Body Rules of the Gendarmerie of the Republic of San Marino.

We the Captains Regent of the Most Serene Republic of San Marino
promulgate and publish the following law approved by the Great and General Council
its meeting of 12 November 1987.
Art. 1
The Corps of Gendarmerie Corps is part of Militar of the Republic. It shall apply
By Laws and Military Discipline.
Art. 2
The Corps of Gendarmerie was established to provveder to the prevention and suppression of crime,
to the maintenance of public order, security of citizens, to their safety and the protection of property
; for ensuring compliance of the Laws, Decrees, Regulations of the State;
to provide assistance in cases of disasters; to execute lawful orders of the Public Authority.
The member of the Gendarmerie can not take political positions and carry out activities of
party.
Art. 3
At the Corps of Gendarmerie is attributed the honor and safety stock service.
Art. 4
The Corps of Gendarmerie provides translations, accompaniments and assistance of
detainees to the services at the Commissioner's Court n the occasion of the hearings, and in any case
once the judicial authority so requests for reasons of judicial police.
Art. 5
The Corps of Gendarmerie depends:
1) from Ecc.ma Regency regarding the serve uncle of order and public safety;
2) by the Secretary of State for Foreign Affairs with regard to recruitment,
administration, equipment, armament and in general for everything related to the proper functioning of the service
;
3) by the Judiciary for the judicial police duties;
4) Military by Congress with regard to military discipline.
Art. 6
The Corps of Gendarmerie includes: Command


Brigades the Information Section, Investigation and Judicial Police
Services Section Quotes and Emergency Services.
Art. 7
The Brigade is the basic operational unit.
The number and location of the Brigades are stable and, in relation to the needs and to the specific characteristics
territory of the Republic, the Congress of State, on the proposal of the Gendarmerie Command
.
The organic strength of the Brigades is determined by the Command of the Gendarmerie.
The most Brigades needs are normally controlled by a marshal or a Brigadier;
Those of lesser need by a Brigadier, by a corporal or by a Pinned. Requirements for even the first
quotas can be controlled by an interim charge of a corporal or

Art. 8
The Information Section, Investigation and Judicial Police department is a qualified

The Section is commanded by a Marshal.
Art. 9

presence and supervision in the territory of the Gendarmerie of which constitute the main force of maneuver
emergency.
The Section, which is always commanded by a Marshal, consists of: at least two Gendarmes and
a road accident team.
Art. 10
They compose the Gendarmerie Corps:
a Commanding Officer;
An Officer Deputy Commander;
Six Marshals;
Six Brigadier; three Vicebrigadieri
; Pinned
; Gendarmes
.
For Pinned and Gendarmes are not expected to limit the number.
For service requirements, reported by the Corps Command, the Great and General Council, on a proposal
Secretary of State for Foreign Affairs and the opinion of the State Congress, may have increased the
staff through the issue of new recruitment notices.
Issuance of the notice must be informed Congress Military for its obligations

For exceptional requirements of security and public order can serve, at

Art. 11

Art. 12

Art. 13
Enrollment Officers, with a degree in legal disciplines or specializations related

Art. 14
At the time of enrollment the final Gendarme pr first oath is the Commander

Art. 15
The feed grade of Gendarmes and non-commissioned officers is done on merit and apartments in the higher grade

:

The feed grade is prepared by the Congress government at the proposal of the Commander of the Gendarmerie

