The Romanian Parliament adopts this law + Article 1 The Order of Health Merit and the Health Merit Medal provided in art. 7 lit. A and B and the Order of Health Merit and the Health Merit Medal provided for art. 9 lit. A section VI and lit. B point VI of Law no. 29/2000 on the national system of decorations of Romania, as amended, are part of the category of civil decorations on fields of activity and military war decorations, respectively. + Article 2 (1) The Order of Health Merit can be granted to civil or military doctors and persons with higher education, Romanian or foreign citizens, who have had special merits in the field of health protection of the population, in fighting epidemics, in the field of medical research and practice, in increasing the prestige of Romanian medical science and in providing health care, both in peacetime and in situations of armed conflict or war. (2) The Health Merit Medal can be granted to civil or military medical-health personnel without higher education, Romanian or foreign citizens who have distinguished themselves through meritorious activities in all medical current fields, both in peacetime and in situations of armed conflict or war. + Article 3 (1) The Order of Health Merit presents itself: a) for civilian personnel, in two forms with equal hierarchical value: insignia and rosette; b) for the military, under three forms with equal hierarchical value: insignia, bareta and rosette. (2) The order of the Sanitary Merit Order is a cross made of silver, enamelled red, having between the arms a beam of metal rays. (3) The Ribbon and the Bareta Order of the Sanitary Merit conferred as military decoration of war differ from the ribbon and the baret of the Order of the Sanitary Merit conferred as a civil decoration, by applying on the edges of a golden thread. + Article 4 (1) The Health Merit Medal shall be presented: a) for civilian personnel, in one form: the mark; b) for the military, in two forms with equal hierarchical value: insignia and bareta. (2) The Insign of the Sanitary Merit Medal is a circular piece with a slightly prominent border, bordered by a pearl circle, and is made of tombac. (3) The ribbon of the Sanitary Merit Medal conferred as a military war decoration is distinguished from the ribbon of the Sanitary Merit Medal conferred as a civil decoration, by applying on the edges of a golden thread. + Article 5 The Regulations on the description and the way of granting the Order of the Sanitary Merit and the Sanitary Merit Medal, for each degree or class, as well as the drawn model of the order and medal are provided in Annexes no. 1 1-4 which are an integral part of this law. + Article 6 (1) The Order of Health Merit and the Sanitary Merit Medal are conferred by the President of Romania by decree, based on the individual decoration proposals formulated, according to art. 4 4 para. ((2) lit. c) of Law no. 29/2000 , as amended, by the competent minister, for persons in his field of activity. (2) The nominal proposals for the conferment of the Sanitary Merit Order and the Sanitary Merit Medal are endorsed by the Chancellery of Orders, in accordance with art. 5 5 of Law no. 29/2000 ,, as amended. (3) The President of Romania may confer the Order of Sanitary Merit and the Sanitary Merit Medal and on his own initiative, in the proportion of 1% of the total number established by law, for each degree or class of each decoration, except for the degree of Great Officer, according to art. 4 4 para. ((3) of Law no. 29/2000 ,, as amended. + Article 7 (1) The distribution of the maximum number of decorations regarding the Sanitary Merit Order and the Health Merit Medal, which is granted annually, is carried out by the Chancellery of Orders, within the limits of vacant places. (2) For the first promotion, from the entry into force of this law, a maximum of 15% of the number of decorations for each grade and class can be conferred. + Article 8 (1) The Sanitary Merit Order conferred as a civil decoration is limited to a maximum of 4,000 members. (2) The Sanitary Merit Order conferred on foreign citizens that civil decoration does not enter the number provided in par. ((1). (3) The Order of the Sanitary Merit, as a military war decoration, can be conferred unlimited. + Article 9 The Health Merit Order comprises 4 degrees. The hierarchy in descending order is as follows: a) Great Officer; b) Commander; c) Officer; d) Knight. + Article 10 The Health Merit Medal includes 3 classes. The hierarchy in descending order is as follows: a) Class I; b) Class II; c) Third grade. + Article 11 (1) The Health Merit Medal conferred as a civil decoration can be granted unlimited for classes III and II and is limited to 3,000 members for class I. (2) The Class I Health Merit Medal, conferred on foreign citizens as a civil decoration, does not enter the number provided in par. ((1). (3) The Health Merit Medal, as a military war decoration, can be conferred unlimited. + Article 12 (1) Attestation of the Sanitary Merit Order and the Sanitary Merit Medal is made by a patent, in accordance with art. 24 24 of Law no. 29/2000 ,, as amended. (2) The patents for the Sanitary Merit Order are validated, for the ranks of Knight and