LAW 127 of 31 October 1985 (published November 15, 1985) Framework Law on Higher Education and higher learning institutions. We the Captains Regent of the Most Serene Republic of San Marino Promulgate and publish the following law approved by the Great and General Council at its meeting of 31 October 1985. TITLE I CONSTITUTION OF THE UNIVERSITY '- AIMS' Art. 1 (Constitution) In implementation of the principles in art. 6 of the Law of July 8, 1974 n.59 has established the University of the Republic of San Marino. It is constituted as a higher education system which includes research and higher learning institutions operating on territoio. The University of the Republic of San Marino is a public body with administrative and managerial autonomy. The supervision on the University of the Studies is carried out by the Department of Education. Art. 2 (Purpose) The University promotes the progress of science and the development of organizing the research culture and study the most 'high levels. In particular it: a) organize the teaching and research activities in relation to social, professional, productive; b) promote the dissemination of scientific culture; c) provide scientific and technical advice to more 'high levels of qualification; d) participate in the cultural and scientific cooperation nternational. TITLE II ORGANS OF THE UNIVERSITY 'Art. 3 (Organs) The organs of the University of San Marino Republic of studies: a) the Scientific Committee University (CUS); b) The Rector; c) the Board of Directors of the University (CAU); d) the Board of Statutory Auditors; e) the Academic Council; f) Departments. CHAPTER I SCIENTIFIC COMMITTEE UNIVERSITY 5 Art. 4 (Composition and functions) The University Scientific Committee (SUC) is compost of 3 members appointed by the Great and General Council by a majority of two thirds qualified for the first ballot and a simple majority in successive ballots between cultural personalities of great renown and expertise. The members remain in office for six years and may be reappointed or replaced in whole or in part. CUS ensures the scientific level of teaching and research activities and their compliance with the institutional goals of the State and the laws that ned end prerogatives. In particular it is responsible for: 1) to cooperate with the bodies responsible for the activities of Education and other bodies of the University to the determination of the addresses and general programs for the implementation of the University's purposes; 2) to formulate an opinion on the establishment of departments and courses of study referred to in this law. CHAPTER II THE RECTOR 5 Art. 5 (Appointment - Powers) The Rector of the University of San Marino Republic of studies is appointed by the Great and General Council, one of the cultural community of the highest repute and competence, for a term of three years and It may be reappointed. The Rector has the responsibility: - act legally on behalf of the University; - Ensure coordination of the activities of the Board, the Departments and the Academic Council; - Conduct supervision on teaching, scientific and university research; - Provide for executing the resolutions of the Council of Directors and other bodies of the University. The Rector also: - has jurisdiction in disciplinary matters; - Appoints the Examination Committees. The Rector may delegate one or more 'professors of the University to carry out some of the tasks falling within its competence and determine precisely the powers. CHAPTER III THE BOARD OF DIRECTORS 5 Art. 6 (Composition) The Board of Directors of the University (CAU) is composed of: a) the Rector, who presides; b) the Administrative Secretary appointed by the Congress of State for the duration of a legislature, with the secretary of the CAU functions; c) by a delegate of the Department of Education; d) 2 members appointed by the Congress of State, among the officials of the Public Administration with managerial skills, or among professionals with technical and administrative skills. 5 Art. 7 (Functions) The Board of Directors of the University (CAU) exercises administrative governance and economic and financial management of the University. In particular, it shall: a) the general administration of the budget of the University and approved the expenditure estimates and final accounts in the availability statutory limits; b) to enter into agreements and contracts with internal and external public entities that contribute to the funds and assets of the University;
