Art.12 (Commitment, validation and payment of expenditure) are authorized commitment, liquidation and payment of the corresponding costs of each output section of the State Budget Forecast. Multiannual expenditure continuing or recurring, subject to the annual limit of appropriations, they may also be authorized on future years in accordance with Articles 10 and 34 of Law 30 of February 18, 1998. With the approval of the Budget automatically means authorized and engaged the
compulsory expenditure due to the salary expenses of the staff, for the mortgage amortization installments, interest and related charges, following the execution of contracts or of the law, attached hereto as Exhibit "V". Art.13 (Assessment, collection and payment of the revenue) are authorized - with the possibility of adjusting the revenue - the assessment, collection and payment of taxes in the state treasury, taxes, income, contributions and any other income attributable to the State. Art.14 (reserve funds Breakdown) The Congress of State is empowered to distribute, through a resolution, in the relevant chapters, and between the same funds, funds of Chapters 03.01.2470 "Reserve Fund expenses unexpected "01/03/2480" reserve Fund compulsory expenditure "and 03.01.2490" intervention Fund "to bind and in subsequent years, subject to their destination, the availability unused. 6 Art.15 (Change Matches Giro) The Congress of State is authorized to issue, by its deliberations, the necessary changes in the items of expenditure in the Giro games, in close correlation with the findings on the corresponding chapters of entry and within the limits Override the investigations themselves. The AASFN is authorized to collect, on behalf of the Treasury Service of the State and the Administration of Posts, the proceeds from the sale of circulating coins and stamps for postal use at face value, with the obligation to provide at least quarterly to payment to the Treasury of the sums collected, to be charged on sections 940 and 950 of the State Budget Forecast. Remains entrusted, for the financial year 2008, the all'AASFN of phone cards emissions management, including all the related loading and accounting. Art.18 (Transfers CONS) The Congress of State is authorized to provide for advances, the contribution for the year 2008 of € 4,835,000.00 to CONS for in Article 8 of the Law March 13, 1997 # 32 . Art.19 (subsidized Convenzionamenti for agriculture) The Congress of State is authorized to have an agreement for 2008, with the banks available for the provision of low-interest loans referred to Laws 22 and 11 March 1981 September 20, 1989 96, up to the total amount of € 2,000,000.00, through the statement of expenses will be borne by the state, even for previous loans, the applicable expenditure. Art.20 (Convenzionamenti subsidized for businesses) In application of Law 13 of January 28, 1993 and subsequent amendments and additions and the access criteria laid down in Article 60 of Law 172 of 16 December 2004, the State Congress 7 it is allowed to have an agreement for 2008, with the banks available for the granting of soft loans to businesses, up to the total amount of € 4,000,000.00, charged to the State interests, even for the previous loans, chapter 2-5-7220. Art.21 (subsidized Convenzionamenti for students) The National Congress, in accordance with Law 5 of January 21, 2004 and Chief Executive Decree 104 of September 28, 2006, is allowed to have an agreement for 2008, with the Credit Institutions available for the provision of loans on trust, up to the total amount of € 155,000.00, with the payment of a subsidy from the State interests, even for previous loans, attributable to the chapter 1-10 -5130. Art.22 (subsidized Convenzionamenti for subsidized housing)
The Congress of State is authorized, in accordance with Law 110 of December 15, 1994 and subsequent amendments and additions, to have an agreement for 2008, with the credit institutions and financial companies available to the purpose of granting the funding provided for by the law, up to the maximum amount of € 29,000,000.00, with the payment of a subsidy from the State interests, even for previous loans, to be charged on chapter 2-8-7450. The Congress of State is committed to submit by 31 May 2008, a bill aimed at the revision of the existing legislation on subsidized housing in order to regulate in a single text the criteria and methods for providing and re-evaluation of ' level of funding. Art.23 (subsidized Convenzionamenti for eliminating architectural barriers) The Congress of State is authorized to have an agreement for 2008, with the banks available for the provision of loans at a subsidized rate referred to in Article 154 of the Law of July 19, 1995 87, up to the total amount of € 250,000.00, with the payment of a subsidy from the State interests, even for previous loans, to be recorded on the chapter 2-8-7465. Art.24 (subsidized Convenzionamenti to companies for research) The Congress of State is authorized to have an agreement for 2008, with the banks available for the provision of soft loans under Law 16 of January 27, 2006 and Decree 36 of February 15, 2006, up to the total amount of € 4,000,000.00, with the payment of a subsidy from the State interests, even for previous loans, to be charged on chapter 2 -5-7221. The Secretary of State responsible undertook to prepare a report, to be submitted to the Great and General Council, on the use of this chapter in order to be able to evaluate the effects and the impact that this item of the budget law has on business growth of Republic. Art.26 (Breakdown of spending funds) The Congress of State is authorized to proceed, at year end and on a reasoned proposal from the Secretariat of the Great and General Council, the distribution of funds between the chapters 1- 1-1470 "Fund independent for the Regency "01/01/1480" Independent Fund for the Great and General Council "and 2-1-6100" Fund of the Regency Individual and the Great and General Council for the purchase of assets ". Art.27 (Funding of Parties and Political Movements) Pursuant to Article 