Spagle Force-Federal Law of 25.10.2002 N 125-FZ RUSSIAN FEDERATION FEDERAL LAW On housing subsidies to citizens leaving the region The Extreme North and equivalent area Accepted State Duma on 2 July 1998 approved by the Federation Council on 9 July 1998 of the Federal budget to the citizens of the Russian Federation (hereinafter referred to as "citizens") who leave the regions of the Far North and similar localities; the allocation of the federal budget for housing subsidies provided for by the Federal Law "About the 1998 federal budget", in the constituent entities of the Russian Federation, in the territories of the Far North and similar localities. Article 1. It is established that the right to receive housing subsidies from the federal budget is enjoyed by citizens with work experience or living in areas of the Far North and similar localities for at least 15 years and having no employment. OF THE PRESIDENT OF THE RUSSIAN FEDERATION However, the total length of service and residence time of pensioners or citizens registered as unemployed in these areas and areas is determined by the second article 6 of this Federal Act. Citizens who receive housing subsidies under this Federal Act are not entitled to other forms of State support from the federal budget for construction (acquisition) of housing. Article 2. The federal budget for the provision of housing subsidies to citizens leaving the regions of the Far North and equivalent to 5 per cent is used for the provision of housing. Grants to citizens who have departed from these areas and areas no earlier than 1 January 1992, who need to improve their living conditions at their new place of residence and have the right to receive such subsidies under this Federal Act. The provision of housing subsidies to citizens who departed from these areas and areas no earlier than 1 January 1992 is subject to the supervision of the legislative (representative) legislative bodies of the constituent entities of the Russian Federation. Article 3. To approve the allocation to the constituent entities of the Russian Federation provided for in article 26 of the Federal Act on the Federal Budget for 1998 Housing subsidies for citizens leaving the regions of the Far North and similar localities, as well as housing construction in the area of BAM in the amount of 1,200.0 million In accordance with the annex. Article 4. Article 7. State and municipal housing stock occupied by citizens leaving the employment or rental contract, as well as privatized housing, is subject to obligatory delivery (transfer) to the place of residence to the executive authorities of the entities The Russian Federation or local authorities within one month after the acquisition of housing and the registration of these citizens at the new place of residence. Citizens who have transferred housing under a contract of sale are entitled to housing subsidies, with the deduction of the value of the transferred dwelling. Article 8. Housing subsidies are provided to citizens in non-cash form by enlisting the executive authorities of the constituent entities of the Russian Federation, in whose territories the regions of the Far North and related localities are located to developers (homeowners) in the region where there are contracts for the construction (acquisition) of housing. To conclude these contracts, citizens entitled to receive housing subsidies, the executive authorities of the constituent entities of the Russian Federation, in the territories of the Far North and similar localities, within the limits of the appropriations as approved by article 3 of this Federal Law, shall issue appropriate letters of guarantee, with reference to the total area of the purchased housing, the composition of the family, and the amount of the housing subsidy provided to the citizen. The housing subsidy is provided after the person has made his/her own and/or loan funds in the amount of the missing money for the construction (acquisition) of the dwelling. Article 9. A citizen who receives a housing subsidy has the right to acquire a dwelling which is in accordance with the requirements for living accommodation, within the limits of the amount of the housing subsidy received, without the use of one's own and (or) Borrowable funds. It is possible to acquire a dwelling whose total area is less than the social standard of housing per family, but not less than the area established for the improvement of housing conditions in the region. Article 10. The authorities of the constituent entities of the Russian Federation shall determine the order in which housing subsidies are provided to citizens, as well as the procedure for the delivery of housing to citizens and their further use. OF THE PRESIDENT OF THE RUSSIAN FEDERATION Article 11. The Government of the Russian Federation: , in drafting a federal law on the federal budget for 1999, provides for a separate allocation for housing subsidies to citizens leaving the regions of the Far North and equated to them.
