--------------- The Romanian Parliament adopts this law + Article 1 (1) The Agency for Payments and Intervention for Agriculture, hereinafter referred to as the Agency, is established, specialized body of the central public administration, subordinated to the Ministry of Agriculture and Rural Development, with legal personality, fully funded by the state budget. ------------ Alin. ((1) of art. 1 1 has been amended by section 1 1 of art. I of LAW no. 93 93 of 8 April 2008 , published in MONITORUL OFFICIAL no. 291 291 of 15 April 2008, amending section 2 2 of art. I of EMERGENCY ORDINANCE no. 89 89 of 11 September 2007 , published in MONITORUL OFFICIAL no. 639 639 of 19 September 2007. (2) The Agency is based in Bucharest. (3) The organizational structure, the state of functions and the organization and functioning regulations of the central apparatus of the Agency shall be approved by order of the Minister of Agriculture and Rural Development. ------------ Alin. I of EMERGENCY ORDINANCE no. 103 103 of 14 July 2005 , published in MONITORUL OFFICIAL no. 646 646 of 21 July 2005. + Article 2 ((1) As of July 2005, the Agency shall be the public institution responsible for the management of forms of support for the support of agriculture, financed from the state budget in accordance with the provisions establishing them. ----------- Alin. ((1) of art. 2 2 has been amended by section 2 2 of art. I of EMERGENCY ORDINANCE no. 103 103 of 14 July 2005 , published in MONITORUL OFFICIAL no. 646 646 of 21 July 2005. (2) Until the date of Romania's accession to the European Union, the Agency will prepare the institutional structure for the management of European funds for agriculture, and from the date of accession the Agency will be responsible for the development concerning: a) direct payments and market measures; b) some measures financed by European funds for agriculture, rural development and fisheries, established by order of the Minister of Agriculture and Rural Development. ----------- Lit. b) a par. (3) In order to carry out the tasks provided in ((1) and (2), the Agency will start the necessary activities from 2004 and will be fully operational in 2007. + Article 2 ^ 1 The Agency may delegate to other bodies from the duties provided for in this Law in the event of their fulfilment of the following conditions: a) the responsibilities and obligations of these bodies, in particular on the control and verification of compliance with Community rules, are clearly defined; b) bodies have effective systems to ensure that their responsibilities are fulfilled; c) The Agency shall be informed regularly and on time of the results of the checks carried out so that the sufficient nature of such checks is taken into account in the management of an application. ----------- Article 2 ^ 1 has been introduced by item 1. 3 3 of art. I of EMERGENCY ORDINANCE no. 103 103 of 14 July 2005 , published in MONITORUL OFFICIAL no. 646 646 of 21 July 2005. b) ensure the verification of payment requests received from the beneficiaries; c) authorise payment to the beneficiaries following the verification of payment requests or notify them of any irregularities noticed, in order to settle them; d) execute authorized payments to beneficiaries; e) keep the accounts of payments made; f) pursues the classification in the funds allocated for the activities referred to in 2 2; g) ensure that the public information on the activities carried out is met; h) ensure the smooth conduct of the Agency's economic, administrative, accounting, personnel and audit activities; i) collaborate to carry out specific tasks with central and local public administration bodies; j) prepares and implements the provisions on trade mechanisms; k) issue import and export licences for agricultural products from the date of entry into force of the Law no. 300/2005 on the establishment of the system of import and export licences for agricultural products; ----------- Lit. k) art. 3 3 has been amended by art. 30 of LAW no. 300 300 of 24 October 2005 , published in MONITORUL OFFICIAL no. 955 955 of 27 October 2005. l) develop and implement the procedures for the application of the intervention system for agricultural products. m) is the public authority responsible for the implementation of the Integrated Administration and Control System; ------------ Lit. m) a art. 3 3 has been amended by section 4.2 2 2 of the single article of LAW no. 359 359 of 12 December 2005 , published in MONITORUL OFFICIAL no. 1.142 1.142 of 16 December 2005, amending section 5 5 of art. I of EMERGENCY ORDINANCE no. 103 103 of 14 July 2005 , published in MONITORUL OFFICIAL no. 646 646 of 21 July 2005. t) prepares and implements the legal provisions on surplus stocks of sugar, sugary products and other agri-food products, as well as those relating to the guarantees of elimination on the market of surplus quantities of sugar. ------------ Lit. t) of art. 3 3 was introduced by art. 41 of EMERGENCY ORDINANCE no. 124 124 of 21 December 2006 , published in MONITORUL OFFICIAL no. 1.051 1.051 of 29 December 2006. t) meets, under the law, duties on the management of the milk quota and duties on the application of the legal provisions on individual additional charges, control of direct sales and deliveries to processors, as well as collecting the contribution to the tax due resulting from exceeding the individual quota of deliveries and direct sales of producers. ----------- Letter t) of art. 3 3 was introduced by section 4.2. 