LAW 150 of 17 December 1997 BUDGET ESTIMATES OF THE STATE AND LOCAL BULLETIN BD LICI FOR THE FINANCIAL YEAR 1998 BUDGET LAW AND MULTI-YEAR MULTI-YEAR 1998/2000 EXPENDITURE We the Captains Regent of the Most Serene Republic of San Marino Promulgate and publish the following law approved by the Great and General Council at its meeting on 17 December 1997. Art.1 E 'approved, in terms of competence, the state prediction of the Entry and Exit tool exercise finanziario1998 annexed to this Act (Annex " TO"). Art.2 E 'it approved, in accordance with Article 12 of Law 70 of November 9, 1979, the Multi-year state budget for the 1998-2000 triennium, as attached to this Act (Annex "B"). Art.3 are approved in terms of expertise: - the Budget for the financial year 1998 of the Institute for Social Security (Annex "C / 1"), as well as its multi-year financial statements (Annex "C /" 2) ; - The Budget for the financial year 1998 the Company Autonomous State for Public Services (Annex "C / 3"), as well as its multi-year financial statements (Annex "C / 4"); - The Budget for the financial year 1998 the Company Autonomous Production State (Annex "C / 5"), as well as its multi-year financial statements (Annex "C / 6"); - The Budget for the financial year 1998 the Company Autonomous Philatelic-Numismatic State (Annex "C / 7"), as well as its multi-year financial statements (Annex "C / 8); - the Budget for ' financial year 1998 of the Centrale del Latte (Annex "C / 9"); - the Budget for the financial year 1998 CONS (Annex "C / 10"), as well as its multi-year financial statements (Annex "C / 11" ); - the Budget for the financial year 1998 of the University (Appendix "C / 12"), as well as its multi-year financial statements (Annex "C / 13"). Art.4 are authorized under laws, the assessment, collection and payment in the State Treasury, with the commitment to bring its revenue to the extent of the recovery of the real value so far lost it on the basis dell'evouzi index of consumer prices, taxes, fees, revenue, contributions and any other income attributable to the State, in accordance with current standards for the financial year 1998. Article 5. It 'authorized the commitment and payment of expenditure for the 1998 financial year , within the limits of competence appropriations defined in the estimates referred to in Article 1, subject to the availability of authorized commitment on future periods, in accordance with Article 14 of Law 70 of November 9, 1979. Art.6 The authorization of expenditure for the year 1998 resulting from laws and decrees currently in force, which regulate activities or actions have ongoing or recurrent, is willing, in the present law, within the limits of the amounts indicated in respect of each expenditure item Annex estimates. The management procedures and methods of payment are those indicated in the laws expressly mentioned nellad naming of the chapters or the list annexed to this Act (Annex "D"). Article 7 The Congress of State is authorized, in accordance with Law 110 of 15 December 1994, to have an agreement with the banks available for delivery during the 1998 financial year, funding foreseen by this law up to competition maximum of £ .14.000.000.000 amount, with the payment of an interest subsidy for a total amount, inclusive of past loans, not exceeding £ .2.200.000.000, to be charged on cap.2-8-7450. Art.8 E 'approved, in accordance with Article 13 of Law 70 of November 9, 1979, the elevation, respectively £ .350.000.000 and £ .525.000.000, the maximum expenditure ceiling for the year 1998 financial year of which the Laws November 30, 1979 and February 21, 1990 77 35, with the option for the State Congress to authorize the commitment of the individual expenses on 02.01.1930 and 02.01.2030 chapters. Article 9. The Congress of State is authorized, within the limits of the appropriations entered in chapters 2-8- 7470 "Expenses for professional training agreement" and 2-8-7480 "Expenses for vocational training in companies", respectively, for £ .250.000 000 and £ .210.000.000, to commit, for 1998, expenses in implementing the provisions of article 14 of Law 10 of February 13, 1980 and Article 13 of Law 24 July 1987 n. 89. Art.10 The Congress of State is reserved for faculty to share with its deliberations among the relevant chapters, the appropriations referred to cap.1-3-2490 "Intervention Fund" and to cap.1-3-2650 "Charges
