RUSSIAN FEDERATION FEDERAL law on higher and postgraduate vocational education adopted by the State Duma on July 19, 1996 year approved by the Federation Council August 7, 1996 year chapter i. General provisions article 1. Legal regulation of relations in the field of higher and postgraduate vocational education 1. Legal regulation of relations in the field of higher and postgraduate vocational education is carried out by this federal law, other laws and other normative legal acts of the Russian Federation, as well as the laws and other normative legal acts of the constituent entities of the Russian Federation.
2. If an international treaty of the Russian Federation stipulates other rules than those provided for in this federal law, the rules of the international treaty shall apply.
Article 2. Public policy and Government guarantees the rights of citizens of the Russian Federation in the field of higher and postgraduate vocational education 1. State policy in the field of higher and postgraduate vocational education based on the principles defined by the Education Act of the Russian Federation, as well as on the following principles: 1) sovereignty rights of subjects of the Russian Federation in defining their own policies in the field of higher and postgraduate vocational education part of national-regional components of the State educational standards;
2) continuity and succession of education;
3) integration of higher and post-graduate professional education of the Russian Federation, while preserving and promoting the achievements and traditions of the Russian higher school into the world system of higher education;
4) konkursnost' and transparency in determining the priority directions of the development of science, engineering, technology, as well as specialist training, retraining and improvement of professional skill of employees;
5) State support for the training of professional staff, the priority directions of fundamental and applied scientific research in the field of higher and postgraduate vocational education.
2. The institutional framework of the State policy in the field of higher and postgraduate vocational education is a federal programme for the development of education in the part corresponding to the higher and postgraduate vocational education.
3. the State provides priority development of higher and postgraduate vocational education through: 1) funding from the federal budget of State educational institutions of higher professional education (hereinafter referred to as tertiary institutions). While the goals may not be allocated less than three per cent of the federal budget, which provides funding for education in State higher educational establishments, not less than one hundred and seventy students for every ten thousand people living in the Russian Federation;
2) increased access of citizens of the Russian Federation for higher education, to prevent a reduction in the number of students studying at the expense of the federal budget;
3) tax benefits to universities and educational institutions of the corresponding supplementary education, as well as organizations investing in development of higher and postgraduate vocational education;
4) provide to the trainees (students, post-graduate students, students and other categories of students) in the public system, higher and postgraduate vocational education State grants, places in dormitories, and benefits, including food and travel on public transport, in accordance with this federal law;
5) create the conditions for equal access to higher and postgraduate vocational education;
6) facilitate the establishment and functioning of non-governmental institutions of higher learning.
4. citizens of the Russian Federation on the basis of competition are guaranteed free higher and postgraduate vocational training in State and municipal institutions of higher education within State educational standards if this level of education receives for the first time.
5. citizens of the Russian Federation shall be guaranteed the freedom to choose the form of higher and postgraduate vocational education, educational institutions and training areas (specialities).
Restricting the rights of citizens to receive higher and postgraduate vocational education may be established solely by federal law only to the extent necessary in order to protect morality, health, rights and lawful interests of other persons, ensure national defense and State security.
Article 3. The autonomy of institutions of higher education and academic freedom

1. Under the autonomy of the higher educational institution refers to its autonomy in the selection and placement of staff, implementation of educational, scientific, financial and economic and other activities in accordance with the laws and statutes of the higher educational institution approved in accordance with the procedure established by law.
2. Institution of higher education is responsible for its activities to the individual, society and the State. licensed higher educational establishments and educational institutions an additional professional education irrespective of their organizational-legal forms;

management bodies higher and postgraduate vocational education, as well as the subordinated enterprises, institutions and organizations;

Article 5. The State educational standards of higher and postgraduate vocational education and educational programs of higher and postgraduate vocational education 1. 2) unity of educational space of the Russian Federation;
3) basis for an objective assessment of the activities of educational institutions that implement educational programs of higher and postgraduate vocational education;

2. The State educational standards of higher and postgraduate vocational education consist of federal and national and regional components.
The Federal components of the State educational standards for higher and postgraduate vocational education include: 1) General requirements to the basic educational programs of higher and postgraduate vocational education;
2) compulsory minimum requirements for the content of the main educational programs of higher and postgraduate vocational education, the conditions for their implementation, including training and production practice and final certification graduates, graduates in each direction (specialty);
3) terms of mastering basic educational programs of higher and postgraduate vocational training in State and municipal educational establishments, which do not contradict the terms established by the legislation of the Russian Federation and (or) the provisions on higher educational establishments of the species concerned;
4) the maximum amount of study load of students.
National-regional components of the State educational standards for higher and postgraduate vocational education reflect national cultural training in relevant areas of training (professions).
3. the procedure for development, approval and introduction of State educational standards of higher and postgraduate vocational education in the part not regulated by this federal law, shall be determined by the Government of the Russian Federation.

4. the content of national-regional components of the State educational standards of higher and postgraduate vocational education is determined by the higher education institution in the case of funding for their implementation at the expense of the budget of the Russian Federation-in consultation with the relevant body of executive authorities of the constituent entities of the Russian Federation.
5. Basic educational programs of higher and postgraduate vocational education developed by the Federal (Central) education authorities and departmental public education authorities and in part, beyond appropriate State educational standards, serve as exemplary educational programs of higher and postgraduate vocational education.
6. the list of directions (specialities), higher and postgraduate vocational education shall be established in accordance with the procedure determined by the Government of the Russian Federation.
Article 6. Higher professional education, terms and forms of receipt 1. The main educational programs of higher professional education can be implemented continuously and the stairs.

