AMENDMENTS AND SUPPLEMENTS TO THE LAW FRAMEWORK ON EDUCATION
UNIVERSITY AND CULTURAL INSTITUTIONS OF HIGHER

We the Captains Regent of the Most Serene Republic of San
Marino promulgate and publish the following law approved by the Great and General Council
its meeting on 30 November 1995.

TITLE I CONSTITUTION oF tHE UNIVERSITY '- AIMS'
Art.1
(Constitution)
this law amends, supplements and completely replaces the Framework law 127 of October 31
1985.
In implementation of the principles stated in article 6 of the Law of July 8, 1974 n.59 has established the University
Studies of the Republic of San Marino.
It is constituted as a higher education system suited to pursue and encourage studies of three
university levels, of which art.19 with the release of their titles to deserving students.
It also pursues and promotes postgraduate studies further education, as well as scientific research
.
The supervision on the University of the Studies is carried out by the Department of Education.

Art.2 (Purpose)
The University promotes the progress of science and the development of culture organizing the
research and study the most 'high levels.
In particular it:
a) organize the teaching and research activities in relation to social, professional, productive
;
B) promote the dissemination of scientific culture;
C) provide scientific and technical advice to more 'high levels of qualification;
D) participate in the cultural and scientific cooperation nternational. TITLE II

UNIVERSITY SCIENTIFIC COMMITTEE

Art.3 (Composition and functions)
The University Scientific Committee (SUC) is compost of three members appointed by the Great and General Council to
a qualified majority of two-thirds for the first ballot and a simple majority

The meetings are attended by the Rector of the University of CUS in a consultative capacity.
The members remain in office for three years and may be reappointed or replaced in whole or in part.
The CUS ensures the scientific level of teaching and research activities and their compliance with the institutional purposes

The CUS is an advisory body of the Deputy Education.
In particular it competes:
1) to collaborate with organizations entrusted with the activity of Education and with the organs of the University
to the determination of the addresses and general programs;
2) to formulate opinions on the scientific validity related to the establishment of Departments,
Interdepartmental centers, schools, centers, and Institut of study courses covered by this law;
3) give opinions on the effectiveness and efficiency of the University activities.
The CUS shall elect its own President cheonvoca least three times a year meetings.
The members of the CUS receive an attendance fee the amount of which is fixed by the State Congress

Art.4 (Bodies)

THE RECTOR 5


Art.5 (Appointment-Skills)

Art.6 (Composition)
The Board of Directors of the University (CAU) holds office for three years and consists of:

C) by a delegate of the Department of Education;
D) two members appointed by the State Congress. 5


Art.7 (Functions)
The Board of Directors of the University (CAU) exercises administrative
government and the economic and financial management of the University.
In particular, it provides:
a) the administration of the general budget of the University and approved the expenditure estimates and final figures in accounts
availability limits prescribed by law;
B) to enter into agreements and contracts with internal and external public entities that contribute to
funds and assets of the University;
C) to enter into agreements and contracts for teaching staff, establishing the amounts of salaries
according to criteria of equity and professionalism;
D) to enter into employment contracts with the administrative staff and auxiliary staff
;
E) to adopt the rules of procedure for its operation which should include the
payment of attendance fees to its Members;
F) to allocate maintenance funds or investment to the Rector, the Central Administration and
to the Departments on the basis of "fixed charges" of the same;
G) to administer the operating funds annually allocated for development activities, educational
and not approved by the Congress of State and belonging to the Departments.
The CAU is validly convened with the presence of m ggioranza of its members.