Officer, through the paraphernalia of the President of Romania, and for the ranks of Commander and Grand Officer, by the autograph signature of the President of Romania. Patents for all grades are countersigned autographed by the relevant minister and the chancellor of the orders, according to art. 26 lit. b) of Law no. 29/2000 ,, as amended. (3) Brevets for the Sanitary Merit Medal are validated, for classes III and II, through the paraphernalia of the competent minister and the signature of the chancellor of the orders, and for the first class, by the signature of the competent minister and the signature of the chancellor orders, in accordance with art. 28 28 of Law no. 29/2000 ,, as amended. + Article 13 Members of the Health Merit Order, regardless of the degree they have, are appointed Knights of the Sanitary Merit Order. + Article 14 (1) The Day of the Order of the Sanitary Merit is celebrated on November 26, the date of the first institution of the decoration in 1913. (2) On the occasion of the Sanitary Merit Order Day, the relevant ministry and the other public institutions empowered to make proposals for decoration organize, with the support of the Chancellery of the Orders, the meeting of the Knights of the Order of Health + Article 15 Persons decorated with the Order of Health Merit the rank of Commander and Grand Officer, if the awarding of the order was not made directly by the head of state, may request, through the Chancellery of Orders, the right to be received in the audience to the President Romania to thank him personally. (2) For the adjudication of dishonorable acts, which prejudice the moral prejudices of the members of the Sanitary Merit Order, other than those resulting in the conviction of the members of the order to a custodial sentence by judicial decision remaining final, an honorary council shall be constituted, in accordance with art. 53 53 of Law no. 29/2000 ,, as amended. + Article 17 (1) The Board of Honor of the Order of the Sanitary Merit is composed of 5 members, as follows: a member of the ranks of Knight, Officer and Commander and two members of the rank of Grand Officer, of which at least one member of the honorary board is elected from the Military doctors, members of the order, and president of the honorary council will, as a rule, be the oldest member in the rank of Grand Officer. (2) The Board of Honor shall be constituted or shall be elected on the occasion of the Day of the Order of the Sanitary Merit, within 5 years, of the knights (3) May be re-elected, for a new period, 3 of the members of the honorary council, of which at least one of the lower ranks. (4) The relevant Ministry will provide adequate spaces for the activity of the honorary council. + Article 18 (1) The Knights of the Order of the Sanitary Merit may signal to the honorary council acts committed by other members of the order, considered to be of moral prejudice to them (2) As a result of the complaint, the honorary council and the accused person shall be convened, within a maximum of 30 days from the referral. (3) The Knights of the Order of the Sanitary Merit can also signal directly to the Chancellery of the Orders acts committed by other members of the order, considered to bring moral damages As a result of the referral, the Chancellery of Orders convenes the honorary council and the accused person, within a maximum of 45 days of the referral. (4) If the accused person does not present himself at the fixed term, the honorary council shall summon it to another term, and in the case of non-submission and the second time, the case will be tried in absentia. (5) The Board of Honor deliberates and decides after the investigation of the case, but no later than 60 days after the first meeting for the respective case. withdrawal of decoration. (6) The withdrawal of the decorations is made by decree signed by the President of Romania, at the proposal of the Chancellery of the Orders art. 59 59 of Law no. 29/2000 ,, as amended. + Article 19 The Honorary Council of the Order of Merit Sanitary also judges the dishonorable facts of the persons decorated with the Sanitary Merit Medal. ((1) of Law no. 29/2000 ,, as amended. + Article 20 The amounts necessary to make the marks, rosettes, patents and boxes of the decorations of the Order Merit Sanitary Order and the Sanitary Merit Medal will be provided from the budget approved annually to the Presidential Administration. No. 539. + Annex 1 REGULATION on the description and granting of the Order of Health + Article 1 The Sanitary Merit Order is granted for life. + Article 2 (1) The Sanitary Merit Order conferred as a civil decoration is limited to a maximum of 4,000 members, divided by degrees as follows: a) Knight-2,200; b) Officer-1.100; c) Commander-500; d) Great Officer-200. (2) The exceeding of the number of each grade constitutes a breach of this Regulation. The decorations awarded above the limit number are null and void, and the insignia is returned. (3) The conferment of the Order of the Sanitary Merit as a military war decoration can be made unlimited. + Article 3 (1) The mark of the Knight of the Order of the Sanitary Merit is a cross with equal arms, 9 mm wide, having a diameter of 30 mm