
directors and teacher, participation in the management of the school, giving it the characteristics of a
interagiste communities with the most 'wide social and civil community, are set up in the school
childhood, elementary, middle school and secondary collegiate bodies referred to
subsequent articles.
Art. 2

components are part of the governing bodies of school management: teachers, management staff and auxiliary
school, parents of pupils, students, representatives of organized social forces,
representatives of Township Councils .
They play in their respective roles and functions specific action to promote and
coordination of educational activities, their school, in relationship of mutual respect and
open exchange of cultural positions, ideals , civilians.
Art. 3
The District Council and Executive Committee
In kindergarten and primary schools of the District Council is established.
It consists of:
a) a teacher representative from each school complex, elected by the teachers;
B) a parent representative from each plexus, elected by the respective assemblies;
C) two representatives, elected by the non-teaching staff;
D) two representatives appointed by the employees' organizations;
E) a representative designated by the organizations of self-employed;
F) one representative of each Giunta di Castello, appointed by each Government.
There attends the Director of Studies.
In the first meeting after its establishment, the District Council elects a majority
a parent as President and an Executive Board composed of six members, one for each component
, more 'the Director of Studies and the Chairman of the District Council, which make
by right.
The Executive Committee is chaired by the Director of Studies.
The Secretary of the School attends the meetings of the District Council and the Executive Committee with the minutes of
functions.
The District Council shall hold office for one year.
Art. 4
School Council and Executive Committee
In each middle school and high school has established the School Council.
It is composed of:
a) a teacher representative from each class, elected by the class teacher;
B) a parent representative from each class, elected by the respective class meetings;
C) two representatives, elected by the non-teaching staff, working in the Institute;
D) two representatives appointed by the forces you organizz of employees;
E) a representative designated by the organizations of self-employed;
F) one representative from each Giunta di Castello operating in the district as part of
junior high school; for middle school superior special regulation, to be issued with
Reggenziale Decree after consultation with the council of Castello, determine the appointment of the representatives of the
Board under the Institute Council;
G) in Colleges from a student representative for each class.
Automatically attends the Dean.
In the first meeting after its establishment, the Institute Council shall elect from among its members by a majority
, a parent as President, an Executive Committee composed of one member from each
component, more 'the Dean and the Chairman of the School Council who are part of law.
The Executive Committee is chaired by the Dean.
The Secretary of the school attends meetings of the School Council and the Executive Committee with the minutes of
functions.
The Institute of Directors in office lasts one year.
Art. 5
Attribution of the District Council and the School Councils and Executive
The District Council and Institute have Rante resolution no power as regards the organization
educational activities organized by the competent bodies and by the specific governing bodies .

a) organize the general planning of educational activities promoting initiatives for activities

At the School Council are also due:

collabor tion initiatives;
2) promote the integration of students with handicaps or various challenges in the
Institute life;
3) make proposals to buy, innovate, or save yourself the teaching material and equipment necessary for the functioning of the Institute
.
Art. 6
For the District Council and the Institute is responsible, in the form and manner prescribed by the relevant regulations
, the convening of meetings of the Club and Institute:
a) discuss the general outlines and related guidelines the life and school activities;
B) evaluate and verify the performance of the same;
C) propose amendments to the regulations for the functioning of the Councils and Assemblies.
At the end of each school year, the District Council and Institute are to Deputy Public Education
a detailed report on the performance of school activities and the status of
services, including any proposed interventions.
The Executive Committee shall draw up proposals for submission to the District Council and the Institute and is responsible
execution of the resolutions.
The meetings of the District Council and Institute are public.
The resolutions are posted on the notice boards of institutes and school buildings for
period of time deemed necessary.
They are not subject to publication albo acts concerning individual persons, unless otherwise the request
.
The meetings of the District Council and the Institute shall be convened by their Presidents and have
place outside of class time.
The sessions are valid when there is a majority of members.
The resolutions are adopted by a majority of those present, in the event of a tie the President
vote.
Art. 7
plexus Council
In kindergartens and primary schools is established the Council plexus.
It is composed of:
a) by plexus teachers;
B) of two parent representatives for each section or class, elected by the parents
class or section for the duration of a school year;
C) two representatives of the non-teaching staff in activity at the complex;
D) two representatives of the Government of Castle.
The plexus Council, in order to create the right conditions to promote sustainable social and cultural

