RUSSIAN FEDERATION federal law on ratification of the Treaty between the Russian Federation and the United States of America on the further reduction and limitation of strategic offensive arms adopted by the State Duma April 14, 2000 year approved by the Federation Council April 19, 2000 year Article 1 ratification of the Treaty between the Russian Federation and the United States of America on the further reduction and limitation of strategic offensive arms, signed in Moscow January 3, 1993 year , hereinafter referred to as the start Treaty-2, including forming an integral part of it: a memorandum of agreement on transfer of warheads and of data on heavy bombers in connection with the Treaty between the Russian Federation and the United States of America on the further reduction and limitation of strategic offensive arms, signed in Moscow January 3, 1993 onwards;
The Protocol on procedures governing the Elimination of heavy ICBMs, and the procedures governing the alteration of heavy ICBM silo launchers, in connection with the Treaty between the Russian Federation and the United States of America on the further reduction and limitation of strategic offensive arms, signed in Moscow January 3, 1993 onwards;
Protocol on inspections and shows heavy bombers in connection with the Treaty between the Russian Federation and the United States of America on the further reduction and limitation of strategic offensive arms, signed in Moscow January 3, 1993 onwards;

Article 2 to exceptional circumstances, giving the Russian Federation in accordance with article VI of the Treaty, start-2 entitled, in exercising its national sovereignty, to withdraw from that Treaty, along with others, include: 1) violation of the start II Treaty by the United States of America-2, which can lead to threats to the national security of the Russian Federation;
2) withdrawal of the United States of America of the Treaty between the Union of Soviet Socialist Republics and the United States of America on the limitation of anti-ballistic missile systems, which was signed in Moscow on May 26, 1972 year, hereinafter referred to as the ABM Treaty or the violation of the ABM Treaty and related agreements;
3) build-up of strategic offensive arms by States not parties to the start I Treaty 2, in such a way that it will threaten the national security of the Russian Federation;
4) adoption and implementation of the United States, other countries or unions of States, including the North Atlantic Treaty Organization, such solutions in the field of military construction, which will create a threat to the national security of the Russian Federation, including accommodation in the territories of the States that joined the North Atlantic Treaty Organization after the signing of the start II Treaty 2, nuclear weapons;
5) deployment by the United States of America, other Nations or alliances arms States, hindering Russian missile attack warning system;
6) occurrence of emergencies, including economic or technological hazards that make it impossible to execute the Russian Federation of the start II Treaty 2 or could lead to the emergence of environmental threats to the security of the Russian Federation.
Article 3 1. In exceptional circumstances referred to in article 2 hereof, as well as other exceptional circumstances endangering the supreme interests of the Russian Federation, the President of the Russian Federation: a) takes a political, diplomatic and other measures to address exceptional circumstances or neutralize their consequences;
b) provides immediate consultations with Chambers of the Federal Assembly of the Russian Federation and in the light of the results of such consultation takes decisions relating to start-2 Treaty, with proposals if necessary, stipulated by the Federal law "on international treaties of the Russian Federation".
2. the Chambers of the Federal Assembly of the Russian Federation if they deem that there are circumstances that are categorized as exceptional in the sense of article VI of the Treaty, start-2, sent the President of the Russian Federation proposal for consultation or to express to him its recommendations or taking other actions stipulated by the Federal law "on international treaties of the Russian Federation".
Article 4

The President of the Russian Federation provides for consultations with Chambers of the Federal Assembly of the Russian Federation and in the light of the results of such consultation takes decisions relating to start-2 Treaty, with proposals if necessary, provided for in title V of the Federal law "on international treaties of the Russian Federation", if, prior to December 31, 2003 year is not signed the new Treaty between the United States and the Russian Federation on further reduction and limitation of strategic offensive arms providing: 1) the preservation and further strengthening of strategic stability at lower levels of strategic offensive arms by the Russian Federation and the United States of America;
2) save opportunities for the Russian Federation a multi-choice approach to constructing their strategic nuclear forces, including their structure and composition of weapons, ensuring the national security of the Russian Federation, taking into account existing economic conditions;
3) rule out the possibility of rapid build-up in the number of nuclear warheads on carriers of all kinds;
4) providing the parties to the Treaty of equal rights and opportunities in the elimination and disposal of nuclear warheads;
5) economically optimal use of existing infrastructure of the strategic nuclear forces of the Russian Federation, a significant reduction in the costs of disposal and recycling programmes of strategic offensive arms, as well as increasing the capacity of utilization of downsizing of components of the strategic nuclear forces of the Russian Federation and their infrastructure for the development of the national economy;
6) records of all kinds and strategic weapons systems.
