DISCIPLINE ACTIVITY 'SPORTS


We the Captains Regent of the Most Serene Republic of San Marino
Promulgate and publish the following law passed by the Council Great and General
its meeting of 13 March 1997. TITLE I

PURPOSE OF THE LAW AND STATE INTERVENTION

Art.1 (Provisions General)
This law recognizes and provides for the right of citizens to practice sport and
motor activity as a right of promotion it human, social, educational and cultural, coma
appropriate activities to improve the physical and mental capacity, as of
disease prevention factor and as a means for facilitating social gathering.
For the purposes of the practical application of those principles, the 'Commitment, the State is concerned with installations sports

Art.2 (Sports School)
The State promotes education and physical education in the school of all levels

with the various school levels of teaching and aimed at better preparation psychomotor
and to a greater spread of sports activities.
The State shall promote and ultimately facilitates the use of the sports facilities provided to schools, to
outside teaching hours, in the manner set forth in Annex Regulations, an integral part of this
law and editable with Regency Decree .

TITLE II THE LOOK OF SPORT

Art.3 (Institution)
For the accomplishment of the purpose that the present law is intended it is established the Consultation Sports
.

Art.4 (Nature and Functions)
The State Council of Sports is an advisory body and has the task to debate the
sports issues, to issue an opinion on the financial and technical aspects, to indicate and propose to the decision-making organs
every opportune and appropriate initiative to improve and enhance sport in
country, and to coordinate sports activities, leisure and school.

Art.5 (Composition)
The State Council is composed of Sport:
a) by the Deputy for Sport who presides;
B) the President of the CONS;
C) by the Secretary General of the CONS;
D) by the Coordinator of the CONS Services;
E) a representative of Sports Associations Autonomous appointed maturing biennial
;
F) a representative of each legally recognized trade union organization;
G) a representative of the Department of Education;
H) by a Sports Physician indicated by the Department of Health and Social Security;
I) by the Head of Social and Cultural Activities.
Representatives shall be appointed by the bodies referred to in the preceding paragraph and appointed by
Deputy for Sport.

Art.6 (Duration and operation)
The Look of Sport holds office for four years.

TITLE III NATIONAL OLYMPIC COMMITTEE OF SAN MARINO (CONS)

Art.7 (Establishment and nature)
For the implementation of the sports policy programs and the promotion of sport
at every level, is institute, under the supervision of the Department of Sport, the CONS,
Public body with legal personality.
The CONS is responsible for the organization and the strengthening of the San Marino Sports and
its activity is foreign to any religious influence, political, racial and economic.

.


Art.8 (Financing)
For the achievement of its purposes, the CONS shall means:
a) the financial contributions provided for in the appropriate allocation of the State Budget, there
including those involving the Federations, to be divided, then, in terms of this law;
B) contributions from other organizations;
C) of grants and donations from individuals;

D) percentage of the proceeds of sports events, television rights and gains of
annual management arising from sponsorship.

Art.9 (Powers and functions)
The CONS authorities and powers in materi public sport still
and exercised by anyone and in particular:
1) formulates a four-sport policy program to be approved by its decision-making bodies within six months
the renewal of the Board;
2) exercises the management, conservation and control of sports facilities in use
received by the state, to which it remains responsible, in accordance with the provisions contained in the next
Article 10;
3) formulate an overall plan of action priorities for the construction, also direct
, new plants, due to the increase of infrastructure and the improvement of existing ones
, to be approved by its organs deliberating within six months from the renewal of
charges;
4) expresses its opinion on the proposed compulsory, new sports facilities and
intervention of existing ones;
5) monitors and protects all organizations dedicated to sport;
6) ratify the statutes and regulations of the Federations, in harmony with the directives of the
CIO;
7) compile the athletes and the means suitable for the Olympics and for all other sporting events
assimilated and cooperate with the national federations for participation and
organizing international events;
8) cooperates with health care providers and the bodies responsible for the prevention of doping;
9) it carries out expressly demandategli sports justice functions;
10) provides, in the middle of their bodies, to Ripart tion and the payment of financial contributions
Federations, taking into account the four-year program of sports policy
mentioned in point 1) above, the allocation foreseen in the State Budget, the
internal regulations approved in the field by their attributed Organ;
11) has the power to decide on the disbursement of contributions to associations not affiliated sports
, taking into account the reports of the same and considering its opportunities
according to the programs and activities carried out;
12) allocates, in the middle of their bodies, the contributions received by the State for the financing
any other activity or sporting event.