2. Institution of higher education, having the State accreditation, graduates of the State sample documents issues on comparative education with official symbols of the Russian Federation. The form of the document shall be approved by the Federal Government (Central) management body of higher professional education.
3. Establishes the following types of documents, which certify completion of higher professional education at various levels: Bachelor's degree;
Diploma with higher professional education;
Master's degree;

Article 8. Institution of higher education and its tasks and structure 1. 3) training, retraining and improvement of professional skill of workers with higher education and of scientific and pedagogical workers of higher qualification;
4) formation of studying civil position, ability to work and live in conditions of modern civilization and democracy;
5) preservation and augmentation of ethical, cultural and scientific values of society;
6) dissemination of knowledge among the population, improving its educational and cultural level.
3. institutions of higher education shall be independent in the formation of its structure, with the exception of their branches.
Subdivisions of the higher educational institution may be wholly or partly by power of Attorney powers of legal entity in the order specified by the Charter of a higher educational institution. carries out training, retraining and (or) the improvement of professional skill of workers of higher qualification, scientific and scientific-pedagogical employees;
performs basic and applied research across a broad spectrum of Sciences;
is a leading scientific and methodological centre in the areas of its activities.
3. Academy-higher education institution that: implements educational programs of higher and postgraduate vocational education;
carries out training, retraining and (or) the improvement of professional skill of workers of higher qualification for a specific area of scientific and scientific-pedagogical activities;
performs basic and applied research mainly in one area of science or culture;
is a leading scientific and methodological centre in its field of activity.
4. the institution-institution of higher education which: implements educational programs of higher professional education, as well as, usually, educational programs of postgraduate professional education;
carries out training, retraining and (or) the improvement of professional skill of workers for a particular field of professional activity;
conducts basic and (or) applied research.
5. the status of a higher educational institution is determined by its type, organizational-legal form, the presence or absence of State accreditation. The status of a higher educational institution is included in its name.

Article 10. The procedure for the creation and reorganization of higher educational institutions, licensing their activity and accreditation 1. Higher education institution created and reorganized by the founder (founders) in declarative manner in accordance with its decision or with the terms of the memorandum of Association and registered in accordance with the legislation of the Russian Federation. General questions of creation and reorganization of higher educational establishments is regulated by the Education Act of the Russian Federation.
The founder of the higher educational institutions, implement military professional education program (military schools), can only be the Government of the Russian Federation.
2. public higher education institutions under the jurisdiction of the Russian Federation, are created and restructured by the Government of the Russian Federation on agreement with the legislative and executive authorities of the constituent entities of the Russian Federation.

Licensing educational activities of higher educational institution on new areas of training for him (the majors) is made on a general basis regardless of the higher educational institution licenses.

License to conduct educational activities on military professional education programs are issued only to public institutions of higher education in the manner prescribed by the Government of the Russian Federation.
Licenses to higher education institutions, irrespective of their organizational-legal forms, except for educational institutions of further education, can be granted only if they have the rights owner, operational management, lease or independent disposition the necessary educational and material base.
5. 6. Article 11. Admission to higher education and the training of specialists with higher and postgraduate vocational education 1. Admission to higher educational institutions is carried out according to those with secondary (full) General or vocational secondary education on a competitive basis based on the results of entrance examinations, except for the cases stipulated by the legislation of the Russian Federation on education. Citizens reception procedure in institutions of higher learning in the part not regulated by this federal law, shall be determined by the founder (founders) higher educational institution.

Higher education institution is obliged to acquaint the entrant with the specified license, as well as the certificate of State accreditation for each area of training (specialty), for the issuance of the document of the State standard of higher professional education. 4. Postgraduate higher educational establishments, scientific institutions or organizations on a competitive basis shall be taken by citizens of the Russian Federation, having higher professional education, in accordance with this federal law. Graduate studies in these institutions and organizations can be full-time or part-time forms. Post-graduate studies in State and municipal institutions of higher education may not exceed three years in full-time, part-time four years.
5. the doctoral program of higher educational establishments, scientific institutions or organizations shall be taken by citizens of the Russian Federation, having a scientific degree of candidate of Sciences.
Term doctoral institutions or organizations may not exceed three years.
6. Reception of foreign citizens in postgraduate study and doctoral studies at higher educational establishments, scientific institutions or organizations is carried out in accordance with international treaties of the Russian Federation and intergovernmental agreements of the Russian Federation, as well as in the manner provided for in paragraph 2 of article 29 of this federal law.
Admission of stateless persons in postgraduate study and doctoral studies of higher educational establishments, scientific institutions or organizations shall be carried out in accordance with the procedure established by the Government of the Russian Federation.
7. For persons with secondary vocational education in the field, on the decision of the Academic Council of a higher educational institution higher professional education is allowed for reduced or accelerated educational program of higher professional education.

9. Educational and industrial practices, provided for State educational standards higher and postgraduate vocational education, is carried out on the basis of agreements between universities and enterprises, institutions and organizations, in accordance with which these enterprises, institutions and organizations irrespective of their organizational-legal forms required to provide places for internship students of higher educational establishments, state-accredited and funded by the corresponding budget.
10. the State attestation requirements (graduation work, State exams, theses) are determined by the State educational standards of higher and postgraduate vocational education. Monitoring of the implementation of these requirements is carried out in accordance with the procedure established by law.
Article 12. Management of higher educational institution 1. The Office of an institution of higher education is carried out in accordance with the legislation of the Russian Federation, model provision of educational institution of higher professional education (higher education institution) and the Statute of the institution of higher education on the principles of combining unity and collegiality.
Higher education institution Charter was adopted by the general meeting (Conference) of teachers, academics, as well as other categories of employees and students of a higher educational institution (hereinafter General meeting (Conference).
Military educational institutions operate in accordance with the legislation of the Russian Federation.

2. General management of State or municipal institution carries out an elected representative body-the Scientific Council.

The statutes of the institutions of higher education can be provided for the establishment of Guardianship Councils.
3. Direct management institution of higher education carries out the Rector. Rector of the State or municipal institution of higher learning in the order established by the Charter of the University, elected by secret ballot at a general meeting (Conference) for a period of up to five years and alleged in the post body of the education administration in charge of institution of higher education.

