In view of article 4 of the Constitutional Law no.185 / 2005 and Article 6 of Qualified Law
186/2005;
We promulgate and send for publishing the following ordinary law approved by the Great and General Council
its meeting on July 22, 2013:

PROVISIONS ON THE COLLECTION OF NOTES AND COINS
PART I INTRODUCTION




Art.1 (Purposes)

1. This Act is intended to give effect to the Monetary Agreement, signed between the
Republic of San Marino and Europe Union on 27 March 2012 and enforced by Decree 120 of 7 August 2012
Council Chamber, with particular reference the provisions on banknotes and coins in euro
and related fraud and forgery preventive measures listed in the second and third paragraphs of Annex
.


Art.2 (Definitions)

1. Under the present law, we shall apply:
1) "equipment for the selection and acceptance of the" banknotes, a usable device
customer-operated or reserved for the personal device, as defined in Annex
THE;
2) "authentication of euro coins' means the process of verifying the authenticity and appropriateness of the
circulation of euro coins;
3) "competent national authorities":
- BCSM, the Central Bank of the Republic of San Marino of Law 29 June 2005
96 and subsequent amendments and additions;
- UCFM, the Central Office for the False Monetary referred to in Article 3 of this Act;
4) "counterfeit notes" or "counterfeit coins" shall mean notes and coins which, although
having the appearance of euro notes or euro coins, are the subject of a manufacturing or
fraudulent misrepresentation;
5) "euro banknotes unfit for circulation" means genuine euro banknotes but are
deemed unfit for recirculation following the fitness checking referred to in Annex III;
6) "reference band", set of combinations between the values ​​for diameter and values ​​for edge height included
respectively in the reference range for diameter (between 19,00 and 28,00 mm
) and the reference range for edge height (between 7,00% and 12,00% of each reentrant
value in the reference diameter for margin);
7) "ECB", the European Central Bank;
8) "cash for cash withdrawal", a device used independently by customers (self-service
) that, by using a bank card or other means, dispenses euro banknotes to the public with
debiting a bank account, such as an automatic teller machine
(ATM). Are also considered cash dispensers of self-checkout terminals usable
customer-operated (Scots) with which the public can pay for goods or services either by bank card
, either in cash or other means of payment, having a function of
cash withdrawal;
9) "CNAC", the National Centre for Analysis of Coins;
10) "ETSC", the European Technical and Scientific Centre, set up by Decision 2005/37 / EC;
11) "technical and statistical data" means data that help identify counterfeit notes or counterfeit coins
(technical description of type of counterfeit), as well as data on the number of counterfeits in
depending on their origin;
12) "forgery", the following activities:
- making or altering of euro notes or coins, whatever means are employed
;
- The uttering of counterfeit euro notes or coins, with knowledge that
are false;
- The import, export, transport, receiving, or acquisition of counterfeit notes and counterfeit coins
, to uttering the same and with knowledge that they are false;
- The manufacture, receipt, acquisition or possession of:
• instruments, articles, computer programs and any other process, intended to
their very nature, the manufacture of fake or counterfeit coins banknotes
euro or alteration of euro banknotes and euro coins;
• holograms or other components which serve to protect euro notes and coins
euro against counterfeiting;
13) "cash handlers" means:
a) banks and post offices;
B) other providers of payment services referred to in point I of Schedule 1 to the Act 17 November 2005
165 (payment institutions);
C) providers of e-money services referred to in point J of Annex 1
to Law 165 of 17 November 2005 (EMI);

D) persons who professionally carry out the counting activities, endorsement
and the suitability of cash, including those authorized to transport activities and custody of cash
in the Decree -law October 26, 2009 148 (a service company);
E) the BCSM in banking;
F) persons whose activity consists in exchanging notes or coins of other currencies
in exercising reserved referred to in point K of Annex 1 to Law
November 17, 2005 165;
G) other economic agents such as traders and casinos and games of chance which
to Law 67 of July 25, 2000, participating in basis in the processing and distribution to the public of banknotes
through ATMs in

H) San Marino branches of subjects, based abroad, developing the same
activities by persons indicated above;
I) any other persons involved in the management and distribution to the public of notes and coins
identified by the BCSM in the Regulations referred to in paragraph 24 below
;
14) "medals and tokens", metallic objects, other than blanks intended for striking coins
, having the appearance and / or technical properties of a coin, which are not issued under a
San Marino or foreign laws, does not therefore are neither a legal means of payment nor
are legal tender;
15) "commemorative coins", 2-euro coins intended for circulation but
bearing a different design on the national side from that of the regular coins (except
to the edge lettering, and for ' compulsory indication of the year of issue) for
commemorate an event of considerable national or European relevance;
16) "collector coins", euro coins that are not issued for the placing on the
circulation;
17) "circulation coins", euro coins intended for circulation, whose values ​​
unit and whose technical specifications are referred to in Article 14;
18) "euro coins unfit for circulation" means euro coins, even if authentic,
were rejected during the authentication process or euro coins the appearance of which is
been significantly altered;
19) "NAC", the National Centre for Analysis of euro banknotes;
20) "normal" coins, the coins intended for circulation by different commemorative coins
;
21) "money laundering legislation", the national legislation on prevention and combating money laundering
, in compliance with Directive 2005/60 / EC and mainly formed by Law
June 17, 2008 n.92 and subsequent changes and supplemented, the related decrees and instructions
the Financial Intelligence Agency;
22) "gold", "silver" and "platinum" mean alloys containing gold, silver and platinum with purity
thousandths of a weight of at least 375, 500 and 850 respectively;
23) "trained personnel", the employees of cash handlers who have:
a) knowledge of the different public security features and criteria
selection of euro banknotes and coins, as specified and
published by the Eurosystem, and recalled, for banknotes, in Annex III to this
law;
and b) the ability to check euro notes and coins in accordance with these criteria;
24) "BCSM Regulation", the implementing regulation of this Law, issued by BCSM
in the exercise of its regulatory powers under Article 38, paragraph 1, of the Law of 29 June 2005 96
and subsequent amendments and additions;
25) "recycling", the act of uttering, at the counter or through automatic distribution
devices, the banknotes and coins that cash handlers have
received from the public (such as payment or as a deposit) or from another cash handler;
26) "euro symbol" means the symbol representing the euro '€' as shown and described
Annex I of Regulation (EC) N.2182 / 2004 of 6 December 2004;
27) "type of equipment for the selection and acceptance of banknotes",
an apparatus for the selection and acceptance of banknotes that can be distinguished from other equipment
for the acceptance and the sorting of banknotes as described
Annex I, point 3


