Draft Decree Law REPUBLIC OF SAN MARINO DECREE - LAW 27 December 2013 176 We the Captains Regent of the Most Serene Republic of San Marino Having seen the need and urgency referred to in Article 2, paragraph 2, point b) of the Constitutional Law of 15 December 183 of 2005 and Article 12 of the Qualified Law 184 of 15 December 2005, namely: - the need to resolve, in consultation with the various sector authorities, some purely technical-operational issues, recently emerged, related the different types of banking and financial ratios primarily concerned by this legislation; - The urgent need to take action on the terms laid down by Article 25 of Decree-Law 98 of July 25, 2013, on account of their impending expiry; Given the decision of the Congress of State no. 2 adopted at its meeting on 23 December 2013; Having regard to Article 5, paragraph 2, of the Constitutional Law no. 185/2005 and Article 9 and Article 10, paragraph 2, of the Qualified Law n.186 / 2005; Promulgate and publish the following Decree-Law: AMENDMENT OF ARTICLE 25 OF DECREE - LAW July 25, 2013 No. 98 "EXTINCTION OF THE RIGHT TO RETURN IN CONNECTION WITH THE TRANSACTIONS FOR WHICH ARE NOT FULFILLED THE OBLIGATIONS OF PROPER CHECKING AND BOOKS DEPOSIT SAVINGS BEARER "Unique Article 1. Article 25 of the Decree-Law of 25 July 2013 n. 98 is replaced by the following: "1. After Article 95 of Law 17 June 2008 n. 92 is introduced as follows: Art. 95a (Termination of the right to a refund in relation to transactions for which there are not fulfilled the due diligence and passbook savings obligations in bearer form) 1. Transactions for which the date of the due diligence obligations are extinguished under the law with effect from 1 April 2014. 2. by 15 April 2014 the parties shall notify the Agency of Financial Information in the reports to be March 31, 2014 have not been met for which they have not been able to fulfill the due diligence requirements of the customers as at 31 March 2014. 3. the right to restitution of the sums arising from extinction by law the reports referred to in the first paragraph and of the savings passbook bearer, not extinct or not converted into registered relationships in the terms provided by the Decree - Law 136 of 22 September 2009, in partial derogation of the provisions hereof and the provisions of Article 6 of the Delegate Decree 136 of October 31, 2008 , will lapse as follows: - 1 April 2014 for deposit passbooks bearer; - 1 July 2014 for other types of banking relationships. 4. The reports referred to in paragraph 1 may not be moved until the obliged parties have not complied with due diligence obligations. 5. A specific regulation will be regulated the criteria and the procedure and transfer times on the guarantee fund for depositors of the sums of money on these reports and booklets indicated in paragraphs 1 and 3. By the same regulation are also regulated the further effects deriving the extinction of the relationship and the rights referred to in the preceding paragraphs. ".