Article 5 Implementation of the start II Treaty 2 is carried out on the basis of the following: 1) the preservation of the capacity of the strategic nuclear forces of the Russian Federation at the level necessary to ensure the national security of the Russian Federation;
2) priority financing of the strategic nuclear forces of the Russian Federation, as well as works on safe disposal and recycling of strategic offensive arms;
3) observance of the Treaty by the United States of America on the reduction and limitation of strategic offensive arms, signed in Moscow on July 31, 1991 year, hereinafter referred to as the start Treaty-1;
4) reduce falling under the start I Treaty 2 strategic offensive arms by the Russian Federation in view of the timing of their exploitation;
5) maintaining combat readiness of the strategic nuclear forces of the Russian Federation in all development policy environment, maintaining the necessary laboratory test base and production facilities;
6) security operation, storage, disposal and recycling of strategic offensive arms;
7) ensure equality of rights and opportunities for the parties to the start I Treaty 2 in carrying out inspections and monitoring activities, as well as the preservation and improvement of national technical means of verification of the Russian Federation for compliance with the start I Treaty by the United States of America-1, 2 the start II Treaty and the ABM Treaty.
Article 6 the implementation by the Russian Federation of the START II Treaty obligations-2 is carried out in compliance with this federal law, as well as other legislative and normative legal acts of the Russian Federation governing the actions and procedures, which occurs when the implementation of the start II Treaty 2.
Financial support for the strategic nuclear forces of the Russian Federation, as well as production, operation, removal and disposal of nuclear weapons is carried out in accordance with the federal laws.
The President of the Russian Federation within two months after the entry into force of this federal law claims a federal programme for the development of the strategic nuclear forces of the Russian Federation and sends it into the Chamber of the Federal Assembly of the Russian Federation.
The Government of the Russian Federation for a period of three months after the entry into force of this federal law develops and submits for approval by the President of the Russian Federation the federal target programme for the elimination and disposal of weapons and equipment of the strategic nuclear forces of the Russian Federation, allowing the use of reduced components and infrastructure for the development of the domestic economy.
Article 7 in the process of implementation of the start II Treaty-2:1. The President of the Russian Federation: a) determines the main directions of the State policy in the field of the development of the strategic nuclear forces of the Russian Federation and nuclear disarmament, the procedure and time frame for the implementation of measures for the implementation of the start II Treaty 2, while ensuring the preservation of the capacity of the strategic nuclear forces of the Russian Federation and the maintenance of their combat readiness at the level necessary to deter aggression against the Russian Federation and its allies;

b) makes decisions on the timing and modalities of the withdrawal and the deactivation of strategic offensive weapons to be reduced under Start-2 as well as the battle of the new models of strategic offensive arms;
in) determines the Russian concept of further international negotiations in the field of strategic offensive weapons and missile defense, holding consultations and negotiations with the leaders of other States with a view to strengthening strategic stability and ensuring the national security of the Russian Federation.
