Spconsumed by Federal Law July 07.07.2003 N 109-FZ RUSSIAN FEDERATION FEDERAL LAW On improvement of the pension provision of participants in the Great Patriotic War and servicemen killed in The Great Patriotic War, receiving pensions under the Law of the RSFSR "On State Pensions in the RSFSR" , was adopted by the State Duma on 14 April 1995 Article 1. In order to improve the pension provision of the participants of the Great Patriotic War and members of their families and in connection with the upcoming fiftieth anniversary of the Victory in the Great Patriotic War: 1. Participants in the Great Patriotic War (sub-items "a"-"f" of paragraph 1 of Part 2 of the Federal Law "O Veterans") who do not receive an old-age pension at the same time as the old age pension, set a pension supplement in the following amounts: (a) have reached the age of 80 or are disabled, I and II, the two minimum pensions, Old age; b) the rest of the Great Patriotic War-one minimum old-age pension. 2. Widows of soldiers who died in the Great Patriotic War who have not entered into a new marriage, who have the same right to different pensions under the Law of the RSFSR , pay two pensions, one of which is the survivor's pension for the deceased husband. Article 2. In accordance with article 1 of this Federal Law, the RSFSR Law on State Pensions in the RSFSR (Vedomas Congress of People's Deputies) RSFSR and the Supreme Soviet of the RSFSR, 1990, N 27, sect. 351; 1991, N 17, sect. OF THE PRESIDENT OF THE RUSSIAN FEDERATION 531; Legislative Assembly of the Russian Federation, 1994, No. 15, art. 1680) the following changes and additions: 1. Article 5 should read as follows: " Article 5. The right to choose a pension Citizens who have the right to various State pensions are appointed and paid one of them, at their choice. The right to receive two pensions is granted to: (a) citizens who have become disabled as a result of military injury (art. 41 of the Act), to the participants in the Great Patriotic War who have become disabled as a result of the general illness and the labour force injury and other causes (excluding persons whose disability is due to their wrongful acts). They may be entitled to an old-age pension (or a seniority) and a disability pension; (b) widows of soldiers who died in the Great Patriotic War who have not entered into a new marriage. They may be entitled to an old age pension (or a disability pension, a seniority pension, a social pension) and a survivor's pension for the deceased husband. ". 2. Article 21 should read as follows: " Article 21. Pension supplement The following allowances are fixed: (a) for the care of a pensioner if he is a disabled person of the group I or needs constant foreign care (assistance, supervision) at the conclusion of a medical institution or having reached the age of 80; b) for the dependent dependants (arts. 50 to 53 of the Act) if they themselves do not receive any pension. The allowance for disabled dependents is paid to non-working pensioners; in) to the participants of the Great Patriotic War (sub-items "a"-"f" of art. 2, para. 1 of the Federal Law " About Veterans") , who does not receive an old-age pension at the same time as the invalidity pension. The amount of the allowance for a pensioner if he is a disabled person in group I or has reached the age of 80 is equal to the amount of the social pension referred to in article 114 (a) of the Act. Pensionable care allowance if he is under 80 years of age and requires constant outside care (assistance, supervision) for the conclusion of a medical institution, as well as a supplement for each pensioner's dependent is equal to the amount of the social pension referred to in article 114 (b) of the Act, and to the disabled dependant of category III of the group referred to in paragraph "B" of this article. The allowance of the Great Patriotic War participants referred to in paragraph "in" part one of this article shall be fixed in the following dimensions: (a) have reached the age of 80 or are persons with disabilities I and II-two groups. Minimum old-age pensions (part one of article 17 of the Act); b) to the rest of the Great Patriotic War-one minimum old-age pension (art. 17, para. 1). ". 3. Article 38 should be amended to read: " Article 38. Pension supplement The invalidity pensions of I and II groups shall be set by the allowances provided for in paragraphs "a", "b" and "B" of article 21, paragraph 1, of the Act. The group's third disability pension is set by the paragraph "in" part one of article 21 of the Act. ". 4. Supplement the Act with article 86-1 as follows: " Article 86-1. Allowances for retirement The length of service allowance is set by the paragraph "in" part one of article 21 of the Act. ". 5. Article 110, paragraph "g", to read: "g) to the participants of the Great Patriotic War (subparas" (a) "-" of art. 2, para. 1 of article 2 of the Federal Act " About Veterans") 100 per cent of the minimum old-age pension (part one of article 17 of the Act); ".
