Lost effect with July 6, 2003 year-federal law from 27.12.2002 N 184-FZ z and c o n Russian Federation on Standardization (as amended by the federal laws of 27.12.95 N 211-FZ;

from 25.07.2002 N 116-FZ; from 01/10/2003 N 15-FZ) this Act establishes the legal framework for standardization in the Russian Federation, are binding on all public authorities, as well as enterprises and entrepreneurs (hereinafter subjects of economic activity), voluntary associations, and defines measures of State protection of consumer interests and the State through the development and application of normative documents on standardization.
Section I GENERAL PROVISIONS Article 1. The notion of standardization Standardization is an activity to establish rules, regulations and specifications (hereinafter requirements) in order to ensure the safety of products, works and services for the environment Wednesday, life, health and property;
technical and information compatibility and interchangeability of production;
the quality of products, work and services in accordance with the level of development of science and technology;
the uniformity of measurements;
saving all kinds of resources;
security installations, taking into account the risk of natural and man-made disasters and other emergencies;
Defense and mobilization preparedness of the country.
Article 2. The legislation of the Russian Federation on standardization in the field of standardization of Relations regulated by the present law and issued in accordance with the legislative acts of the Russian Federation.
This law does not regulate the relations associated with State educational standards and State standards for social services. (As amended by federal law from 10.07.2002 N 87-FZ), Article 3. International treaties if an international treaty of the Russian Federation stipulates other rules than those contained in the legislation of the Russian Federation on standardization, rules of the international treaty shall apply.
Article 4. Organization of standardization 1. State administration of standardization in the Russian Federation, including the coordination of the activities of State bodies of the Russian Federation, interaction with the authorities of the Russian Federation republics, krais, oblasts, autonomous oblast, autonomous counties, cities, and public associations, including the technical committees on standardization, with subjects of economic activities are overseen by the Committee of the Russian Federation on standardization, metrology and certification (Gosstandart of Russia).
Gosstandart of Russia creates and implements State policy in the field of standardization, exercises State supervision and monitoring of compliance with the mandatory requirements of State standards, participates in the International (regional) standardization, training and retraining in the field of standardization, and lays down rules for the application of international (regional) standards, rules, norms and recommendations on standardization on the territory of the Russian Federation, unless otherwise stipulated by international treaties of the Russian Federation.
Other governmental bodies engaged in standardization work within the limits of their competence.
Business entities, including public associations, organize and conduct of standardization work in accordance with this law.
2. Gosstandart of Russia in accordance with the present law establishes the State standards of the State standardization system common organizational and technical regulation of standardization, the forms and methods of interaction between subjects of economic activities with each other, with government authorities.
Article 5. International cooperation in the field of standardization of Gosstandart of Russia the right to represent the Russian Federation in international (regional) organizations carrying out activities in standardization.
Section II NORMATIVE DOCUMENTS on STANDARDIZATION and application Article 6. Normative documents on standardization and requirements 1. To normative documents for Standardization operating in the territory of the Russian Federation in cases, on such terms and conditions as established by the present law include: the national standards of the Russian Federation (hereinafter-State standards); applied in accordance with the established procedure of international (regional) standards, rules, norms and recommendations on standardization policies; Russian classifiers of technical-economic information;
standards of industries; standards of enterprises; standards of scientific, engineering societies and other associations.
Under the industry in this law refers to the totality of economic entities irrespective of their affiliation and forms of ownership developing and/or producing (carrying out work and providing services) of certain species that have a homogeneous consumer or functional purpose.
2. the requirements established by normative documents for standardization should be based on modern science and technology, international (regional) standards, rules, regulations and recommendations on standardization, progressive national standards of other States, to take into account the conditions of use of the product, the execution of works and rendering of services, conditions and modes of work and does not infringe upon regulations established by legislative acts of the Russian Federation.
3. Normative documents on Standardization of products and services is to be in accordance with the laws of the mandatory certification must contain requirements that are mandatory certification, modalities for monitoring for compliance with these requirements, labeling of products and services, information on the certification requirements to be included in the documentation.
Normative documents on standardization, taken by federal bodies of executive power and install or have installed fire safety requirements, are subject to mandatory consultation with the State fire-prevention service of the Ministry of the Russian Federation for civil defence, emergencies and elimination of consequences of natural disasters. Article 7. State standards, all-Russian classifiers of technical-economic information 1. State standards are developed for products, works and services with intersectoral value, and must not contradict the legislation of the Russian Federation. State standards should contain: the requirements to production, works and services for their environmental security Wednesday, life, health and property, fire safety requirements, safety requirements and industrial sanitation; (As amended by the Federal law of 27.12.95 N 211-FZ) requirements on technical and information compatibility and interchangeability of production;
basic consumer (operating) characteristics of products, methods of their control, the requirements for packing, marking, transportation, storage, use and disposal of the products;
rules and regulations to ensure the technical and informational unity in the development, manufacture, use (exploitation) of products, performance of works and provision of services, including the rules of drawing up technical specifications, tolerances and fits, common rules on the quality of products, works and services, conservation and management of all types of resources, terms and their definitions, symbols, metrological and other general technical and organizational-technical rules and norms.
To ensure public protection of interests of the Russian Federation and the competitiveness of domestic products (services) in the State standards in justified cases establishes prerequisites for the future, ahead of traditional technologies.
Content requirements of State standards, their distribution, their scope and the date of their introduction are determined by State authorities who implement them.
2. The requirements set by State standards to ensure the safety of products, works and services for the environment Wednesday, life, health and property, to ensure the technical and informational compatibility, interchangeability of products, methods of their control and unity unity labelling and other requirements established by the legislation of the Russian Federation are required to comply with State authorities, subjects of economic activities.
Conformity of production and services to the requirements of State standards is determined in the manner prescribed by the legislation of the Russian Federation on certification of products and services.

