DECREE - LAW June 5, 2015 83
(Ratification Decree-Law 47 of April 10, 2015)


We the Captains Regent of the Most Serene Republic of San Marino

The Decree - Law 47 of April 10, 2015 - "Urgent measures in the fight against terrorism", promulgated
:
Given the necessity and urgency referred to in Article 2, paragraph 2 , b) the
Constitutional Law 183 of 15 December 2005 and Article 12 of the Qualified Law 184 of 15 December 2005
namely:
- the need to adapt existing legislation
international cooperation and mutual assistance in order to strengthen security and
develop cooperation between States in the fight against terrorism and
regulate new types of offenses;
- The urgent need to give immediate feedback to the aforementioned need for quick
adaptation to the latest international standards;
Given the decision of the Congress of State # 1 adopted at its meeting on 10 April 2015;
Since the amendment made to the aforementioned decree in connection with ratification of the same from
Great and General Council at its meeting on 27 May 2015;
View of the Great and General Council decision of 27 May 27, 2015;
Having regard to Articles 8 and 9, paragraph 5, of the Qualified Law n.186 / 2005;
Promulgate and publish the final text of the Decree - Law of 10 April 2015 47
as amended as a result of the amendment approved by the Great and General Council
home to ratification: || |

URGENT MEASURES IN THE FIELD OF COMBATING TERRORISM


Art. 1

1. After Article 13 of the Decree - Law of 15 July 2013 n. The following Chapter 83 is inserted:

"CHAPTER IIIa
SUPPRESSION OF TERRORIST ACTS BY WEAPONS EXPLOSIVE

Art. 13a
(Terrorist attacks using explosive devices)

1. Whoever, for the purpose of causing death or serious injury or to cause substantial damage
places, buildings or plant, delivery, place, operates or detonates explosives or
other unexploded lethal in a place open to the public , in a building for public use, against
assets, infrastructure or resources for public use or on vehicles or public transportation facilities or its
service facilities it shall be punished with imprisonment of seventh grade.
2. It applies the captivity of eighth grade and disqualification in the fourth degree if the facts stated in the preceding paragraph
comes the death of one or more persons. ".

Art. 2

1. Article 1, paragraph 1, letter p), last line, of the Law 92 of June 17, 2008, after
words "international organization", the following is inserted: "It is, also, 'terrorism' or | || 'terrorist act' any planned conduct and defined in the international Convention for the suppression of the financing of terrorism
and treaties listed in the annex; ".