Art.10 (Facility Management)
The management of state-owned facilities may be exercised alternatively:
1) by means of a right to use the CONS, which manages them directly or delegated shape
through special agreements with the Sports Federations users;
2) by means of management delegated entirely to private or private with public participation,
through the conclusion of appropriate agreements.

Art.11 (the CONS Bodies)
CONS are part of all federations sharpen you.
Organs are the CONS:
a) the National Council
b) The Olympic Council,
c) the President,
d) the Executive Committee, and
) Secretary General | || f) the Board of Auditors.

Art.12 (Requirements)
Those who hold positions within the CONS of the bodies must satisfy the following requirements

a) be citizens of San Marino;
B) not have been convicted for fraudulent offenses for which provision is made for imprisonment
;
C) have not been subject by the CONS or a Sports Federation at a
disqualification or inhibitions of more than a year.
This law establishes, for each office, incompatibilities.

Art.13 (National Council: Nature - Composition - term)
The National Council is a deliberative body, guidance and control.
And 'it composed of the President of the CONS that presied and the Presidents of Sports Federations affiliated to
CONS elected by their respective Federations.

The functions of Secretary of the National Council are taken by the Secretary General of the

The National Council lasts for four years.

Art.14 (Skills and Powers)
The National Council:
a) designates the President by an absolute majority of its members;
B) elect a Vice President by simple majority of those present;
C) elect three members of the Executive Committee by a simple majority of those present;
D) appoint the Secretary General of an absolute majority of those present;
E) appoints the Standing Committee anti-doping and its President;

F) appoint, on proposal of the Executive Committee, the Technical Committee members;
G) formulates a four-sport policy program approved within six months of
renewal of the Board;
H) formulates and approves, within six months from the renewal of the Board, the project priority intervention
on the systems referred to in Article 9 sub.3 higher);
I) establishes the general directives of the Executive Committee in accordance with the plan approved four
, as well as those for the spread of the Olympic in harmony with the directives
CIO;
J) consider and approve the budget estimates, the related changes, the final accounts and
report of the Executive Committee on the Management Entity;
K) decide, within six months of the submission of requests, affiliation of new
Sports Federations;
L) approve the statutes and financial statements of Sports Federations;
M) has surveys to verify management irregularities or operation of the Federal Organs
and in case of violations appoints the Commissioners to the Sports Federations
for the management of the Federation commissioner until the resolution of the case;
N) decide, by a majority of 2/3 of the members, on the transitory suspension and / or permanent withdrawal of membership
of existing federations, according to the procedure laid down in Article 41
;
O) establishes, in harmony with the Order Sportiv National and International and
within each National Sports Federation, the criteria by which to distinguish the
amateur sports activities other than professional;
P) decides the administrative regulation and accounting of CONS and
Sports Federations;
Q) decide on any other matters as may be submitted by the President or Executive Committee
or where setting ell'ordine has been requested of the day from at least one third of the members
;
R) has the power to enact autonomous domestic regulations technical
operating in harmony with the purposes of this Act;
S) has, for serious reasons, the termination of the mandate of Executive Committee members with
two-thirds majority of its members;
T) decide on the provision of financial contributions in favor of Federations, Associations Sport
unaffiliated and any other activity or sporting event;
U) determines the expenses and the attendance fee for the Executive Committee members,
well as the remuneration for the Chairman of the CONS;
V) ratify, in the first meeting, the emergency resolutions adopted by the Executive Committee in its
replacement;
W) decide on the appeal presented by the second instance against the refusal
affiliate to the Federation;
X) grants clearance prior to the establishment of professional clubs of which
Article 49 and approves the Regulation of Multidisciplinary League of Article 52.