and with the combination of arched arms, made of silver with the title of 800 per thousand, enameled red. Between the arms of the crosses come metal rays that exceed the cross both at the upper and lower sides, giving the meaning an oval shape, with a height of 40 mm and a width of 32 mm. Metallic rays have the natural color of silver. (2) On the obverse, central, the symbol of medicine is applied: two snakes sprouted on a winged toiag, made of silver with the title of 925 per thousand and having the height of 18 mm. (3) On the reverse side are inscribed with letters and high figures of 4 mm, on the horizontal arm "HEALTH MERIT", and on the vertical arm, in the upper part, the year "1913" and, in the lower part, the year "2000", representing historical data on the Order of Merit Sanitary. (4) The mark is surmounted by a half-moon of laurel leaves, with the outer width of 30 mm and the outer height of 20 mm, having the ends of the semi-joint united by a bar, through which the ribbon is spent. On the bar, on the reverse, are the title of silver and the current number of decoration. (5) The ribbon, of white moarat rips, has at 1 mm of edges one red tape, 6 mm wide. The ribbon is 40 mm wide and the apparent height of 50 mm. (6) For female persons, civil personnel, the ribbon is folded in the form of a bow and has a length of 120 mm. (7) The ribbon of war means a golden thread, 2 mm wide, on the edges. (8) The rosetta is presented as a rectangular ribbon of rips, 16 mm long and 6 mm wide, with the dimensions of the coloured bands of the ribbon reduced to 40%. On the back has a clamping system. (9) The barrier for military doctors is presented in the form of a rectangular ribbon of rips, applied on a metal stand, 20 mm long, 10 mm wide and having the dimensions of the colored bands of the ribbon reduced to 50%. On the back has a clamping system. (10) The war bar receives on the edges a golden thread, 1 mm wide. + Article 4 The mark and rosette of the Officer of the Order of the Sanitary Merit have the general characteristics of the meaning and rosette of the Knight, with the following peculiarities a) the mark is gilded; b) the ribbon receives a rosette of 25 mm diameter; c) the rosette shall be in the form of a reel of 10 mm diameter rips and a height of 6 mm, having the dimensions of the coloured bands of the ribbon reduced to 40%; on the back it has a clamping system; d) for female persons rosette shall apply on the middle of the rope; e) the bar for military doctors is similar to that of the rank of Knight, on which a rosette with a diameter of 10 mm is caught; f) the war bar receives on its edges and rosette a golden thread, 1 mm wide. + Article 5 (1) The rank of Commander of the Order of the Sanitary Merit is a cross with equal arms, 11 mm wide and 40 mm in diameter, made of silver with the title of 925 per thousand, gilded. The oval piece has a height of 50 mm and a width of 38 mm. (2) The other elements of the meaning have the general characteristics of the rank of Officer, with the following peculiarities a) the insignia of the doctors on the obverse is 22 mm high; b) the letters and figures of the inscription on the reverse are 5 mm high; c) the insignia is surmounted by an open crown of laurel leaves with an outer width of 37 mm and the height of 28 mm, which is caught a flat ring, 30 mm high and 3 mm wide, through which the ribbon is spent; on the reverse of the ring are poansonate the title of silver and the current number of decoration corresponding to the degree; d) the ribbon is 45 mm wide and has the adjustable length to be adapted to the circumference of the neck; the red strips are 7 mm wide; e) the rosette of the rank of Commander is formed by the overlap of the rosette of the rank of Officer with that of the Knight; on the back has a clamping system f) the bar for military doctors presents itself in the form of a rectangular ribbon of rips, applied on a metal stand, 23 mm long, 10 mm wide and having the dimensions of the colored bands of the ribbon reduced to 50%; on the center of the bar is caught a silver disc with a diameter of 5 mm; on the back it has a clamping system; g) the war bar receives on the edges and on the silver disc a golden thread, 1 mm wide. + Article 6 (1) The sign of the Grand Officer of the Order of the Sanitary Merit is composed of the insignia of propriuzis and the degree (2) The sign itself and the ribbon of the Grand Officer of the Order of the Sanitary Merit are identical to the mark and ribbon of the Commander. (3) The degree board is an 8-ray star, made of silver with the title of 925 per thousand and having a diameter of 70 mm. On the plate is applied the insignor obverse of the Commander. On the reverse, in a central medallion, the name of the producer company, the title of the silver and the current number of the decoration corresponding to the degree are posted. On the back has a clamping system. (4) The rosette of the grade is presented in the form of a rectangular ribbon of silver rips, 16 mm long and 6 mm wide, over which the rosette of the rank of Officer is applied. On the back has a clamping system. (5) The bar for military doctors has the dimensions of the rank of Commander, on it a diamond