Other requirements of State standards to production, works and services subject to mandatory observance of subjects of economic activities by virtue of a contract or in the case referred to in the technical documentation of the manufacturer (supplier) of products, works or services. That the products and services the requirements of State standards can be determined in the manner prescribed by the legislation of the Russian Federation on voluntary certification of products and services.
3. conformity of production and services requirements of State standards can be confirmed through marking of products and services of the mark of conformity to state standards.
The form of the mark of conformity to state standards, the procedure of marking this sign sets the Gosstandart of Russia. 4. In accordance with this law, public standards and all-Russian classifiers of technical-economic information takes Gosstandart of Russia, and in the field of construction and building materials industry-Russian Federation State Committee on architecture and construction (Gosstroy).
State standards are put into effect after their State registration in Gosstandart of Russia.
5. the procedure for development, approval, operationalization, implementation and conduct of classifiers-economic information sets the Gosstandart of Russia.
Article 8. Standards of industries, standards of enterprises, scientific and technical standards, engineering societies and other voluntary associations 1. Standards of industries could be developed and accepted by government authorities within their competence in order to ensure that the requirements referred to in article 1 of this Act in relation to production, works and services industry values.
Standards of industries must not violate the requirements of State standards.
Responsible for compliance with the mandatory requirements of the industries standards national standards lies with their host Governments.
Procedure for development, approval, registration, application, monitoring compliance with the mandatory requirements, change and cancellation set state standards industries standards State Standardization System.
2. Standards of enterprises can be developed and approved by the enterprises themselves, on the basis of the need for their application in order to ensure that the requirements referred to in article 1 of this law, as well as to improve the Organization and management of production.
Standards of enterprises are subject to mandatory observance of other economic entities, if the contract for the design, manufacture and supply of products, execution of works and rendering of services, reference is made to these standards.
3. scientific and Technical Standards, engineering societies and other voluntary associations are developed and accepted by these associations for the dynamic dissemination and use obtained knowledge in various fields of research and development. 4. the procedure for development, approval, registration, modification and cancellation of standards stakeholders set on their own in accordance with this law.
5. standards of business entities must not violate the requirements of State standards.

