RUSSIAN FEDERATION federal law on the quality and safety of food products, adopted by the State Duma of the year December 1, 1999 approved by the Federation Council of the year December 23, 1999 (as amended by the federal laws on out N 196-FZ;

Chapter i. General provisions article 1. Basic concepts for the purposes of this federal law uses the following concepts:-products in natural or processed form, used by humans for food (including baby foods, diet products), bottled drinking water, alcoholic drinks (including beer), soft drinks, chewing gum, as well as food raw materials, food additives and dietary supplements;
baby foods-designed for feeding children under the age of 14 years and meet the physiological needs of children food;
dietary foods intended for therapeutic and preventive nutrition foods;
food raw-raw material of plant, animal, microbial, mineral and synthetic origin and the water used for the manufacture of food products;
nutritional supplements-natural or artificial substances and their compounds, specifically entered in food products during the production process in order to make food of certain properties and (or) preservation of food quality;
biologically active supplements-natural (natural identical) biologically active substances intended for use simultaneously with the food or the composition of the foodstuffs;
materials and articles in contact with foodstuffs (hereinafter referred to as materials and articles), materials and products used for the manufacture, packaging, storage, transport, sale and use of food products, including technology equipment, instruments and devices, containers, dishes, cutlery;
food quality-the totality of characteristics of food products, able to meet human needs in food under normal conditions of use;
food safety-State of well-founded confidence in foods under normal conditions of use are not harmful and pose no risk to the health of present and future generations;
nutritional value of a food product is a set of properties of a food product, in which human physiological needs are met in the necessary substances and energy;

circulation of foodstuff, materials and products-purchase and sale (including exports and imports) and other ways to transfer foodstuff, materials and products (hereinafter referred to as the implementation), storage and transportation;
counterfeit foods (including food supplements), materials and products-foods (including food supplements), materials and products, intentionally changed (fake) and (or) having hidden properties and quality, which is known to be incomplete or illegible; (As amended by federal law from 31.12.2014 N 532-FZ) identification of foodstuff, materials and products-efforts to establish conformity of certain foodstuffs, materials and products the requirements of normative and technical documentation and information about foods, materials and products contained in the accompanying documents and labels;
recycling of food products, materials and articles-the use of substandard and dangerous food products, materials and products for purposes other than the purposes for which the foodstuff, materials and products are designed and are commonly used.
Article 2. Legal regulation of relations in the field of quality assurance and food safety

Legal regulation of relations in the field of quality assurance and food safety are carried out by this federal law, other federal laws and adopted in accordance with them and other normative legal acts of the Russian Federation, as well as the laws and other normative legal acts of the constituent entities of the Russian Federation.
Federal laws, the laws of the constituent entities of the Russian Federation and adopted in accordance with the regulations in relation to ensuring the quality and safety of foodstuff should not contain rules that contradict this federal law.
If an international treaty of the Russian Federation stipulates other rules than those provided for by the legislation of the Russian Federation in the field of quality assurance and food safety, rules of the international treaty shall apply.
Article 3. Alienability of foodstuff, materials and products 1. In circulation may be foods, materials and products corresponding to requirements of normative documents and passed the State registration in the order established by this federal law.

Article 4. Ensuring quality and safety of food, materials and products quality and food safety, materials and products are provided by the application of measures of State regulation in the field of quality assurance and food safety, materials and products;
spending by citizens, including individual entrepreneurs and legal entities engaged in the manufacture and circulation of foodstuffs, materials and products, organizational, agrochemical, veterinary, technological, technical, sanitary and anti-epidemic and phytosanitary activities to meet the requirements of the normative documents for food, materials and products, their manufacture, storage, transport and disposal;
conducting the production quality control and food safety, materials and products, their manufacture, storage, transport and sales, introduction of quality management systems of food, materials and products (hereinafter referred to as the quality systems);
application of measures to prevent violations of this federal law, including the requirements of normative documents, as well as civil, administrative and criminal responsibility of the perpetrators of these violations.
Article 5. Information on the quality and safety of food, materials and products 1. Individual entrepreneurs and legal entities performing activities in manufacturing and sales of food products, materials and products, providing services in the sphere of retail trade of food, materials and articles, and catering, are obliged to provide buyers or consumers, as well as a State supervisory bodies complete and reliable information about the quality and safety of food, materials and products, meeting the requirements of normative documents in the manufacture and circulation of foodstuffs , materials and products and the provision of such services. State supervision Authorities in ensuring the quality and safety of food, materials and products provide public authorities and local self-government bodies, legal entities and individual entrepreneurs and citizens with information about the quality and safety of food, materials and products, on compliance with the normative documents in the manufacture and circulation of foodstuffs, materials and products, providing services in the sphere of retail trade of food, materials and products and catering about State registration of food, materials and products, for confirmation of their compliance with the requirements of normative documents, as well as on measures to prevent the implementation of substandard and dangerous food products, materials and products. Powers of the Russian Federation in the field of quality assurance and food safety (as amended by federal law from 22/08/2004, no. 122-FZ), Article 6. Powers of the Russian Federation in the field of quality assurance and food safety 1. The powers of the Russian Federation in the field of quality assurance and food safety are: (as amended by the Federal law on 31.12.2005. N 199-FZ), development and implementation in the Russian Federation, the unified State policy;
adoption of federal laws and other regulatory legal acts of the Russian Federation;
development and implementation of the federal target scientific and technical programs and ensure the quality and safety of food, materials and products;
State regulation in the field of quality assurance and food safety, materials and products;