embossed, made of silver, having a large diagonal of 7 mm and a small diagonal of 5 mm. On the back has a clamping system. (6) The war bar receives on the edges and on the center of the rombum a golden thread, 1 mm wide. + Article 7 (1) The box in which the decoration is kept is dressed in white leather and inside is lined with red plus. (2) On the lid of the box are printed gold: Romanian coat of arms, name and degree of order + Article 8 (1) The Order of Health Merit shall be carried, as a rule, on the occasion of the National Day of Romania and of the other national or religious holidays, on the occasion of the Day of the Sanitary Merit Order and in other situations established by (2) The Knight and Officer Grades of the Order of the Sanitary Merit shall be worn on the left side of the chest. (3) The rank of Commander of the Order of the Sanitary Merit is worn at the neck, with the ribbon caught under the tie, the insignia being visible at 50 mm on the left side, under the tie knot. (4) The degree of Grand Officer of the Order of the Sanitary Merit is carried on the left side of the chest. (5) Only the highest degree of the Order of the Sanitary Merit which has been conferred is always carried. (6) The rosette can be worn daily, but only the rosette of the highest grade. The rosette is worn at the buttonhole from the left reverse of the garment or the cutter. (7) The military carries the Order of Health Merit in accordance with the specific military regulations. + Article 9 (1) The appointment of the Sanitary Merit Order shall be made mandatory starting with the rank of Knight, except for the first promotion of the order. (2) The appointment of the Sanitary Merit Order can be done only after fulfilling with special results, for 5 years, specific activities or functions. + Article 10 (1) In order to confer a higher degree to the same person it is necessary to perform an internship in the immediate lower degree, as follows a) from the rank of Knight to the Officer-3 years; b) from the rank of Officer to the Commander-4 years; c) from the rank of Commander to the Great Officer 5 years. ((. The proposals for conferencing shall take into account the criteria laid down in this Regulation, including the first class of decoration. (3) The direct conferment of the higher grades at the first promotion is made as a result of a summation of special merits, which could have led to the granting of successive degrees. + Article 11 For entirely special merits the term of 5 years, as well as the minimum age in grade, provided in art. 9 9 para. ((2) and in art. 10 10 para. ((1), may be reduced by a maximum of one third. + Article 12 (1) The Order of the Sanitary Merit, as military decoration of war, shall be conferred without regard to time served in medical or military structures, but only for the merits and abnegation proven in the specific services during armed conflict or by War. (2) Doctors who in peacetime were decorated with the Order of Health Merit can receive, for the merits of armed conflict or war, the immediate superior degree of military war decoration. + Article 13 (1) The conferment of a higher degree automatically leads to the removal of the respective person from the lower grade, the place becoming vacant (2) The lower grade mark remains in possession of the decorated one. + Article 14 (1) The Order of Health Merit can be granted to civil or military doctors and persons with higher education, Romanian or foreign citizens, who have had special merits in the field of health protection of the population, in fighting epidemics, in the field of medical research and practice, in increasing the prestige of Romanian medical science and in providing healthcare both in peacetime and in situations of armed conflict or war. (. In particular merits, for the purposes of this Regulation, it shall be understood: a) obtaining significant results in ensuring the health of the population; b) introduction of new methods in the practice of medical act; c) effective control of social diseases; d) prevention of epidemic diseases and obtaining medical performance in the treatment of various diseases; e) the discovery and production of new and effective drugs or drugs in the treatment of various diseases; f) ensuring proper medical care of combatants injured during armed conflict or war; g) obtaining the invention-innovation patent for the realization of equipment in the medical field. + Article 15 Within 30 days of the entry into force of this law, the relevant ministries will elaborate, based on art. 14, regulations specific to their field of activity, approved by order of the competent minister, in which the conditions under which the Sanitary Merit Order is conferred will be detailed. + Annex 2 REGULATION on the description and award of the Sanitary Merit Medal + Article 1 The Health Merit Medal is awarded for life. + Article 2 (1) The Health Merit Medal conferred as a civil decoration is unlimited in number for classes III and II and limited to 3,000 members for Class I. (2) Exceeding the number of medals for Class I is a violation of this Regulation. The decorations awarded above the limit number are null and void, and the insignia is returned. (3) The