Therefore it competes:
1) to contribute to the determination of criteria for the implementation and organization of the educational and teaching
plexus for the organization of the same activity;
2) to make proposals to buy, innovate and maintain the equipment and teaching materials
required to operate the complex, within the limits of budgetary funds intended for that purpose;
3) to promote contacts with other complexes in order to develop exchange of information and experiences and to undertake
collabor tion initiatives;
4) promote experimental initiatives;
5) to promote social and cultural activities of special educational interest;
6) promote the integration of handicapped pupils in plexus or with various challenges,
promoting the achievement of the purposes of art. 3 of Law 30 July 1980 n. 60, also
by attending the specialist team meetings in the employ of the Institute for
Social Security;
7) in kindergarten to plexus Council is also responsible for deciding the opening of the school
for service in summer, subject to the conditions and in the manner prescribed by law;
8) in kindergartens and primary schools full-time to the plexus Council competes

The plexus Council is chaired by the Coordinator elected annually among teachers in activities

The Director of Education will participate in law.
The plexus Council in elementary school meets in the class council or interclass

Meetings of the complex, except for the meetings, take place during the hours of service of teachers in
hours do not coincide with school hours, according to legal standards.

Art. 8

The Class Council Class Council in the middle school and high school consists of:
a) by the teachers of each class;
B) two representatives of the parents appointed by the assembly of parents of pupils enrolled in the
class;
C) technical colleges, 2 representatives of the students in the class
appointed by the students in the class.
In the class council is responsible for:
1) to contribute to the determination of the criteria for teaching programming in art.
18 of Law No 30 July. 60;
2) to propose experimental initiatives, active à interdisciplinary and complementary
deemed appropriate to ensure that all students acquire the basic tools and facilitate the inclusion of pupils

3) to adopt the teaching material to budgetary limits indicated by the

4) to decide on disciplinary matters concerning pupils.
In the class council is also responsible to convene the meeting of the class for:
a) discuss the general lines of educational planning;
B) check the progress of the same.
The Class Council will meet with the presence of only the teachers to plan, monitor and evaluate
educational activities and for evaluating the periodic vidual pupils.
The meetings of the class, except for the meetings, take place during the hours of service of teachers in
hours do not coincide with school hours, according to legal standards.
It is convened and chaired by the Dean or by a teacher member of the Board delegated by the Dean
class. This teacher is elected annually by the class council; is in any case

Art. 9
Programme Board or elapsed

Art. 10

The teachers:

In determining its deliberations the teachers take into account any proposals or opinions of the plexus

The teachers takes office at the beginning of each school year and meets when the
Director of Studies or the Dean deems it necessary or when at least one third of its components
so requests.
The Board meetings take place during the hours of service hours coincide with the lesson
time.
The functions of Secretary of the College are assigned to one of the teachers. Chapter II COORDINATION

Coordination of constituency The constituency coordination refers to the constituencies I, II, III of the middle school

Chairs the constituency coordinating an Executive Committee consisting of seven members appointed
within its members, a majority of those present.
The constituency coordination is established annually by the Deputy Education.
The sessions are valid with any number of appearances.
It has the function to discuss general issues relating to the operation of
school activities of the area in relation to their integration with recreational activities, sports, cultural
, social and political.
Proposes and organizes initiatives independently on issues concerning general political content
school. Chapter III


COMMISSION PUBLIC EDUCATION Art.
12 Composition of the Commission Education
E 'established the Public Education Commission.
It is formed by:
a) seven representatives appointed by the Great and General Council, in proportion between the groups;
B) two representatives appointed by trade union organizations of employees;
C) two representatives appointed by the trade unions of self-employed;
D) two representatives of teachers for each order the schools elected annually by inspecting
assemblies;
E) management staff of the schools of the Republic;
F) two staff representatives not elected annually by the assembly of the entire teaching staff
non-teaching staff;
G) a representative of the university students elected annually by the assembly of the same
students;
H) a representative of the students enrolled in secondary schools of the Republic, elected annually by
special student assembly;
I) two representatives of the students enrolled in secondary schools in places outside the territory,
elected annually by the special shareholders' meeting;
L) by the Deputy Public Education that he presides.
All meetings are chaired by the Deputy for Education or his delegate, who
draw up the relevant acts.
Art. 13