Article 13. Research and other organizations and institutions in the system of higher and postgraduate vocational education in higher and postgraduate vocational education in accordance with the legislation of the Russian Federation may be created and operate scientific-research and design institutes, design bureaus, plants, factories, companies, educational and experimental farms, clinical medical education base of education institutions, experimental stations and other organizations and institutions dealing with education and is aimed at achieving.
Article 14. Association of legal entities (associations, unions) in higher and postgraduate vocational education 1. 3. Association of legal entities (associations, unions) in higher and postgraduate vocational education, having the status of legal persons and licenses, are eligible for tax benefits, designed for educational institutions in the Education Act of the Russian Federation.
4. the Office of the Association of legal entities (Association Union) in higher and postgraduate vocational education is carried out in accordance with the legislation of the Russian Federation and the constituent documents of the specified associations (associations, Union).
Article 15. Public organizations and public associations in higher and postgraduate vocational education 1. Public organizations and public associations in higher and postgraduate vocational education act in accordance with the legislation of the Russian Federation.
2. the interests of students of higher educational institutions may submit public organizations attending. The specific relationship of the administration of the institution of higher learning and social organizations of students in higher educational establishments shall be as designated by the statutes and the agreement between his administration and the students.
3. In the system of higher and postgraduate vocational education can be created without formation of legal entities-public associations of the type teaching associations of higher education institutions, scientific-methodological, scientific and technical and other boards and commissions.
4. public associations are created by State education authorities and conduct their activities in accordance with the regulations approved by the Government. Model provisions on public associations are approved by the Federal (Central) management body of higher professional education. The composition of the public-public associations on a voluntary basis includes scientific and pedagogical and other employees of higher educational establishments, employees of enterprises, institutions and organizations operating in the system of higher and postgraduate vocational education. Public associations may involve the participation of foreign citizens, persons without citizenship and foreign legal entities in accordance with the legislation of the Russian Federation.
5. Public Administration higher professional education, scientific councils of higher educational institutions to consider and take into account the recommendations in their activities of public organizations and public associations in higher and postgraduate vocational education.
6. Public administration education and municipal education authorities have the right to support social organizations and public associations in higher and postgraduate vocational education.
7. in order to facilitate the preparation of specialists with higher professional education, promotion of scientific research, as well as to support the individual higher education institutions funds may be established for the support and development of higher and postgraduate vocational education as not having membership non-profit organization. The procedure for the establishment and status of said funds shall be determined by the civil legislation of the Russian Federation.
Chapter III. SUBJECTS of academic and scientific activities in higher and postgraduate vocational education, their rights and responsibilities Article 16. Students at higher educational institutions 1. A student at a higher education institution is the person in the prescribed manner added in institution of higher learning for training.
A student of the higher educational institution are given free with student ID and record book of the established sample.
2. in addition to the principles enshrined in the Education Act of the Russian Federation the rights of students of higher educational establishments have the right to: 1) choose optional (optional for this direction (specialty) training and elective (elected by mandatory) courses offered by the respective faculty and faculty;

2) participate in shaping the content of their education, subject to the requirements of State educational standards of higher vocational education. This right may be restricted by the terms of the contract concluded between the student higher educational institution and the natural or legal person providing him with assistance in obtaining education and subsequent job placement;
3) master in addition to courses on selected areas of training (professions) any other subjects taught at this institution of higher education, in accordance with its Statute, and also taught at other institutions of higher education (by agreement between their leaders);
4) participate in discussing and addressing critical issues of higher education institutions, including through community organizations and governing bodies of higher education institutions;
5) free use in public institutions of higher education libraries, information services, educational foundations, scientific, medical and other units of the higher educational institution in the manner prescribed by the Statute of a higher educational institution; take part in all kinds of research papers, conferences, symposia;
6) to submit their work for publication, including the publications of the higher educational institution;
7) appeal against the orders and instructions of the administration of a higher educational institution in the manner prescribed by the legislation of the Russian Federation;
8) receive military education specialty in the manner prescribed by the legislation of the Russian Federation;
9) move from tuition fees to free in the order specified by the Charter of a higher educational institution.
3. Students of public, municipal institutions of higher learning enrolled on full-time education (hereinafter referred to as full-time students) and receiving education at the expense of the corresponding budget, provided scholarships in the amount of the Federal law of double the minimum wage. Students with category I or II disabilities, orphans and children deprived of parental care, the size of the scholarship is increased by fifty percent. The procedures for the appointment and payment of scholarships shall be established by the Government of the Russian Federation. Students can receive scholarships assigned by them to the training of legal or natural persons, as well as scholarships on the basis of the relevant provisions.
Full-time students of public, municipal institutions of higher education are allocated additional funds at the expense of the respective budgets to assist needy students in the amount of five percent of the Endowment provided in the prescribed manner to the costs of the relevant budgets, as well as additional funds are allocated in two months scholarship funds for the Organization of cultural-mass and sports and work with students, their sanatorium-and-spa treatment and rest.
Full-time students of public, municipal institutions of higher education is issued to food supplement per person for each calendar day is less than two per cent of the established federal statutory minimum wage, the right to free travel by rail once a year back and forth.
Nonresident students and full-time postgraduate students of public, municipal institutions of higher education, students in full-time education (hereinafter referred to as the full-time graduate students) is also entitled to free travel by rail once a year back and forth or bus transport in the absence of rail service; students residing in regions of the far North and similar areas, in Siberia and the far East, by air once a year back and forth.
On medical grounds and in other exceptional cases, a student of the higher educational institution is given a sabbatical in the manner laid down by Federal (Central) organ of management education.
Full-time students studying in higher educational establishments, deferred from military service while studying in accordance with federal law.
Students in higher education are entitled to free use of services of public and municipal libraries, as well as free access to State and municipal museums.
For full-time students and full-time part-time (evening) forms of learning not less than twice a school year holidays are installed with a total duration of not less than seven weeks.
Each pupil in need living space must be ventilated adequately meet sanitary standards and rules of a place in a hostel with a housing stock of a higher educational institution. The fee for accommodation, utilities and household services for students at the expense of the corresponding budget may not exceed five per cent of scholarships.