2 of Law 170 of 23 November 2005, for the year 2008, the contribution to be paid to the State Parties and Political Movements is set at € 1,696,433, 35 and entered the chapter 01/01/1450. Art.28 (Allocation of funds for the Township Councils) The State Congress has reserved the right to proceed, at the proposal of the Township Councils, the allocation of funds between chapters 1-6-3810 "Checks to Township Councils" and 2-6-7280 "Quote Juntas contribution Castle intended for the purchase of assets". Art.29 (Destination of resources to Township Councils) For the purposes of Article 29 of Law 22 of 24 February 1994, the AASP is authorized to make available to the Township Councils the sum of € 420,000.00 to be charged on relevant chapters of the Annual Report of the same company forecast. Art.30 (Transfers ISS) Pursuant to and the effects of Article 26, third paragraph, of Law 112 of 20 December 2002, the Congress of State is authorized to provide the Institute for Social Security, for the ' financial year 2008, an endowment fund for health care, to be charged on 1-9-4590 chapter, to the extent of € 52,800,000.00 as well as a fund for the social and health services, to be charged on chapter 1-9- 4610, in the amount of € 9,900,000.00. Art.31 (lump Recovery pensions allowances paid by ISS) The flat-rate recovery borne ISS related to pensions allowances paid in connection with the Law March 23, 1927 # 3, referred to in section 1080 is established at 10 % of the amount recorded on the chapter 03/01/2670. Art.32 (mutual Turning at the Central Bank and deposit guarantee systems)
Under Decree-Law 112 of 15 October 2007 the Congress of State is authorized to conclude with the Central Bank of the Republic of San Marino, in the amount of € 10,500,000.00, ten-year loan aimed at supporting the banking system San Marino. 9 It mandates the Congress of State to adopt before 30 June 2008, appropriate delegated decree implementing Article 100 of Law 165 of 17 November 2005 on the guarantee schemes for the protection of depositors, transposing the guarantees bank and consolidated financial systems, harmonizing the basic principles of the European Union legislation on the protection of savers. Art.33 (extraordinary health interventions) Any charges set out in Decrees Nos 20 May 1996. 48 and 49 for the 2008 financial year are posted on the chapter on 01/03/2490 or 01/03/2470 and 01/03/2480 chapters. Art.34 (Chapter Breakdown 03/01/2650) The State Congress is given the power, through a resolution, to allocate, among the relevant chapters, the allocation of Chapter 03/01/2650 "salary expenses and for restructuring and economic improvements to employees and pensioners of the State "and to engage in subsequent years, subject to their destination, the availability unused. Art.35 (AASS - use of reserves) The Autonomous State Agency for Public Services is authorized, for 2008, to use its reserves up to € 1,750,000.00 be allocated to funding of the planned investment, including those relating to investments made on behalf of the State whose expenses are charged to dell'AASS Art.36 (AASS - Sector Sewer) in compliance with Law 147 of 30 October 2003, as part of all'AASS transfers for 2008, the Congress of State is authorized to provide the Company the same € 1,000,000.00 on 01.03.2501 chapter "charges AASS for Sewer Service" and € 1,000,000.00 on 2-5-6431 chapter "Fund of AASS envelope for Sewer Service investment ". Art.37 (Appropriations vincolati- chapters 2-4-6442 and 2-5-6432) For the 2008 financial year the allocation bound on 2-4-6442 chapter "of AASP Endowment Fund for bound investments - use surplus of Directors of previous years ", amounting to € 3,300,000.00, will be earmarked for € 1,600,000.00 to the continuation of the interventions indicated in paragraph a) of the second paragraph of Article 35 of Law 135 of December 18, 2006, and € 1,700,000.00 for further work referred to in subparagraph b) of clause and article mentioned above. For the financial year 2009, the constrained budget, totaling € 2,700,000.00, will be earmarked for € 1,300,000.00 to the same work under subparagraph a) of the second paragraph of Article 35 of Law 18 December 2006 n .135, and € 1,400,000.00 for the work under subparagraph b) of paragraph and Article mentioned above. On 2-5-6432 chapter "of AASS Endowment Fund for bound investments - Using surplus of Directors of prior years' appropriations for the years 2008 and 2009, they amounted to € 2,000,000.00 for each year and are allocated to aid on the electrical substation and for the safety of the power lines. 10 Art.38 (chapters Adjustment for Set General Income Tax and Tax on Imports) As from the current fiscal year the Congress of State, in the presence of more general findings on income tax and tax on imports involving more refunds of those taxes, is authorized to adapt the appropriations in and out provided on chapters 20 "general income tax", 260 "tax on imported goods", 1- 3-2870 "tax refunds tax Office" and 1-3 -2890 "Refund on imports", in respect for the balance of the financial statements. The adjustment referred to in the preceding paragraph may be made by 31 May of the following year. Art.39 (Mortgage tie) E 'allowed the lighting of a mortgage balance of the Budget deficit in 2008 up to € 8,624,349.15. Art.40 (Promotion and incentives for the sector tourist-commercial) The budget chapter on 01/03/2396 "Fund for the promotion and incentives for the tourist-commercial sector", amounting to € 2,000,000.00 will be allocated by: a) the redevelopment and promotion of the tourism sector and the commercial with particular reference to the city of San Marino City that will be defined through appropriate legislative measures; b) the project of the San Marino Card, which will be regulated by a specific statutory instrument, as a tool to build customer loyalty by increasing the convenience of purchasing and in Republic
