REPUBLIC OF SAN MARINO DECREE - LAW 130 of 30 September 2013 (Ratification Decree-Law 87 of July 19, 2013) We the Captains Regent of the Most Serene Republic of San Marino The Decree - Law 87 of July 19, 2013 - "Urgent norms for the organization of the General Plan of the Chairs regarding school year 2013-2014 ", promulgated: Given the necessity and urgency referred to in Article 2, paragraph 2, point b) of the Constitutional Law of 15 December 2005 and 183 Article 12 of the Qualified Law 184 of 15 December 2005, namely: - organize Chair Plans relating to the academic year 2013/14 and formalize, in the context of the Joint Commission, the General Plan of the Chairs in art. 15 of the Law of 17 July 1979 n. 41 as amended in accordance with Article 53 of the Law of 5 December 2011 n. 188; - Define certain situations to allow normal activity in the school sector and not compromising the quality of services provided, even in the knowledge of operating in an effort to streamline the resources deployed; Given the decision of the Congress of State no. 43 adopted at its meeting on July 9, 2013; Given the amendments to the above Decree in connection with ratification of the same by the Great and General Council at its meeting on 26 September 2013; The resolution of the Great and General Council # 5 of 26 September 2013; Having regard to Articles 8 and 9, paragraph 5, of the Qualified Law n.186 / 2005; We promulgate and publish the final text of the Decree - Law 87 of July 19, 2013 as amended as a result of the amendments approved by the Great and General Council at the time of ratification of the same: URGENT RULES FOR THE ORGANISATION OF THE GENERAL PLAN FOR CHAIRS sCHOOL YEAR 2013/2014 Art. 1 (Resource Centre unit) 1. extending the activities of the unit Resource Center for the school system of San Marino (CRU), set up by Chief Executive Decree 14 May 2007 n. 59. The objective is to achieve the goals expressed in Articles 10, 11 and 14 of Law 12 February 1998 n. 21. In particular, the CRU is designed to: - ensure greater flexibility and continuity in the projects conducted in the documentation centers; - Continue response actions to ensure educational continuity and teaching; - Start and make an ongoing assessment of the education and training system; - Actively support experimental projects, intended to further qualify their educational offer, meet new training needs of the students, to enable functional teaching methods; - Collaborate on training programs provided by the laws of the Republic, with regard to specific educational projects (inclusion, violence against children and gender, etc.); - Implement the activities of the "Portal of Education". Art. 2 (Organization of CRU) 1. The CRU, as already defined in the Delegated Decree n. 59/2007, it operates on the basis of the priorities and guidelines established by the Teaching Coordination widened to the Scientific Committee referred to in Article 6 of this decree - law and is composed as follows: a) Documentation Centers - located at each school order, perform functions collection of documentation, support to innovative and experimental activities, planning and carrying out of training activities, also in collaboration with the Department of Education, in accordance with Article 10 of Law 12 February 1998 n. 21; b) Monitoring Centre of the education and training system - work in collaboration with the Education Department and the Department of Education, University of San Marino in accordance with article 12 of Law 12 February 1998 n. 21, prepares the tools for the evaluation of the system and works with schools to the realization of national and international valuation periodic surveys. 2. A partial change of government as defined in the Agreement - Trade Unions for the renewal of the civil service employment contract for 2011-2012 ratified by the Great and General Council on 21 June 2012, teachers seconded or assigned to the CRU serve for n. 36 hours per week, from the start of programming up to 30 June, with flexible working hours to be agreed with the Head teachers and respecting the holidays established by the school calendar and keep the remuneration received in the post of origin. The hours of replacements for short-term absences made by seconded teachers to the documentation centers will riparametrate according to the hours of service of the order in which schools operate. 3. Teachers posted under the previous legislation to the present decree - law,