2. the Government of the Russian Federation: a) provides, in accordance with federal laws and federal targeted programmes priority financing of the strategic nuclear forces of the Russian Federation, works for the safe disposal and recycling of strategic offensive arms, as well as the implementation of the start II Treaty and the start II Treaty 1-2;
b) ensures the preservation and development of the laboratory and test facilities and production capacity required to maintain nuclear capabilities and combat readiness of the strategic nuclear forces of the Russian Federation;
in) in accordance with article 8 hereof regularly sends in the Chamber of the Federal Assembly of the Russian Federation report on the status of the strategic nuclear forces of the Russian Federation and the implementation of the start II Treaty 1, 2 the start II Treaty and the ABM Treaty;
g) is in the Chamber of the Federal Assembly of the Russian Federation the data provided for in the memorandum of understanding on enrolling warheads and on data on heavy bombers in connection with the start Treaty-2;
d) ensures effective use of national technical means for monitoring compliance with the provisions of the start I Treaty 1, 2 the start II Treaty and the ABM Treaty, their technical development, as well as carrying out monitoring procedures under those instruments;
e) takes measures to ensure the safety during operation, storage, disposal and recycling of strategic offensive weapons, warheads and propellants, as well as to prevent unauthorized access to nuclear boezarjadam;
f) taking steps to use economically optimal methods and ways of elimination and disposal of strategic offensive arms;
w) on the instructions of the President of the Russian Federation carries out foreign policy activities in the field of reduction and limitation of strategic offensive arms and the non-proliferation of nuclear weapons;
and) invites (by agreement) the representatives of the Chambers of the Federal Assembly of the Russian Federation to participate in the review of negotiations on strategic offensive weapons and missile defence.
3. the Chambers of the Federal Assembly of the Russian Federation: a) the annual consideration of the draft federal law on the federal budget are involved in making decisions about funding levels of scientific-research and experimental-design works in the field of strategic offensive arms, procurement of strategic offensive weapons, construction (repair, upgrade) Home Basic objects of the strategic nuclear forces of the Russian Federation and the management, as well as works on safe disposal and recycling of strategic offensive weapons and the implementation of the start II Treaty and the start II Treaty 1-2;
b) participate in the development of federal laws and federal targeted programmes, take federal laws needed to maintain strategic nuclear forces of the Russian Federation at a level ensuring the national security of the Russian Federation, as well as to perform activities in the area of nuclear arms reduction;
in an annual report) deal with the Government of the Russian Federation on the status of the strategic nuclear forces of the Russian Federation and the implementation of the start II Treaty 1, 2 the start II Treaty and the ABM Treaty and to take appropriate decisions;
g) if necessary, give instructions to the accounts Chamber of the Russian Federation concerning the verification of expenditure of funds allocated for the implementation of the start II Treaty and the start II Treaty 1-2;
d) where necessary, take action in accordance with section V of the Federal law "on international treaties of the Russian Federation".
Article 8 after start II enters into force, 2 the Government of the Russian Federation annually, not later than 1 October shall submit to the Chamber of the Federal Assembly of the Russian Federation report on the status of the strategic nuclear forces of the Russian Federation and the implementation of the start II Treaty 1, 2 the start II Treaty and the ABM Treaty, containing information on the following issues: 1) the change in the composition and structure of the strategic nuclear forces of the Russian Federation, financial security and the results of the executed works to preserve their capabilities and combat readiness;
2) implementation by the Russian Federation and the United States obligations under the start I Treaty, the start I Treaty 1-2 and the ABM Treaty;

3) progress of the elimination and disposal of decommissioned of strategic offensive arms by the Russian Federation, State funding for the implementation of the start II Treaty and the start II Treaty 1 2, including the use of international assistance;
4) environment in places of storage, disposal, and recycling of strategic offensive weapons, especially nuclear warheads and propellants;
5) progress in negotiating new agreements on the reduction and limitation of strategic offensive arms, as well as in the area of theatre missile defence;
6) status in the United States, other countries and unions of States in the field of strategic offensive weapons and missile defense, the situation in the field of non-proliferation of nuclear weapons, of missiles and missile technologies.
Article 9 exchange of instruments of ratification of the start II Treaty by the Russian Federation of 2 produce after the completion of the United States of America procedures for ratification of the start II Treaty-2, including the Protocol thereto signed at New York City September 26, 1997 onwards, as well as a memorandum of understanding with regard to the ABM Treaty, signed in New York on September 26, 1997 year, First agreed statement with regard to the ABM Treaty, signed in New York on September 26, 1997 year The second agreed statement with regard to the ABM Treaty, signed in New York on September 26, 1997 year, the agreement on confidence-building measures with regard to ballistic missile systems, non-strategic ballistic missiles, signed in New York on September 26, 1997 year.
Article 10 this federal law shall enter into force on the day of its official publication.