3 3 of art. I of EMERGENCY ORDINANCE no. 89 89 of 11 September 2007 , published in MONITORUL OFFICIAL no. 639 639 of 19 September 2007. u) substantiate and issue financial recovery decisions based on the checks carried out within the control of the operations that are part of the financing system through the European Agricultural Guarantee Fund and notify the final result to the Ministry Agriculture and Rural Development and the European Commission. ----------- Lit. u) of art. 3 3 was introduced by art. 19 of ORDINANCE no. 24 24 of 25 August 2010 , published in MONITORUL OFFICIAL no. 613 613 of 30 August 2010. v) orders precautionary measures on the assets of its own debtors, in accordance with the normative acts governing the legal regime of claims administered by the Agency, as well as in accordance with the provisions Government Ordinance no. 92/2003 on the Fiscal Procedure Code, republished, with subsequent amendments and completions. ----------- Lit. v) art. 3 3 was introduced by art. 32 of LAW no. 188 188 of 24 October 2011 , published in MONITORUL OFFICIAL no. 763 763 of 28 October 2011. + Article 3 ^ 1 (1) The Integrated Administration and Control System is the technical management and control tool that applies to certain payment schemes, in accordance with the provisions establishing them. (2) The Integrated Administration and Control System represents a set of rules and procedures of institutional organization, IT infrastructure and human resources. (3) The Integrated Administration and Control System comprises the following elements: a) an electronic database; b) an identification system for agricultural parcels; c) a system for the identification and registration of payment entitlements; d) requests for support; e) an integrated control system; f) a unique identification system for each farmer who submitted the application for support; g) an animal identification and registration system. ----------- Art. 3 ^ 1 was introduced by item 1. 6 6 of art. I of EMERGENCY ORDINANCE no. 103 103 of 14 July 2005 , published in MONITORUL OFFICIAL no. 646 646 of 21 July 2005. + Article 3 ^ 2 (1) The Agency shall be designated as the national competent authority responsible for the efficient, effective and transparent implementation of financial operations on grants allocated to information and promotion programmes for agricultural products on the internal market and in third countries, as well as for the monitoring and control of the proper implementation of the selected programmes. ------------ Alin. (2) The Agency, in accordance with the provisions of para. (1), has the following main tasks: a) ensure compliance with the Community rules in force on guarantees for the proper execution of contracts for the implementation of promotion programmes, as well as on guarantees related to requests for payment of the advance; ------------ Letter a) a par. ((2) art. 3 ^ 2 was amended by section 4.2. 6 6 of the single article of LAW no. 36 36 of 13 March 2009 , published in MONITORUL OFFICIAL no. 182 of 24 March 2009, which complements art. 5 of EMERGENCY ORDINANCE no. 76 76 of 18 June 2008 , published in MONITORUL OFFICIAL no. 464 464 of 23 June 2008, with point 1. c) transmit to the European Commission copies of contracts for the promotion programs concluded, as well as copies of the supporting documents on the formation of guarantees related to these contracts; ------------ Letter c) a par. ((2) art. 3 ^ 2 was amended by section 4.2. 6 6 of the single article of LAW no. 36 36 of 13 March 2009 , published in MONITORUL OFFICIAL no. 182 of 24 March 2009, which complements art. 5 of EMERGENCY ORDINANCE no. 76 76 of 18 June 2008 , published in MONITORUL OFFICIAL no. 464 464 of 23 June 2008, with point 1. d) receive, record and verify the payment claims and the attached documents; e) authorizes the payment following the verification of payment requests and the attached documents or notifies the beneficiaries of any irregularities noticed, in order to solve them; f) execute the authorized payments within the time limits and under the conditions laid down by the Community regulations and by the national legislation g) receives, records, verifies and endorses the interim, annual and final reports received from the contracting organizations; ------------ Letter g) a par. ((2) art. 3 ^ 2 was amended by section 4.2. 6 6 of the single article of LAW no. 36 36 of 13 March 2009 , published in MONITORUL OFFICIAL no. 182 of 24 March 2009, which complements art. 5 of EMERGENCY ORDINANCE no. 76 76 of 18 June 2008 , published in MONITORUL OFFICIAL no. 464 464 of 23 June 2008, with point 1. i) verify by technical, accounting and administrative checks the beneficiaries and implementing bodies and inform the European Commission as soon as possible of the planned and carried out checks and on the results obtained from the verification and control measures; ------------ Letter i) a par. ((2) art. 3 ^ 2 was amended by section 4.2. 6 6 of the single article of LAW no. 36 36 of 13 March 2009 , published in MONITORUL OFFICIAL no. 182 of 24 March 2009, which complements art. 5 of EMERGENCY ORDINANCE no. 76 76 of 18 June 2008 , published in MONITORUL OFFICIAL no. 464 464 of 23 June 2008, with point 1. j) develop procedures manuals for the proper implementation of their duties and which will be approved by order of the Minister of Agriculture and Rural Development. k) ensure the maintenance of financial and accounting records on the operations they carry out, in accordance with the observance of the Community regulations and the national legislation in force; l) performs other duties, under the law. ------------ Article 3 ^ 2 was introduced by art. 5 of EMERGENCY ORDINANCE no. 76 76 of 18 June 2008 , published in MONITORUL OFFICIAL no. 464 464 of 23 June 2008. + Article 4 (1) The Agency shall be headed by a director-general appointed, under the law, by order of the Minister of Agriculture and Rural Development. ----------- Alin. The