c) to enter into agreements and contracts for teaching staff, establishing the amounts of remuneration according to criteria of equity and professionalism; d) to enter into employment contracts with the administrative staff and support staff; e) to adopt the rules of procedure for its operation which should include the payment of attendance fees to its Members; f) allocate funds to departments on the basis of annual and multi-annual work programs. The CAU is validly convened with the presence of m ggioranza of its members. For the validity of the resolutions it required a majority vote of the members. The meetings of the CAU and decisions taken in those areas must be recorded in the minutes prepared by the Secretary and the process under the responsibility of the President. It shall be published, for the parts that do not concernino private interests, in the roll of the University, the Public Palace and the Township Councils and in the Official Bulletin. The resolutions of the CAU are immediately enforceable. CHAPTER IV THE BOARD OF STATUTORY AUDITORS 5 Art. 8 (Composition) The Board of Auditors consists of three m tates who serve for three years. The Board of Auditors shall exercise the function of guaranteeing the state in acts involving expenditure and their compliance with the objectives of the University. The Great and General Council shall appoint, by a majority of two thirds qualified for the first ballot and a simple majority in successive ballots, Auditors Auditors from administrative and managerial persons of experience and expertise among them and designates the President. They can not be appointed Auditors Auditors members of the State Congress. For the performance of their duties the Auditors Auditors shall receive an attendance fee the amount of which is determined by the CAU. 5 Art. 9 (Functions) The Board of Statutory Auditors shall perform the following functions: 1) controls the administrative and accounting regularity of the management of the University; 2) monitor the financial management and the balance sheet corresponds to the underlying accounting documents za; 3) carries out half-yearly checks on the financial performance of the University, redigendone the minutes. The Auditors Auditors are entitled to examine all accounting documents, administrative and financial data relating to the activity of the University and are entitled to receive copies of the minutes of the sessions of the CAU. special audits on administrativ management are carried out at the request of at least three members of the Board or of a majority of the Auditors Auditors. CHAPTER V THE COUNCIL ACADEMIC 5 Art. 10 (Composition and skills) The Academic Council consists of: - the rector who presides over it; - Heads of Departments; - The Presidents of the degree programs and the elapsed directors diploma, specialization and dottorat. TITLE III ORGANIZATION CHAPTER I DEPARTMENTS 5 Art. 11 (Constitution) The University of the Republic of San Marino is organized into departments, each of which functionally integrates one or more 'research areas. The departments are equipped with autonomous management of their allocated funds and work programs approved by the Departments of the same organisms. The Department has established through Reggenziale Decree on the proposal of the Rector, after hearing the opinion of the CUS. The Reggenziale Decree determines the purposes and means of operation. 5 Art. 12 (Bodies of the Department) are the Department organs: a) the Director of the Department; b) The Department Council. The Head of Department is elected from among the professors by professors and researchers of the same Department and was appointed by decision of the Rector. The Director remains in office for 3 academic years and may be reappointed. The Department Council are part of professors and researchers, working in the Department itself. Its members are also a representative of enrolled students and non-teaching technical staff with the procedures defined by the specific erni regulations. 5 Art. 13 (the Director of the Department Functions) It is for the Director of the Department: 1) to chair the Council of the Department and shall supervise the execution of the resolutions supervising compliance with laws and regulations; 2) to maintain relations with academic organizations and schools and institutions within the department itself, as well as with research institutions which are established collaborative relationships; 3) to propose the annual plan of teaching and research of the Department,
predisponendone its necessary tive organizz instruments; 4) annually preparing requests for finance chin and staffing for the realization of the development programs and strengthening of research and teaching activity; 5) to oversee the purchase of equipment, tools and materials necessary for the operation of the activities of the Department; 6) annually prepare a detail report on the results of research and the teaching activity carried out in the Department. 5 Art. 14 (Functions of the Department Council) The Department shall exercise the following functions: - prepare the program of teaching and research activities; - Sets out the general criteria for the use of funds, personnel, equipment; - Decides on the courses to be activated, their duration, the academic level and its eventual professional title; - Down the procedure for admission of students, as well as their numbers to the Department; - Approve the research plans submitted by professors and researchers individually or collectively; - Cooperates with the bodies of the State for the identification, development and implementation of research projects and educational activities aimed at the economic, social and cultural development of the Republic, turning on its presence in the international community sc entifica, and the needs of qualification and retraining , although not aimed at the achievement of qualifications provided for in this law, and the training of new professional profiles and continuing education activities. 