may extend the period of secondment, as defined in Articles 3 and 5. Art. 3 (Documentation Centres) 1. Documentation Centres have teachers with full-time or partial separation from teaching, appointed by the Academic Colleges defining projects within the priorities set by the bodies referred to in Article 2. 2. the duration of the secondment of teachers is linked to the time necessary for the realization of the projects. 3. At the end of the school year, evaluated the results, individual executives, upon advice of the Scientific Committee referred to in this decree - law may provide for the assignment interruption. It is subject to the right to terminate the posting by the individual teacher at the end of the school year, upon notice by the end of May. Art. 4 (Seconded Teachers at the Documentation Centres) 1. A partial amendment of the Delegate Decree n. 59/2007, for the implementation of the Unitary Resource Center will be involved at the Documentation Centers 8 figures, namely: - No. 2 Educators - Teachers Nursery School; - N. 2 Teachers Elementary School; - N. 4 Lower Secondary School Teachers (2 of which are specifically charged to the study and the realization of projects and experiences workshops at school libraries). 2. Socio Educational Services Early Childhood perform the functions of documentation, research, training and promoting innovation teaching educators - teachers in accordance with Article 39 of Regulation 13 July 2007 n. 6, while in the Higher Secondary School, those tasks will be carried out using internal professional resources. Art. 5 (Centre for Monitoring of the education and training system) 1. The Centre for Monitoring of the education and training system, as already envisaged by the Delegate Decree n. 59/2007, by a teacher, detached as a result of selection of appropriate contract, issued by the Department of Education of the University. 2. The aspiring teachers to be seconded to the Centre for Monitoring must be in possession of the following requirements: - Master's degree or equivalent; - Expertise in the field of documentation and training. 3. The Department of Education, concluded the selection operations, will make a declaration, on the basis of fixed requirements and prior aptitude interview, a specific ranking. 4. The teacher seconded to work in collaboration with the Education Department and the Department of Education of the University; It refers, as regards the functions, coordination bodies referred to in Article 2, while the administration is the responsibility of the Director of the Education Department. Art. 6 (Scientific Committee) 1. The Scientific Committee will consist of: - Director of the Department of Education who chairs it; - N. 1 Expert appointed by the Secretary of State responsible; - N. 1 Expert appointed by the Department of Education; 2. The Committee, in collaboration with the Educational Coordination, performs the tasks of: - establish guidelines and priorities of the Center Resources Unit; - Monitor and evaluate the activities of Centres are part of the CRU. 3. For these tasks is not provided for the payment of compensation. The experts will be identified within the existing staff. Art. 7 (The managerial staff) 1. A partial amendment of Article 6 of the Law 18 June 2008 n. 94 and subsequent amendments, the executive staff comprise: - Socio Educational Services Early Childhood: the Deputy Executive functions are performed by the pedagogical coordinator, as required by Law 25 May 2004 n. 68, by Law 28 January 2005 n. 12 and Decree 70 of May 5, 2005; - Infant School: 1 Deputy Director; - Elementary School: n. 2 Deputy Managers; - Lower Secondary School: # 3 Deputy Managers; - Secondary School: # 1 Deputy Manager. Art. 8 (The figures in the school system) 1. The figures in the school system are distributed as follows: - Socio Educational Services Early Childhood: the plexus coordinators; - Infant School: the plexus coordinators; - Elementary School: the plexus coordinators; - Lower Secondary School: the Class Council Coordinators; - Secondary School: the Class Council vice-presidents. 2. Early Childhood Services Coordinator works with the plexus, the head teacher in achieving the objectives of efficiency and effectiveness in education. He is appointed annually by the team teacher of each plexus and continues to pay the educator activities in the assigned seat.
