RUSSIAN FEDERATION federal law on ratification of the Treaty between the Russian Federation and the United States of America on further reduction and limitation of strategic offensive arms adopted by the State Duma January 25, 2011 year approved by the Federation Council January 26, 2011 Article 1 year ratify the Treaty between the Russian Federation and the United States of America on further reduction and limitation of strategic offensive arms, signed in Prague on April 8, 2010 year , hereinafter referred to as the new START Treaty.
Article 2 implementation of the new start Treaty is carried out under the following conditions: 1) maintaining the capacity of the strategic nuclear forces of the Russian Federation at the level necessary to ensure the national security of the Russian Federation, including through the development, testing, production and deployment of new types and new types of strategic offensive weapons with the advantages to overcome anti-missile defence systems;
2) maintaining combat readiness of the strategic nuclear forces of the Russian Federation in any strategic environment, the preservation and development of the necessary research and development base and production facilities;
3) financing in accordance with the level of unmet needs in the strategic nuclear forces of the Russian Federation, activities relating to the conservation and development of the necessary research and development base and production facilities, as well as works on safe disposal and recycling of strategic offensive arms by the Russian Federation and the new start Treaty;
4) ensuring safe operational conditions, storage, disposal and recycling of strategic offensive arms by the Russian Federation;
5) accounting of the interrelationship between strategic offensive arms and strategic defensive arms, the growing importance of this relationship in the process of reducing strategic nuclear weapons, and that strategic defensive armament of one party do not undermine the viability and effectiveness of the strategic offensive arms of the other party of the new start Treaty;
6) dissemination of the provisions of the new start Treaty, including those relating to the zascheta of warheads and delivery vehicles, in accordance with its terms to any strategic offensive weapons, as well as to any new types of strategic offensive armaments range;
7) question of dissemination of the provisions of the new start Treaty on any new kind of strategic offensive armaments range should be solved within the framework of a bilateral Consultative Commission, created in accordance with article XII of the new start Treaty before the new type of strategic offensive armaments range will be expanded;
8) granting the United States telemetry information about launches of existing types of intercontinental ballistic missiles and submarine-launched ballistic missiles of the Russian Federation only until the secession of the autonomous unit breeding or payload from the last stage of intercontinental ballistic missiles or submarine-launched ballistic missiles and the failure of the United States of America telemetry information about launches of new types of intercontinental ballistic missiles and submarine-launched ballistic missiles of the Russian Federation;
9) effective use, improvement and development of new control START Treaty, including national technical means of verification of the Russian Federation for compliance with the United States of America of the new start Treaty.
Article 3 1. Implementation by the Russian Federation's obligations under the new START Treaty is carried out in compliance with this federal law and other normative legal acts of the Russian Federation governing the actions and procedures that occur during the execution of the new start Treaty.
2. In the process of implementation of the new start Treaty: 1), the President of the Russian Federation: a) determines the main directions of the State policy in the field of the development of the strategic nuclear forces of the Russian Federation and the nuclear disarmament process, procedure and deadlines for the implementation of the new start Treaty, while ensuring the preservation of the capacity of the strategic nuclear forces of the Russian Federation and the maintenance of their combat readiness at the level necessary to deter aggression against the Russian Federation;
b) after the entry into force of the new start Treaty adopts the programme for the development of the strategic nuclear forces of the Russian Federation as part of the State program of armament and informs the Chamber of the Federal Assembly of the Russian Federation;
in) determines the main directions of international activities of the Russian Federation on strategic offensive weapons and missile defence, with a view to strengthening strategic stability and ensuring the national security of the Russian Federation;

g) Decides to create new types and new types of strategic offensive arms, as well as entering them in battle;
d) defines national concept further international negotiations in the field of strategic offensive weapons and missile defense, holding consultations and negotiations with the leaders of other States with a view to strengthening strategic stability and ensuring the national security of the Russian Federation;
2) the Government of the Russian Federation: a) provides, in accordance with federal laws, other regulatory legal acts of the Russian Federation and the State program of armament priority financing of the strategic nuclear forces of the Russian Federation;
b) ensures the preservation and development of scientific-research and experimental-design and production capacity required to maintain nuclear capabilities and combat readiness of the strategic nuclear forces of the Russian Federation;
in effective use) provides national technical means of verification of the Russian Federation for compliance with the provisions of the United States of America of the new start Treaty, their technical development, as well as carrying out monitoring procedures under the new START Treaty;
g) after the date of entry into force of this federal law, contends the federal target program of industrial disposal of weapons and military equipment, to provide for the possibility of use of downsizing and infrastructure components of the strategic nuclear forces of the Russian Federation for the development of the national economy;
d) takes measures to ensure the safety during operation, storage, disposal and recycling of strategic offensive weapons, warheads and propellants, as well as to prevent unauthorized access to nuclear boezarjadam;