Art.15 (Notice of Meeting - procedures for setting up and releases)
The National Council shall be convened by the Chairman at least twice a year to
examination of budgets and no later than March 31 of the year following that of
celebration of the Olympic Games, for the renewal of the Board , as per the regulation.
The National Council shall be convened on first and second call.
The first convocation is valid with the presence of the absolute majority of those entitled to vote;
The second call is valid with the presence of a third of those entitled to vote and must be
called half an hour later the same day and venue set for the first call.
The President and the Executive Committee can convene the National
Board whenever they deem it necessary and must also, convene within thirty days when they face
reasoned request in writing at least one third of the members.
The notice of meeting is made by registered letter containing the order of the day from

Resolutions are adopted by a simple majority of the members entitled to vote, except for the various
qualified majorities required by law to individual subjects.

Art.16 (The Olympic Council)

The Olympic Council consists of the Chairman of the CONS who chairs it, the Presidents
of the Olympic Federations and the Secretary General of the CONS
Acting by an absolute majority of the members, the participation in the Olympic Games and all events
comparable basis and, on the recommendation of the Technical Committee, the

Art.17 (the CONS)

Art.18 (Executive Committee - Composition and incompatibility)
The Executive Committee consists of the Chairman of the CONS who chairs it,
by four members elected by the National Council, including one with the function of Vice President, and General Secretary
, participating without voting rights.
Two of the four members elected by the National Council are incompatible with federal and corporate offices
. All Executive Committee members are incompatible with belonging to the
Great and General Council.
They can, also, be part of the Executive Committee: competitive athletes, technicians,
coaches, doctors, trainers, consultants working relationship or collaboration with
Federations and affiliated Sports Associations , officials of the Department of Sport and the CONS


Art.19 (duration and powers)
The Executive Committee lasts for four years.
In accordance with the laws and resolutions of the National Council, it exercises the
its functions and has the following attributions:
a) provides the direction and management ADMIN goes according to Council Directives National

B) prepare the management report, the budget, the variations and the
final account;
C) exercise control functions and address on ervices and offices and on all
National Sports Federations;
D) examines the budget estimates, the related changes, and the final accounts approved by the
National Sports Federations, to be drawn up according to the model;
E) examine the statutes and internal regulations of the National Sports Federations and
proposes them for approval by the National Council;
F) in the case of alleged irregularities it has inspections on the administrative and accounting management
of National Sports Federations and affiliated companies, as well as activities which
Federations are responsible for formulating a report prepared in accordance with and for
effects of Article 41;
G) adopt urgent resolutions in place of the National Council and submit
to its ratification at the first meeting;
H) propose to the National Council of the Technical Commission members;
I) decides on actions and resistance in the Ente judgment, as well as on all matters not expressly reserved
to the National Council or the President;
J) gives the operating authority for the functions within its competence;
K) propose to the National Council for the adoption of appropriate technical and operational nature of internal regulations
, in execution of paragraph m) of Article 14;
L) holds sports justice competencies according to the powers set out in this
law;
M) appoint a member in the Commission for the organization of international sports events
.

Art.20 (Convening meetings and decadence members)
The Executive Committee is convened by the President as a rule once a month and

Art.21 (Replacement of resignation or revocation of the President - Executive Committee - members of the Executive Committee
)
In case of resignation of the President, the Executive Committee shall convene within forty days of the
National Council for the appointment of the new President.
The Chairman or, in his absence, the Vice President, shall convene within forty days of the National Council
for the election of the new Executive Committee in case of resignation and forfeiture contemporary

Art.22 (Minutes of meetings of the National Council and Executive Committee)

relations between CONS and federations must be sent to Federations concerned.

Art.23 (General Secretary)
The Secretary General is appointed by the National Council and chosen from outside the Council
National itself; holds office for the Olympic cycle; It may be reappointed.

Art.24 (regulatory and economic framework of the General)

Art.25 (Board of Auditors: Composition - Incompatibility)
The Board of Auditors consists of three members appointed by the State Congress.

Art.26 (Term of office and powers)

budgets and final accounts for each financial year and may attend meetings of the
Executive Committee and the National Council taking view of the resolutions passed.

Art.27 (Compensation)
The members of the Executive Committee of the CONS entitled to reimbursement of expenses and a
attendance fee determined by the National Council.
The Chairman of the CONS also entitled to compensation in nuo always determined by
National Council.