for renovations and improvements to employees and retirees The costs of the state. "referred to in those chapters, uncommitted at the close of 1998, they may be so in subsequent years, subject to a special resolution of the same Congress of State. Art .11 The Congress of State is authorized, through a resolution, to commit or distributed among the relevant chapters, within the limits of the appropriations referred to cap.1-3-2480 "of expenses for compulsory reserve fund", the derivant compulsory expenditure by laws or decrees in force. the same faculty is recognized at the Congress of State for the commitment or the breakdown of the allocation referred to cap.1-3-2470 "reserve fund for unexpected expenses" Art.12 the Congress of State is authorized to issue, by its deliberations, the necessary changes in the items of expenditure in the Giro games, in close correlation with the findings on the corresponding entry sections in the Giro games and within the mandatory limits of the investigations themselves. The Congress of State is also authorized to have the 'monthly payment, in favor dell'AASP, of a portion of the endowment fund for workers referred to cap.1-3-2590. Art. 14 The Congress of State is authorized to provide any all'AASFN periodic advances to account on the basis of annual special agreement, which must be defined the program of philatelic and numismatic for 1998, and its estimated cost, as well as the 'premium collection agreed for the sale and philatelic and numismatic values. The AASFN is authorized to collect on behalf of the Treasury Service of the State Administration of Posts and proceeds from the sale of circulating coins and stamps for postal use at face value conl 'bbligo to provide at least quarterly to the payment to the Treasury the results obtained, to be paid out chapters 940 and 950 of the State Budget for 1998. Art.15 The annual contribution pursuant to Article 12 of Law 105 of 30 November 1982 shall not exceed, for 1998, the total amount of £ .7.500.000.000. Art.17 Under Article 6 of Law 118 of 29 September 1987 and the Law 13 of January 28, 1993, the Congress of State is authorized to have an agreement in 1998 with the banks available for the granting of soft loans to companies, up to the total amount of £ .35.000.000.000. Its contributions in c / a the State interests, as well as interest on old loans, are attributed, in competence account and residual account on cap.2-5-7220 "Interest subsidy for concessional loans to businesses". Art.18 The Congress of State is authorized, for 1998, to have an agreement for the organization of language courses and evening classes for adults. The payment of salaries due to staff agreement, on which the burden will exceed the total amount of £ .138.000.000, will take place in the manner prescribed for civil servants, with allocation of expenditure on 1-10-4750 and chapters 1- 10-4760. Article 19 Notwithstanding the provisions of Article 7 of Dcreto September 15, 1980 72, amended by Law 124 of 30 October 1990, the management of the school meals service of the nursery school is entrusted definitively and arrangements similar to those in force for the meals of the Elementary School, the Management of the nursery school. Art.20 The Congress of State is authorized, pursuant to the Decree 11 February 1988 8, to have an agreement with the available banks, in 1998, for the provision of loans on trust up to the maximum amount of £ .450.000.000, with the payment of an interest subsidy for a total amount, inclusive of past loans, not exceeding
to £ .50.000.000, to be charged on cap.1-10-5130. Art.21 According to Article 5 of Law 59 of May 20, 1985, as amended by Act 14 of January 29, 1987, the Congress of State is authorized, for the 1998 financial year, to provide a maximum contribution to the Council Groups , including home allowance, equal to £ = .2.472.459.809, whose final amount will be determined based on actual proven R evenue financial year, with allocation on capp.1-1-1450-and 1- 1-1460 of the Budget of the State for the financial year 1998. Art.22 the Congress of State is authorized, under Article 2 of Law 13 of 29 January 1987 to provide, up to the maximum amount of £ .696.000.000, financing the Council Groups referred to in Article 1 of the law, with recognition of the expense on cap.1-1-1270 of the State Budget for 1998. Art.23 the Cap. 01.01.1480 "Independent Fund for the Great and General Council" for the total amount of £ .456.000.000 will be managed, for the 1998 financial year, in the manner provided by law on State General Accounting. The State Congress has reserved the right to proceed, on a proposal from the Secretariat of the Great and General Council, the reversal of funds at year-end, between chapters 1-1- 1470 "Independent Fund for the Regency", 1 -1-1480 "Autonomous Fund for the Great and General Council" and 2-1-6100 "Individual Fund of the Regency of the Great and General Council for the purchase of assets". Art.24 The State Congress has reserved the right to proceed, at the proposal of the Township Councils, the transfer of funds at year-end, between chapters 1-6-3810 "Checks to Township Councils" and 2-6- 