The Romanian Parliament adopts this law + Article 1 (1) The National Philatelic Museum, hereinafter referred to as the Museum, the branch without legal personality of the National Company "Posta Romana"-S.A., is reorganized as a section without legal personality of the National Museum of Romanian History. (2) The museum will operate in the building owned by the National Museum of Romanian History. + Article 2 (1) The patrimony of the Museum is transferred from the National Company "Posta Romana"-S.A. to the National Museum of Romanian History, in compliance with the legislation on the property regime. (2) With the book value of the philatelic collection constituted after 1998 by acquisitions of the National Company "Posta Romana"-S.A., located in its private property, it shall, accordingly, extinguish its fiscal obligations to the state budget. (3) The collection transferred under the conditions of para. (2) becomes public property of the state. (4) The date of termination of the tax obligations to the state budget is the date of conclusion of the protocol provided 5. provisions art. 115 of Government Ordinance no. 92/2003 on Tax procedure code , republished, with subsequent amendments and completions, are applicable accordingly. (5) In order to carry out the tax obligations of the National Company "Posta Romana"-S.A. to the state budget, the protocol provided for in art. 5 will also contain mentions regarding the book value of the philatelic collection provided in par. ((2), on the date of its conclusion. (6) The extinguishing of the fiscal obligations of the National Company "Posta Romana"-S.A. to the state budget will also operate on the private property of the National Company "Posta Romana"-S.A. in the patrimony of the Museum, other than those provided in par. (2), in compliance with the provisions of paragraph ((4) and (5). (7) The extinguishing of tax obligations, in the situation provided in par. ((6), shall be made at the value of the goods established by an evaluation report drawn up by an independent assessor. The costs of the evaluation are borne by the National Company "Posta Romana"-S.A. (8) If the value of the goods established according to the provisions of par. (2) and (6) is higher than the amount of the fiscal obligations of the National Company "Posta Romana"-S.A. to the state budget, with the resulting difference, other fiscal obligations, including future fiscal obligations, managed by the Agency National Tax Administration. + Article 3 (1) The philatelic collection of Romania, public property of the state, part of the national mobile cultural heritage, under the administration of the National Museum of Romanian History according to art. 2, is taught in the custody of the National Bank of Romania (2) The philatelic collection of Romania is composed of Romanian and foreign postage and tax stamps, postage, projects and layouts of postage and postage stamps, moulds for printing postage stamps, lithographic plates, essays, printing samples, specimens, modeling and any other objects and documents related to it and held in administration by the National Company "Posta Romana"-S.A. + Article 4 (1) The National Bank of Romania will ensure the preservation, management, protection, as well as the enhancement of the philatelic collection of Romania, in compliance with the provisions Law no. 182/2000 on the protection of the mobile national cultural heritage, republished, with subsequent amendments and completions. (2) The National Bank of Romania will ensure the public access to the philatelic collection of Romania. + Article 5 (1) The surrender-takeover of the inventoried heritage, including the philatelic collection of Romania, is carried out by protocol concluded between the National Company "Posta Romana"-S.A., the Ministry of Culture, the National Museum of History of Romania and the Bank National of Romania, within 30 days from the date of entry into force of this Law. (2) In the protocol provided in par. (1) the goods handed over in the administration of the National Museum of History of Romania, namely those handed over in the custody of the National Bank of Romania + Article 6 The entire document fund related to the philatelic collection of Romania is taken over, simultaneously with its transfer, in original, by the National Museum of Romanian History, as follows: a) the Museum archive and library; b) the records of the operative record and the accounting documents. + Article 7 The National Museum of Romanian History teaches the National Bank of Romania, at the time of taking into custody the philatelic collection, in original, the documents provided in art. 6 lit. a) and, in copy, on paper and electronic support, the documents provided in art. 6 lit. b). + Article 8 Management that on January 1, 2013 held in management the collections of Romanian postage stamps, foreign postage stamps, postal effects and molds are taken over by the National Bank of Romania from the National Company "Posta Romana"-S.A. with teaching the philatelic collection of Romania in custody, according to the provisions of art. 3 3 para. ((1). + Article 9 (1) The inventory and expertise, in order to classify in the national mobile cultural heritage, as well as the evaluation, as the case may be, of the goods belonging to the philatelic collection of Romania are continued by the Ministry of Culture and the National Museum of History of Romania, in the headquarters of the National Bank of Romania. (2) The financing of the activity of expertise and evaluation, as the case may be, for the classification, of the goods that make up the philatelic collection of Romania shall be ensured by the National Museum of Romanian History with the classification in the amounts provided with this destination in its own budget, according to law (3) Any differences resulting from the operations referred to in par. (1) is registered in the accounting records of the National Museum of Romanian History and those of the National Bank of Romania, according to the law. + Article 10 (1) After the completion of the operations of expertise, evaluation and ranking, according to the provisions of art. 9, the goods belonging to the philatelic collection of Romania, public property of the state, are transmitted from the administration of the National Museum of Romanian History in the administration of the National Bank of Romania. ((2) Teaching-taking over the goods referred to in par. (1) is carried out by protocol concluded between the Ministry of Culture, the National Museum of Romanian History and the National Bank of Romania. (3) The National Bank of Romania issues its own regulations regarding the administration of the philatelic collection of Romania. + Article 11 (1) The amendment of the Regulation on the organization and functioning of the National Museum of Romanian History according to the provisions of this law is approved by order of the Minister of Culture, within 60 days from the date of its entry into force. (2) The specialized staff of the Museum is taken over by the National Museum of Romanian History. + Article 12 With the circulation of each philatelic issue, the Commercial Society "Romfilatelia"-S.A. provides, free of charge, the National Museum of Romanian History and the National Bank of Romania a copy of stamps and/or postal effects introduced into circulation, in order to complete the philatelic collection in the public property of the state and in its administration. This law was adopted by the Romanian Parliament, in compliance with the provisions of art. 75 75 and art. 76 76 para. (2) of the Romanian Constitution, republished.