Art.3 (Central Office for the False Money)

1. E 'set up at the National Central Interpol Bureau of the Republic of San Marino

2. The UCFM:

A) organizes and coordinates investigations with regard to counterfeit banknotes and coins and collects
information likely to facilitate such investigations as well as to prevent and repress the
falsification;
B) cooperate with the issuing authorities and national police authorities as well as with foreign authorities
who perform equivalent functions;
C) cooperate with the judicial authorities for investigations relating to criminal offenses resulting
enforcement of this Act;
D) received by management of cash banknotes and coins in currencies other than the euro suspicious of
falsehoods in order of their withdrawal from circulation and related investigations;
E) issue instructions to cash handlers for the purposes indicated in this Article. 3
. The UCFM signs a memorandum of understanding with the BCSM that defines forms of cooperation
and their respective responsibilities with regard to the prevention and control procedures
authenticity of euro banknotes and euro coins.
4. The UCFM may also enter into memoranda of understanding with Europol or with authorities competent foreign
who perform equivalent functions.


Art.4 (Disclosure requirements)

1. Persons intending to engage in cash management activities, referred to in paragraph 13)
Article 2, they give prior information to the national authorities to indicate
activities to be performed, the organizational set up and the type of equipment that
will be used, using the form attached to BCSM Regulation.
2. The cash handlers shall also inform the competent national authorities of the cessation
year.

PART II


euro banknotes


Art.5 (Denominations and specifications)

1. The euro banknotes include seven denominations in the range from 5 euro to 500 euro,
depicting the theme "Ages and styles of Europe", characterized by the technical specifications laid down
time to time by the ECB and currently listed in Schedule IV, Table 1.
2. The seven denominations in the euro banknote series shall bear the representation of gateways and windows on the front
(recto) and bridges on the reverse side (verso). All seven denominations are typical of the different periods of European art
indicated in Annex IV. Among the other elements of the design include:
a) the symbol of the European Union;
B) the name of the currency in the Roman and greek alphabets and, in addition, for the second series of euro banknotes
, the name of the currency in the Cyrillic alphabet;
C) the acronym of the ECB in their official language of the European Union; for the first
series of euro banknotes, the ECB acronym is limited to the following five official languages: ECB,
ECB, EZB, EKT and EKP and, in addition, for the second series of euro banknotes the acronym ECB
is limited to the following nine official languages: BCE, ECB, ЕЦБ, EZB, EKP, EKT, EKB,
ECB and EBC;
D) the © symbol to indicate that the copyright belongs to the ECB;
E) the signature of the ECB President.


Art.6 (Copyright and playback speed)

1. ECB holds the copyright on the euro banknote designs. BCSM
protection in the territory of the Republic of San Marino, in the name and on behalf of the ECB, the copyright law on
reproduction of euro banknotes.
2. And 'any illicit reproduction of banknotes that the public might mistake for genuine euro banknotes
. 3

which infringes the copyright of the ECB, which, inter alia, that
that adversely affects the reputation of the euro banknotes.
4. "Reproduction" shall mean any tangible or intangible image that uses all or part of
in euro banknote as specified in paragraph 5 above and in Annex IV, or
parts of its individual design elements, such as, inter alia , color, dimensions and use of letters or symbols, the
which image may resemble or give the general impression of a euro banknote in authentic, regardless
:
a) the image size;
or b) the material (s) or technique (or techniques) used to produce it;
or c) if the design elements of a euro banknote have been altered or added, including
letters or symbols.
5. Reproductions complying with the following criteria shall be deemed lawful since there is the
danger of confusing the public with genuine euro banknotes:
a) reproductions on only one side of a euro banknote, provided that their
dimensions are equal to or greater than 125% both in length and in width, or equal to or not greater than the

