No. 37. Law establishing the Extraordinary Commission for the purification (1). We the Captains Regent of the Most Serene Republic of San Marino availing ourselves of the faculty concesseCi by the Great and General Council Seat models in the November 16, 1944; We decree, promulgate and publish: Art. 1. 'appointed by the Great and General Council a Special Committee of seven Members to purge procedures by the offices of those citizens and forensic acceded to the resurgent Republican Fascist Party and participated in acts and actions c mpromettenti peace and security of the Republic and offensive to citizens' freedoms, after the peace promoted by the Great and General Council at its meeting of 28 October 1943; the removal of those judges who have made themselves complicit in the actions promoted by the public power organs during the fascist regime established in the Republic, for the spirit of reprisal and political oppression; examination of the personal position of the Consuls and the Government Representatives in Italy and abroad, reflected in the attitude taken and even political action carried out privately by each of them, while also ensuring that the elimination of those whose tenure does not it was compatible with the spirit of the new political situation in the Republic. Art. 2. With regard to Employees, will be submitted it to the judgment of purging members of the Republican Fascist Party and those who have participated in acts and actions compromising the peace and security of the Republic and invasive of citizens' freedom, serving in qualunqe form and category, in government departments, parastatal bodies, citizens and businesses of the Institutes in which the Government exercises its control and that are recognized in the public interest. Art. 3. According to the function performed and the degree of responabilità of each employee under investigation, the Extraordinary Commission of purging apply tion cases deemed liable to purge appropriate measures ranging: from the pantry of the service, with right or not of legal liquidation, the suspension of the service for a specified period without payment of salary to relegation and the return to the role of origin in the case of improper feeding, to transfer to another office in the determination of the State Congress, applying minor disciplinary measures . Art. 4. The cleansing process is the initiative of the Commission itself. Art. 5. According to the Commission, the employee undergoes a cleansing process may be immediately suspended from office. Art. 8. Against the judgment of the Commission, which will be communicated by the Secretariat of State for Internal Affairs to the person, will produce an appeal within five days to the Council of the Twelve who will judge in the second and final instance. Art. 9. The purification process is also independent from the one he effects of the sanctions to be adopted by the Union established by Law 25 October 1944. Art. 10 The Commission will inform the Union of purging itself of measures taken to load the indicted. Art. 11. The beginning of the purging procedure is set at 20 November 1944. Art. 12. The measures adopted by the Commission will apply after ten days when they were communicated to him through the Secretariat of Internal Affairs, and, in case of appeal addressed to the Council of Twelve, immediately after the judgment of the second and final grade.