Article 9. Application of normative documents for Standardization 1. Normative documents on standardization should be applied to public administrations, business entities, development phases of production to the production, manufacture, implementation (delivery, sales), use (exploitation), storage, transportation and disposal, when carrying out works and rendering of services, when developing technical documentation (construction, technological, design), including technical specifications, catalog sheets for the products (services).

2. The customer and the contractor are obliged to include in the Treaty a condition of conformity of products, works and services performed the obligatory requirements of State standards.
3. Need to apply normative documents on Standardization of products (services) produced (provided) on the territory of the Russian Federation with a view to exportation from its territory is determined by the contract (Agreement), except in cases established by the legislation of the Russian Federation.

Article 10. Information on normative documents on standardization, their publication and implementation 1. Official information on developed and adopted state standards, all-Russian classifiers of technical and economic information, as well as those State standards and all-Russian classifiers must be accessible to users, including foreign ones, to the extent that they do not constitute State secrets.
2. Gosstandart of Russia shall arrange for the publication of official information about State standards, all-Russian classifiers of techno-economic information, international (regional) standards, rules, regulations and recommendations on standardization, national standards of other States, as well as information on international treaties in the field of standardization and the rules for their application; creates and maintains a Federal Fund of governmental standards and classifiers-economic information, as well as international (regional) standards, rules, norms and recommendations on standardization, national standards of foreign countries. 5. the exclusive right of official publication of information contained in All products and services made in the State Register of the products and services bearing the mark of conformity to state standards, belongs to Gosstandard of Russia.
Title III, STATE control and supervision OVER COMPLIANCE with the REQUIREMENTS of STATE STANDARDS of Article 11. State control and supervision 1. State control and supervision over observance of subjects of economic activities of the mandatory requirements of State standards is performed on the stages of the development, production, manufacture, implementation (delivery, sales), use (exploitation), storage, transportation and disposal, as well as at performance of works and provision of services.
2. the procedure for State control and supervision over compliance with the requirements of State standards sets Gosstandart of Russia in accordance with the legislation of the Russian Federation.
3. officials of economic entities are obliged to create all the conditions necessary for the exercise of supervision and control.
Article 12. Bodies of State control and supervision

1. Bodies exercising State supervision and monitoring of compliance with the mandatory requirements of State standards are different, Gosstandart of Russia authorized public administration authorities within their competencies.
2. implementation of the State control and supervision over compliance with the requirements of State standards is conducted by officials of the public administration within the limits of their competence.
Direct implementation of State control and supervision over compliance with the requirements of State standards on behalf of Gosstandart of Russia carried out its officials, State inspectors: Chief State Inspector-General of the Russian Federation on supervision of State standards;
the main State inspectors within the Russian Federation republics, krais, oblasts, autonomous oblast, autonomous okrugs, towns on supervision of State standards;
State inspectors to oversee State standards.
Article 13. Government inspectors, their rights and responsibilities 1. Government inspectors carrying out State control and supervision of compliance with the mandatory requirements of State standards, are representatives of the Government and are under the protection of the State.
The State Comptroller has the right of free access to Office and production premises of the business entity;
receive from the business entity documents and information necessary for carrying out State control and supervision;
use the technical means and expertise of the business entity, when conducting supervision and control;
carried out in accordance with the applicable regulations on the standardization of sampling and sample products and services to monitor their compliance with the mandatory requirements of State standards with the allocation of the cost of consumed designs and cost of testing (analyses, measurements) on production costs of scanned subjects of economic activities;
to issue regulations on Elimination of revealed violations of the mandatory requirements of State standards at the stages of the development, production, manufacture, implementation (delivery, sales), use (exploitation), storage, transportation and disposal, as well as at performance of works and provision of services;
to issue regulations banning or suspension of implementation (delivery, sales), use (exploitation) proven products, as well as the execution of works and rendering of services in cases of discrepancy of production, works and services of obligatory requirements of State standards;
prohibit the sale of products, execution of works and rendering of services in case of evasion of the business entity from the presentation of products, works and services for validation.
Chief State Inspector of the Russian Federation on supervision of State standards, Chief State inspectors within the Russian Federation republics, krais, oblasts, autonomous oblast, autonomous okrugs, towns on supervision of State standards are authorized to issue the subject of economical activity provisions specified in the seventh and eighth subparagraphs of this paragraph, and shall also have the right: to make regulations about applying to subjects of economic activities of fines for violations of the mandatory requirements of State standards;
prohibit the implementation of import products and providing import services not conforming to the obligatory requirements of State standards and have not passed the State registration in accordance with the legislation of the Russian Federation.