rewarding consumer loyalty. The goal to increase sales within the territory will be implemented through a contextual and targeted tax reduction phase; c) the implementation of the Trade Enhancement Strategic Tourism Plan and the Plan intended as strategic and multidisciplinary tools for revitalizing the sector as part of a modernization project and development of the country; d) the development and marketing of typical products and agri-food and traditional food and wines of San Marino, including through the certification of the same. The above measures will be subject to comparison with the trade associations of the sector they belong to. Art.41 (promotion of the economic system Interventions) On 01/03/2305 Chapter "Initiatives and promotion of the economic system charges" will be funded by € 250,000.00. It mandates the State Congress to set up a program to promote the economy of San Marino project, identifying areas better able to make development and competitiveness of the country system. This plan will be built through the identification of appropriate forms of communication to promote the economic system supranational level also through a specialized international communication agencies in the areas mentioned in the first paragraph of Article 50 of Law 13 December 2005 n. 179. 11 Art.42 (Shanghai 2010) Universal Exhibition In view of the role played by the participation of the Republic of San Marino at the Shanghai 2010 Universal for the promotion and the image of our state for tourism - commercial and general system for the entire country, is hereby established by the Secretariat of State for Tourism, Sports, Telecommunications, Transportation and Economic Cooperation, "the Commissioner general of San Marino Government for the World Exposition Shanghai 2010 participation" . It mandates the State Congress to adopt appropriate delegated decree governing the structure, organization and management methods of the General Commissariat above. All expenses related to the participation of San Marino World Exposition Shanghai 2010 will be recorded on the appropriate chapter 1-7-3936 called "Charges for participation in the World Exposition Shanghai 2010". For the financial years 2008, 2009 and 2010, the appropriations provided on this chapter will be respectively equal to € 500,000.00, € 500,000.00 and € 900,000.00. Exclusively for the activities and operations carried out in China, the delegate decree above may provide for any exceptions to the current administrative and accounting procedures. The delegate decree must also regulate the terms and manner of presentation of estimated expenditure, the statement of expenditure and the final balance of the participation in the World Exposition Shanghai 2010, to be transmitted to the competent supervisory body. Art.43 (Public Administration Reform) According to the principles and guidelines contained in the Order of the Day of the Great and General Council of 16 May 2007, the Constitutional Law n.183 / 2005, the Qualified Law n.184 / 2005 in civil service contract, in order to support the administration's reform process has established the chapter 01/01/1396 "reform of public Administration and Institutional" with an allocation of € 130,000.00 for the issue of the necessary normative documents, contractual and administrative, to the adoption of the acts already identified on schedule, improving the functionality of the executive and administrative, to the adoption of a coherent response to the evolution of the economic and social institutional system as well as the provision of more effective services and consistent with the requirements of users, expenditure restraint, the rationalization of public services and the gradual elimination of insecurity. Art.44 (Replacement of Title I of the law 22 March 1986 n.38) The entire Title I of the law 22 March 1986 n.38, replaced by article 37 of Law 155/1986 amended and supplemented by Article 1 of Law n.55 / 2004 is replaced by the following: "tITLE I Art.1 (overseas products income) income produced abroad by resident individuals are exempt from tax; they are nevertheless required to declare, with the exception of large capital income in interest, premium and other income derived from bonds and any other different note receivable from actions. If the total income of legal persons and similar entities
concur foreign income, taxes on that income paid there outright or to be held these, however, non-recurring, they are permitted in sharp deduction of tax due until 12 competition of the San Marino tax rate corresponding to the ratio between the incomes products abroad and the total income. The net tax and the tax rate are inferred, after the positive and negative changes in income, in the "B" under the IGR model "P". If competing products income in more foreign states, the deduction applies separately for each State. The effects of the provisions in the second paragraph, the deduction shall be made in the tax return relative to the tax period in which the foreign income has contributed to forming the overall income and the statement are including relevant taxes that have been permanently paid before its presentation. The credit for taxes paid abroad can not exceed the net amount of tax payable on the total income. The deduction is not up if the foreign income has not been declared or in the event of failure to submit the declaration or statement about anything. If the period to which they belong such foreign income does not match the one in which foreign tax has actually been paid, except as provided in the preceding paragraph, the deduction shall be made in respect of this period always statement from the year of accrual basis, taking into account any adjustments in the increase in foreign income taxes recoverable within three years. The foreign tax actually paid and not recovered than the deductible under the second paragraph becomes negative component of income deductible in the declaration for the next tax period. With the exception of foreign earnings through permanent establishment, foreign income to be considered in the calculation of the tax credit, in the preceding paragraphs, it shall be determined by multiplying the total gain for the ratio between the gross proceeds and foreign total revenue.