3. In the nursery and the primary school the plexus coordinator collaborates with the head teacher in achieving the objectives of efficiency and effectiveness in education. It is appointed annually by the teachers of the plexus, and continues to lend teaching activities in the assigned class. Under Decree No. 59/1995, for these functions receives an allowance as determined by the Chief Executive Decree n. 110/2012. 4. In the nursery school, as previously defined by the Agreement PA - unions on of managerial staff of the school figures ratified by the Great and General Council September 27, 2011, they are commissioned annually n. 2 teachers for the continuation of the organizational action research already under way and to allow coverage of a portion of the complex organization of service coordinators, necessary to carry out the above functions. 5. In the Primary School, in the complexes where they are operating up to 8 classes, the teacher of Motor Education is credited with leading a group of "Let's play at the Sport", in addition to two weekly hours of physical activity with each class of plexus. In the remaining hours, until completion of weekly, the teacher participates in recreational activities and workshops, carries out educational support activities and run in partnership with the plexus coordinator, organizational and management tasks to a minimum of two hours per week. 6. In the complexes where they are operating more than 8 classes, will be integrated with the time of a special education teacher 3 hours a week, from the beginning of the school year and until the end of the lessons. The teacher, during the hours assigned, riparametrate in trentaseiesimi, carries out support tasks to the coordinator plexus. 7. In the Lower School Class Council Coordinators, who carry out the functions corresponding to those for the Vice-Presidents of the Class of Secondary School Council, receive the compensation provided for by the Government - trade unions ratified by the Great and General Council on 21 June 2012. 8. In the Higher Secondary School Vice-Presidents of the Class Council receive remuneration for the functions as provided for by the Government - trade unions ratified by the Great and General Council on 21 June 2012. These figures are nominated by teachers for each class council between those teachers who express their willingness. In case they do not emerge availability appoints the head teacher. Art. 9 (Coordinators of curricular and extracurricular sports activities) 1. A partial amendment of Article 4 of Law 26 June 2003 n. 85, the hours of service of the coordinators of the curricular and extracurricular sports activities is extended to 36 hours per week. The hours of replacements for short-term absences made by the coordinators will riparametrate according to the hours of service of the order in which schools operate. 2. Coordinators serve from the beginning of the programming until 30 June, with flexible working hours to be agreed with the Head teachers and respecting the holidays established by the school calendar, and keep the remuneration received in the post of origin. Art. 10 (The Toy Library Service) 1. The Game Room Service pursues the aim to provide a concrete answer to basic needs in the social, cultural and educational. In particular regard to teaching the Toy Library stands as the area agency, in close contact with the families, the school and other educational services, with the aim of enhancing the specific educational significance of the game and toy. Art. 11 (Seconded Teachers at the Toy Library Service) 1. The Game Room service, in accordance with Article 39, paragraph 2, letter. j) of Appendix A of the Law 5 December 2011 n. 188, is run by the Nursery School and will be equipped, up to the drafting of specific legislation, the following personnel: - 4 teachers seconded from the Nursery School; - N.1 cultural worker. 2. The teaching staff seconded to the Toy Library is required to perform, with flexibility, a schedule of 36 hours per week and observes the timetable set by the previous annual agreements PA - unions for the Game Service. 3. The teaching staff seconded to the Game Room is not paid for the period of posting, the allowance depending on the membership role. 4. In case you were not present nominations to fill posts available in the Game by organically teachers, the headmaster may request coverage of such places in the ranking by assignment of teachers. Art. 12 (Experimental Project for complexes with less than 60 pupils)
1. In the complexes of the Elementary School where there are fewer than 60 pupils, while ensuring the organizational model of full-time, is delegated to the Board of Education to draw up an experimental project that provides educational activities for each class group, alternating with workshop experiences open classes, that foster opportunities for discussion in a larger group and more of a cultural stimuli in research activities, subject to the constraint of not exceeding the numbers provided by Article 3 of Law 27 June 2003 n. 87. 2. For the implementation of the complex project requires 9 elementary teachers and teachers of English Language, Education and Religion Motor. Art. 13 (General Plan of the Chairs) 1. Notwithstanding Article 15 of the law 17 July 1979 n. 41, for the school year 2013/2014 the Joint Commission shall draw up the General Plan of the Chairs by 25 July 2013. Art. 14 (Duration) 1. The provisions of this Decree - Law are valid for the academic year 2013 / 2014 and can be changed during the year in accordance with the guidelines and the resolutions made under the executive Plan of the spending reduction action to be approved by the Great and General Council at the proposal of the State Congress under Article 15 , paragraph 5 of Law 21 December 2012 n. 150 "Balance sheets of the State and Public Bodies forecast for the financial year 2013 and Accounts 2013/2015 Recurring".
