No. 33. Law containing measures in matrimonial matters and in defense of the race. We the Captains Regent of the Most Serene Republic of San Marino We promulgate and publish the following law approved by the Prince and Sovereign Council of the LX in His today's Returned: Art. 1. The marriage of the San Marino citizen of ari na race with people belonging to another race is prohibited. Art. 2. Without prejudice to the prohibition in Article. 1, the wedding of the city of San Marino with a person of foreign nationality, or stateless person not born in this territory there is not established over ten years, is subject to the prior consent of the Regency, heard, if necessary, the Council of Twelve. Violators are punished with imprisonment up to three months and a fine of up to ten thousand lire. Art. 3. For the purposes of Article 2 of the Italian citizens are not considered foreigners. Art. 4. And 'forbidden to Italian citizens to marry in this Republic in violation of the provisions of the Royal Decree Law 17 November 1938 n. 1728 containing measures for the defense of the Italian race. Art. 5. It can not produce civil effects and should not, therefore, be transcribed in the civil status registers the marriage celebrated in violation of art. 1 as well as art. 4 as it relates to the Italian city of marriage of the Aryan race with person belonging to another race. And if the transcript occurred nor will the revocation ordered by decree of the Law Commissioner after consultation with the Attorney of the Treasury. The officer of civil status who has proceeded to the transcript of the proceedings relating to marriages celebrated without observing the provisions of art. 2 as well as art. 4, in regard to the Italian citizen marriage to persons of foreign nationality, is required to make reports to the competent authority. Art. 6. The court will not examine actions for annulment or nullity of marriage, contracted abroad by non-citizens of San Marino, except when, in addition to the conditions demanded by statutory provisions, recourse also to stay on this territory of at least six months. Art. 7. The present law will apply beginning with the fifteenth day of its legal publication, and until it will be repealed so expressed.