75% in both length and width, relative to the size of the corresponding
in euro banknote as specified in Article 5 and Annex IV; or
b) reproductions on both sides of a euro banknote, provided that the size of the
same are equal to or greater than 200% both in length and in width, or equal to, or not more
50% in both length and width, relative to the size of the banknote
corresponding euro, as described in Article 5 and Annex IV; or
c) reproductions of individual design elements of a euro banknote, provided that such
a design element is not depicted on a background resembling a
banknote as specified in Article 5 and in ' Annex IV;
or d) one-sided reproductions depicting a part of the front or the back of a banknote
EUR provided that the part is smaller than one third of the original front side or reverse side of the banknote
in euro, as described in Article 5 and Annex IV; or
e) reproductions material clearly different from paper, which looks distinctly different
the material used for banknotes; or
f) intangible reproductions made available electronically on websites, or through
of communication cable or wireless, or by any other means which
allows the public to access these intangible reproductions places and times chosen by
them individually, provided that:
- the word "sPECIMEN" (sample) is incorporated
diagonally across the reproduction in Arial font or a similar character, and
- the resolution of the electronic reproduction in its size to 100% does not exceed 72
dots per inch (dpi).
6. In the case of reproductions in accordance with paragraph 5, letter f):
- the length of the word "SPECIMEN" is at least 75% of the length of
reproduction, and
- the height of the word " SPECIMEN "is at least 15% of the amplitude of the reproduction, and
- the word" SPECIMEN "appears in a non-transparent (opaque) color contrasting with
dominant color of the respective euro banknote, shown in 'Annex IV.
7. BCSM ECB and, on receipt of a written request, provide confirmation that reproductions not lawful
in line with the criteria referred to in paragraphs 5 and 6, if they are not
confused by the public with banknotes genuine euro as described in Article 5 and Annex IV

above request is addressed to BCSM while, in all other cases, such requests should be addressed to the ECB
. BCSM, receiving the request on behalf of the ECB, shall advise
to all responses to requests for confirmation
8. If BCSM becomes available:
- of a non-compliant reproduction in the territory of San Marino, with standard
communication drafted by the ECB, order the author of the non-compliant reproduction to interrupt the
production and, where appropriate, the holder of compliant reproduction to hand over the same,
and in case of non-compliance with the order, shall immediately to the ECB for information
consequent measures to be taken after consultation with BCSM, making use of the collaboration of the latter
and his interposition;
- Irregular playback available electronically on websites, through tools of communication
cable or wireless means or by any other means that allow the public to access the non-compliant reproduction
in individual places and times
chosen by the individual, it shall immediately inform the ECB for the consequent measures to be taken after consultation with
BCSM, also with the collaboration of the latter and the
its interposition.
9. The provisions of the preceding paragraphs shall also apply to euro banknotes withdrawn from circulation
or have lost their legal tender.


Art.7 (General principles of banknotes suspected of being false or unfit for circulation)

1. The cash handlers undergo euro banknotes for authenticity and fitness checking
accordance with the procedures set out in this law, its Appendices and Regulations for BCSM
any further technical questions of detail.
2. If two or more cash handlers are involved in the recirculation of the same
euro banknotes, the person responsible for the authenticity and fitness of such banknotes into euro
control will be identified in the contractual arrangements between them managers, subject
as provided for in paragraph 4 below.

. The authenticity and fitness checking is carried out by means of equipment for selection
banknote handling machines successfully tested by the Eurosystem and listed on the ECB
Internet site, or manually by trained personnel.
4. The euro banknotes can be recirculated via customer-operated machines
, or via cash dispensers, only if they have undergone
to the authenticity and fitness check carried out with a type of equipment for the || | selection and acceptance of banknotes in the previous paragraph, and were classified as genuine and fit
. This requirement does not apply to euro banknotes that have been delivered
directly to a cash handler by BCSM or by another cash handler that declares
have already made the authenticity and fitness in the same way.
5. The staff-operated machines, when used for the authenticity and fitness checking,
and customer-operated devices can be operated by cash handlers
only if included among those that have been successfully tested | || Eurosystem and listed on the ECB's website referred to in Article 11. the devices are used
only for cuts and for the series of euro banknotes listed in the ECB's Internet site for
devices correspondents in the normal factory settings, including any respective
updates, which have been successfully tested, unless they are agreed
more restrictive settings between BCSM and cash manager.


Art.8 (Classification and treatment of euro banknotes by means of devices for selection
banknote handling)

1. Euro notes subject to control by means of a device usable
customer-or use of staff-are classified and treated in accordance with
Annexes IIa and IIb.


Art.9 (Identification of euro banknotes suspected of being false)

1. The cash manager has an obligation to ensure the authenticity of euro banknotes
from the same receipts that it intends to put back into circulation and to ensure that they are identified
false ones.
2. For the purposes of the provisions of the preceding paragraph the cash manager:
a) withdraw from circulation all euro banknotes received which has
know or have sufficient reason to believe to be false;
B) delivery to the competent national authorities immediately, in line with the Rules
BCSM, and in any event within a maximum of 20 working days, the banknotes that have not been classified as genuine
following classification carried out in accordance with Annexes IIa or IIb
, or following the authenticity manual control performed by trained personnel.