If there are students in need living space, you cannot use not as intended is a member of the higher education institution housing groundspace residences (lease and other transactions) as well as the use, leading to its reduction.
With each students living in a dormitory, a contract, a typical form of which shall be approved by the Federal (Central) management body of higher professional education.
Other law students may be established by legislation and (or) the Charter of a higher educational institution.
4. A student has the right to reinstatement at a higher education institution within five years after the expulsion of it of his own volition or for good reasons with saving the Foundation training (free or paid), in accordance with which he studied before deductions.
The procedure and conditions for the restoration of the high school student had been expelled, distortion is determined by a higher education institution Charter.
5. Student of the higher educational institution has the right to obtain from the administration of an institution of higher education information on the employment situation of the population of the Russian Federation.
6. Students in higher education are guaranteed the freedom of moving to another institution of higher education in the manner laid down by Federal (Central) organ of management education. When switching from one higher education institution to another for a student retains all the rights as per students for the first time at the level of higher professional education.
7. For successes in study and active participation in scientific-research work of students of higher educational establishments receive moral and (or) material incentives in accordance with the Charter of the higher educational institution.
8. Students in higher education are obliged to acquire expertise, to implement within the prescribed time limits all sorts of tasks, provided by the curriculum and educational programs of higher professional education, abide by the Charter of the University, the internal regulations and rules of the hostel.
9. For a violation of student responsibilities under the Charter of the higher educational institution and its rules, internal regulations, it may be subject to disciplinary action up to and including expulsion from the institution of higher learning.
Disciplinary action, including expulsion, may be imposed on a student of the higher educational institution after receiving an explanation in writing.
Disciplinary action shall apply not later than one month from the date of discovery of misconduct and no later than six months from the date it occurred, not counting the time student illness and (or) find it on vacation. It is not allowed to expel students during their illness, vacations, academic leave or maternity leave.
10. The student status of non-governmental higher education institution whose State accreditation in respect of academic rights and academic freedom is equated to the status of State higher educational institution student, except the right to receive State scholarships. The student status of non-governmental higher educational institution, which has no State accreditation is defined by the Charter of the institution of higher learning.
Article 17. Benefits provided to persons combining studies in high school with work 1. Persons who successfully studying at state-accredited institutions of higher education regardless of their organizational-legal forms of part-time and full-time part-time (evening) forms in the workplace are provided additional leave with retention of accrued average salary in accordance with the procedure established for annual leave (with the possibility of attaching additional to sabbatical leave annual leave) for: putting tests and examinations in the first and second years respectively on forty calendar days future courses respectively on fifty-calendar days;
preparation and protection degree project (work) with State examinations for four months;
putting public examination one month.
2. additional leave without pay in the workplace are provided: persons admitted testing for entrance to institutions of higher education, fifteen calendar days;
listeners of preparatory departments in higher education institutions for putting the final fifteen calendar days;
for tertiary students full-time, combining study with work, to pass tests and examinations fifteen calendar days in a school year; to prepare and defend graduation project (work) with State examinations for four months; to pass State examinations one month.
3. Students studying by correspondence in higher educational institutions, which have State accreditation, once a school year the contracting employer pays for travel to the location of a higher educational institution and back to perform laboratory work, tests and examinations, as well as to pass State examinations, training and protection of the diploma project (work).

4. form help-call, giving the right to grant additional leave in the workplace and other benefits relating to education in institution of higher education that have State accreditation, shall be approved by the Federal (Central) management body of higher professional education.
5. For employees of enterprises, institutions and organizations irrespective of their organizational-legal forms and forms of ownership, combining studies in higher education with work, collective agreement or employment contract (contract) may provide for the extension of the duration of additional leave, leave of absence with pay in lieu of leave without pay and other benefits.
6. enterprises, institutions and organizations of workers on full-time and full-time part-time (evening) forms of training are exempt from taxes on the amount of funds that are spent on students, referred to in this article and article 19 of this federal law.
7. When teaching students combining study with work simultaneously in two higher education establishments, the above benefits may only take place on one of these institutions of higher education (student's choice).
Article 18. Listeners of the institutions of higher and postgraduate vocational education 1. Listeners of the institutions of higher and postgraduate vocational education are persons studying in institutions of higher learning: preparatory departments, faculties (departments) of qualification improvement and retraining workers;
another institution of higher education if they are parallel to get second higher education;
residency or internship medical higher educational establishments.
2. status of listeners institutions of higher and postgraduate vocational education in obtaining educational services is equivalent to the status of students in higher educational establishments appropriate forms of training.
Article 19. Doctoral students, post-graduate students and competitors 1. Doctoral student is a person with a PhD degree and added for doctoral studies for the preparation of theses for the degree of doctor of science.
2. Graduate student is a person having higher professional education and learning in graduate school and prepares the dissertation on competition of a scientific degree of candidate of Sciences.
3. the Applicant is a person having higher professional education, attached to the organization or agency who have post-graduate and/or doctoral studies and prepares the dissertation on competition of a scientific degree of candidate of Sciences without training in graduate school, or a person holding a PhD degree and prepares the dissertation on competition of a scientific degree of the doctor of Sciences.
4. the provisions of doktorantah, about aspirantah and the applicant shall be approved by the procedure established by the Government of the Russian Federation.
5. persons admitted for entrance tests to graduate school are granted leave of thirty calendar days with the retention of the average wage in the workplace.
6. Persons studying in graduate school for full-time education at the expense of the budget, the Government provided scholarships and enjoyed holidays annually for a period of two months.
7. Graduate students enrolled in postgraduate study on the correspondence form of training are entitled to annual additional leave in the workplace for a period of thirty calendar days from the persistence of the average wage.
Additional postgraduate annual leave is added to the time taken to travel from place of employment to the place of location of the graduate school and vice versa with the retention of the average wage. The specified travel pays the employer organization.
Graduate students enrolled in postgraduate study on the correspondence form of training, are entitled to one free respectively from work day per week paid at the rate of fifty per cent of the wages, but not lower than the Federal minimum wage law. The employer organization may provide Graduate students in their fourth year optional advanced training no more than two work-free days a week without pay.
Graduate students studying in the postgraduate course by distance learning, in residence are available for the period exams and perform work on the thesis.
8. citizens, receiving postgraduate vocational training in state-accredited public universities and scientific institutions licensed to conduct educational activities on educational programs, postgraduate professional training available deferment from military service for the period of study and protection of qualifying works.
9. Students are paid to State scholarships and are granted annual vacation for a period of two months.
For doctoral candidates, retains all rights in the workplace, which they had prior to enrolling in a doctorate (law on obtaining residential space on the attribution of academic titles and other rights), as well as the right to return to their former places of work.

