DECREE - LAW 30 December 2014 225


We the Captains Regent of the Most Serene Republic of San Marino

Given the necessity and urgency referred to in Article 2, paragraph 2, point b) of the Constitutional Law
15 December 2005 n. 183 and Article 12 of the Qualified Law 184 of 15 December 2005
namely:
- the need to authorize the Department Prevention ISS, acting on a proposal dell'UOS
Veterinary Health and Food Hygiene, to prepare organic
national plans to combat animal diseases, included or not included in the list referred to in Article 1 of Decree
October 4, 1984 n. 87 specifying the search methods, the methods of assessment and intervention
and any other necessary details;
- The need to allocate, therefore, the Secretary of State for Health the power to
Ordinance, so far attributed all'Ecc.ma Regency in Article 179 of the Decree of 21 January 1954
n. 3 (Hygiene Regulations), and then the power to authorize the emergency
cases required by the Director of the Department of Prevention
ISS adoption of appropriate measures to remedy the state of emergency, imposing obligations and prohibitions to
order to observe and apply the organic national plans for the fight against animal diseases;
- The urgent need to carry out that allocation in the light of the special contingent
concrete risks and present, in the light of the recent emergence of an outbreak of
Bluetongue, more commonly known as Blue tongue even in
province of Rimini and the consequent communication come from the General Directorate
Animal Health and Veterinary drugs of the Italian Ministry of Health (executive
device prot. n.0025042-27 / 11 / 2014- DGSAF-COD_UO-P) with which it is noted that the
territory of San Marino is part of the restricted zones for blue tongue
BTV serotype 1;
- Also the urgent need to adopt measures to prevent the spread of the disease in the territory and
to the northern territories of the Italian Republic is currently free and held
the analysis of risk;

In view of Article 4 of the EU-San Marino Cooperation Committee Decision No. 1/2010
"omnibus" of 29 March 2010 made by Chief Executive Decree 10 June 2010 n.102;
Given the decision of the 70 State Congress adopted in the sitting of 29 December 2014;
Considering Article 5, paragraph 2, of the Constitutional Law no.185 / 2005 and Articles 9 and 10, paragraph 2,
of Qualified Law n.186 / 2005;
We promulgate and send for publishing the following Decree-Law:


ATTRIBUTION TO THE SECRETARY OF STATE FOR HEALTH AND SOCIAL SECURITY OF THE ORDER

1. The Director of Prevention Department is authorized, on a proposal dell'UOS Health
Veterinary and Food Hygiene, to prepare organic national plans to combat animal diseases
, included or not included in the list referred to in Article 1 of the Decree of 4 October 1984
n. 87 specifying the search methods, the methods of assessment and intervention as well
any other necessary details.
2. Any declaration of a state of emergency is for the Secretary of State for Health and Social Security
who, at the request of the Directorate of the Department of Prevention
ISS, adopting appropriate ordinance. 3
. The ordinance referred to in the previous paragraph must contain prohibitions and obligations which follow
in the period of operation, in order to observe and apply the organic
national plans to combat animal diseases.
4. The ordinance should indicate the state of emergency lasting; It may be withdrawn or extended
if you modify the conditions determining its adoption.
5. In the emergency period declared Ordinance, must be respected
provisions.