Art.10 (Identification and reimbursement of euro banknotes unfit)

1. The cash handlers are obliged to:
a) run:
- the eligibility manual controls in accordance with the minimum requirements set out in Annex III;
- The eligibility automatic controls by means of equipment for the selection and
banknote handling machines successfully tested according to published minimum requirements,
time to time, on the website of the ECB;
B) withdraw from circulation euro banknotes received by them which, although not suspected of
falsehoods, are unfit for circulation;
C) deliver to BCSM, in order to refund or replacement, genuine banknotes and damaged
in compliance with the provisions in Annexes IIa and IIb, and any technical
supplementary provisions contained in the Rules BCSM.
2. BCSM at the request replaces the authentic and damaged euro banknotes if:
- the applicant presents more than 50% of the euro banknote; or
- the applicant provides 50% or less of the euro banknote, where the applicant can
proves that the missing parts have been destroyed. 3
. In addition to the provisions in the preceding paragraph, the replacement of genuine euro banknotes
damaged occurs in accordance with the following additional conditions:
a) in case of doubt as to the ownership of the applicant in relation to the euro banknotes: the || | applicant must provide identification, and proof that the applicant is the owner or
otherwise authorized applicant;
B) in case of doubt about the authenticity of euro banknotes: The applicant shall provide the
their identification;
C) in the case are presented genuine euro banknotes ink-stained, contaminated or
impregnated
: it needs to be provided by the applicant with a written explanation as to the kind of stain
, contamination or impregnation;
D) if genuine euro banknotes have been damaged by anti-theft devices:
it needs to be provided by the applicant a written statement on the cause of cancellation
;
E) if genuine euro banknotes have been damaged by anti-theft devices in
due to robbery or theft, attempted or actual or other criminal activity: the banknotes are
replaced only at the request of the owner or otherwise at the request of the authorized applicant
who is the victim of criminal activity attempted or consumed which damaged banknotes;
F) if genuine euro banknotes have been damaged by anti-theft devices and
be presented by cash handlers: it is necessary that those responsible must
a written statement on the cause of the cancellation, the reference and the characteristics of
warning alarm, detailed information of the submitting party banknotes damaged
and the date of submission;
G) where the genuine euro banknotes have been damaged in bulk due
activation of anti-theft devices: the banknotes in question must normally be presented in
100 banknotes groups, provided that the '
amount of euro banknotes presented is sufficient to form such groups;
H) in the event that the cash handlers present for replacement in one or more transactions,
in genuine euro banknotes damaged for a value of at least EUR 7,500:
these managers provide documentation on the origin notes and customer identification or, where
possible, the beneficial owner as defined in the anti-money laundering legislation. If in doubt,
this obligation applies even if it is not reached the threshold of 7,500 euro. The rules set out in
this subsection shall not affect any other more stringent
identification requirement and reporting according to anti-money laundering legislation.
4. Without prejudice to the above, in cases where BCSM is satisfied or have sufficient reason to believe that
:
a) genuine euro banknotes have been intentionally damaged, BCSM same refuses
replacement and traps banknotes in order to avoid the return on the market or that the
applicant from presenting for replacement. However, BCSM replaces genuine euro banknotes
damaged if he know or have sufficient reason to believe that applicants are
bona fide, or if applicants can prove that they are bona fide.
The euro banknotes that will bring a degree of modest damage, why go to

;
B) has committed a crime, BCSM refuses the replacement of genuine euro banknotes damaged

are to qualify for exchange pursuant to the conditions defined in
preceding paragraphs;
C) in genuine euro banknotes are damaged contaminated in such a way as to present a
risk to health and safety, BCSM replaces genuine euro banknotes damaged
if the applicant can provide its expertise not harmful to the health of
money issued by public offices.
5. BCSM requires the payment of a commission of 10 euro cents per banknote, in
Chief to cash handlers when they request to BCSM under the preceding paragraph
replacing genuine euro banknotes that have been damaged by 'use of anti-theft devices
. The fee shall only be charged if they are replaced at least 100 euro banknotes
damaged and all exchanged euro banknotes. It is not required to pay any fees

6. BCSM recognizes the cash handlers the value of genuine euro banknotes, which

B) BCSM can verify immediately that the amount requested
probably corresponds to the value of euro banknotes presented; is

C) is transmitted to any other information required by BCSM.
7. Any difference, if any, identified later, between the value of genuine euro banknotes in
accidentally damaged presented for exchange and the amount credited
before payment is charged or credited, as appropriate, to the || operator | cash. The fees referred to in paragraph 5 will be calculated based on the actual number of genuine euro banknotes
accidentally damaged that they have been treated by BCSM.
8. E 'right to BCSM, after informing the ECB, lay down more stringent requirements than those
in Annex III to one or more cuts or series of euro banknotes if this is justified, for
example, by a deterioration in the quality of euro banknotes in circulation within the
own State; these more stringent requirements are published on the website of BCSM.


Art.11 (Verification procedures for equipment for the selection and acceptance of banknotes)

1. All types of equipment for the selection and acceptance of verified banknotes positively
are listed on the ECB's website during the period of validity of the relevant tests
results, as indicated in paragraph 2. A type of equipment for
the selection and acceptance of banknotes already included in the list that is no longer able, during that period, the
identify all counterfeit euro banknotes known to the Eurosystem is
removed from the list, the second procedure specified by the ECB.
2. If a type of equipment for the selection and acceptance of banknotes occurred
positively, the test results are valid for one year from the end of the month in which the test is

Art.12 (monitoring activities and corrective measures)