10. Graduate students and doctoral students enjoyed free equipment, laboratories, teaching rooms, libraries, as well as the right to travel, including universities and research centers of foreign countries, participation in expeditions for scientific research selected topics on an equal footing with scientific and pedagogical workers of higher educational institutions and scientists research institutions (organizations).
11. For the acquisition of scientific literature each graduate students and doctoral student, trainee at the expense of the budget, you will receive an annual allowance equal to two monthly scholarships.
12. To complete dissertations on competition of a scientific degree of candidate of Sciences or Ph.d. to employees of enterprises, institutions and organizations in the workplace are granted leave with pay for a period of three or six months respectively, in the manner prescribed by the regulations for the aspirantah, doktorantah and aspiring candidates.
13. Competitors working on dissertations on competition of a scientific degree of the doctor of Sciences and having significant scientific results on current socio-economic problems or priority areas of basic research, can be transferred to the post of scientists for up to two years for the preparation of theses for the degree of doctor of science. For applicants, translated into positions of researchers retained their salaries and the right to return to their former places of work.
Article 20. Employees of higher educational institutions 1. In higher education provides for the post of scientific-pedagogical (teaching staff, researchers), engineering, technical, administrative, productive, educational support and other staff.
To teaching posts include Dean, head of Department, Professor, Associate Professor, senior lecturer, lecturer, Assistant.
2. replacement of all posts of scientific and pedagogical workers in higher education, with the exception of the posts of Dean and head of Department, is made under an employment contract entered into for a term not exceeding five years. At replacement of posts of scientific and pedagogical workers of conclusion of a labour agreement (contract) precedes the selection. The regulations on the procedure for the substitution of these positions shall be approved by the Federal (Central) management body of higher professional education.
The post of the Dean, the head of the Chair are elected. The election procedure for these posts is determined by the statutes of the institutions of higher education.
3. State and municipal higher education institutions rectors, Vice-Rectors, deans of faculties, heads of departments, heads of branches and institutions are replaced by persons aged sixty-five years regardless of the time of the conclusion of labour agreements (contracts). The persons occupying these posts and have reached this age are transferred with their consent to the other positions that match their skills.
Vice-Rectors are employed under a fixed-term employment agreement (contract). The duration of a fixed-term employment contract (contract) concluded with the Provost of higher educational institution, coincide with the expiration of the powers of the Rector.
On presentation of the Academic Council of a higher educational institution founder (founders) shall be entitled to extend the term of Office of the Rector until the child reaches the age of seventy years.
For other posts under this paragraph, the extension of a specified period before attaining the age of seventy years, may be exercised by the Rector on presentation of the Academic Council of a higher educational institution.
4. Scientific and pedagogical workers of higher educational establishments have the right to: 1) in the prescribed manner to elect and be elected to the Scientific Council of the University;
2) to participate in the discussion and resolution of issues relating to the work of the University;
3) use free libraries, information services, foundations, academic and scientific units, as well as social services, medical and other structural subdivisions of the higher educational institution in accordance with its Statute and (or) the collective agreement;
4) determine the content of training courses in accordance with State educational standards higher and postgraduate vocational education;
5) to choose methods and means of training that best meet their individual needs and provide high quality of educational process;
6) appeal against the orders and instructions of the administration of a higher educational institution in the manner prescribed by the legislation;
7) on organizational and logistical support for their professional activities.
5. Scientific and pedagogical workers of higher educational establishments are obliged to: 1) ensure high efficiency of pedagogical and scientific processes;
2) abide by the Charter of a higher educational institution;

