We the Captains Regent of the Most Serene Republic of San Marino


In view of article 4 of the Constitutional Law no.185 / 2005 and Article 6 of Qualified Law
186/2005;
Promulgate and publish the following ordinary law approved by the Great and General Council
its meeting on July 20, 2011:

ESTABLISHMENT OF A COMMISSION ON THE PHENOMENON OF Consiliare
INFILTRATION OF CRIME 'ORGANIZED


Art.
1 (Establishment and tasks)

And 'it established a Council Committee for the infiltration phenomenon of organized crime
with the following tasks:
1. assess the presence of criminal infiltration of the type organized in the territory of the Republic,
in all its possible forms and connections;
2. monitor the evolution and development of economic and financial activity, or the phenomena of social type
what particular migratory flows that could appear as indicators of palatability
by criminal organizations; 3
. verify that the organs and offices of the State committed in the fight against underworld infiltration,
or even occupied at large in the control and surveillance activities, effectively carry out the task assigned to them
and are equipped with the means and adequate and appropriate resources ;
4. raising public awareness and the other institutions of the state in order to create an appropriate alert
social environment against the dangers arising from possible infiltration of organized crime
;
5. promoting legislative initiatives and administrative organization that can help fight in ways more efficient and effective
the infiltration phenomenon and increase the level of defense and
impermeability;
6. developing an exchange of information, experiences and collaborations with leading institutions and
foreign institutions, with proven experience and recognized consideration in the fight against organized crime
.



Art.2 (Appointment and composition)

The Commission consists of eight directors, four of whom indicated by the forces
majority and four by the opposition, appointed by an absolute majority by
Great and General Council at the beginning of the legislature.
For the validity of the session requires the presence of half plus one of the Commissioners;
The resolutions are adopted by an absolute majority of its members. In case of equality of votes, the Chairman
.



Art.3 (President)

Among the eight appointed members, the Great and General Council shall designate the President of the Commission
.
The President convenes and chairs the meetings, represents the Commission in its relations with the outside
and with other institutions.



Art.4 (specifications)

The Commission:
- shall report regularly, through its Chairman, to the Great and General Council;
- May invite members of the Government to report on certain Services, intentions or episodes;
- Will convey to the Congress of State, or to individual Secretaries of State own resolutions, addresses
, proposals or suggestions;
- He has the power of hearing in respect of the Executive Magistrate, the people in charge of the various services of
security, control and supervision of the State, as well as require reports and references to the same
;
- Will be able to carry out their work in the Hall of the Great and General Council.
As Secretary of the Commission, which shall record synthetically, they are carried out by an official of the Institutional
Secretariat.
For the preparation of the minutes, the provisions of Article 14 of the Law
21 March 1995 n.42.


Art.5 (Regime of the sessions)

The Commission's sessions are usually secret. They can be declared public
of majority decision of the Commission.
Members of the Commission and officials of the same tax inspectors are required to
professional secrecy. Extracts of the minutes may be issued by the Chairman of each Board
Commission on submission of a written request, under their own responsibility
.


Art.6 (Temporary provision)

For the current legislature, the Commission shall be appointed within three months from the entry into force of this Act
.



Section 7 (Entry into force)

This Law shall enter into force on the fifteenth day following that of its legal publication
.