Director-General of the Agency shall be the secondary authorising officer and shall manage the approved public funds, including the amounts of pre-financing and co-financing through the EAGF payment schemes and the EAFRD payment schemes. ----------- Alin. (3) The Director General directs the Agency's activity and represents it in the relations with the other specialized bodies of the central and local public administration, with other legal and natural persons, as well as in justice. In the exercise of his duties, the Director-General shall issue (5) The Director-General may give power of representation to other persons within the Agency. + Article 4 ^ 1 (1) The agency has 42 county centers in subordination, with legal personality. (2) The county centers are headed by executive directors, appointed by decision of the Director General, in accordance with the legislation in force. (3) The executive directors of the county centers have the quality of tertiary authorising officers, for the funds from the state budget, except for the pre-funded and co-financed expenses through the EAGF payment schemes and the EAFRD payment schemes. (4) The organizational structure, the number of local centers for each county center, the organization and functioning regulations, as well as the states of functions of the county centers are approved by decision of the Director General of the Agency, who also establishes the number of local centers related to county centers. ------------ Article 4 ^ 1 has been amended by section 4. 2 2 of art. I of EMERGENCY ORDINANCE no. 89 89 of 11 September 2007 , published in MONITORUL OFFICIAL no. 639 639 of 19 September 2007. + Article 5 (1) The staff of the Agency shall also ensure by taking over the posts and personnel with responsibilities in the management of financial support from the state budget, existing within the Ministry of Agriculture and Rural Development and within the directions for agriculture and rural rural development and the city of Bucharest. ------------ Alin. ((4) The Agency may engage in seasonal activities, with a view to the timely fulfilment of tasks on which the full access of European funds is dependent on the basis of a service contract staff, on the basis of a justification substantiated, approved by the principal authorising officer *). ------------ Alin. I of EMERGENCY ORDINANCE no. 89 89 of 11 September 2007 , published in MONITORUL OFFICIAL no. 639 639 of 19 September 2007. ------------ + Article 7 (1) Civil servants and contract staff, other than those assigned to common positions in the budgetary sector, within the Agency for Payments and Intervention for Agriculture and its county branches shall receive basic salaries. corresponding to the functions in which they are assigned, plus an increase in basic salaries by up to 75% of them *). (2) Evaluation of the staff activity provided in par. (1) shall be made at least once a year, during which the percentage of increase of the basic salary may be modified according to the results of its own activity. ------------ Article 7 has been amended by art. VII of EMERGENCY ORDINANCE no. 35 35 of 11 April 2009 , published in MONITORUL OFFICIAL no. 249 249 of 14 April 2009. + Article 7 ^ 1 (1) The management staff who benefit from the rights provided in art. 7, in sensitive positions, is assessed annually on the basis of performance indicators. The method of evaluation of the management staff, the organization and functioning of the commission for its evaluation, as well as the performance indicators are approved by order of the Minister of Agriculture and Rural Development. (2) Within the meaning of this law, the post of which the holder participates in taking the final decision on the implementation and payment system shall be understood by post-sensitive, in the following situations: a) the evaluation and selection of payment applications; b) technical verification; c) verification of payment applications, authorization, accounting and payment; d) administration of the computer system ------------ Article 7 ^ 1 has been introduced by item 1. 7 7 of the single article of LAW no. 36 36 of 13 March 2009 , published in MONITORUL OFFICIAL no. 182 of 24 March 2009, which complements art. 5 of EMERGENCY ORDINANCE no. 76 76 of 18 June 2008 , published in MONITORUL OFFICIAL no. 464 464 of 23 June 2008, with point 2. + Article 8 The funds necessary to carry out the Agency's activity, including for the implementation and implementation of the Integrated Administration and Control System, shall be ensured from the state budget through the budget of the Ministry of Agriculture and Rural Development. ------------ Article 8 has been amended by section 6.6. 10 10 of art. For expenditure subject to Community financing, the Agency's accounts shall be certified by a certification body, on the basis of an examination of the procedures and a sample of transactions, in accordance with the standards of internationally accepted audit. (2) The certification body is an entity independent of the Agency and the Coordination Body. ----------- Article 8 ^ 2 was introduced by the section 10 10 of art. I of EMERGENCY ORDINANCE no. 103 103 of 14 July 2005 , published in MONITORUL OFFICIAL no. 646 646 of 21 July 2005. + Article 9 (1) The Agency uses for the central apparatus two cars, a minibus for passenger transport, 26 vehicles for specific activities and 3 boats, with a monthly fuel consumption of 600 litres/motor vehicle and dinghy. (2) The county centers use two cars for passenger transport and 16 vehicles for specific activities, with a monthly fuel consumption of 600 l/motor vehicle, with the maximum number of vehicles approved Ministry of Agriculture and Rural Development. --------------- Alin.
