Law No. 262 of 16 December 2010 for ratification of the agreement in addition to the multilateral Memorandum of understanding on the NATO E-3A, signed on 6 December 1978, completed on 10 December 1990, amended on 13 august 1997, concerning the accession of the Government of the Czech Republic, and the supplementary agreement to the memorandum of understanding on operations and support of the Force NATO Airborne early warning and Control , signed on 26 September 1984, and revised on 27 March 2003 concerning the accession of the Czech Republic Government, opened for signature on 3 February 2009, signed by Romanian side Bucuresti on January 28, 2010 posted in PARLIAMENT ISSUING the OFFICIAL GAZETTE nr. 874 dated December 28, 2010, the Romanian Parliament adopts this law.


Article 1 shall be ratified the agreement in addition to the multilateral Memorandum of understanding on the NATO E-3A, signed on 6 December 1978, completed on 10 December 1990, amended on 13 august 1997, concerning the accession of the Government of the Czech Republic, opened for signature on 3 February 2009, signed by Romanian side Bucuresti on January 28, 2010.


Article 2 shall ratify the supplementary agreement to the memorandum of understanding on operations and support of the Force NATO Airborne early warning and Control, signed on 26 September 1984, and revised on 27 March 2003 concerning the accession of the Czech Republic Government, opened for signature on 3 February 2009, signed by Romanian side Bucuresti on January 28, 2010.
This law was adopted in the Romanian Parliament, in compliance with the provisions of art. 75 and of art. 76 para. (2) of the Constitution of Romania, republished.

ADDITIONAL AGREEMENT to the multilateral Memorandum of understanding on the NATO E-3A, on accession of the Government of the Czech Republic *) — — — — — — *) version.
The Governments of Belgium, Canada, Denmark, Germany, Greece, Hungary, Italy, Luxembourg, Netherlands, Norway, Poland, Portugal, Romania, Spain, Turkey, United Kingdom of Great Britain and Northern Ireland and United States of America (hereinafter the participants), developing the NATO E-3A in the multilateral memorandum of understanding on the NATO E-3A, signed on 6 December 1978, completed on 10 December 1990, as at 13 august 1997 on December 11, 1998 and supplemented for the accession of Spain, as at 8 April 2004, supplemented on 22 December 2005 Hungary's accession, as at 14 February 2006, supplemented on 29 December 2006 for the accession of Poland and supplemented 19 March 2009 for Romania's accession (hereinafter MMOU, with subsequent amendments and additions), following the request of the Government of the Czech Republic to participate in the NATO E-3A according to MMOU , as amended and supplemented; and as a result of the consultations concerning the accession of the Government of the Czech Republic, have come to the conclusion that, by accepting the terms and conditions detailed in the articles that follow, the Government of the Czech Republic joining the MMOU, with subsequent amendments and additions, and agree: (I) the Government of the Czech Republic, through the present document, joining the MMOU, with subsequent amendments and additions, and will abide by its provisions, the scope of the agreements and of the documents and decisions approved by the Board of Directors (BOD) of the Organization for the NATO AEW and program management C (NAPMO).


Article II the Government of the Czech Republic, as a member of NAPMO, will have a representative with voting rights in committees and in BOD NAPMO NAPMO, under the same conditions as all other members NAPMO. The Government of the Czech Republic will have no rights, including voting rights, with regard to aspects of NATO AEW and C Program formerly accession of the Czech Republic Government and in relation to which the Government of the Czech Republic had no financial contribution.


Article III taking into account participants ' financial contributions ceiling, 200 million u.s. dollars for the project "Large Aircraft Infrared Counter Measures" (LAIRCM), as has been established in the MMOU, with subsequent amendments and additions, the Government of the Czech Republic will help with 1.2240% of the total amount of the contributions to the draft LAIRCM.
The Government of the Czech Republic will also pay with effect from 1 January 2010:488,376 amount of) us dollars, which is equivalent to 1.2240% of the required amount to the other projects approved which lies NAPMO underway (39.9 million u.s. dollars);
  

b) an amount equal to 1.2240% of all other expenses have been approved, resulting in the NATO AEW and C; and c) from the year 2010, the annual contributions towards the costs of the NATO E-3A operations and support, as defined in the supplementary agreement on the accession of the Czech Republic Government in the memorandum of understanding for operations and support of the Force NATO AEW and C, signed on 26 September 1984, and revised on March 27, 2003.
  


Article IV the Government of the Czech Republic will appoint personnel to work within NAPMA in accordance with approved policies and procedures by the NAPMO BOD.


Article V of this agreement in addition to the MMOU, with subsequent amendments and additions, will enter into force on the date of the last signature.

The Governments of Belgium, Canada, Denmark, Germany, Greece, Hungary, Italy, Luxembourg, Netherlands, Norway, Poland, Portugal, Romania, Spain, Turkey, United Kingdom of Great Britain and Northern Ireland and United States of America, by developing a common programme in support of the NATO AEW Force operations and C, based on the memorandum of understanding on operations and support of the Force NATO Airborne early warning and Control , signed on 26 September 1984, and revised on March 27, 2003, supplemented on 22 December 2005 Hungary's accession, on 29 December 2006 for the accession of Poland, and on March 19, 2009 for Romania's accession (hereinafter MOU for operations and support) as a result of the request of the Government of the Czech Republic to participate in the Force NATO AEW and C, according to the provisions of the MOU and operations support; and as a result of the consultations concerning the accession of the Government of the Czech Republic, have come to the conclusion that, by accepting the terms and conditions detailed in the articles that follow, the Government of the Czech Republic was a signatory to the MOU for operations and support and agree: (I) the Government of the Czech Republic, through the present document, adheres to the MOU for operations and support and will abide by its provisions and those of the implementing agreements.


Article II from 2010, the Government of the Czech Republic will participate in the operations and support of the NATO AEW Force elements and (C) financed by NATO and will participate in the Division of the costs of operations and support of the E-3A, as set out in section VIII of the MOU on operations and support.
The annual contribution of the Government of the Czech Republic will grow to achieve a fixed contribution of 1.2240% of the budget for operations and support in 2012 (2010-0.4080% and 0.8160% of the 2011 budget for operations and support, contract value less DLM). The annual contribution of the Government of the Czech Republic to the NATO AEW Force Headquarters and C will be 0.9790% from 2010. The percentage contributions of the participants to the MOU for operations and support will be adjusted according to section VIII, paragraph 1. 2. (a) (2).


Article III the Government of the Czech Republic will appoint personnel to work within the framework of the NATO AEW Force Command and C and the NATO E-3A Component, in accordance with NATO policies and procedures.


Article IV of this agreement in addition to the MOU for operations and support will come into force on the date of the last signature.