1. BCSM, for the purposes of this Act, shall be permitted:
i) to conduct inspections, with or without notice, at the premises of cash handlers, in order to
monitor their equipment for the selection and acceptance of banknotes ,
in particular their ability to make the authenticity and fitness, as well as
due to the account holder, or otherwise subject to the presenter
euro banknotes suspected of being counterfeit and non identified clearly authenticated;
Ii) to verify the procedures governing the operation and control of equipment for
selection banknote handling, the treatment of the euro banknotes undergo
check and any of authenticity and fitness checking performed manually.
2. For the purposes of the preceding paragraph, BCSM uses dell'UCFM collaboration,
in the terms and with the arrangements agreed in the appropriate Memorandum of Understanding under the preceding article

3. 3. BCSM and UCFM may require the submission of documents and records they deem necessary
and collecting specimens of euro banknotes treated to subject them to inspection at the headquarters of
BCSM; In the latter case, the inspected entity has the right to attend their own
representative verification.
4. Except as provided in article 31, in the event of proven non-compliance
provisions of this Act and the Regulations BCSM, BCSM may require the cash
operator to take corrective measures within a period specifically indicated pending
which the BCSM, on behalf of the ECB, prohibit the same operator to recirculate the
cut or cuts of euro banknotes of the series in question. Where the failure is caused by a defect
type of equipment for the selection and acceptance of banknotes, this could
lead to its removal from the list referred to in Article 11.
5. If a cash handler does not cooperate with BCSM in relation to an inspection, this
conduct constitutes failure to comply with the purposes of the preceding paragraph as well as for the purposes of Article 31.

Art.13 (Reporting obligations)

1. The cash manager must:
i) notify BCSM in writing - in paper or electronic form - the kind of
equipment for the selection and acceptance of banknotes used at least five days before the
'equipment is put into operation;
Ii) notify BCSM any other information required by Regulation BCSM
in full compliance with the objectives, principles and other contents of Annex IV of Decision ECB
/ 2010/14.
PART III


COINS

Art.14 (Denominations and specifications)


1. The euro coins include eight denominations in the range from 1 cent
euro and 2 euro with the technical specifications laid down from time to time by the European
law currently listed in Annex IV, Table 2.


Art.15 (National Face)

1. The national side of circulation coins shall not repeat any
indicating the denomination of the coin, or any part thereof, nor the name of the
single currency or of its subdivision, except for ' any recording of unit value
on the edge of the 2 euro coin, provided that it is only the figure '2' or the term 'euro' in
its alphabet, or both.
2. The national side of all denominations of coins intended for circulation are
:
a) the indication of the "Republic of San Marino", in full or abbreviated form;
B) the design approved by the European Commission, pursuant to procedures established in the applicable
Community legislation;
C) the crown of twelve stars, the same as those appearing on the flag of the European Union;
D) the year mark. 3
. The design of the national sides of the coins intended for circulation is chosen
taking into account the fact that euro coins circulate in all Member States whose currency is the euro
.


Art.16 (Issuance of coins intended for circulation)

1. The circulation coins are issued and put into circulation at their par value

Art.17 (Special Provisions for commemorative coins)

1. Every year the Republic of San Marino may issue no more than two commemorative coins
.
2. The total number of commemorative coins put into circulation for each individual issue
will also exceed the higher of the following two ceilings:
- 0.1% of the cumulated total net number of 2-euro coins put into circulation
by all Member States whose currency is the euro up to the beginning of the year preceding the year of issuance of the commemorative coin
. This limit can be increased, on a reasoned request, to
2.0% if it is commemorated a widely recognized and highly symbolic.
In this case the Republic of San Marino should refrain from launching another commemorative coin issue
using the raised ceiling during the subsequent four years;
- 5.0% of the total of 2-euro coins put into circulation by the Republic of San Marino,
until the beginning of the year preceding the year of issuance of the commemorative coin.


Art.18 (issuance of collector coins)

1. The Republic of San Marino may issue collector coins and putting them on the market also
to a value higher than their nominal value.
2. Collector coins are legal tender only in the territory of San Marino, in
which still can not be considered as ordinary means of payment, not being
issued for entry into service; the BCSM Regulations may therefore be introduced
necessary measures to discourage the use of collector coins as a means of payment. 3
. In collector coins:
a) is clearly and easily recognizable the San Marino issue identity;
B) the nominal value is different from that of the coins intended for circulation;
C) the images are not similar to the common sides of the coins intended for circulation and, where
similar to a national side, their overall appearance
must still be easily differentiated;
D) the color, diameter and weight are significantly different from those of the coins intended for circulation
, at least for two of the three characteristics, for which the value of
difference must go beyond the limits of tolerance fixed for circulation coins;
E) there is no "knurled" or "Spanish flower".
4. The collector coin issues are in the volume of coin issuance to be
approval of the ECB overall basis.


Art.19 (Copyright and playback speed)

1. Copyright on the designs of the common side of the euro coins belongs to the European Union
, represented by the European Commission, also with regard to euro coins
issued by the Republic of San Marino and in circulation in San Marino .
Copyright on the drawings of the national side of the euro coins issued by the Republic of San Marino belongs
all'Ecc.ma Room.

2. As a result of the provisions of the preceding paragraph, the complete or partial reproduction of
the common face design of euro coins is allowed, without the need
recourse to a specific procedure, only in the following cases: || | - photographs, drawings, paintings, films, images and dimensional reproduction (without relief), provided
who are in faithful likeness and that their use is not harmful and offensive image of the euro
;
- For reproduction with relief on objects other than coins, medals and tokens or
any other object that can be exchanged for money;
- Reproduction on tokens made in soft or plastic material, as long as their size
either larger or smaller than fifty percent than the real coins. 3
. Any other reproduction of all or part of the common face design of euro coins
must be explicitly authorized by BCSM, after verification with the CNAC
identified for the Republic of San Marino.


