Council Commission THE PERMANENT JUSTICE, EDUCATION, CULTURE AND HERITAGE, UNIVERSITY 'AND SCIENTIFIC RESEARCH, SPORTS LAW 22 February 2006 44 REPUBLIC OF SAN MARINO RULES AGAINST CRIMINAL USE OF UNDUE CREDIT CARDS, PAYMENT AND MONEY WITHDRAWAL CASH We the Captains Regent of the Most Serene Republic of San Marino promulgate and publish the following law approved by the Great and General Council at its meeting on 22 February 2006. Art. 1 after Article 204 of the Criminal Code shall be inserted the following article: "Art . 204a (improper use of credit cards or similar documents) Anyone who, in order to obtain for themselves or others an unjust profit, without being the holder, using credit cards or payment, or any other document that enables pickup cash or purchase of goods or services, shall be punished by imprisonment and a fine of second-degree daily. ". Art. 2 after Article 401 of the Penal Code is added to the following article: "Art. 401 bis (Counterfeiting of credit cards or similar documents) Anyone who, in order to obtain for themselves or others an unjust profit, counterfeits or alters credit cards or payment or any other document that enables the collection of cash, the purchase of goods or services, or holds, sells, buys, or otherwise receives such papers or documents shall be punished with imprisonment of third degree . the use of the cards or the documents mentioned in the previous paragraph shall be punished in accordance with Article 204a. ". Art. 3 Article 402 of the Criminal Code is replaced by the following: "Art. 402 (Cause of non-punishment) is not punishable if, having committed any of the offenses provided for in articles 401 and 401 bis of the first paragraph, it shall inform the authority prior to use or putting into circulation counterfeit or altered things. " - 2 - Art. 4 Article 403 of the Criminal Code is replaced by the following: "Art. 403 (manufacture, possession, acquisition, sale of instruments or counterfeiting materials) Anyone factory, holds, sells, buys or receives any case tools, materials or other resources intended to counterfeiting or alteration of the things referred to in articles 401 and 401 bis, shall be punished with imprisonment of the second degree. the same penalty applies if the conduct laid down in the first paragraph have as their object: a) computer programs or other means which by their nature are peculiarly adapted for the counterfeiting or alteration; b) holograms or components of currency, cards or other documents provided for in Article 401 bis, intended to ensure the protection against counterfeiting or alteration . ". Art. 5 This Law shall enter into force on the fifth day following that of its legal publication.