The members of the Board of Auditors Auditors an annual remuneration determined by
State Congress.

Art.28 (control organs and extraordinary administration)
At the proposal of the Deputy of Sport and on par conforming kings of the State Congress, the
Regency, by special decree, may dissolve the Executive Committee and / or revocation of the President
for persistent non-compliance with legal provisions or settlement, for serious administrative irregularities
likely to jeopardize the normal functioning of the Ente.

TITLE IV THE SPORTS FEDERATIONS AND ASSOCIATIONS SPORTS

Art.29 (Nature and purpose of Sports Federations)
Sports Federations are the entities responsible organization and strengthening of
sport and the technical and athletic preparation within individual sporting disciplines,
by designating among other components of the national teams, doctors framing, coaches , officers,

Art.30 (Type)

Art.31 (Requirements for the establishment of the Olympic and non-Olympic Federations)

The service federations are exempted from the obligations provided in this Article;

Art.32 (Prohibition on inclusion to the Olympic and non-Olympic Federations)
individual membership is not permitted to Olympic and non-Olympic Federations
except in cases provided for in Article 31 points 2), 3) and 4).

Art.33 (Sorting Sports Federations)

Art.34 (Bodies of Sports Federations)

a) the General Assembly;

Art.35 (Managers of the Olympic and non-Olympic Federations and service)
Executives of the Olympic and non-Olympic Federations and service can be

Art.36 (Incompatibility of the President)

Art.38 (Affiliates sports federations to the CONS)

CONS adopting affiliate measure.
The request must be in writing and all races on pain of unacceptability:
- Statute, updated list of affiliated companies and each of their members, of the Executive Council members with
joined extracted with certified copies of the minutes of the relevant meeting in which they were elected

organizing events, achievements and activities programs att.

Art.39 (Affiliation in associated form)

Art.40 (Temporary provision)

Art.41 (Suspension and revocation of membership to the Sports Federations)
The National Council, if the prove malfunctions, breaches the rules and
statutory objectives, particularly with regard to the conduct of sports activities and the correct administrative
by the affiliated Federations, it shall instruct the Executive Committee, if || | latter had not already done so independently, to carry out investigations, audits, and
for the formulation of a preliminary report.

ordinary court within thirty days from the notification.
The procedure provided for in the preceding paragraphs shall not prejudice the adoption of competitor

Art.42 (The Sports Associations: nature and purpose)
The sports associations are organized by private groups that do not pursue
profit and constitute the first aggreante form of development, promotion and exercise
of sport and motor.
The membership and withdrawal from sports associations are voluntary and leads to social charges
for elections, in compliance with the statutes.
The Sports Associations may require affii t on the competent Federations by
which depend technically and disciplinary action, as well as from an administrative point of view.
The multi-sport associations may require sharpen tion to the relevant federations to
business sector.
Associations sports clubs must comply with the obligations set out in the preceding paragraphs.
In the case of affiliate refusal by the federations, the interested company is
allowed the opportunity to appeal to the Executive Committee of the CONS, in the first instance, and the
National Council, in the second instance.
Its proceedings shall be governed by the statutory provisions.

Art.43 (Financing of the Federations and Associations)
Federations pursue their own ends by means of financial support
annually by CONS, in accordance with Article 9, sub.10) and 8 points b), c) and d).
Non-affiliated sports associations can receive contributions from CONS under
Article 9 sub.11).
Federations and Sports Associations can access, also, the Facilitated Credit and
to Credito Sportivo.

Art.44 (Commission for the organization of international sporting events)

The Commission shall consist of one member designated by the Department of Sport,
by a member designated by the Executive Committee and, from time to time, by the President of the Federation concerned
or by a delegate of the Federal Council.

The Commission expresses binding prior opinions regarding the availability

Art.51 (sports professional performance ratio)
The sport performance ratio professional character is defined through a
contract of employment between stakeholders.
The contract must be in writing and delivered for information to the CONS and
Sports Federation of expertise.