Education Secretariat of the Commission The Commission shall elect from among functional Education ari referred to in subparagraph e) of Article
that precedes, by an absolute majority of its members, a secretary; if in the first vote

Art. 14
Commission Functions Education
The Public Education Commission performs the following functions:
a) annually formula, based on the relationships of the school administration, an evaluation on the overall performance of analytical
'scholastic activities and related services;
B) makes proposals concerning the promotion of experimentation and innovation in terms

and assesses the results; coordinates the activities of the District Council and the Institute;
C) expresses mandatory opinion on proposals or designer of law and generally legislative and
relevant legislation concerning the Public Education;

Chapter IV MEETINGS OF STUDENTS AND PARENTS
Art. 15

Right of Assembly Students in the high school and the parents of the pupils of the school of each order and
grade, college students and secondary schools outside the territory, have the right to assemble in
Assembly the premises made available to them by the Department of Education, according to
modes envisaged by the following articles.
Art. 16

The student assemblies Assemblies student an opportunity for democratic participation for the

They are divided into assemblies of Institutes, in meetings of university students and secondary schools
out territory and may meet separately or together.
Art. 17

The student assembly is convened at the request of the majority of the student committee
Institute or at the request of 10% of the Interior Institute students.
The date of the meeting, the agenda and the minutes of the shareholders' meeting must be submitted to the Dean
.
The student who does not wish to participate in the assemble during school hours must not be absent
Institute.
The student committee, if established, elected by ssemblea, guarantees the democratic exercise of the rights of participants
.
Art. 18
Meetings of university students and secondary school students placed outside the territory
Meetings of university students and students enrolled in secondary schools placed outside
territory where it is conducted in the school premises which are to be agreed with the Institute and
Heads must take place outside school hours in the school itself.
The meeting shall be given at least ten students and contain the agenda.
They can express the student committees, one for each type of school.
The student committees guarantee the democratic exercise of the rights of the participants.
Art. 19

Student associations Students are recognized freedom of association.
However, students, citizens and residents of the high schools of the Republic schools, places of
secondary institutions outside the territory and the University, intending to build up in association
student, to use the benefits of this Act and financial contributions of the state,
must file the Articles thereof, undersigned by at least 10 members promoters, at
Chancellery of the Secretariat of Internal Affairs which, after verification of compliance with the law, sends the
' act to the Department of Education to have legal effect.

The above associations shall appoint one or more 'legal representatives who are required to
communicate the acceptance to the Department of Education; the same body goes

The associations subsidized by the State must be drawn up by June 30 of each year

Art. 20

The meeting takes place outside school hours.
The Parents' Assembly should adopt a regulation for its own operation that is sent
in vision to the District Council or Institute.
Parents Assembly may attend, upon resolution of those summoned parents, with
right to attend, the Director of Studies or the Principal, teachers and students. Chapter V COMMON RULES


Art. 21 Elections

The active and passive election, for individual representations in the bodies set out in this
law, it is solely to members of the respective participants components
such bodies.
The vote and stand for election of parent representatives in the governing bodies
up to the parents of the pupils or his legal guardian.
May not be elected in the collegial bodies such as representatives of parents, teachers
operating in complex or the same school.
The vote by card is personal, free, secret.
The elections of the governing bodies referred to in this Act shall be held annually in
forty days following the beginning of the school year.
The elections are held by Regency Decree emsso least 10 days before the date set
and take place for a whole day on Sundays.

Art. 22

Art. 23 Settlement of the governing bodies

Art. 24
Extension of the organs in charge
Collegial bodies under this Act shall remain in office and continue to perform the duties they are entitled until
establishment of new bodies.
Art. 25
Management Fund

Art. 26
With the entry into force of this Act are abr gate the rules of the Law March 30, 1909, the Superior
Congress Regulation of Studies, its modifications and additions at odds with the standards of this law
.
The functions still under the laws of the Commission of Studies are transferred to the Commission
Education, under this law.
Art.

27 Entry into force This Act comes into force after its legal publication.

It becomes operational with the entry into force of the new legal status of the school staff.
