Chapter I General Provisions



Article 1


(1) This law regulates the organization of university studies in three cycles, ie Bachelor's degree, Master's degree and doctoral studies.


(2) Each course of study is delimited by others in separate procedures for admission and graduation.


(3) Duration of the study cycles fields and specializations is determined by the Ministry of Education, the National Council of Rectors proposal, and approved by Government decision.


(4) regulated professions in the European Union by specific rules concerning the conditions of studies, these rules apply.


(5) Financing study cycles in para. (1) shall comply with provisions of the Education Law no. 84/1995, republished, as amended and supplemented.


Article 2


Organisation of each course of study is the responsibility of higher education institutions, with the approval of the Ministry of Education and Research.

Article 3


Ministry of Education together with the Ministry of Labor, Social Solidarity and Family, in collaboration with higher education institutions and social partners, correlate the educational offer of university education, based on cycles labor market needs and the development of social life.

Chapter II

cycle I - Bachelor's degree

Article 4


(1) undergraduate studies correspond to between a minimum 180 and maximum 240 transferable credits, according to the European system of transferable credits (ECTS).


(2) Under this law, the transferable credits are numerical values ​​assigned to some units of courses and other educational activities. By transferable credits is estimated, on average, the amount of labor in all its forms, made by a student to acquire a discipline.


(3) at the full, normal undergraduate studies is 3-4 years and corresponds to 60 transferable credits for one academic year. Duration Graduating technical education is 4 years.


(4) In the evening classes the duration of studies for obtaining the number of transferable credits necessary for graduation is higher than that a year of full-time education in the field.


(5) Duration of study for obtaining credits transferable to the part time and distance are regulated by Government decision.


(6) undergraduate studies provide an adequate level of qualification to practice a profession insertion in the labor market through general and specialized knowledge appropriate.


(7) Within undergraduate studies is mandatory for internships.


Article 5


(1) undergraduate studies provides knowledge and skills broad fields of study.


(2) Students who have completed undergraduate studies you can practice their profession under the appropriate skills and diplomas acquired rights, or continue university studies by Masters.


(3) The Ministry of Education regularly updates on a proposal from the National Council of Rectors, the list of areas and specialties license, approved by Government decision.


(4) Universities can organize financed from own resources and studies other than those referred to in paragraph majors. (3) under the procedures of licensing and accreditation.


Article 6


(1) Diploma awarded after completing undergraduate studies attest that the holder has acquired general knowledge and skills and specialized and specific cognitive abilities profession.



(2) allow general knowledge of the art scientific approaches that ensure understanding, innovation and creation of new knowledge and effective oral and written communication in the art and various cultural contexts.


(3) Expertise refers to knowledge processes, reproduction and understanding specific field of study taken as a whole, way of establishing relations with the knowledge of other disciplines and professional areas, familiarity with the latest developments knowledge and professional applications in the field, as well as understanding and applying fundamental principles and methods specific investigation.


(4) general responsibilities relate to:


A) collection, analysis and interpretation of data and information in terms of quantity and quality of various alternative sources, and real professional contexts of literature in the field, formulating arguments, decisions and concrete actions;


B) use different ways of written and oral communication, including in a foreign language;


C) use of information technology;


D) responsibility to develop a personal program of self-improvement;


E) the design and conduct processes specific to the field.


(5) specific cognitive skills include:


A) applying concepts, theories and methods of fundamental research in the field of study to formulate projects and professional approaches;


B) the ability to synthesize and interpret information, to solve basic problems and evaluate the possible conclusions;


C) The independent analysis of problems and the ability to communicate and prove the chosen solutions;


D) the ability to evaluate complex problems and to communicate the results of self evaluation;


E) initiative in analyzing and solving problems.


(6) specialized competences are established by regulations of each field.


Article 7


(1) undergraduate studies may be pursued through master studies.


(2) In certain areas and specializations where undergraduate studies are not pursued master's degree, graduates may opt, as determined by universities for master studies organized in other areas.




Chapter III Cycle II - Master's degree

Article 8


(1) Master studies correspond to a number of transferable credits included, usually between 90 and 120. By way of exception, depending on the length of undergraduate studies, the lower limit may be 60 credits of study transferable.


(2) at the full, normal master studies is 1-2 years and corresponds to 60 transferable credits for one academic year.


(3) Cumulative total duration of the cycle - undergraduate studies and cycle II - Master's degree must meet to obtain at least 300 transferable credits.


(4) For professions regulated by rules or recommendations or best European practices, cycle and cycle II can be offered merged into a single program of university studies lasting between 5 and 6 years at full time, under art. 1 para. (3) educational qualifications equivalent title of master.


(5) Admission to master academic studies is conditional diploma awarded after completing undergraduate studies.


Article 9


(1) Master studies are organized usually at full time.


(2) provides deepening Master studies in undergraduate studies or in a related field, research and development capabilities constitute a compulsory basis for doctoral studies.


(3) Master studies carried out in areas other than those provided in par. (2) ensures the complementary skills.


(4) Master studies may be organized by time or distance. The duration of studies for obtaining credits transferable to the part time and distance are regulated by Government decision.



(5) Graduates of educational curricula of undergraduate or master can handle teaching positions in preschool and pre-binding, provided they have a minimum of 30 transferable study credits of pedagogical training program offered by the Teacher Training Departments. The existing staff in the education system, which does not have the 30 credits transferable study of pedagogical training program is required to acquire a maximum of 3 years.

