LAW 28 January 1987 n. 10 (published February 3, 1987) Ruling for the reorganization and restructuring of health facilities We the Captains Regent of the Most Serene Republic of San Marino Promulgate and publish the following law approved by the Great and General Council at its meeting of 28 January 1987. Art. 1 (purpose) in order to improve the functionality and efficiency of Health Services and the administrative structure of the Institute for Social Security and establish a comprehensive knowledge and operational support for the Member of functions and responsibilities to the Health and Social Security and the President are taken the following measures: - legislative changes of d ll'Istituto institutional reform for Social Security and the National Health Council; - The establishment of the Information Health Service; - Establishment of the Health Council; - Temporary appointment of experts. Art. 2 (Change article 5 of the Law 1 December 1982 n. 106) Article. 5 of the Law of 1 December 1982 n. 106 is replaced by the following: "The Health Board is composed of: a) Member of the Health and Social Security who chairs it; b) an expert in Public Health and Programming Sa itaria; c) an expert in Healthcare Management Hospital; d) an expert in Health Economics. the experts referred to in paragraphs b), c), d), are chosen outside the structures of the Institute for Social Security on the basis of the professional curriculum. of these appointments the Congress of State must give communication to the Great and General Council in the session more 'next including on the professional curricula. Art. 3 (Amendment Art. 3 of Law 24 March 1983 n. 43) the last paragraph of Art. 3 of Law 24 March 1983 n. 43 is amended as follows: "The President is appointed by the Great and General Council and remains in office for 4 (four) years. The Executive Committee responsible for Health Services and Social and Health Sector is composed of the following members: a) President; b) Director General; c) three representatives of the political forces; d) two representatives of employees desgnati by legally recognized trade unions; e) a representative of employers and workers utonomi designated by trade associations legally recognized; f) Hospital and Specialist Services Manager; g) Director of Primary Care Services; h) Environmental Health Service Executive; i) Director of Social and Health Services; l) A representative appointed by the Management Control Committees; m) the Head of the Medical Information Service. The members of the Commission provided for in letters f), g), h), i), l), m), attend the meetings in an advisory. "Art. 5 (Amendment Article 7 of the Law March 24, 1983 n. 43) the art. 7 of the Law March 24, 1983 n. 43 is amended as follows: "Art. 7 (Functions of the Executive Committee responsible for Health Services and the S-ie Health Sector). The Executive Committee responsible for Health Services and the Health and Social Sector, the following tasks: 1) approve the commitment of funds available for the relevant sectors according to the criteria established by the General Committee; 2) to examine: a) the budget of the areas of competence and any subsequent adjustments; b) the reports of the areas of competence; 3) examine all proposals of relationship and relevance for consideration by the General Committee and all topics that President rites will present to the Commission itself; 4) to examine the proposals and suggestions of the Audit Committee; 5) consider the claims in specific subject; 6) propose to the General Commission approval of internal regulations of the various services; 7) supervise the Services and promptly propose any measures to the General Committee; 8) exercise all the powers delegated to the Commission by the Laws. "Art. 6 (Repeal of previous standards) Articles. 8 and 9 of Law 24 March 1983 n. 43. As a result of the provisions of Articles 4 and 5 of this are hereby repealed law Art. 2 of law 24 March 1983 n. 43 is amended as follows: "Art. 2 (Bodies of the Institute). Are the Institute for Social Security: 1. - the President;
2. - The General Committee; 3. - the Executive Committee responsible for Health Services and the Health and Social Sector; 4. - the Executive Committee responsible to the Social Security Sector; 5. - The Board of Auditors of the Institute; 6. - the Committees of Management Control; 7. - The View. Art. 7 (Competence and composition of the Information Health Service) The Information Health Service has functions of collecting and processing of all information useful for the technical evaluation and management within the established health planning. Executives and managers of health Services are required to promptly provide the information requested by the information Service, on which the service is supposed to operate in the strictest confidence and in compliance with the law 1 March 1983 n . 27. the Information Health Service consists of: a) Epidemiologist with functions of Head of Service; b) Statistical Health; c) Computer Technician; d) Secretary. the seats supplementing Law no. 100 of 1982 are distributed and regulated with the annex to this law. the Disclosure Health Service Institute for Social Security is an information support instrument of the Board of Health and Institutional bodies of the Institute. The Head of the Medical Information Service can be called to participate in an advisory capacity to the General Committee and always takes part in an advisory capacity to the Executive Committee responsible for Health Services and Social and Health Sector of the Institute for Social Security. "Art. 8 (Powers of Board of Health) the Board of Health is a technical body and provides advice to the President and Deputy in reference to training programs, vocational training, organization or reorganization of services and scientific research programs. Form to his interior of the sector working groups for the study and the development of specific projects in relation to the Board of Health projects. Provides technical support functions to the Deputy in the relationship with international organizations. Art. 9 (Composition of the Board of Health) the Board of Health is composed of: a) hospital Primary; b) the aid hospital managers; c) two representatives of the hospital aid; d) two representatives appointed by hospital assistants; e) two representatives appointed by the Auxiliary Health Personnel; f) three representatives appointed by the GPs (one for each health center); g) a representative designated by the doctors of the Social and Health Services; h) one representative appointed by the Operators of the Environmental Hygiene Service. i) one representative appointed by the Operators of the Environmental Hygiene Service Representatives remain in office for three years and may be reappointed. "Art. 10 (Appointment of the Coordinator, Secretary and in charge of Bibl oteca) The Council of Health appoints among its members a Coordinator, a secretary and in charge of the Library, who shall hold office for one year and may be reelected. Art. 11 (Convocation) the Board of Health was convened by the Coordinator, or in the absence of the majority of the members, with written notice of the Order and by Day treated and sent at least three days before the meeting. the Board of Health will meet ordinarily at least once a month. the Board of Health may be convened in extraordinary session in the cases of urgency and necessity by notice delivered even on the same day the meeting. Art. 12 (transitional Provision) the Congress of State, proposed by the President of the Institute for Social Security, fixed term appointment Experts with the task of examining the operational and administrative management, Health Services, Social Health and staff re ative. Experts should periodically draw up a detailed report on the operational status of the Institute for Social Security for the Member of Parliament, the President and the institutional bodies. For the duration of the nomination period, the President assisted by experts, they must undergo the managerial acts of the General Management and Executives of the Services to ensure its consistency with the health policy objectives. The President may suspend the enforceability of management actions as it deems contrary to the health policy guidelines or rules expressed by Institutional Bodies demandandone in this case the final decision to the competent institutional bodies. The experts may attend if summoned by the President, in all meetings of the institutional bodies and the Department in an advisory capacity. "Art. 13 (Term of Appointment)
The appointment of experts in art. 12 of this Law can not have a duration of more than two years and does not give any right to employment in the role. Art. 14 (Entry into force) This Law shall enter into force on the 5th day following that of its legal publication.