Art.20 (Medals and tokens similar to euro coins)

1. The production and sale of medals and tokens, and their importation and
distribution for sale or for other commercial purposes, shall be prohibited in the following circumstances:
a) when the terms "euro" or "euro cent »or the euro symbol appear on their surface;
B) when their size is inside the reference band;
C) when a design appearing on the surface of medals and tokens is similar to:
i) any design, or parts thereof, appearing on the surface of euro coins,
including in particular the terms' euro "or" euro cent ", the twelve stars
European Union, the image of the geographical representation and the numerals, as well as
are depicted on euro coins;
or ii) those symbols representative of national sovereignty of States, as depicted on
euro coins, including in particular the effigies of Heads of State, the coat of arms, brands

i) the combinations of diameter and height of medals and tokens are aboard
consistently outside the ranges defined in each of the cases listed in Section
A) of Annex V; and
ii) the combinations of diameter and metal properties of medals and tokens are
consistently outside the ranges defined in each of the cases reported in the
Section B) of Annex V.
4. BCSM, with dell'UCFM collaboration, ensures strict compliance with the provisions of this Article
.


Art.21 (General principles of suspicious coins of falsehood or unfit for circulation)

1. Control of authenticity and fitness of euro coins is performed in compliance with the procedures established in this Act
and
out technical provisions that may be included in the BCSM Regulation.
2. If two or more cash handlers are involved in the recirculation of the same coin
in euro, the person responsible for the authenticity and fitness checking of these euro coins will be
one identified in the contractual arrangements between those operators.


Art.22 (Authentication of euro coins)

1. The cash handlers, other than those referred to in paragraph 13, letter g) of Article 2
are obliged to ensure that euro coins which they have received and intend
put back into circulation, are subject to an authentication procedure.
They fulfill this obligation through the use of suitable equipment for the treatment of
coins or manually by trained personnel.
2. Following authentication all coins for which the cash handlers have the

Know or have sufficient reason to believe to be counterfeit, to be provided, in line with the BCSM
Regulation and in any event within a maximum of twenty working days, the competent national authorities

Art.23 (detection test for equipment for the handling of euro coins)

1. The cash handlers in the previous article shall use only the types of
processing equipment of coins, having passed the detection test,

Art.25 (Controls)

1. BCSM is authorized, including use of dell'UCFM collaboration, to carry
controls, with or without notice, at the headquarters of cash handlers to verify the use exclusive
by the latter of equipment in the previous article and the
functionality of a representative number of the same equipment. In case of testing manuals
, the cash manager must issue a suitable declaration to their competent authorities in order
training and the training received by the staff in charge of verifying

equipment operating within the State, all the machines operating in the State
same will be checked annually.
2. As part of the checks carried out, BCSM tests the ability of the cash managers
authenticate euro coins on the basis:
a) the existence of a written policy providing instructions relating, as appropriate, || | the use of automatic coin-processing equipment or the manual controls
;
B) the allocation of appropriate human resources;
C) the existence of a written maintenance plan intended to keep machines for
coin processing at an adequate level of efficiency;
D) the existence of written procedures for handing over to the competent national authorities
counterfeit euro coins, euro coins unfit for circulation and other coin-like objects that
do not comply with the specifications of the coins genuine euro;
E) the existence of internal control procedures describing the modalities and frequency of
checks that cash handlers should carry out in order to ensure that their selection
centers and their staff follow the instructions set out in this paragraph. 3
. Except as provided in article 31, in the event of proven non-compliance
provisions of this Act and the Regulations BCSM, BCSM may require the cash
operator to take corrective measures within a period specifically indicated pending
BCSM of which may prohibit the same operator to recirculate the cut or cuts of coins

Art.26 (Withdrawal and reimbursement of euro coins unfit for circulation)

1. BCSM reimburse or replace euro coins that have become unfit or rejected during the authentication process
.
2. BCSM may refuse reimbursement of euro coins unfit for circulation which have
been deliberately altered or because of a process having the expected effect of altering them,
exception of coins collected for charitable purposes. 3
. BCSM shall ensure that the coins unfit for circulation, after withdrawal,
reaches, those responsible for their destruction by physical and permanent deformation
so that those coins can not be put back into circulation or be submitted for reimbursement purposes.


Art.27 (Treatment costs of euro coins delivered)

1. In order to encourage the withdrawal from circulation and delivery BCSM of euro coins
counterfeit or unfit for circulation, it is expected the general exemption from commissions
treatment for those who will provide the understanding that the costs for delivery
BCSM and any other related costs are still dependent on them.
2. For granting the exemption referred to in the preceding paragraph, the applicant must show
certificate attesting to their residence or registered office in the territory of San Marino.