2. State authorities of the constituent entities of the Russian Federation shall have the right to participate in the exercise of the powers of the Russian Federation in the field of quality assurance and food safety by adopting, in accordance with federal laws, laws and other regulations of constituent entities of the Russian Federation;
development, approval and implementation of regional programmes for quality assurance and food safety;

State regulation in the field of quality assurance and food safety Article 9. 2. making food products, materials and products and their manufacturers, suppliers in the State Register of food products, materials and articles that are permitted for the manufacture in the territory of the Russian Federation or importation into the territory of the Russian Federation and implementation;
issuance of certificates of State registration of applicants of foodstuff, materials and products eligible for their production on the territory of the Russian Federation or importation into the territory of the Russian Federation and turnover.
3. State registration of certain types of foodstuffs, materials and products is carried out by the authorized federal executive authorities in the manner prescribed by the Government of the Russian Federation. (As amended by the Federal Act of 19/07/2011 N 248-FZ)

State supervision in the area of quality and safety of food, materials and products is carried out by federal bodies of executive power, bodies of executive power of the constituent entities of the Russian Federation, authorized the implementation of, respectively, the federal state sanitary-and-epidemiologic supervision, Federal State veterinary supervision, the regional State veterinary supervision in accordance with their competence, in the manner prescribed by the Government of the Russian Federation. Federal bodies of executive authorities referred to in paragraph 1 of this article, exercise respectively sanitary and quarantine control and state veterinary supervision in the manner prescribed by the legislation of the Russian Federation in the field of sanitary-epidemiological welfare of the population and on veterinary medicine. 4. Requirements for ensuring the quality and safety of food 1. Article 16. Requirements for ensuring the quality and safety of new food products, materials and products in their design and staging to the production of 1. When developing new foods, materials and products, new technological processes of their manufacture, packing, storage, transportation and realization of individual entrepreneurs and legal persons have the obligation to justify the demands for quality and safety of food products, materials and products, their packaging, labelling and information about such foodstuffs, materials and products, the preservation of the quality and safety of foodstuff, materials and products in their manufacture and trafficking develop program of production control over the quality and safety of such food products, materials and products, their testing methods, as well as to set expiration dates of such food products, materials and products.

3. 3. In the manufacture of baby foods and dietary foods are not allowed food raw materials, manufactured using feed additives, animal growth stimulants (including hormonal drugs), certain types of medicines, pesticides, agrochemicals and other health hazardous substances and compounds.
4. Food additives used in the manufacture of food products and dietary supplements should not cause harm to human life and health.
In the manufacture of food products, as well as for human consumption may be used in food supplements and biologically active additives, have passed the State registration in the order established in article 10 hereof.
5. Used in the manufacture of food products and articles must conform to the requirements of normative documents for the security of such materials and products. 8. 2. Individual entrepreneurs and legal entities performing packing and packaging of foodstuffs must observe the requirements of the normative documents for packaging and food packaging, marking, and also used for food packaging and labelling materials.