2. in case of failure to comply with State inspectors issued their prescriptions and orders of subjects of economic activities of sending the necessary materials to the Arbitration Court, the public prosecutors or the Court for action, established by the legislation of the Russian Federation.
3. Government inspectors in carrying out their duties must protect the interests of consumers, business entities and States, guided by the law.
4. Government inspectors bear responsibility for failure to comply with established by legislation and failing to perform their duties, disclosing State or business secrets.
Section IV LIABILITY for VIOLATION of the PROVISIONS OF THIS LAW Article 14. Criminal, administrative or civil liability of legal and natural persons, as well as public administration, guilty of violating the provisions of this law, shall be borne in accordance with the current legislation of criminal, administrative or civil liability.
Title V FUNDING for STATE STANDARDIZATION, STATE CONTROL and supervision, promoting the APPLICATION of the STATE STANDARDS of Article 15. Funding for State standardization, State control and supervision 1. Compulsory public financing: development of State standards, establishing mandatory requirements in accordance with the legislation of the Russian Federation, classifiers-economic information, preparation and publication of official information about it, as well as the publication of information on the publication of these documents for its distribution to all interested users;
development and (or) participation in the development of international (regional) standards, rules, norms and recommendations on Standardization;
development of projects of legislative acts of the Russian Federation-specific standardization, as well as the development and maintenance of fundamental organizational and technical and general technical complexes standards;
research and other works on Standardization of national importance;
conducting public monitoring and supervision of compliance with the mandatory requirements of State standards;
the formation and maintenance of a Federal Fund of governmental standards classifiers-economic information, international (regional) standards, rules, norms and recommendations on standardization, national standards of other countries, as well as the public registry products and services bearing the mark of conformity to state standards;
other State standardization, defined by the Government of the Russian Federation.
2. the sources of funding for State standardization, State control and supervision of compliance with the mandatory requirements of State standards could be funds received in accordance with the established procedure of implementation published (reprinted) State standards, classifiers-economic information published (revised version) catalog of all products and services made in the State Register of the products and services bearing the mark of conformity to state standards, as well as a portion of the proceeds from the fines for violation of the provisions of this law communicated in Gosstandart of Russia. The specific amount of money channelled in Gosstandart of Russia from the proceeds of the fines for violation of the provisions of this law, establishes the legislative acts of the Russian Federation.
3. in the development of federal and other government programmes financed wholly or partially from the funds of the Republican budget of the Russian Federation, including the creation and development of production of Defense products, normative sections shall be provided to ensure the quality of products (works, services).
Article 16. Promoting the application of the State standards 1. The State guarantees the economic support and stimulation of economic agents that produce (provide services) marked a sign of conformity to state standards, including State standards with the prerequisites for the future, ahead of traditional technologies.
2. Measures of economic support and stimulate economic entities engaged in production (services) in accordance with paragraph 1 of this article shall be defined in the manner and under the conditions stipulated by legislative acts of the Russian Federation.