7280 "Quote Juntas contribution Castle intended for the purchase of assets". Art.25 Notwithstanding the provisions of article 37 of Law 42 of March 21, 1995, financial expenses arising from the Board's Permanent Commission will be recognized, for the financial year 1998 on cap.1-1-1280 "Inde appropriateness of function and meeting allowance for the" councilors. Art.26 The Congress of State is authorized to exercise f nancial 1998, to provide the Board of Directors of the University of Studies a maximum contribution of £ .4.830.000.000, with attribution of the expenditure on the following chapters: 1 -10-4970 "contribution of University Studies for fixed costs" £ .3.630.000.000; 1-10-4980 "Contribution to the University of the Studies for administrative expenditure", £ .1.100.000.000; 1-10-4990 "contribu or at the University for Development Studies", £ .100.000.000. The Congress of State is also authorized, pursuant to Article 3 of Law 132 of 29 November 1995, to provide, up to the maximum amount of £ .85.000.000, an attendance fee to the members of the Scientific Committee University with allocation of expenditure on Cap.1- 10-4830. Art.27 The dell'AASP Board of Directors is authorized to make available to the Township Councils the sum of £ .820.000.000, to be used in the manner prescribed in Article 29 of the law 24 February 1994 n.22. The amount will be charged on sections 103 and 119 of the dell'AASP Budget. Art.28 Pursuant to Article 1 of Law 156 of 20 December 1990, the Congress of State is authorized to provide the ISS, for the year f nancial 1998, a loan not exceeding £ .65.000.000.000, from attributable to the Cap. 1-9-4590, and a contribution not exceeding £ .9.000.000.000, to be charged on the cap. 1-9-4610, without prejudice to the undertaking to absorb any deficit in financial year 1999 established ac nsuntivo for managing healthcare and social health service in the year end 1998. Art.29 The Congress State is authorized to make available to the International Monetary Fund, to be paid by anticipation ICS, foreign exchange reserves that, by way of participation in the IMF's principal, may from time to time required in execution of commitments to 'act of accession to the Fund. Art.30 The Congress of State is authorized to require the ISS a refund equal to 10% of the amount recognized in the balance in the previous financial ye ar es on the cap. 03.01.2670, by way of flat-rate recovery of paid pension contributions in the state regime in favor of former employees ISS. Art.31 Pursuant to Article 19 of Law 83 of October 28, 1992, earnings from the paper to the Convention therein shall be charged against the cap.1-10-5920 "Salaries and staff benefits Judicial Offices". Art.32 The Congress of State is authorized to regulate the accounting regularization, by
administrative compensation between income and expenditure, assets and liabilities of related compounds to the Tax Office suspended, as far as export refunds goods with allocation of any active or passive balances established at the end of the verification of debit statements relating to years past on the relevant chapters of entry and exit of the financial year in which the assessment takes place. Art.33 The Congress of State is authorized, under Article 84 of Law 149 of 29 November 1991, to provide, to the Fund for the development of cooperation, a maximum contribution of £ .20.000.000, with allocation on Postal Code. 1-8-4350 "Contribution to the Fund for the development of cooperation". Art.34 The Congress of State is authorized, for the f nancial year 1998 was to contribute to the Santa Chiara Foundation up to the maximum amount of £ .50.000.000, to be charged on cap.1-10-5010 . Art.35 The Congress of State is authorized to affix ar residue, for the 1998 financial year, the amounts committed in the course of the financial year 1997 pursuant to Article 22 of the Decree of 20 May 1996 49 and Article 19 Decree 48 of May 20, 1996. Art.36 The roof of the funding provided for in Article 2 of Law 129 of 25 November 1993 it may be raised up to a maximum amount of the related consolidated loans. The Congress of State is authorized to have an agreement with the San Marino banks. Art.37 E 'approved the total expenditure of £ .10.000.000.0 = for the acquisition of immovable property for use as qualifying action in the social field. The Congress of State is authorized to allocate and commit expenditure for the financial years 1998-1999-2000 on 2-4-6600 chapter "buy real estate" and to delegate the Government Mayors for the conclusion of the sales. Art.38 E 'authorized the ignition of a mortgage in the 1998 budget deficit in the balance of £ .29.832.682.064 = measure. Art.39 This Law shall enter into force on the fifth day following that of its legal publication.