5 Art. 15 (PhD) The degree courses of the University of San Marino Republic of the studies, as well as the diploma courses, graduate and doctoral, are established by Regency Decree Degree courses, diploma, specialization, at the proposal of the Rector after consultation with the CUS. The Reggenziale Decree determines the aims, organizational methods and teaching disciplines. The President of the degree course and the directors of the diploma courses, specialization and dottora, are appointed by the board of the course for the duration of three years and may be reappointed. CHAPTER II SCHOOLS - SCHOOLS - ACADEMIC - FOUNDATIONS 5 Art. 16 (Constitution and competences) For the conduct of the teaching work in collaboration with the Departments concerned: a) normal schools set up in the territory of courses lasting at least four years for the achievement of degree. I shall be admitted to regular schools students possess a high school diploma or who have successfully passed the supplementary examinations in the manner prescribed by the Department Council; b) the doctoral schools and specialization: establishing territory in postgraduate courses leading to a degree or a diploma of specialization; c) institutions: taking place in the territory of scientific research activities in a particular sector or more 'related sectors, providing advice and technical collaboration with public and private stakeholders. They organize courses and training seminars aimed specialization updating and retraining; d) academies: promote in the territory in different forms literary studies, science, art. They may establish schools of higher education with RSI of at least four years and further training and specialized schools; e) foundations: promote in the territory in different shapes teaching and research activities. They may establish higher education studies conrsi of varying duration as well as regular schools and schools doctorates and specialization. Regular schools, schools of doctorate or specialization, institutions, as well as schools and courses set up by the academies and foundations referred to in this law, are made through Reggenziale Decree, at the proposal of the Rector, who will instruct one or more 'competent Departments to follow their implementation. The Reggenziale Decree determines the purposes and means of operation. CHAPTER III PRIVATE INITIATIVES 5 Art. 17 (Implementation Mode) In order to ensure the most 'extensive exercise of freedom of research the state recognizes the local institutions in initiatives promoted by private organizations, whose aims are consistent with those established by this law. At the request of the interested parties that will define the modalities of the actions, as well as the characteristics of the staff who will be involved in them, and after consultation with the SUC the Congress of State shall issue a special clearance in the form societar constitution on the basis of current legislation, which duration will be determined in a special agreement.
The activities take place under the responsibility of the managing bodies for the individual initiatives. The permission can be revoked at any time if there are justified and proven reasons of default of its stated purpose and programs based on which it was granted the permit itself. When activities referred to in this Article shall be fi alizzate the granting of degrees, the University Rector will give job to a competent Department to follow their implementation and to prepare the final assessment. TITLE IV EDUCATION Art. 18 (Distance Learning) The degree courses, schools, institutes, academies and departments referred to in this Act may establish courses for obtaining titles of the following articles, with a conduct remote, providing suitable expansion of legal dur ta of curricula, methods of teaching support to students, as well as special modes of practice and participation in courses and intensive seminars to be carried out on site. Art. 19 (Degrees) The achievable academic qualifications at the University of the Republic of San Marino are classified as follows: 1) Diploma: achievable in two or three years of study after secondary school at the institutions mentioned in this Act; 2) Degree: achievable in 4-6 years of study after secondary school at the institutions covered by this law; 3) Specialization: achievable in 1-2 years in the course of post-graduate studies, with intent mainly professional, at the departments covered by this law; 4) PhD: achieved after at least 3 years of a course of post-graduate studies with intent to start scientific research at the departments covered by this law. The degrees issued under present law have legal force. Art. 20 (mode of achievement of qualifications) Students wishing to obtain the study referred to in article titles are: - to obtain from the Department Council referred to its own course of the prior approval of the curriculum study ; - Have successfully passed all practical tests and examination specified in the plan of studies and in the manner envisaged by the specific courses; - Have