RUSSIAN FEDERATION FEDERAL LAW on amendments to article 5 of the Federal law "on the Prosecutor's Office of the Russian Federation" adopted by the State Duma on June 21, 2013 year June 26, 2013 year approved by the Federation Council to amend article 5 of the Federal law "on the Prosecutor's Office of the Russian Federation" (as amended by the Federal law of November 17, 1995, N 168-FZ) (Gazette of the Congress of people's deputies of the Russian Federation and the Supreme Soviet of the Russian Federation , 1992, no. 8, art. 366; Collection of laws of the Russian Federation, 1995, no. 47, art. 4472; 2007, N 24, art. 2830; 2011, N 1, art. 16) as follows: 1) in paragraph 2 the words "federal legislation" should be replaced by the words "paragraph 4 of this article";
2) shall be amended with paragraph 4 as follows: "4. Familiarization with the materials of citizen verification is carried out by the public prosecutor in charge of the relevant material or the superior prosecutor, adopted following the examination of the treatment of a citizen if materials directly affect their rights and freedoms.
A citizen cannot be granted for consultation documents available in materials inspection and containing information constituting a State secret or other secret protected by law.
The decision of getting acquainted with the materials of the citizen or checking the reasoned decision to refuse reading materials verification shall be taken within ten days from the date of circulation of the citizen. In the case of a decision on refusal to be acquainted with materials verification citizen explains the right to appeal the decision to a higher prosecutor and (or) in court. "