(e)) takes actions on the use of economically optimal methods and ways of elimination and disposal of strategic offensive arms;
f) after the date of entry into force of the new start Treaty annually informs the Chamber of the Federal Assembly of the Russian Federation on the status of implementation of the new start Treaty on the following issues: the implementation by the Russian Federation and the United States obligations under the new START Treaty;
the deployment of missile defence systems by other States, their impact on the capacity of the strategic nuclear forces of the Russian Federation and the possible threat to the national security of the Russian Federation in case of the emergence of new types of offensive weapons, strategic range, as well as the placement of weapons in outer space;
enhanced dialogue with the Russian Federation, the United States of America in the field of strategic offensive arms;
information about prisoners of international treaties of the Russian Federation, related to the implementation of the new start Treaty (with the direction of the official texts of the treaties);
financial security-keeping capacity in strategic nuclear forces of the Russian Federation, their operational status and results of these activities;
status and options for research and development base and production facilities;
progress in the elimination and disposal of decommissioned of strategic offensive arms by the Russian Federation, State funding for the implementation of the new start Treaty, including through international technical assistance;
the environmental situation in the places of storage, disposal, and recycling of strategic offensive arms by the Russian Federation, particularly nuclear warheads and propellants;
w) on the instructions of the President of the Russian Federation carries out foreign policy activities in the field of reduction and limitation of strategic offensive arms and the non-proliferation of nuclear weapons.
3. Chamber of the Federal Assembly of the Russian Federation, each within the framework of its powers: 1) the annual consideration of the draft federal law on the federal budget for the next financial year are involved in making (approval) decisions on the funding of research and development works in the field of strategic offensive armaments, procurement of strategic offensive weapons, construction (repair, upgrade) Home Basic objects of strategic nuclear forces of the Russian Federation, as well as works on safe disposal and recycling of strategic offensive weapons and the implementation of action to comply with the new start Treaty;

2) participate in the formulation of projects of federal laws, the State program of armament and key indicators of the Government's defence order for the corresponding financial year, adopt (endorse) Federal laws aimed at maintaining the strategic nuclear forces of the Russian Federation at the level necessary to ensure the national security of the Russian Federation, as well as to perform activities in the area of nuclear arms reduction, including allowing the use of reduced component of the strategic nuclear forces of the Russian Federation and their infrastructure for the development of the national economy;
3) review the annual report of the Government of the Russian Federation on the status of the strategic nuclear forces of the Russian Federation and the status of implementation of the new start Treaty;
4) where necessary, take measures in accordance with part V of the Federal law dated July 15, 1995 N 101-FZ "on international treaties of the Russian Federation".
Article 4 1. The provisions of the preamble of the new start Treaty are of undeniable importance for understanding the intentions of the parties upon signature, including the content of the agreed conditions and understandings between them, without which the new start treaty would not be signed. In this regard, they should be fully taken into account by the parties during the execution of the new start Treaty.
2. the Russian Federation carries out provided for in article XIV of the new start Treaty, the right of withdrawal under exceptional circumstances endangering its supreme interests. Such circumstances may include: 1) material breach of United States obligations under the new START Treaty that could lead to a threat to the national security of the Russian Federation;
2) deployment by the United States of America, by another State or group of States missile defence system capable of significantly reducing the efficiency of the strategic nuclear forces of the Russian Federation;
3) build-up by the United States of America, by another State or group of States strategic offensive arms or their decisions in the field of military construction, as well as other circumstances which may endanger the national security of the Russian Federation;
4) deployment by the United States of America, other States or group of weapons, hindering Russian missile attack warning system.
3. in the exceptional circumstances referred to in paragraph 2 of this article, the President of the Russian Federation: 1) takes a political, diplomatic and other measures to address exceptional circumstances or neutralize their consequences;
2) provides immediate consultations with Chambers of the Federal Assembly of the Russian Federation and in the light of the results of such consultation takes decisions regarding the new start Treaty, subject, where necessary, in the Chamber of the Federal Assembly of the Russian Federation proposals stipulated by the Federal law of July 15, 1995 N 101-FZ "on international treaties of the Russian Federation".
4. the Chambers of the Federal Assembly of the Russian Federation if they deem that there are circumstances that are categorized as exceptional within the meaning of article XIV of the new start Treaty, sent the President of the Russian Federation proposal for consultations, or expressed him their recommendations or taking other actions within its competence.
Article 5 the President of the Russian Federation shall take a decision on the holding of negotiations on further reduction and limitation of nuclear weapons, taking into account the progress of the new start Treaty, its principles and provisions, as well as the status of such weapons, the United States, third States in complex with the other objectives of the national security of the Russian Federation.
Article 6 this federal law shall enter into force on the day of its official publication.
