LAW 22 of 24 February 1994 (published February 28, 1994) LAW ON CASTLE SEAMLESS We the Captains Regent of the Most Serene Republic of San Marino Promulgate and publish the following law approved by the Great and General Council at its meeting of 24 February 1994. CHAPTER the CAPTAIN oF CASTLE AND CASTLE Art.1 JUNTA (Castles) the territory of the Republic is divided into nine Castles: City of San Marino, Borgo Maggiore, Serravalle, Acquaviva, Chiesanuova, Domagnano, Faetano, Fiorentino, Montegiardino. Article 2 (Purpose) This Act regulates the election system, the powers of the Township Councils and the Captains Castle, in order to promote, enhance and empower the participation of citizens, also in a direct, social and administrative life the Republic, and also in order to stimulate the competition of individuals associated with the organization and efficiency of the services entrusted to jurisdiction or supervision of the Castle. Article 3 (Composition of the Board) The Captain of the Castle and the Board of Castle are located in the Casa del Castello. The council is chaired by the Castello di Castello Captain. It also belong to 9 members in the Castelli with populations equal to or greater than 2,000 inhabitants and 7 members in castles with a population of less than 2,000 inhabitants. Art.4 (Oath and decadence) In the fifteen days following the elections, unless justified delay, the Castle of the Captains and members of elected Councils oath of fe Elta to the Republic, in the prescribed forms, first to the Captains Regent. Likewise there shall be new elections if it can not make room for replacement of the directors who have resigned, are forfeited or dead, in the second paragraph of this article, for lack of unelected candidates. Except in cases of serious illness, the Castle Captain can not resign from office in the first two years of office. Art.6 (Convocation and decadence of the Board) The Board sessions Castle are public, except for issues relating to a person. The quorum for meetings requires the presence of at least half more 'one of its members. The deliberations of the Board are adopted with v conducive to the majority of those present. In case of equality of votes, the vote of no Capit Castle. The sessions are convened by the Captain of the Castle at least once a month and whenever it is necessary, or may be motivated request of at least 1/3 of its members, in which case the order of the day must be that shown in the meeting request . Article 7 (absolute immunity) The members of the Board and the Castle Captain can not be prosecuted for opinions expressed and votes cast within the Giunta di Castello. CHAPTER II
ELECTION OF THE CASTLE OF THE CAPTAIN AND THE JUNTA Art.8 MEMBERS (active electorate) The election of the Castle Captain and d t the council councilors takes place through a direct vote. Voters are all adult citizens of San Marino, who have residence in the castle and are not in any requirements under art.2 of the Law 36 of December 23, 1958 and subsequent amendments. They are allowed to vote for the election of each of the Captain of the Castle and the members of each council the San Marino citizens registered to vote of each Castelli, formed in accordance with Law 36 of December 23, 1958 and subsequent amendments. The polling stations are constituted under article 3 of Law 36 of December 23, 1958 and subsequent amendments. The Castello di Serravalle Board is elected by voters registered in sections of Serravalle and Customs, which form a single constituency. The voters residing in Falciano are aggregated to the polling station of Customs. For the election of the Castle Captain and members of the Board the voting body of the individual Castle is one college. Art.10 (electoral lists) The time of the meeting of the Castle Captain elections and the Board is fixed with Reggenziale Decree least 90 days before the same. Who intends to stand for the Captain of Castle or a member of the Giunta di Castello is personally present at the Office of Civil Status - Demographic Services and Electoral, or at the House of the Castle before the Captain of the outgoing Castle, within 70 hours 12,00 day prior to the elections and declares its will by signing a special pre-printed form. Within the 65 day preceding the elections, the Office of Civil Status - Demographic Services and Electoral make public the list of candidates for the position of Captain of the Castle and the list of candidates for the position of Executive Advisor. These lists will be exhibited, by posting, for public viewing in the respective Castle. It is up to the Electoral Commission referred to in article 4 of Law 36 of December 23, 1958 and subsequent amendments verify applications, excluding those that are not provided with the prescribed requirements. This exclusion, duly substantiated, must be imm diately notified, by Cursor, to candidates. Within the 45 days preceding the election each candidate for the office of Captain Castle will form a list, of which he is leaders, indicating, among the candidates to membership of the Board members in the list published, a number of persons not exceeding that of members of the Board and not less than 5 in the Castelli popolazi it equal to or greater than 2,000 inhabitants, and not less than 4 at the Castles with less than 2,000 inhabitants. the nomination is not permitted in more 'than one list; nominations are void in more 'than one list. In each Castle candidate lists, as presented, they are exposed to the public by posting the appropriate manifest. Art.11 (electoral Comizi) The presentation campaign for the election of the Castle and the Captain of the Board shall be convened by the Captain of the outgoing Castle with a manifesto made public 30 days before the election date. In the manifesto they are published lists of candidates and indicate the provisions on the conduct of the elections. By the 25th day before the election ach list must submit their plans, which must be filed with the House and the Castle preserved from the Castle Captain. Within 60 days