CHANGE OF LEGISLATION AND THE AMOUNT MONTHLY DEG LI FAMILY BENEFITS


We the Captains Regent of the Most Serene Republic of San Marino
promulgate and publish the following law approved by the Great and General Council
its meeting on 16 December 1994. Art.1

as from 1 January 1994 the measure of family allowances in favor of the persons referred
Article 2 and the first paragraph of Article 31 of Decree 15 of 26 April 1976 is hereby amended
:
1) £ .97.500 = 1 for a dependent;
2) = £ .127.500 for the second dependent person;
3) = £ .157.500 for the third dependent person;
4) = £ .187.500 for the fourth dependent person and for each subsequent dependent.

Art.2 The parties under Article 2 and the first paragraph of Article 31 of the Decree 26 April 1976 15
the Social Security Institute will pay annually a supplementary family allowance whose | || amount will be equal to 50% of family benefits received in the calendar year reference
included the increase of first check referred to in article 3
the additional child support payment is subject to following conditions:
a) that the person referred to in the previous paragraph and their family are actually
residents in the territory of the Republic of San Marino;
B) that the annual household income per capita is equal to or less than £ .12.000.000 = (twelve),
reggenziale revalued annually by decree on the basis of inflation data provided by
Processing Center data and Statistics of the State.
The annual household income per capita is calculated by dividing the sum of the income of fiscal reference
of all household members for the number of members of the same family nucleus
.
For the determination of the annual household income per capita combine all income wherever
products that profit to members of the household, net of killing and
of analytically deduced liabilities, provided by Law 13 October 1984
91 and subsequent amendments and additions. They are excluded from the calculation the fees and arrears on previous years
.
The additional child benefit in the first paragraph of this article is unwound by the
December 31 of each year, on presentation of a special application by the parties concerned
to be sent by July 31 to the competent Institute Social Security office.

Art.3 The child support amount, referred to in point 1 of Article 1 of this law,
in favor of the persons referred to in Article 2 and the first subparagraph of Article 31 of the Decree of 26 April 1976 n.15,
for the spouse entitled with children within the thirty-six months of life, is raised to £ .420.000 =.
The benefit to the following conditions applies:
a) that the person referred to in Article 2 and the first paragraph of Article 31 of the Decree of 26 April 1976
15 and their relatives are actually residing in the territory of the Republic of San Marino
;
B) that such persons fall within the conditions of annual household income per capita calculated
in the scale and in the manner set out in Article 2 on the upper;
C) that the child does not frequent the childcare service.
For the purposes of the progression of the shares related to the provision of family allowances considering
first borne by the spouse of the persons referred to in Article 2 and the first paragraph of Article 31 of the Decree of 26 April 1976
15.
The integration mentioned in the first paragraph of this ar icle is liquidated by December 31
each year, upon presentation of a specific application within the period specified in the last subparagraph of Article 2. Previous

family allowances can be paid, as an alternative, to the working woman or retired
under the same conditions with the same limits for the employee or retiree.
In case of request of both parents family allowances shall be payable to
parent with whom the child lives.

Art.5 The forecast of higher expenditure arising from application of this law is charged against a
Fund cash payment of family allowances of the Institute Annual Social Security.

Article 6. With effect from 1 January 1995 are repealed the rules in the last paragraph of Article 2 and Article 28 of the Decree
April 26, 1976 n.15.
They are also repealed all the laws that are inconsistent with the rules laid down
previous articles.
The benefits referred to in Articles 2 and 3 of the present Act shall apply with effect from 1 January 1994.
Art.7

This Law shall enter into force on the fifth day following that of its legal publication.