3. On the labels or labels or sheets-inserts packaged foods other than information, which is defined by the legislation of the Russian Federation on protection of consumer rights, taking into account the types of food products should contain the following information: the nutritional value (caloric content, the content of proteins, fats, carbohydrates, vitamins, macro-and micronutrients);
of appointment and the conditions of application (for baby foods, diet products and biologically active additives);
about how to and the conditions of manufacture of ready meals (in respect of concentrates and semi-processed food products);
on the storage conditions (for foods that have storage requirements);
on the date of manufacture and date of food packaging.
Article 19. Requirements for ensuring the quality and safety of food, materials and goods storage and transport 1. Storage and transportation of food substances, materials and products should be carried out in conditions ensuring the maintenance of their quality and safety.
2. Individual entrepreneurs and legal entities performing storage, transportation of food substances, materials and products are required to comply with the requirements of regulatory documents to the conditions of storage and transportation of food, materials and products and confirm compliance with such requirements corresponding entries in the shipping documents.
3. storage of food, materials and products is permitted in specially equipped premises, installations, which must conform to the requirements of normative documents. (As amended by the Federal Act of 19/07/2011 N 248-FZ)
4. For the transport of foodstuffs shall be designed or specially equipped vehicles for such purposes. (As amended by the Federal Act of 19/07/2011 N 248-FZ)
5. If during storage, transport foodstuff, materials and articles, a violation that led to a loss of food, materials and products quality and acquisition of their hazardous properties, individual entrepreneurs and legal entities performing storage, transportation of food substances, materials and articles, shall be obliged to inform the owners and recipients of food, materials and products.
Such foodstuff, materials and products are not subject to implementation, are sent for examination, in accordance with the results of which they disposed of or destroyed.
Article 20. Requirements for ensuring the quality and safety of food, materials and products in their implementation 1. When implementing foodstuff, materials and products (including individual entrepreneurs) and legal persons are obliged to observe the requirements of normative documents.
2. Retail sale not allowed the bulk and unpackaged foods, except for certain kinds of foods, the list whereof shall be determined by the Federal Executive Body in the field of trade in consultation with the authorized federal body of executive power executing federal state sanitary and epidemiological surveillance. Implementation of food markets food products of nonindustrial manufacturing is allowed only after the veterinary-sanitary examination and obtain the sellers of such food products under the requirements of the veterinary rules and norms. 4. In case when implementing food products, materials and articles, a violation that led to a loss of food, materials and products quality and acquisition of their hazardous properties, citizens (including individual entrepreneurs) and legal entities engaged in the implementation of food products, materials and articles, shall be obliged to withdraw such foodstuff, materials and products with implementation, to provide them with feedback from consumers, to send a substandard and unsafe foods materials and products for examination, to organize their disposal or destruction.
Article 21. Requirements for ensuring the quality and safety of food, materials and products, the importation of which into the territory of the Russian Federation 1. Quality and food safety, materials and products, the importation of which into the territory of the Russian Federation, shall conform to the requirements of normative documents.
2. obligations of manufacturers, suppliers to comply with the requirements of the normative documents for foods, materials and products, the importation of which into the territory of the Russian Federation are essential conditions of the contract.

(As amended by the Federal law of 18 N 242-FZ), Owner of dangerous food products, materials and articles shall within ten days take them outside the territory of the Russian Federation.
If dangerous foods, materials and products in the fourth subparagraph of this paragraph established a term not exported outside the territory of the Russian Federation, they are confiscated in accordance with the legislation of the Russian Federation shall be sent for examination, in accordance with the results of which should not be disposed of or destroyed.
Article 22. Requirements for the Organization and conduct of the production quality control and food safety, materials and products 1. Individual entrepreneurs and legal entities performing activities in manufacturing and sales of food products, materials and articles are obliged to organise and conduct the production quality control and safety, compliance with the requirements of the normative and technical documents to the conditions of manufacture and circulation of foodstuffs, materials and products.
2. Production control over the quality and safety of food products, materials and articles shall be carried out in accordance with the program of production control, which is being developed by an individual entrepreneur or legal person on the basis of normative documents and technical documents. The programme defines the procedure for the implementation of production quality control and food safety, materials and products, techniques and methods of such controls verify the conditions of their manufacturing and trafficking. (As amended by the Federal Act of 19/07/2011 N 248-FZ), Article 23. Requirements for workers involved in the manufacture and circulation of foodstuffs 1. Workers in jobs that are associated with the manufacture, trafficking and abuse of food, provision of services in the sphere of retail trade of food, materials and articles, and catering and when carried out direct contact employees with food, materials and products undergo obligatory preliminary at entry and periodic medical examinations, as well as hygiene education in accordance with the legislation of the Russian Federation.
2. patients with infectious diseases, persons with such diseases, persons in contact with the patients of infectious diseases, of persons who are carriers of infectious diseases, which can represent in connection with peculiarities of manufacture and circulation of foodstuffs, materials and products the risk of spread of such diseases, as well as to workers who have not passed the hygienic instruction, are not allowed to work when implemented direct contact employees with food , materials and products.
Article 24. The requirements for removal from circulation of substandard and dangerous food products, materials and products 1. Substandard and dangerous food products, materials and articles subject to seizure.
The owner of the substandard and dangerous food products, materials and articles shall be obliged to withdraw them from circulation independently or on the basis of the requirements of government supervision and control.
2. If the owner of the substandard and dangerous food products, materials and articles not taken steps to withdraw them from circulation, such foodstuff, materials and products shall be confiscated in accordance with the legislation of the Russian Federation.
Article 25. Requirements for the examination, to recycling