of the adoption of the Decree Reggenziale as in Article 10, to the Office of Civil State care - Demographic and Electoral Services are completed all the formalities related to the electoral certificat in article 11 of Law 23 December 36 of 1958 as amended. They must be delivered to voters by 75 days following the adoption of Decree Reggenziale fixing of the election date. And 'applicable, to the extent compatible, the article 12 of Law 36 of December 23, 1958 and subsequent amendments. With proper Reggenziale Decree will be established, observing the criterion of equal, the arrangements for disseminating and advertising programs as well as the discipline of the presentation campaign. Art.12 (Ballot) The vote takes place with a unique statement which lists the names and surnames of candidates for the Castle Captain charge written in a special rectangle, according to the order determined by lot, and marked with a letter following the alphabetical order. At the center of the card are placed two lines in which preferences for members of the Board shall be indicated. The cards are provided by the Office of Civil Status - Demographic and Electoral Services on the model to be adopted by Reggenziale Decree, which will be issued within 30 days of entry into force of this Act. CHAPTER III PROCEDURE OF ELECTIONS Art.13 (Reference) For the election procedure shall apply to matters not expressly provided by this Act, the principles and norms of the Law 36 of December 23, 1958 and subsequent amendments, if they are compatible . Art.14 (polling station presidents and tellers) The Commission referred to in article 4 of Law 36 of December 23, 1958 and subsequent amendments it is responsible for completing each year and make public, no more 'later than February 28, by deposit the Office of Civil Status - Demographic and electoral Services and posting in any Castle, a list of citizens with the President of the polling station functions during the current year. The Commission has to choose the presidents from the following categories of citizens and residents in the Republic of San Marino voters: a) graduates and graduates; b) those who have held the office of President of the polling station during previous elections. Are excluded from this list: the members of the State Congress, members of the Council Great and General, the Civil Status Office Manager - Demographic and Electoral Services, the seven elected members of the Electoral Commission, the magistrates, the Clerks of Courts and Managers of the Department of Institutional Affairs. For any complaints against the formation of this list, to the finality of that list, it invokes the provisions of artt.23 and 5 of Law 36 of December 23, 1958. The Commission by the 20th day prior to the vote proceed to appoint the chairmen of the individual polling stations choosing from the residents in the Castle. In case of absence of one or more 'of the polling station chairmen, the Commission itself will replace. The Commission, between 20 and 10 days before the elections, shall appoint four
scrutineers for polling among voters residing in the Castle that they hold at least primary school education, to be assessed in relation to school age, excluded candidates and the people who hold the positions mentioned in the third paragraph of this article. They can not be appointed polling station chairmen and candidates for the tellers of Castle Captain charge and member of the Executive. Nominations for President of the polling station and those in scrutineer must be notified by Cursor within 48 hours of sitting of the Electoral Commission. The voter expected to perform the functions Presid nt of the polling station or scrutineer can not abstain, except for just cause. Art.15 (Formalities preceding the vote) At 5 am the day fixed for the vote of the polling station presidents must go to the Public Palace to receive the President of the Electoral Commission the delivery of all the material needed for the vote, including a copy of the list section from which the Commission itself will have removed the names of iscr cts that fail to comply with the 18 years of age by the day of the vote, the State boards and a large number of copiative pencils, as well as the list of scrutineers. To carry out the functions referred to in the previous paragraph, the Chairman of the Electoral Commission may delegate to the Director of the Executive Secretariat of the Congress of State or other officer of the Department of Institutional Affairs. The cards will be delivered in a number equal to that of registered voters increased by a fifth. The cards will carry the dry seal of the Secretariat of State for Internal Affairs and to be signed on the back by the Home Secretary, or, by delegation of the Secretary of State for Internal Affairs, by the State Office Manager civil - Demographic and Electoral Services. Art.16 (Constitution of the seat) At 6 o'clock the president of each polling station is the Electoral Office of section calling upon the tellers appointed by the Electoral Commission referred to in article 14. One of the scrutineers designated by the President assumes the functions of Vice - President and the other those of the Secretary of the polling station. At least two of the five members of the polling station must always be present at the electoral operations. If the nominee to chair the Electoral Office can not, for justified reasons, to take office, he must immediately notify the Chairman of the Electoral Commission to be replaced. During election operations, in case of absence or incapacity of the President, his Deputy Vice President. In the absence of the Secretary shall take his Vice-President. Art.17 (The vote) The vote is expressed by drawing on the board, with indelible pencil, a mark on the name of the chosen candidate Captain Castle. The voter can express a preference for a aximum number of two candidates for the office of Member of Council, choosing from the list of which is headed by the candidate to the chosen Castle Captain. The preference can be expressed by