successfully passed the final test consisting of: - an examination interview with the professors of the course for graduation; - The discussion of a thesis on a topic chosen by the candidate and agreed with the teachers, in the manner determined by the academic bodies, with which they will take the exam for graduation or specialization or PhD. The examination committees are appointed by the Rector and consists of: - 6 members for the diploma courses - 11 members for degree courses and specialization, - six members for PhD programs, belonging to the academic body of which the present law. The Board of the Department establishes with its resolution the amount of hours of attendance at the courses necessary to obtain registration of the examinations and practical tests. TITLE V PERSONNEL Art. 21 (Professors and Researchers) The professors and researchers of the University of San Marino Republic of the studies that are entitled to carry out the teaching function are employed on temporary assignment through specific works contract entered into pursuant to this law and signed by the Rector. The professors and researchers, for the term, have an obligation to comply with all the clauses of the contract signed, as well as the laws of the Republic. Employees of the Public Administration of Companies and autonomous institutions in charge of the State to carry out teaching, research and laboratory in the University of Studies, are detached from their place of work for the entire term, by administrative act of chief of Staff. Art. 22 (Secretariat of the University) The University has a secretarial office. The necessary staff and its employment are determined by the CAU. The secretariat carries out executive functions under the direct
responsibilities of the Rector and the Secretary ADMIN vo. TITLE VI ASSETS - FINANCIAL MANAGEMENT Art. 23 (Heritage) The assets of the University shall consist of: a) the financial contributions of the State; b) movable and immovable property acquired property in any capacity; c) the proceeds and income from activities and services provided; d) proceeds from the agreements, contributions, donations. The State contribution figure separately in the State Budget under the chapter on the Department of Education and Culture. Art. 24 (Fiscal Year) The fiscal year shall commence University DAL1 January until December 31 of each year. The Board of Directors decides on the Budget by the end of June each year. In the Budget revenue and expenditure they shall be kept separate according to origin and destination. Each entry category or spending must corresp ndere a chapter of balance. A budget must be provided in a reserve fund in order to provide for unforeseen needs that may occur after the approvazi it of the financial statements. In the resolution by which it approved the Budget of the Board of Directors, by means of specific descriptive report, it shall state the reasons for which increases or decreases in individual items were decided, both the revenue and expenditure in relation to the financial statements of ' previous year. The Budget, together with the explanatory report, is transmitted to the Great and General Council by 31 October of each year. In order to allow the University carrying out the activities and services necessary to achieve its institutional purposes, the State shall pay its contribution on a special account held by the University. And 'it delegated to the administrative secretary of the University to keep: - the cash journal; - The ledger of debtors and creditors; - Ledgers for each chapter entry or expenditure; - The stub receipts. The procedures relating to the submission of financial statements, the provisions on the General Ledger of the State of Law November 9, 1979, n.70. Art. 25 (actual flow statement) The year-end financial statements are approved by December 31 of each year. The final statement must contain the exact and clear indication of the economic results of the entire financial management of the year which the statement relates. The statement is attached an explanatory memorandum. The final balance is drawn distinguishing the R evenue and expenses into chapters and items, as indicated in the Budget. Expenditure accounts, together with the explanatory report of the Auditors Auditors, is transmitted to the Great and General Council for approval. Art. 26 (Luxury) And 'forbidden the University to acquire assets, financing, advantages or benefits in any form which tend to distort its purpose, to diminish the autonomy and that go to the detriment of its cultural and scientific prestige. Art. 27 (Revocation of organisms) In any case of declaration of non-compliance with the purposes of the present law of the organs of the University is responsible to the Deputy of Education to withdraw the functions and entrusted to a special commissioner. The organisms will be made available again by the final deadline of months 3. Art. 28 (Entry into force) This Law shall enter into force on the 5th day after its legal publication. The Great and General Council appoints the members of the CUS, the Rector and the Board members of the Auditors Auditors within two months of the entry into force of this Act.