or destruction of substandard and dangerous food products, materials and products seized from the turnover of 1. Substandard and dangerous foods, materials and products withdrawn from circulation shall be subject to appropriate assessment (epidemiological, veterinary care, and other commodity expert), carried out by bodies of the State supervision in accordance with its competence, in order to determine the feasibility of recycling or destruction of such food products, materials and products. (As amended by the Federal law of 18 N 242-FZ), foodstuff, materials and products, the owner of which cannot confirm their origin that are telltale signs of poor quality and therefore constitute an immediate danger to human life and health, should be recycled or destroyed without examination. Prior to the disposal or destruction of such food products, materials and products to their owner in the presence of a representative of State supervisory authority is required to modify the properties of such food products, materials and articles any available and reliable way, precluding the possibility of their further use for the intended purpose. 2. Substandard and dangerous foods, materials and products for the period necessary for examination, disposal or destruction shall be sent for temporary storage, conditions which preclude access to such food, materials and products.
Temporary storage are substandard and dangerous foods, materials and products are subject to strict accounting. Responsibility for the safety of such foods, materials and products bear their owner.
3. on the basis of examination results of substandard and dangerous food products, materials and products corresponding to the State supervision authority makes a decision about their disposal or destruction. (As amended by the Federal law of 18 N 242-FZ), Owner of low-quality and (or) dangerous food products, materials and products select the ways and conditions of their disposal or destruction, in accordance with the requirements of the normative technical documents and coordinates with the State supervisory agency, handed down the ruling on disposal or destruction of such food products, materials and products, methods and terms of their disposal or destruction. 4. the costs of the examination, storage, transportation, disposal or destruction of substandard and dangerous food products, materials and products shall be paid by the owner.
5. the owner of a substandard and dangerous food products, materials and articles shall submit to the State supervisory authority, has issued a decree scrapping or destruction, document or its certified copy in prescribed manner certifying disposal or destruction of such food products, materials and products. 6. State supervision Bodies, delivering a ruling on disposal or destruction of substandard and (or) dangerous food products, materials and products are required to monitor their disposal or destruction of the danger of the emergence and spread of diseases and poisoning of humans and animals, as well as pollution of Wednesday. Responsible officials of the State supervision and control officials of State supervision and monitoring of improper performance of their duties, as well as the concealment of facts, pose a threat to human life and health, shall bear responsibility in the manner prescribed by the legislation of the Russian Federation.
Chapter VI. Final provisions Article 30. Enactment of this federal law

1. this federal law shall be put into effect from the day of its official publication, with the exception of the provisions of paragraph 1 of this federal law, which entered into force from the day of official publication of the Government of the Russian Federation approved by the relevant regulatory acts. The provisions of article 10 of the present Federal law also apply to cosmetic products, tools and products for oral hygiene. (As amended by the Federal law dated 05.12.2005 N 151-FZ)
2. the provisions of articles 2-8, article 9 (with the exception of the second paragraph of paragraph 2), article 10, article 12 (with the exception of the provisions concerning the assessment and attestation of conformity to requirements of normative documents of the services rendered in retailing and catering), article 13, article 16, paragraphs 1, 2, 5-8 article 17, paragraphs 1 and 2 of article 18, paragraphs 1-3 and 5 of article 19, paragraphs 1 and 4 of article 20 articles 21-28 this federal law apply also to perfume and cosmetic products, tools and products for oral hygiene, tobacco.
3. invite the President of the Russian Federation to bring its normative acts in compliance with this federal law.
4. To instruct the Government of the Russian Federation to elaborate normative legal acts provided for in this federal law, and to bring its normative acts in compliance with this federal law.
