The content of this act is not an official document, being intended to inform users The Romanian Parliament adopts this law + Article 1 The financing contract, hereinafter referred to as the contract, between Romania and the European Investment Bank and the National Highway and Road Company of Romania-S.A., amounting to 200 million euros equivalent, for the financing The project for the construction of the Arad-Timisoara-Lugoj highway, stage I, signed in Bucharest on December 24, 2003 and in Luxembourg on December 17, 2003. + Article 2 The implementation of the contract will be carried out by the National Company of Highways and National Roads in Romania-S.A., hereinafter referred to as C.N.A.D.N.R. ------------ Article 2 has been amended by section 2. 1 1 of art. 28 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 3 Between the Ministry of Public Finance, as a representative of Romania in relation to the European Investment Bank, on the one hand, and C.N.A.D.N.R., as the final beneficiary of the loan, and the Ministry of Transport, Construction and Tourism, as the principal authorising officer and organ coordinating the activity of C.N.A.D.N.R., on the other hand, is to conclude a subsidiary loan agreement, under which the entire authority and authority will be delegated to the C.N.A.D.N.R. responsibility for the use of the loan, project implementation and compliance obligations assumed by the contract. + Article 3 ^ 1 As of January 1, 2009, the subsidiary loan agreement provided for in art. 3 is amended as a subsidiary agreement and includes the rights and obligations of the parties in the application of the financing contract, according to the provisions art. 14 of Government Emergency Ordinance no. 64/2007 on public debt, approved with amendments and additions by Law no. 109/2008 ,, as amended. ----------- Art. 3 ^ 1 was introduced by item 1. 2 2 of art. 28 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 4 The funds needed to repay the loan, interest payments, commissions, charges and any other costs of the loan granted by the European Investment Bank, as well as the contribution of the Romanian Government to the project will be ensured from the state budget, through the budget of the Ministry of Transport, Construction and Tourism. + Article 4 ^ 1 As of January 1, 2009, the expenses related to the project, representing the expenses equivalent to the amount of the remaining amounts to be used and to draw from the loan and from the contribution of the Romanian Government to the cumulated in the budget of the Ministry of Transport, within the amounts allocated annually with this destination from the state budget. ----------- Article 4 ^ 1 has been introduced by section 4. 3 3 of art. 28 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 5 (1) The Romanian Government is authorized that, through the Ministry of Public Finance, in agreement with the European Investment Bank, to introduce during the use of the loan, in relation to the concrete conditions for carrying out the contract referred to in art. 1, amendments to its content concerning reallocations of funds, changes of deadlines, as well as any other changes that are not likely to increase Romania's financial obligations to the European Investment Bank or to determine new economic conditionings compared to those originally agreed between the parties. ((2) Amendments to the contract agreed with the European Investment Bank according to par. (1) is approved by Government decision. This law was adopted by the Romanian Parliament, in compliance with the provisions of art. 75 75 and art. 76 76 para. (2) of the Romanian Constitution, republished.