Conference of the Sanitary Merit Medal as a military war decoration can be made unlimited. + Article 3 (1) The mark of the Sanitary Merit Medal presents itself in the form of a circular piece with a diameter of 36 mm, with slightly elevated headboard, bordered by a pearl circle, and is made of tombac. (2) On the obverse is embossed the insignia of the Order of the Sanitary Merit, which has the height of 30 mm and the width of 22.5 (3) On the reverse side is inscribed with letters and figures of 4 mm: "1913/MERIT SANITAR/2000", representing historical data on the Sanitary Merit Medal. ((4) The medal is surmounted by a half-moon of laurel leaves, with the outer width of 35 mm and the height of 25 mm, having the ends of the semi-joint united by a bar through which the ribbon is spent. On the bar, on the reverse, is pounded in the first class the current number of the decoration. (5) The ribbon, 35 mm wide and with the apparent width of 50 mm, is from white moarat rips, having at the edges, at a distance of 1 mm, a red stripe, 2 mm wide, and on the center a red stripe, 8 mm wide. (6) For female persons, civil personnel, the ribbon is folded in the form of a bow and has a length of 100 mm. (7) The Ribbon of the war meaning receives on the edges a gilded thread, 2 mm wide. (8) The barrier for military medical personnel is presented in the form of a rectangular ribbon of rips, applied on a metal stand, 18 mm long, 10 mm wide and having the dimensions of the colored bands of the ribbon reduced to 50%. On the back has a clamping system. (9) The war bar receives on the edges a golden thread, 1 mm wide. + Article 4 The distinction between classes is as follows: a) the third grade is dark; b) Class II is silver; c) Class I is gold plated. + Article 5 (1) The box in which the medal is kept is made of cardboard dressed in white pergamoid and is lined with red silk. (2) The name and class of the medal are printed on the box cover. + Article 6 (1) The Health Merit Medal shall be carried, as a rule, on the occasion of the National Day of Romania and the other national or religious holidays, on the occasion of the Sanitary Merit Order Day and in other situations established by specific regulations. (2) It is always only the insignia of the highest class of the Sanitary Merit Medal which has been conferred. + Article 7 (1) The conferment of the Sanitary Merit Medal is made mandatory starting with the third grade. (2) The conferment of the Sanitary Merit Medal, as a civil decoration, can be done only after obtaining special results in the specific activity, practical or theoretical, for 4 years. + Article 8 (1) In order to confer an upper class to the same person, it is necessary to carry out an internship in the immediately lower class, a) from the third grade to the second class-5 years; b) from the second grade to the first class-6 years. ((. The proposals for conferencing shall take into account the criteria laid down in this Regulation, including the first class of decoration. (3) The direct conferment of the upper classes at the first promotion is made as a result of a summation of special merits, which could have led to the granting of successive classes. + Article 9 For very special merits, the term of 4 years, as well as the minimum age in the class, provided in art. 7 7 para. ((2) and in art. 8 8 para. ((1), may be reduced by a maximum of one third. + Article 10 (1) The Health Merit Medal, as a war decoration, is conferred without regard to the time served in medical or military structures. (2) The health personnel who in peacetime was decorated with the Health Merit Medal can receive, for the merits had during armed conflict or war, the immediately superior class of the military war decoration. + Article 11 (1) The conferment of an upper class automatically leads to the removal of the name of the respective person from the (2) The lower class sign remains in possession of the decorated one. + Article 12 (1) The Health Merit Medal can be granted to civil or military medical-health personnel without higher education, Romanian or foreign citizens who have distinguished themselves through meritorious activities in all medical current fields, both in peacetime and in situations of armed conflict or war. For the purposes of this Regulation, the meritorious activities shall be understood: a) assisting and helping with competence, within the limit of professional duties, of medical professionals with superior training in the exercise of the medical act; b) care with conscientiousness and abnegation of sufferers or injured persons; c) ensuring optimal conditions of care for people suffering or injured, in peacetime, armed conflict or war. + Article 13 Within 30 days of the entry into force of this law, the relevant ministries will elaborate, based on art. 12, regulations specific to their field of activity, approved by order of the competent minister, in which the conditions in which the Health Merit Medal is awarded will be detailed. + Annex 3 Drawn model of the Order of Health Merit image Drawn model of the Order of Health Merit image Drawn model of the Order of Health Merit image + Annex 4 The drawn model of the Sanitary Merit Medal image ------------------