Art.28 (Packaging of euro coins unfit for circulation)

1. The natural or legal person, by the submitting euro coins for reimbursement or replacement
, shall sort them per denomination puts in bags or containers
standardized, according to the following guidelines: || | a) the bags or boxes shall comprise the quantities for cuts under specified (
if the total quantity of euro coins unfit for circulation is less than 100 for each denomination,
coins can be submitted in non-standard packaging) :
i) 500 coins for the denominations of EUR 2 and EUR 1;
Ii) 1 000 coins for the denominations of EUR 0.50, EUR 0.20 and EUR 0.10;
Iii) 2 000 coins for the denominations of EUR 0.05, EUR 0.02 and EUR 0.01;
Iv) for smaller quantities, 100 coins of each denomination;
B) each bag or box indicates the natural or legal person responsible for the delivery,
the value and the denomination contained, the weight, date of packaging and the number of bag or container
;
C) the natural or legal person responsible for the delivery provides a list of packaging
with an overview of the bags or containers;
D) where coins have been treated with chemical or other hazardous substances, the standard packaging
are accompanied by a written declaration specifying the exact substances used
.


Art.29 (Checks of euro coins unfit for circulation)

1. BCSM, the euro coins unfit for circulation which has received, check:
a) the quantity declared by weighing each bag or box;
B) the appearance and the authenticity of a sample of at least 10% of the delivered coins.
2. Where the checks referred to in paragraph 1 that anomalies or deviations than
provisions of the previous article, the entire bag or box is checked. 3
. Where the acceptance or processing of euro coins constitutes a health risk
staff who treat or a submission fails to meet standards of
packaging and labeling, BCSM may refuse to accept these currencies.


Art.30 (Reporting, communication and evaluation)

1. Without prejudice to further disclosure obligations possibly arranged in the BCSM Regulations,
the cash handlers, provide BCSM at least annually or simple request, the following minimum information
:
a) the types and number of equipment coin-processing machines used;
B) the location of each apparatus for the treatment of the coins;
C) the volume of processed coins for equipment, by year and cutting, for at least the main
three cuts.
2. BCSM ensures that information concerning the authorities designated for reimbursement or
replacement of euro coins and specific modalities, are publicly available on the Internet site of the same
BCSM.
3
. BCSM also ensures the availability on an annual basis to the competent authorities
European, or ones from those identified for relations with the Republic of San Marino, of each
information and statistical data relating the pursuit of activities, including control, referred to in this Act
.


PART IV FINAL AND TRANSITIONAL


Art.31 (Sanctions)

1. Unless the act constitutes a crime, cash handlers, in cases of violation of
provisions of this Act and Regulations in the BCSM, they are punished with a pecuniary administrative sanction
from 100.00 to 50,000.00 Euros imposed by BCSM accordance
by delegated decree to be issued by August 31, 2013, while confirming the criteria and procedures prescribed by the decree
May 30, 2006 n.76; in cases of violation of the prohibition referred to in the previous
Article 20, paragraph 1, the measurement of the administrative fine can be established
up to 40% of the value of the assets and rights which are the subject of the offense to which is added a
2 to 15 euro penalty for every medal, metallic coin or metal object.
2. In case of voluntary settlement the offender is required to pay half the
applied administrative fine. 3
. Violations of the provisions of this Act and the Regulations BCSM are valued by
BCSM also to the purpose of supervision of the financial system and for the purpose of reporting
Office of Control and Supervision of Economic Activities.
4. To supplement the provisions of Article 32 of Law 96/2005 and subsequent amendments and additions
, BCSM can publish the sanctioning activity data derived
by this Act in respect of any cash manager.


Art.32 (Cooperation and Mutual Assistance)

1. The competent national authorities, in applying this law,
transmit, for the purpose of analysis and identification, banknotes and coins suspected of
be false, and the relevant technical and statistical data held by the national authorities of other States with equal
tasks. The same agencies may request the cooperation and
necessary assistance to ensure the repression of forgery. In particular the necessary expert analyzes of suspected
euro banknotes of falsehood will be entrusted to NAC identified by current European
provisions for the territory of San Marino, while those on the suspect euro coins
falsehoods are submitted to the CNAC identified by European provisions in force for the territory
San Marino.
2. The results of the analyzes on the euro in the preceding subparagraph shall be communicated to Europol in
dell'UCFM care, as well as, more generally, all centralized information on the
proceedings relating to the falsification and the related criminal offenses counterfeiting of the euro, including
identification of the people involved, the circumstances in which the offenses were discovered, the
of the seizure and links with other cases. A similar activity is performed by dell'UCFM
with reference to banknotes and coins denominated in a foreign currency. 3
. The provisions referred to in paragraphs above will be applied in such a way as not to impede
the use and preservation of euro banknotes and coins suspected counterfeit
as evidence in criminal proceedings, provided that NAC and CNAC,
in order to allow the discovery of other notes and counterfeit coins still in circulation,
will examine the falsified euro even while they are still ongoing judicial proceedings.
4. For the purposes of this Act, BCSM may enter into Memorandums of Understanding with the NAC and CNAC.
5. Notwithstanding the above, in order to ensure effective protection of the euro against the
risk of counterfeiting, the competent national authorities shall cooperate with the European Commission, the ECB and Europol
.


Art.33 (Coordination and repealing Regulations)

1. Article 9, paragraph 2 of the Decree 121 of 27 November 2001 is amended as follows:
"2. Equating established in paragraph 1 shall take effect for offenses committed before 1 January 2002 and
for banknotes and coins not yet issued but are designated for circulation, and are
legal tender. ".
2. Are hereby repealed Articles 3, 7 and 8 of Decree 121 of November 27, 2001, as amended
Article 96 of Law 194 of December 22, 2010.