ART.52 (Multidisciplinary League)
At the end of the coordination and organization of their activities, the Company

TITLE VI

ATHLETES AND OFFICIALS

art.53 (Employee athletes in Society and Sport Federations - Athletes Behaviour)

TITLE VII SPORTS MEDICINE

Art.55 (Health Protection)
Control and protection of health in favor of all practitioners of competitive offers fun and sports activities
are insured by the state, as for other services, through health facilities

They are part of the four-year term Committee:
a) a representative of the CONS, appointed by the National Council, who presides;
B) a representative designated by the Department of Sport;
C) a doctor appointed by the ISS;
D) a representative of the sports federations;
E) a representative of the sports clubs.
The Committee, in keeping with the provisions of the IOC, the laws of the State and
International Conventions, imposes also sporting sanctions of competence in the field of the fight against doping
to all those who are guilty of infringements made to 'sporting ethics.
The CONS, through its bodies, shall regulate the litigation in the fight against doping
, taking into account the International Convention dell'apposita anti-doping. TITLE VIII INSURANCE



Art.58 (Insurance)
Federations and Sports Associations are obliged to insure their members
agonists or providing recreational and sporting activities, with the exception of the supporting members, against
damage arising from accidents occurring in the exercise of the sport. At the same insurance coverage are
technical subjects, coaches, assistants, managers are regular members. Such coverage must
understand the risks associated with transfers of domicile to meeting places made either by its own means
that collective methods. The costs arising from the Insurance Coverage is

The civil liability of the CONS, the Federations, the Sports Associations, the

TITLE IX JUSTICE SPORTS



Articles 59 (Sports Justice)
The degrees of litigation are three instance order:
1) the Federal Council of the Federation;
2) the Executive Committee of the CONS;

TITLE XI PERSONAL



Art.61 (Staff CONS)

Art.62 (Employees)

Art.63 (Salaried)

Art.69 (Special leave for sports)
Athletes, sports administrators, technicians, healthcare, the auxiliary employees, enrolled in their recognized
Sports Federations, shall be eligible for paid overtime allowed, and both
employees of the State or public bodies, whether employees employers of private work, up to a maximum of five days
for each calendar year, to participate in competitions outside the territory or
competitions and the international meetings.
The maximum duration of the permit is elevated to fifteen days for participation in the Olympic Games
.
The salary costs of employees of private employers, are borne entirely by the

CONS To self-employed workers, convened by CONS or the Federations for participation
races and meetings referred to in the preceding paragraphs, it shall be recognized a special allowance.

allocation.

Art.70 (Application Rules)
The Application Rules are an integral part of this Act, and may be modified

Art.71 (Read repealed)

Art.72 (Entry into force)
This Law shall enter into force on the fifth day following that of its legal publication

OR REGULATION FOR THE GRANT OF USE AND SCHOOL fitness facility
(outside the teaching hours)
Art .1
In order to allow full and rational use of state-owned gyms
CONS refer the matter to the management of sport in the school halls outside the teaching hours
including elective and intgrative activities.
The use of the gyms will not, in any way, replace c-conditioning service school
, which must have priority of use of the facilities in accordance with
school authority.

Art.2 Cleaning of plants used outside teaching hours will be performed at
care staff must put at the disposal by the Federation, the Company
Organized Group or individuals, to whom it is granted the use of the plant .

Art.3 Federations, Society, Organized Groups or individuals who intend to avail of
school gyms for sports or physical activity for training activities, courses or activities
racing, will have to make a request to CONS and in it shall be specified: || | - name and address of the person responsible;
- Type of activity being undertaken;
- Days and times when it is required to grant.

Art.4 The grant applications will be reviewed by the CONS offices in chronological order
submitted those applications, by adopting equitable distribution criteria.

Art.5 Federations, Society, Organized Groups and singol citizens, will have to ensure compliance with the following standards
:
- compliance with the agreed timetables;
- Environment used;
- Compliance with rules and regulations of use of the plant;
- Immediate remelting the CONS of the damage caused.

Art.6 If an assignee is not using the gym is committed must immediately inform the CONS

REGULATION APPLICATION Art.1


With the aim to safeguard that all citizens have the standing to sporting activities, in deference

Federations are required to proportion, a sense of responsibility, any appearances to the real