Superior Commander of the Militia.
Art. 16
Remuneration levels of Gendarmes in accordance with the provisions of the Annex to the Law
25 November 1980 n. 86, as amended, they are as follows:
Commander level 10;
Deputy Commander level 9;
Marshal level 7;
Brigadier level 7;
Vice Brigadier level 6;
Pinned level 6; Gendarme
level 5;
Student Gendarme level 4 (for the 1st year of service)
The remuneration is susceptible of shots and changes arranged in favor of the personnel
dependent state.
The Gendarme perceives:
compensation in the amount provided by the State Congress;
Compensation for overtime;
The compensation for the ordinary service provided at night and on holidays;
Family allowances, the cost of living allowance, the thirteenth month, the payment of end of service
, in accordance with current laws.
Art. 17
Normal service has a duration of 36 hours per week, divided into one or more 'daily shifts.
The Gendarme is required to pay straordinaio service when the needs demand it,
for a maximum of 120 hours per year.
The Gendarme enjoys two weekly rest days, if not used for official purposes,
must be recovered normally within the next week.
The Commander of the Gendarmerie, for official purposes or for other justifiable reasons, may
transferred to any other location dependent on milta or NCO.
Art. 18
The Gendarme is entitled to an annual license to the following extent:
a) one day a month for the first year of service;
B) 15 days during the second year of service;
C) 20 days during the third year of service;
D) 26 days from the fourth year of service onwards.
The license can be enjoyed in one or more 'periods consistent with the needs of the service.
It can also get the following straordinai permissions:
a) 15 days in case of marriage;
B) 5 days for serious family bereavement;
C) two days a year for special circumstances;

D) 20 days a year to take exams or for study, related to regular courses;
E) sports permits, as required previst from the rules governing the activity of CONS

The Commander of the Gendarmerie of issuing licenses and permits overtime, and can suspend requirements for service
the grant of the licenses.
The ordinary licenses can not be waived.
Art. 19
The Gendarme is relieved temporarily out of service and placed on leave at his own request or
Authority, for one of the following causes:
a) infirmity from service causes;
B) illness not coming from car causes;
C) personal reasons;
D) pregnancy or childbirth.
The expectation normally ceases with the cessation of the cause that has determined.
The expectation for the cause referred to in subparagraph a) is imposed for a maximum period of three years, with
payment of the entire salary.
Two or more 'leave of absence will add to the effects of determining the upper limit of
term, unless one of them is not separated by a period of service of more than three months.
The total length of leave may not exceed in any case three years into a five-year period.
The expectation for the cause referred to in point b) èdisposta for a period of six months, with
payment of the entire salary.
Leave may be extended until aximum term of one year, with payment of 86%
entire salary.
After the maximum period of leave:
1) The Gendarme unable to resume ncondizionato service is placed on leave and is

Art. 20
The Gendarme is placed on leave to the achievement of 53 years of age, with the right to request

general compulsory statutory aforementioned.
The Gendarme may, at the time of the leave for reasons of age or permanent disability
that does not enable him to remain in the service and provided that he has not gained
full pension or other retirement in San Marino (with the exception of pensions accrued with
voluntary payments) to redeem up to a maximum of five years relevant to the achievement
of the pension, subject to the payment of statutory contributions based on the last salary received.
To this end, the Institute for Social Security is authorized to accredit their contributions to
Article. 9 of Law no. 15 of 1983.

Art. 21
The Gendarme may, at any time, to resign in writing to the Corps Command.

ongoing criminal or disciplinary proceedings.
Art. 22
The Gendarme, which became particularly distinguished and meritorious in the line of duty, may

Commendation of the Superior Commander of the Militia;
Commendation solemn Most Excellent Regency.
Art. 23
Without prejudice to the competence of the State Congress as regards administrative sanctions, the
disciplinary punishments are applied in the manner and form prescribed by the
Military Discipline Regulations.
Art. 24
The Gendarme is insured for risks and injuries, resulting from professional occupations, which
can cause death or permanent disability.
In case of death, the insurance amount is up to the legal heirs or testamentary.
Art. 25
The sale, the seizure, the seizure of salary

Art. 26

Art. 28

by the Command of the Gendarmerie and approved by the State Congress after consulting the Congress
Military.
Art. 29
are repealed:
the Corps of Gendarmerie 19 dicembr Regulations 1935: the Law 23 November 1976 n. 70;
All other rules and provision contrary to the footsteps of these Regulations.
Art. 30
These regulations come into force on the 5th day following that of its legal publication
.