The meetings of the CAU and decisions taken in those areas must be recorded in the minutes

Art.8 (Composition)
The Board of Auditors consists of three m tates who serve for three years.
The Board of Auditors shall exercise the function of guaranteeing the state in acts involving spending

The Great and General Council shall appoint, by a qualified majority of 2/3 for the first
vote and a simple majority in successive ballots, Auditors Auditors from among persons of experience and

Art.9 (Functions)

Art.10 (Composition and skills)
The Academic Council consists of:
- the rector who presides over it;
- Heads of Departments and Interdepartmental Centres;
- The scientific responsible of the courses that result in the awarding of academic degrees,
- Directors of schools, centers and institutes;
- Professors with years of teaching contract;
- Professors Assistants.
It is for the Academic Council to debate and prepare the organizational lines of scientific

CHAPTER I DEPARTMENTS 5


Art.11 (Constitution)
The University is organized into departments, each of which functionally integrates one or more '
areas of research, to them exclusively heads the educational activities that can be organized by
more' departments or interdepartmental centers. They are the recipients of funds disbursed
to fund the educational activities authorized. The departments, as part of the internal regulations of operation
approved by CAU, have autonomy of the work programs of
organizational and managerial autonomy.
The Departments may be structured in Sections whose direction, without remuneration may be entrusted to the Department
teachers with multi-year contract. The Sections have no external relevance to
Department and can not manage funds.
The Department is established through Reggenziale Decree on the proposal of the Rector, after consultation with the
CUS.
The Reggenziale Decree determines the purposes and means of operation. 5


Art.12 (Bodies Department)
They are organs of the Department:
a) the Director of the Department;
B) the advice of the Department.
The Head of Department is elected from among the professors by professors and researchers of the Department
same and is appointed by decree by the Rector.
The Director remains in office for 3 academic years and may be reappointed.
Regarding the Board of the Department are part of the professors and researchers with multi-year contract, and the
Professors Assistants working in the Department itself.
It includes also a representative of enrolled students and non-teaching technical staff

Art.13 (the Director of the Department Functions)
It is for the Director of the Department:
1) to chair the Council of the Department and to ensure its implementation of the resolutions supervising || | compliance with laws and regulations;
2) to liaise with academic bodies and schools and institutions that belong to the same
Department, as well as with research institutions with which relationships are established for
collaboration;
3) to propose the annual plan of teaching and research of the Department,

5) to oversee the purchase of equipment, tools and materials required

Art.14 (Functions of the Department Council)
The Department Council shall exercise the following functions:
- enables the program of teaching and research activities;

Art.15 (Diploma Courses, Degree, Postgraduate, Specialization, Doctorate)

CHAPTER II SCHOOL-CENTRES-INSTITUTES 5


Art.16 (Constitution and competences)

Art.17 (Implementing Arrangements)

EDUCATION

Art.18 (Distance Learning)

19 (Degrees)

- 3 members for the 3rd level qualifications;

Art.21 (Professors and Researchers)

Art.26 (Financial year)

(actual flow statement) || | The year-end financial statements are approved by December 31 of each year.
The final statement must contain the exact and clear indication of the economic results of the whole of the financial management
which the statement relates.
At flow statement is attached an explanatory memorandum.
The final balance is drawn distinguishing the R evenue and expenses into chapters and headings, as well as
indicated in the Budget.
The final balance, together with the explanatory report of the Statutory Auditors, it shall be forwarded to
Great and General Council for approval.

Art.28 (Luxury)
And 'forbidden the University to acquire assets, financing, advantages or benefits under
any form that tend to distort its purpose, to diminish the autonomy and
they go to the detriment of its cultural and scientific prestige.

Art.29 of organism (Revocation)
In any case, a finding of non-compliance with the purposes of the present law of the organs
University is delegated to the Deputy of Education to propose to Congress of State
revocation by entrusting tasks to a special commissioner.
The bodies will have to be reconstituted within a deadline of three months.

Art.30 (Entry into force)
This Law shall enter into force on the fifth day following that of its legal publication.
The Deputy Public Education requires urgently to the CUS opinion as to all acts
needed for the restructuring of the University, also in adaptation to the dictates of this
law.
By the end of February 1996 will be issued the necessary additional reggenziali decrees, replacement
or amending those regulations that where in contrast to the present law, the same date
are abolished.
The current bodies remain in office until the enactment of the regulations referred to in the previous paragraph
. At that time they are considered forfeited and replaced with those contained in this

Law, except the Rector and the Administrative Secretary whose mandate ends when
provided for by the previous legislation.