3) form the students professional skills for the chosen direction (specialty) training, active citizenship, ability to work and live in conditions of modern civilization and democracy;
4) students develop autonomy, initiative, creativity;
5) systematically to raise their qualifications.
6. scientific workers of higher educational establishments have the right to choose methods and means of research, meet the security measures that best correspond to their individual peculiarities and to ensure high quality of the scientific process. Researchers are obliged to abide by the Charter of a higher educational institution.
7. the rights and duties of administration, engineering, technical, production, support and other staff of higher educational institution are determined by labour legislation of the Russian Federation and the Charter of the University, the internal regulations of the higher educational institution and job descriptions.
Article 21. Training and improving of professional skill of scientific and pedagogical workers 1. Preparation of scientific and pedagogical workers is carried out postgraduate study and doctoral studies in higher educational establishments, scientific institutions or organizations, as well as by attaching to those agencies or organizations applicants for preparation and protection of dissertations on competition of a scientific degree of candidate of Sciences or Ph.d. or through the redeployment of teachers for positions of research workers for the preparation of dissertations on competition of a scientific degree of the doctor of Sciences.
2. the State guarantees the necessary conditions to improve the skills of not less than once in five years of scientific and pedagogical workers of public institutions of higher education and of scientific and pedagogical workers of the State scientific institutions and organizations operating in the system of higher and postgraduate vocational education by allocating the necessary funds for this purpose at the expense of the federal budget.
Improvement of professional skill of scientific and pedagogical workers may also be on contracts concluded by natural and/or legal persons with higher educational institutions and scientific organizations or institutions at the expense of natural and/or legal persons.
3. Order types and forms of training in the part not regulated by the legislation of the Russian Federation, shall be established by the Government of the Russian Federation.
Article 22. Titles 1. In the Russian Federation establishes the academic titles of Professor and Assistant Professor.
2. Professor can be assigned to a person who, as a rule, the degree of doctor of Sciences, teaching, scientific and methodological work in the field of higher and postgraduate vocational education.
3. Academic rank of Assistant Professor may be assigned to a person who, as a rule, PhD degree, teaching, scientific and methodical work in institutions of higher learning.
Article 23. Recognition and establishment of equivalence of foreign States on higher and postgraduate vocational education and academics titles 1. Under the recognition of documents of foreign States on higher and postgraduate vocational education and ranks of scientists in the present Federal law refers to the consent of the relevant State authorities on the presence of void of these documents on the territory of the Russian Federation.
2. establishing the equivalence of foreign States on higher and postgraduate vocational education and ranks of scientists in the present Federal law means providing relevant government authorities to the holders of these documents the same academic and/or professional rights as holders of the documents of the Russian Federation State standard on higher and postgraduate vocational education and academics titles.
3. recognition and establishing equivalence of foreign States on higher and postgraduate vocational education do not absolve the holders of these documents from the General requirements for admission to educational establishments or to employment (including conditions of proficiency in the State language), which established the relevant provisions.
4. the decision on the recognition and the establishment of equivalence of foreign States on higher and postgraduate vocational education and ranks of scientists accepted Federal (Central) management body of education on the basis of relevant international agreements of the Russian Federation.

5. The procedure for the recognition and establishment of equivalence of foreign States on higher and postgraduate vocational education and academics titles, the issue of certificates of establishing equivalence is determined by Federal (Central) management body of higher professional education. Recognition and establishment of equivalence of foreign States on higher and postgraduate vocational education and academics titles confirmed by certificates issued by the Federal (Central) management body of higher professional education.
Chapter IV. The MANAGEMENT SYSTEM of HIGHER and postgraduate vocational education Article 24. The competence of the Russian Federation in the field of higher and postgraduate vocational education 1. The competence of the Federal Assembly of the Russian Federation in the field of higher and postgraduate vocational education include: 1) drafting of legislation, the adoption of federal laws in the field of higher and postgraduate vocational education and changes in relevant laws and amendments thereto;
2) approval of the federal programme for the development of education and monitoring of its implementation in the part relating to higher and postgraduate vocational education;
3) approval of the relevant articles of the federal budget and overseeing their implementation;
4) establishing levels of higher and postgraduate vocational education;
5) ratification of international treaties of the Russian Federation governing issues higher and postgraduate vocational education, in accordance with the legislation of the Russian Federation.
2. the competence of the Government of the Russian Federation in the field of higher and postgraduate vocational education include: 1) participate in the formulation and implementation of State policy in this area;
2) preparation of relevant sections of the federal programme for the development of education and monitoring the executive authorities;
3) implementation of budgetary financing of higher and postgraduate vocational education;
4) drafting and adoption in accordance with normative legal acts determining the functioning of the system of higher and postgraduate vocational education;
5) establishment licensing activities of higher education institutions, their certification and State accreditation;
6) creation, reorganization and liquidation of public higher education institutions under the jurisdiction of the Russian Federation, subject to the concurrence of the legislative and executive authorities of the constituent entities of the Russian Federation;
7) conclusion and implementation of intergovernmental treaties regulating questions of higher and postgraduate vocational education;
8) determine the procedure for development, approval and introduction of State educational standards of higher and postgraduate vocational education, except for the cases stipulated by the legislation of the Russian Federation;
9) determine the order establishing the list of directions (specialities), higher and postgraduate vocational education.
3. the competence of the Federal (Central) management body of higher professional education are: 1) development and implementation, jointly with other federal education authorities of the relevant sections of the Federal programme for the development of education and international programmes in the field of higher and postgraduate vocational education, appropriate additional education;
2 federal approval of relevant components) State educational standards, approval of the regulations on the final State certification students and about jeksternate in State and municipal establishments of higher education;
3) elaboration and approval of sample curricula and educational programs of higher and postgraduate vocational education, organisation of the publication of educational literature and production of teaching and Visual AIDS;
4) exercise of the powers of the founder (founders) subordinated State higher educational institutions;
5) contribute to the development and implementation of effective new learning technologies in the field of higher and postgraduate vocational education;
6) licensing of institutions of higher education regardless of their organizational and legal forms and public educational institutions of the corresponding supplementary education, as well as their State accreditation;
7) establishing forms of Government issued documents on higher and postgraduate vocational education, the implementation of the recognition and establishment of equivalence of foreign States on higher and postgraduate vocational education and academics titles;
8) determine the order of recognition and establishing equivalence of foreign States on higher and postgraduate vocational education and academics titles, issuing certificates of establishing equivalence of these documents;