(6) Graduates with master's can handle teaching positions in secondary education, post-secondary or university, provided they have a pedagogical training, corresponding to a minimum of 60 transferable study credits, training programs offered by departments teacher training. The existing staff in the education system, which lacks the 60 transferable study credits of pedagogical training program is required to acquire a maximum of 3 years.

(7) pedagogical training programs offered by the faculties of Psychology and Educational Sciences and Teacher Training departments empowered by the Ministry of Education and Research.

(8) Faculty of Psychology and Educational Sciences can organize master studies teacher.

(9) Master Teacher has a duration of 2 years with accumulation of 120 transferable study credits. Annually, the Ministry of Education approves tuition figures on majors and master's degree programs of teaching.

(10) Diploma Master Teacher, which contains a module of specialization in the field near the license gives the right to pursue the teaching profession, fully completing time in that area.

Article 10


(1) master diplomas attesting that their holders have acquired knowledge and skills and specialized general and specific cognitive abilities.


(2) General knowledge refers to:


A) familiarity with the latest developments and advanced knowledge in the field;


B) superior skills of independent research;


C) the ability to apply theory to new situations and who could not be provided.


(3) Expertise covers:



A) accumulating a substantial amount of new knowledge;


B) identifying, addressing and solving cognitive problems and new professional;


C) comparing ourselves with traditional knowledge and the ability to establish relationships between them, in bringing new growth directions of knowledge and development of the profession.


(4) general responsibilities relate to:


A) creative application of research techniques and problem-solving;


B) studies and reports published or applicable professional;


C) ability to lead working groups and to communicate in the most diverse contexts;


D) the ability to act independently and creatively address and solve problems, to evaluate objectively and constructively critical conditions, to creatively solve problems and communicate results demonstratively;


E) leadership skills and clear commitment on the path of their professional development.


(5) specific cognitive skills include:


A) critical evaluation of the results of new research;


B) formulation of alternative interpretative and demonstrate their relevance;


C) creative application of research methods;


D) design and conduct processes specific to the field.


(6) specialized competences are established by regulations of each field.


Article 11


(1) Higher education institutions are autonomous and responsible for the design, application and development of appropriate studies majors and programs.


(2) Number of places funded annually from the state budget under Art. 1 para. (5) is less than 50% of graduates with diploma awarded after completing undergraduate studies.


(3) Higher education institutions can initiate and develop programs Master's degree at the request of public institutions and other stakeholders, to ensure appropriate funding by them.




Cycle III Chapter IV - doctoral studies

Article 12


Doctoral studies were usually lasts 3 years. In special cases when the subject matter requires a longer period of study or trial duration may be extended by 1-2 years, with the approval of the university senate, at the suggestion of the doctorate. Doctoral thesis can be done within a maximum of 4 years from completion of doctoral studies, with the agreement of the university senate and doctoral supervisor.

Article 13


(1) The diploma certifies that the holder has acquired general knowledge and skills and specialized and specific cognitive abilities.


(2) refers to the accumulation of general knowledge, interpretation and development of knowledge in the field of doctoral peak.


(3) general responsibilities relate to:


A) developing research techniques and their application in different contexts and specific;


B) theoretical construction and application training;


C) discursive construction type prestigious academic publications in the field and the type of common knowledge for public communication;


D) responsibility to develop a program of research, critical spirit, creativity, inventiveness.


(4) specific cognitive skills include: identifying new issues and addressing them through research, creative imagination and combination, critical analysis and interpretative.


Article 14


Specific regulations organizing doctoral studies are developed by the Ministry of Education and are subject to government approval.

Chapter V

Linking educational system in Romania with European education

Article 15


(1) Application in all universities of the European system of transferable credits (ECTS) is mandatory.


(2) Beginning with the 2005-2006 academic year, universities issued free of charge, including a used language, each graduate, the Diploma Supplement, whose content is in line with European standards.


(3) integrated study programs offered by two or more universities, leading to joint degrees, the Ministry of Education shall develop and submit to the Government framework methodology for the application of this provision in accordance with regulations.





Chapter VI Transitional and Final

Article 16


(1) short-term higher education, which is currently underway in the existing colleges publication of this law goes into liquidation or reorganization into undergraduate studies in existing areas or close.


(2) Students who have completed higher education short can continue their studies to obtain a degree in the cycle - undergraduate studies.


(3) Higher education institutions determine how to obtain transferable credits, from which it admits undergraduate enrollment exam Short-term higher education graduates.


Article 17


Organization study programs in higher education institutions that train specialists in the field of defense, public order and national security is determined by Government decision.

Article 18


(1) Ministry of Education and Ministry of Labor, Social Solidarity and Family determine, having regard to the provisions of this law, the correlation between academic qualifications and job classification and pay system changes required under the law.


(2) diplomas of higher education graduates are recognized and provides rights under the terms established by legislation act after obtaining the graduation.


(3) The diplomas of higher education graduates with 5-6 years duration are as equivalent to master degrees.


(4) Qualifications awarded after completing undergraduate studies, masters and doctoral provides access to various professions and occupations that will be established by law.


Article 19


This law applies to public and private higher education, accredited and provisionally authorized, functioning under the law, beginning with the 2005-2006 academic year for students admitted in the first year, except as provided in Art. 1 para. (4).

Article 20


On entry into force of this Law, art. 57, art. 60 para. (2) art. 62-65, art. 72 para. (4) - (6) and Art. 73 para. (1) of the Education Law no. 84/1995, republished in the Official Gazette of Romania, Part I, no. 606 of 10 December 1999 with subsequent amendments.
This law was adopted by the Parliament of Romania, in compliance with art. 75 and Art. 76 para. (1) of the Romanian Constitution.