indicating the n me and surname of the candidate or his list number, or both. If the voter has voted for a candidate for membership of the Board without affixing the mark for the candidate for the office of Captain Castle, the vote means that you have the list which the member belongs to the chosen council. The preferences for candidates belonging to lists other than that to which the candidate belongs to the chosen Castle Capitano are void. In the case of preferences expressed in excess of the capacity, means canceled the votes of preference expressed. Remains valid voting list. If the candidate has two surnames electors may write one of the two. For the purposes of the vote valid indication must contain both names when there is no possibility of confusion between more 'candidates. Are void preferences in which the candidate is not designated with the clarity necessary to distinguish it from any other candidate. Are void cards: a) which are not those of the state, does not bear the seal of the Secretariat of State for Internal Affairs and the signature of the Secretary of State or his delegate and the signature of the President of the polling station or a scrutinizing delegated; b) when they present records or signs intended to secure recognition of the voter. They are considered white boards that do not cast their vote for any of the candidates. The validity of the vote on the card should be allowed whenever it can infer the actual will of the voter, subject to the provisions of the preceding paragraphs. Art.18 (Poll and electoral operations) E 'declared elected Captain of the Castle candidate for the office that received the most votes.
In case of a tie there shall be a second ballot between the two candidates who obtained the most votes, to be made on the second Sunday next. In case of further tie is elected the most 'senior age. In each list of candidates for the position of member of the Board shall be construed attributed as many votes as the number of votes received by the candidate for the post of Captain Castle or to the members of the Executive. The list to which the candidate belongs to the Castle Captain charge that received the most votes are attributed respectively six and five seats, including that of the Castle Captain, depending on the population to 2,000 inhabitants is higher or lower, although the votes obtained are lower than the figure of 60%. If the percentage of valid votes obtained exceeds 60%, the list is assigned a number of seats equal to the percentage of valid votes obtained by it. The remaining seats are divided proportionately among other lists in accordance with the D'Hondt method. Within each list, the candidates shall be declared elected members of the Board in order of preference votes obtained. Equal number of votes shall be declared elected more 'older age candidates. The first polling station due to each list minora za is attributed to the candidate to the post of Captain of the same list Castle. If the elections in a castle is a single list, the elections are to be considered valid if it has voted more 'of 50% of eligible voters and presentatasi list obtained more' than 50% of valid votes cast. CHAPTER IV TASKS OF THE CAPTAIN OF CASTLE AND CASTLE Art.20 JUNTA (the Castle Captain Tasks) To the Castle Captain is responsible for: a) represent the Government in every field and headquarters; b) convene and chair the meetings of the Board; c) prepare the Agenda, after verification of the proposals and requests received; d) implement the resolutions of the Board; e) transmitting, if the Board resolves on matters of significant interest, a copy of the resolutions at the Department of Relations with the Township Councils, which is obliged to send them to ministries and bodies concerned; f) report to the Congress of State through the Department of Relations with the Township Councils; g) perform such other functions delegated by the State or anismi; h) civil marriage as delegated by the Home Secretary. Art.21 (The Secretary of the Board of Castle) In the first session the Board shall elect from among its members the Secretary. Art.22 (Duties of the Board Castle) To the Castle Board is responsible for administering the annual budget, the conservation and management of the assets transferred to it. The duties and functions of the Castle Council are deliberative, consultative, promotional, control and management of local services. The Government competes promote decisions of regulatory authorities on general or interest of the Castle by: a) the transmission of agendas, concerns and suggestions to institutions and public bodies;
b) the presentation of interpellations, requests and proposals to the Congress of State, which is held within a period of 60 days to respond in writing; c) an invitation to attend its sessions to the members of the Congress of State and the Great and General Council as well as representatives of institutions or institutional bodies, so refer to matters falling under their direct competence and responsibility; d) the publication of proposals, observations and documents; e) the activation of assemblies, debates and public meetings. The Board shall act independently within the limits of its annual accounts, relating to: - operation and functioning of that Board; - Interventions with humanitarian and social solidar age; - Financing of cultural, recreational, sports and social, also in collaboration with organizations, institutions and associations, public and private; - Design and construction of public works referred to in this law as laid down in Articles 27 and 29. The Township Councils can establish direct relationships with organizations or governments of other states, following the joint permission of the Department of Relations with the Township Councils and the Secretary of State for Foreign Affairs. The committees have the task of coordinating the cultural, recreational and social promoted within the castle in order to foster collaboration between the various stakeholders in the territory, as well as how to use the Social