9) involved in studying the needs of the labor market for specialists; forecasting training; elaboration of proposals for the volume of budgetary financing of higher education institutions, other enterprises, institutions and organizations active in the field of higher and post-graduate professional and appropriate additional education, as well as scientific organizations and their structural subdivisions; elaboration of proposals for the volume of capital construction of these enterprises, institutions and organizations;
10) participation in the work of the federal bodies of executive power on the determination of budget funding allocated to training, retraining and improvement of professional skill of scientific and pedagogical workers, employees, including researchers, development of science, as well as participation in the development of federal regulations and funding of educational institutions;
11) coordination of the activities of higher educational establishments, industry and regional systems of higher and postgraduate vocational education, by definition, scope and structure of the training, organization of intersectoral and interregional cooperation in this field;
12) the setting of General admission and reception structures for training in higher educational institutions and institutions of higher professional education students, postgraduates and doctoral students;
13) opening of postgraduate and doctoral studies public higher educational institutions, scientific organizations, regardless of their affiliation, except for agencies operating in the system of the Russian Academy of Sciences and academies with State status, approval of the regulations on the preparation of scientific and pedagogical workers, including researchers;
14) establishing the order of reception of citizens in public institutions of higher education established by federal bodies of executive power, and order the transfer of students from one higher education institution to another;
15) forecasting the development of a network of institutions of higher professional education, coordination of the creation of new public institutions of higher professional and appropriate additional education;
16) organizing participation of higher education institutions and scientific organizations in the system of higher and postgraduate vocational education in federal scientific and technological programmes, development and approval of Interuniversity programmes on priority directions of science, implementation of resourcing these programmes and monitor their implementation;
17) development and implementation, jointly with trade unions and public organizations measures for the social protection of students, graduate students, doctoral students, trainees and workers of higher and postgraduate vocational education to improve their education, labor, welfare, recreation and medical services;
18) financing activities under its higher education institutions, enterprises, institutions and organizations;
19) harmonization of normative documents in the field of higher and post-graduate professional and appropriate additional education, issued by the federal authorities in charge of institutions of higher learning, and, if necessary, suspension of the specified normative documents;
20) implementation in consultation with the federal authorities responsible for higher education the authority to order the State property in the system of higher and postgraduate vocational education;
21) approval of the regulations on the procedure of succession of scientific and pedagogical staff;
22) development and adoption of the model provisions on branches of higher educational institutions under the jurisdiction of the federal executive authorities, organization of these branches;
23) publication within the limits of its competence, normative acts;
24) conclude international treaties interdepartmental nature, in accordance with the legislation of the Russian Federation.
4. the competence of the State attestation services include: 1) monitoring compliance with State educational standards in all state-accredited institutions of higher education regardless of their organizational and legal forms;
2) scientific-methodical maintenance of final certification and quality control of training upon completion of each level and step of higher and postgraduate vocational training in accordance with State educational standards higher and postgraduate vocational education;
3) consideration of the submissions and decide on the direction of higher educational institution of complaints on the quality of education and (or) non-conformity education requirements of the State educational standard;
4) organization functioning system of regional bodies of State certification and service certification of educational institutions.

Article 25. Chapter v. ECONOMICS of HIGHER and postgraduate vocational education Article 27. Property relations in the system of higher and postgraduate vocational education 1. For an institution of higher education in order to ensure activities under its Statute, the founder (founders) enshrines the right of operative administration buildings, property complexes, equipment, and other necessary equipment for consumer, social, cultural or any other destination.
2. Institution of higher education shall have the right of ownership of funds, assets and other property submitted to it by individuals and legal entities in the form of a gift, donation or bequest, the products of intellectual and creative work, resulting from the activities of an institution of higher education, as well as the income from its own activities and acquired at these income property.
3. For State and municipal institution of higher education in the indefinite allocated free of charge in accordance with the established procedure plots.
4. Institution of higher education shall have the right to act as a tenant and (or) the lessor of the property. Letting public municipal institution of higher learning reserved properties, as well as land is without foreclosures, with the consent of the Academic Council of a higher educational institution at prices that can not be lower than the prices prevailing in this region.
Funds received by an institution of higher education as rent, are used for maintenance and development of the educational process.

6. the powers of the owners at the behest of the State property of higher and postgraduate vocational education on federal property is set for the Federal (Central) management body of higher professional education, exercising these powers, in conjunction with federal authorities in charge of higher education.

7. State, municipal, universities, reserved for them on the operational control or rights owned or independent possession of objects of industrial and social infrastructure, including accommodation, located in school buildings, industrial, social, cultural, as well as accommodation, located in the countryside, the hostel, clinical medical education base of education institutions located in the operational management of educational establishments or other conduct , including possession, use and (or) disposal, other enterprises, institutions and organizations working in the system of higher and postgraduate vocational education, privatisation (deregulation) will not be considered.
Article 28. Financing higher education institutions 1. Financing of the educational activities of State institutions of higher learning at the expense of the federal budget is carried out by the Federal (Central) management body of higher professional education or executive bodies in charge of these institutions, in accordance with public tasks (targets) for training, retraining and improvement of professional skill of employees on the basis of the established Government, including departmental, funding regulations.
For higher education institutions located in the regions covered by the district coefficients and allowances, funding ratios are based on the rates and allowances.
If local regulations exceed the public funding, additional funding is financed from the local budget.
2. the activities of non-State higher educational establishments financed by its founder (founders) in accordance with the contract between them. Under the agreement between founder (founders) and institution of higher education activities may be partial or complete self-financing.
3. research carried out by public institutions of higher education, are funded by the Federal (Central) management body of the higher professional education and (or) executive bodies in charge of these higher educational establishments, irrespective of funding educational activities.
4. public institutions of higher learning independently determine the direction and order of the use of funds received from the State budget and other sources not prohibited by the legislation of the Russian Federation, including funds for salaries and material incentives for their employees. Not used in the current period (year, quarter, month) may not be withdrawn from public higher education institutions or set off in funding these institutions of higher education beyond.
5. reimbursement of additional costs in connection with the indexing of the costs of higher education institutions operating budget-based financing is made at the expense of the corresponding budget.
6. Institution of higher education has accounts in banks and other credit institutions to store cash and all kinds of payment, credit and cash transactions, including currency.
Article 29. Paid activities of higher educational institution 1. Higher education institution, in accordance with its Charter, may exercise a paid activity in the field of education and in other areas, if it does not go to the detriment of its core activities.
Paid educational activities of higher educational institution may not be carried out in return, and within the framework of the educational activities financed by the budget. Otherwise the funds earned as a result of such activities, shall be the founder (founders) higher educational institution.
2. A State or municipal institution of higher education shall have the right, within the limits of the license to carry out over funded from the federal budget for public tasks (control digits) on the admission of students training in relevant treaties with payment of tuition fee physical and (or) legal entities to the extent consistent with Executive authority, the local government body in charge of this institution is located.
Higher education institution decides independently on matters of contracts, the definition of the obligations and other terms and conditions, do not contradict the legislation of the Russian Federation and the Charter of the institution of higher learning.
Article 30. Compensation of employees of the higher educational institution 1. Institution of higher education within the limits of available funds to pay employees yourself determines the shape and dimensions of the pay system charges, allowances, bonuses and other incentive measures, as well as official salaries (rates) of all categories of employees (without setting limits salaries (rates).

