Art REPUBLIC OF SAN MARINO DECREE - LAW 27 October 2011 173 We the Captains Regent of the Most Serene Republic of San Marino Having seen the need and urgency referred to in Article 2, paragraph 2, point b) of the Constitutional Law of 15 December 2005 .183 and Article 12 of the Qualified Law 184 of December 15, 2005 and more specifically the need to allow associations and organizations nonprofit struck off as a result of the Decree - Law 82 of May 19, 2011 to regularize their position and l ' urgent to avoid an interruption of the same for a period of time such as to definitely jeopardize the recovery; Given the decision of the Congress of State 15 adopted at its meeting of 18 October 2011; Having regard to Article 5, paragraph 2, of the Constitutional Law no. 185/2005 and Article 9 and Article 10, paragraph 2, of the Qualified Law n.186 / 2005; Promulgate and publish the following Decree-Law: REGULARIZATION ASSOCIATIONS AND NON-PROFIT ORGANIZATIONS WITH RESPECT TO THE DECREE - LAW 19 May 2011 No. 82 Single Article The nonprofit associations and organizations that have been struck off under one Article of the Decree - Law May 19, 2011 n. Pursuant to Article 82. 37 of the Law of 23 July 2010 n. 129, but they are still on schedule to bring an appeal to the Radiation Decree issued by the Commissioner's Court, are allowed to regularize their position by 31 December 2011. The regularization is effected by filing the missing documentation, as well as a special meeting of the members who clearly manifests the will to continue in the associative bond and consequently in the activity entity. With the Commissioner's decree notes the complete regularization, extinguish the effects of the Decree of Radiation and all consequent effects, acting, also, the automatic loss of the appeal to the Judicial Authority if already submitted to the date of entry into force of this Decree- law. Until the expiry of the terms of the preceding paragraphs, the effects of Decree Radiation remain suspended. With the regularization, the assets and liabilities, as well as any identifying information already existing at the time of the Radiation Decree, were safe and unchanged.