Center from the population. The activity of social centers will be annually agreed and planned with all the Township Councils and the Department of Education and Culture. Art.23 (Duties and powers of the Board of Castello) Decision on authorization for the Board of Active à street trading. The opinion is advisory in terms of: 1) a proposed business plan limited to the territory of the Castle; 2) change in the category of membership of trade licenses; 3) instances of Arengo; 4) remedies provided dall'art.20 of Law 27 March 1987 n.40 "Health and safety in the workplace"; 5) skills that article 3 of the Law of July 6th, 1982 n. 69 "Discipline of the progress of craft in property with no specific use" destination; 6) establishment of Reggenziale decree, proposed by the Committee for Civil Protection, on the declaration of "natural disasters and exceptional event", according art.5 of the Law 1 March 1983 n. 24 "; 7) proposals for action for the prevention of natural disasters and for the containment of damage to property and people. In this regard the Government can make reports to the Committee for Civil Protection; 8) requests from the Commission for Housing Residnziale. the Board is required to give its opinion in all other cases expressly provided by law. it 'competence of the Board to propose the names of new areas of movement and the change of names already existing within the territorial limits of the Castle under Article. 3 of Law 75 of September 26, 1980. the Board promotes research, studies and initiatives to promote and disseminate knowledge of the history, customs and traditions, as well as the peculiarities of the Castle, with the collaboration of the State offices and also institutions and public and private cultural institutions. the Board shall be authorized to promote, in agreement with the Commission for the Preservation of Monuments and works of art and antiquities of Law 29 of 19 February 1993 and with the competent authorities , appropriate measures for the restoration and conservation of artistic, architectural and archaeological past. Members of the Castle Juntas are called to represent the committees themselves within collective bodies and committees as required by law. Art.24 (Opinion of the Juntas on the State Budget) The Administration is obliged to call with complete the documentation to each Junta

Art.25 (legislative initiative and referendum) The Castle Board may submit to the Regency of bills drawn up in articles, with explanatory report and indicating the expense coverage of any material, excluding the laws of amnesty and pardon, laws tax and budget and laws of ratifying international treaties, because being on the agenda of the Great and General Council within 90 days of submission. The Congress of State, with the assent of the Commission responsible Political Council Chamber, may, within 60 days following the presentation, refer the bill to the Council proposing, which I can withdraw, modify or confirm. Art.27 (public parks and green) The Castle Government has the right to promote the re tion of areas to be equipped to public green and park areas within the constraints and procedures set out in the Planning Act and the General Town Plan Law . For this purpose the council can present their projects to be subject to the ordinary procedure for approval and will be funded directly by the Government in collaboration with agencies and private institutions and with it vidual citizens. Art.28 (Conference of the Captains of Castle) In order to coordinate the activities of the Township Councils, also in relation to the activity of the Great and General Council and the Congress of State, the Department of Relations with the Township Councils of available the Regency, convenes Cap tani di Castello at least once in the six months reggenziale. The remaining 25% of the available funds is, in turn, committed by resolution of dell'AASP Board of Directors and of the State Congress, in relation to the needs of extraordinary maintenance reported by individual Township Councils. Art.30 (The fund for operation of the Juntas) In the state budget is expected an annual fund for the ordinary and extraordinary operation of the Juntas in relation to the tasks entrusted to them.
The Member of Parliament for Relations with the Township Councils bank tees that fund half in equal parts between the individual Councils and the remaining half in proportion to the registered voters of each Castle. The liquidation of the fund is carried out to 50% at the beginning of the financial year and the remainder after the administrative control by the Administrative General Secretariat, the final budget of the Board for the previous year. The fund for each council will be managed by the same standard. The annual reports are presented by each Government to the Department for Relations with the Township Councils by 28 February next year and are sent to the Secretary General Administration for its monitoring to be carried out by 30 April. Art.31 (Remuneration of Captain Castle, the Secretary and the Board members) The Castle Captain and the Executive Secretary are paid for their work as part of the Government budget, according to the amount that the council itself determine. For any duly convened meeting it is granted to members of the Board an attendance fee that will be determined as part of the same council budget. The members of the council employees by private individuals or public bodies are entitled to unpaid overtime allowed, if they are to perform functions related to their mandate during working hours. Art.32 (Rules) For the performance of the Giunta di Castello, where the law provides otherwise, is recognized to the Board the power to adopt its own rules of procedure. Art.33 (Repeals) E 'repealed Decree 23 of 12 February 1990 "Consolidated laws relating to Township Councils" and any rules which contravene this Act. It remains in force the Administrative Regulations for the Township Councils and the Regulations for the management of exhibitions and special services of the 'AASP.