Art. 34
(Implementing Rules and update)

1. Annexes I, IIa, IIb, III, IV, V can be integrated or changeable by delegated decree.

2. BCSM, with the Regulations referred to in Article 2, may introduce measures to
greater detail, technical or operational nature, compliance with the provisions in this law, which shall take effect
however, from its date of entry into force.


Art.35 (Transitional Provisions)

1. The cash handlers, who are already working on the entry into force of this Act,
are required to submit to the competent national authorities, within the terms and the forms set out in
BCSM Regulation, the notice of exercise of ' activities referred to in Article 4.
2. The cash handlers that use the date of entry into force of this Act
of the treatment equipment of banknotes and coins which are not included in the Community list
of which, respectively, Article 11 and Article 24 , provide for their replacement
no later than 31 December 2014 provided that the case of equipment resulting suitable
as at 11 January 2011. 3
. In the absence of the condition mentioned in the preceding paragraph, the cash
managers shall ensure the replacement of the equipment by 31 August 2013.


Art.36 (Entry into force)

1. This Law shall enter into force on the fifteenth day following that of its legal publication

1. General technical requirements

1.1. To be classified as a device for the selection and acceptance of
banknotes, a device must be able to treat
euro banknotes and physically separating the euro banknotes according to their classification without

Specific rules in relation to Table 2:

1. Euro banknotes in categories 1, 2 and 3 may not be physically separated

CLASSIFICATION AND TREATMENT OF EURO BANKNOTES BY STAFF RESERVED DEVICES


The euro banknotes are classified into one of the categories specified in Table 1. Banknotes in
euro referred to in category 4a and 4b must be physically separated from euro banknotes of which
categories 1, 2 and 3. the devices that do not control the suitability of euro banknotes
do not have to distinguish between the euro banknotes belonging to the category 4a and
those in the category 4b.

Specific rule in relation to Table 1:

If euro banknotes in categories 2:03
can be separated from the equipment itself or by another device for the selection and acceptance of
banknotes or, with the consent BCSM, from trained personnel, euro banknotes which
category 3 can be delivered to BCSM together with the euro banknotes which the
category 4b. In this case apply both the deadline for the delivery of the BCSM
euro banknotes of Category 2, is the term for the euro banknotes of mixed
categories 3 and 4b, as specified in the table.


Specific classification and selection rules for certain staff-

1. The equipment for the selection and verification of bank notes (BPM) classify and physically sort the
euro banknotes in categories 1, 2 and 3 in one or more boxes and reception
euro banknotes of the fourth categories and 4b in two dedicated output stackers separate
as set out in Annex IIb, so I needed at least three receiving the boxes to avoid
the intervention of the machine operator.

2. The equipment for the selection and verification of bank notes (BPM) with only two
special reception boxes can still classify and sort euro banknotes if the following requirements are respected
:
controls a) authenticity and fitness shall be carried out in the same step. In this passage
euro banknotes of Category 4a must be sorted and placed in a box
fixed reception, while the euro banknotes in other categories must be
sorted and placed in a box fixed separate receipt which has no physical contact with
euro banknotes of category 4a;
B) if in the second output stacker is detected the presence of a euro banknote
belonging to categories 1, 2 or 3, the operator has to go over the bill or bills
in euro from the output stacker. In this second pass, euro banknotes
categories 1, 2 and 3 must be separated from banknotes in the euro
category 4b placing them in a special receiver box, and dealt with as provided in
table above. Because the equipment is not able to physically separate the
euro banknotes in categories 1, 2 and 3 in different Receive boxes, they should be considered and treated as
all euro notes referred to category 2

. The equipment for checking the authenticity of bank notes (BAM) classify and physically
be handling euro banknotes in categories 1, 2 and 3 in a box of reception and
euro banknotes in categories 4a and 4b in a second receiving box, so they are

needed at least two special reception boxes to avoid the intervention of the machine operator
equipment.

4. The equipment for the authentication of banknotes (BAM) with one
output stacker may however classify and sort euro banknotes if the following requirements are respected
:
a) each time it is treated a euro banknote belonging to the categories 1, 2 or 3,
the equipment should stop treatment immediately and keep the banknote
EUR interested in such a position as to avoid any physical contact with banknotes
€ authenticated;
B) the authenticity check results should be contained on one screen for each
euro banknote belonging to the categories 1, 2 or 3. Since the equipment can not be separated physically
euro banknotes in categories 1, 2 and 3 in different boxes
receipt, they must all be considered and treated as euro notes referred to
category 2;
C) the equipment must check for euro banknotes in categories 1, 2 or 3
when it stops processing, and the latter can only be resumed after the physical removal of the euro banknote belonging
category 1, 2 or 3 by the operator;
D) at each stop of the processing, the operator can not have access to more than a euro banknote
our department 1, 2 or 3.

ANNEX III (to the Law 29 July 2013 101)

MINIMUM REQUIREMENTS FOR THE PURPOSE OF THE MANUAL OF BANK NOTES FITNESS IN EURO


This Annex sets out the minimum requirements for the manual controls of eligibility of euro banknotes
by the trained staff.
During the fitness checks, euro banknotes with any defect in Table here
below, or with an obvious flaw in the eye in one of the safety features, are
considered unsuitable. However, folded euro banknotes and euro banknotes with folded corners
can be adjusted manually extending them where possible.
The suitability checks are carried out by a visual inspection of the individual euro banknotes and do not require
using other tools.
