---------- The Romanian Parliament adopts this law + Article 1 (1) As of the date of entry into force of this Law and until 31 December 2011, the teaching and auxiliary teaching staff shall enjoy the salary rights established in accordance with the Annexes to this Law. (2) The gross amount of employment salaries for teaching and auxiliary teaching staff in education is the one provided for in Annexes no. 1, 2, 3a and 3b, as appropriate. (3) The specific driving allowances are set out in Annex no. 4. (4) The sports, allowances, compensations and other elements of the salary system enjoyed by the staff referred to in par. ((1), as well as their calculation methodology, are set out in Annex no. 5. (5) The amount of allowances, allowances, compensations and other elements of the salary system provided for by this Law shall be calculated according to the employment salaries provided for in Annexes no. 1, 2, 3a or 3b, as applicable, in accordance with the methodology set out in Annex no. 5 5, taking into account the driving allowance provided for in Annex no. 4 4, if applicable. (6) Through collective agreements or collective agreements and individual labor contracts, salaries or other monetary rights or in kind that exceed the provisions of this law may not be negotiated. ((7) Provisions art. 8 8, 9, 12 and 13 of Law no. 285/2010 on the salary in 2011 of the staff paid from public funds, as well as those of art. 22 22, 25-30 of the Framework Law no. 284/2010 on the unitary pay of the personnel paid from public funds shall also be applied accordingly for the teaching and auxiliary teaching staff in education, salarized according to the provisions of this law. + Article 2 (1) The inclusion of the staff provided in art. 1 is made according to the provisions of the ((2) Persons who have the salary of framing between the minimum and maximum limit of the age tranche for teaching positions in university education, respectively of the professional degree or of the professional step for auxiliary teaching positions retain the intended classification if it is within the limits set out in the Annexes to this Law. (3) The promotion of teaching staff to teaching degrees is based on their own regulations on obtaining them. The passage of the teaching staff in a tranche of seniority in higher education will be made from the first of the month following the month in which the intended seniority was fulfilled. ((4) The promotion of auxiliary teaching staff to functions, degrees or professional steps is made according to the legal regulations in force applicable to staff employed with employment contract, respectively according to the provisions art. 26 26 of the Framework Law no. 284/2010 and art. 4 4 of Annex no. I Head. II lit. L of the Framework Law no. 284/2010 . + Article 3 If following the application of the calculation methodology covered by Annex no. 5 results in an amount of gross basic salary of less than 670 lei per month, for a full working hours of 170 hours on average per month in 2011, the latter amount will be taken into account. + Article 4 (1) The management of the personnel payroll system in the state pre-university and university educational institutions shall be provided by the principal authorising officers and by the Ministry of Education, Research, Youth and Sports. (2) The principal authorising officers and employers have the obligation to establish the basic salaries, bonuses and other salary rights established under this law, to ensure the promotion of staff to functions, degrees and professional steps, in the terms of the law, so as to fit into the amounts approved with this destination in its own budget. + Article 5 The violation of the provisions of the present law on the establishment of the individual basic salary and the other rights, as well as the granting of rights without respecting its provisions attract, as the case may be, the disciplinary guilty persons, according to the law. + Article 6 Any other provisions contrary to the establishment of salaries and other rights of a salary nature, in 2011, for the staff referred to in art. 1 1 para. ((1), shall be repealed. + Article 7 Annexes no. 1, 2, 3a, 3b, 4 and 5 are an integral part of this law. This law was adopted pursuant to the provisions of art. 114 114 para. (3) of the Romanian Constitution, republished, following the commitment of the Government's responsibility to the Chamber of Deputies and the Senate, at the joint meeting on April 18, 2011.