2. Salary (rate) paid worker of the higher educational institution for the implementation of functional responsibilities and works stipulated by the labour agreement (contract).
3. Public higher education institution alone generates payroll workers at the expense of the budget devoted to the content of higher education, and other sources not prohibited by the legislation of the Russian Federation.
4. minimum rates for teachers from among the teaching staff of higher educational establishments are set at a rate no lower than eight minimum wage established by federal law.
5. Scientific and pedagogical workers of higher educational establishments are set by the allowance to official salaries (rates): forty percent for associate;
Sixty percent for Professorship;
triple the minimum wage established by federal law, for the PhD degree;
five times the minimum wage established by federal law, for the degree of doctor of science.
6. Under article 54 of the law of the Russian Federation "on education" dimensions of average salaries (rates) of workers of higher educational institutions in the part relating to employees ' pay higher educational institution shall be established by the Government of the Russian Federation on the first day of the second month of each quarter in accordance with the legally established their relationship to the level of the average wage of workers in industry in the Russian Federation for the previous quarter.
7. average salaries (rates) of workers of the higher educational institution shall be established at the level of: for pedagogical workers from among the teaching staff of higher educational establishments-twice the level of the average wage of workers in industry in the Russian Federation;
for teachers and other educational professionals-no less than the average wage of workers in industry in the Russian Federation;
for other employees of the universities-the average wages of similar categories of workers in industry in the Russian Federation.
8. The Government of the Russian Federation within two months from the date of entry into force of this federal law to introduce the requirements of the present article tariff grid to pay workers higher educational institution.
9. Official salaries (rates) of workers of the higher educational institution are defined by each quarter in accordance with paragraphs 6, 7 and 8 of this article are minimal for the relevant categories of employees of the higher educational institution and are obligatory on the territory of the Russian Federation.
Article 31. Pay and seniority of the employees of the public administration higher and postgraduate vocational education 1. Employees of the public administration higher and postgraduate vocational education shall be counted as seniority of civil servant jobs in higher education, decision-making positions and positions of scientific and pedagogical workers.
2. Supplement for the degree provided for employees of higher educational institutions, applies to employees of the managing bodies higher and post-graduate professional education.
Article 32. Accounting, reporting and control in institutions of higher education 1. Higher education institutions in the prescribed manner exercise operational and accounting the results of its work, conduct statistical and accounting records.
2. Officials are established by the legislation of the Russian Federation to disciplinary, administrative and criminal responsibility for the distortion of public accountability.
3. Control over execution of the legislation of the Russian Federation in the area of budgetary and financial discipline in the tertiary institutions exercise legislative and executive authority within the limits of their authority.
Chapter VI. INTERNATIONAL and foreign economic ACTIVITY of HIGHER EDUCATION INSTITUTIONS, article 33. International cooperation of the Russian Federation in the field of higher and postgraduate vocational education 1. Higher education institutions have the right to participate in the international cooperation of the Russian Federation in the field of higher and postgraduate vocational education through: 1) participation in programmes of bilateral and multilateral exchange of students, graduate students, doctoral candidates, teachers and researchers;
2) conduct joint scientific research, as well as congresses, conferences, symposia and other events;
3) the implementation of fundamental and applied research, and experimental works on the orders of foreign legal entities;
4) participation in international programmes to improve higher and postgraduate vocational education.

2. Training, retraining and advanced training of foreign citizens in the Russian Federation, teaching and research work of the citizens of the Russian Federation outside the territory of the Russian Federation within the Russian Federation quotas established by the Government are carried out by interstate treaties, treaties between the Federal (Central) management body of higher professional education or departmental public body management education and the relevant education authorities of foreign States, as well as by direct contracts entered higher education institutions with foreign citizens and foreign legal entities.
3. in order to participate in the international activities of the Russian Federation higher educational establishments have the right to engage in non-governmental international organizations;
conclude contracts with foreign partners on joint activities which cannot be regarded as international treaties of the Russian Federation;
build with foreign partners subdivisions (centers, laboratories, technology parks and other units).
4. institutions of higher education in accordance with the legislation of the Russian Federation has the right to engage in foreign trade activities, under the statutes of the institutions of higher learning and designed to perform tasks that are defined by this federal law, as well as the development of international contacts.
5. Cash provided by higher educational establishments, enterprises, institutions and organizations active in the system of higher and postgraduate vocational education, as a result of foreign trade activities, is not subject to seizure and taxation, including mandatory sale when they are spent on performing basic tasks defined for the specified higher educational institutions, enterprises, institutions and organizations of the present Federal law.
Chapter VII. FINAL PROVISIONS Article 34. The entry into force of this federal law 1. The procedure for the award of degrees and awarding academic titles remains pending the enactment of federal laws.
2. invite the President of the Russian Federation and to entrust the Government of the Russian Federation to bring its legal acts in compliance with this federal law.
3. this federal law shall enter into force on the day of its official publication.
