The Romanian Parliament adopts this law + Article 1 It is ratified Additional Agreement to the Multilateral Memorandum of Understanding on the NATO Joint Programme E-3A, signed on 6 December 1978, completed on 10 December 1990, amended on 13 August 1997, on the accession of the Government of the Czech Republic, opened for signature on 3 February 2009, signed by the Romanian side in Bucharest on 28 January 2010. + Article 2 It is ratified Additional Agreement to the Memorandum of Understanding for Operations and Support of the NATO Air Force on Early Warning and Control, signed on 26 September 1984 and revised on 27 March 2003, on the accession of the Government of the Czech Republic, open for signature at 3 February 2009, signed by the Romanian side in Bucharest on 28 January 2010. This law was adopted by the Romanian Parliament, in compliance with the provisions of art. 75 75 and art. 76 76 para. (2) of the Romanian Constitution, republished. ADDITIONAL AGREEMENT to the multilateral Memorandum of Understanding on the Programme joint NATO E-3A, on the accession of the Czech Republic Government *) ------ * *) Translation. The Governments of Belgium, Canada, Denmark, Germany, Greece, Hungary, Italy, Luxembourg, the Netherlands, Norway, Poland, Portugal, Romania, Spain, Turkey, the United Kingdom of Great Britain and Northern Ireland and the United States of America ((hereinafter referred to as participants), developing the NATO E-3A Joint Programme on the basis of the multilateral Memorandum of Understanding on the NATO Joint Programme E-3A, signed on 6 December 1978, completed on 10 December 1990, amended on 13 August 1997, supplemented on 11 December 1998 for Accession of Spain, amended on 8 April 2004, supplemented on 22 December 2005 for the accession of Hungary, amended on 14 February 2006, supplemented on 29 December 2006 for the accession of Poland and supplemented on 19 March 2009 for the accession of Romania ((hereinafter referred to as MMOU, as amended and supplemented), following the request of the Government of the Czech Republic to participate in the NATO Joint Programme E-3A according to the MMOU, with subsequent amendments and completions; and following consultations on the accession of the Government of the Czech Republic, have concluded that, by accepting the detailed conditions in the following articles, the Government of the Czech Republic shall accede to the MMOU, with subsequent amendments and completions, and agree: + Article I The Government of the Czech Republic, by this document, adheres to the MMOU, with subsequent amendments and completions, and will comply with its provisions, application agreements and documents and decisions approved by the Board of Directors (BOD) of the Organization for Management of the NATO AEW and C Program (NAPMO). + Article II The government of the Czech Republic, as a member of NAPMO, will have a representative with the right to vote in NAPMO BOD and in the NAPMO committees, under the same conditions as all other NAPMO members. The government of the Czech Republic will not have rights, including the right to vote, on aspects of the AEW and C NATO Programme previously decided on the accession of the Government of the Czech Republic and in relation to which the Government of the Czech Republic had no contribution financial. + Article III Taking into account the financial contribution ceiling of the participants, US $200 million for the project "Large Aircraft Infrared Counter Measures" (LAIRCM), as set out in the MMOU, with subsequent amendments and completions, The government of the Czech Republic will contribute 1.2240% of the total amount of contributions to the LAIRCM project. The Government of the Czech Republic will also pay, as of 1 January 2010: a) the amount of US $488,376, which is equivalent to 1,2240% of the amount required of the other approved NAPMO projects that are ongoing (US $39.9 million); b) an amount equal to 1,2240% of any other approved expenditure, resulting from the NATO AEW and C Program; and c) starting from 2010, the annual contributions to the coverage of NATO E-3A costs for operations and support, as defined in the Supplementary Agreement on the Accession of the Government of the Czech Republic to the Memorandum of Understanding for Operations and support of the NATO AEW and C Force, signed on 26 September 1984 and revised on 27 March 2003. + Article IV The government of the Czech Republic will designate the staff to work within the NAPMA, in accordance with the policies and procedures approved by NAPMO BOD. + Article V This additional agreement at the MMOU, with subsequent amendments and completions, will enter into force on the date of the last signature. The Governments of Belgium, Canada, Denmark, Germany, Greece, Hungary, Italy, Luxembourg, the Netherlands, Norway, Poland, Portugal, Romania, Spain, Turkey, the United Kingdom of Great Britain and Northern Ireland and the United States of America, developing a joint programme in support of the operations of the NATO AEW and C Force, based on the Memorandum of Understanding for Operations and Support of the NATO Air Force Early Warning and Control, signed on 26 September 1984 and revised to 27 March 2003, supplemented on 22 December 2005 for the accession of Hungary, on 29 December 2006 for the accession of Poland and on 19 March 2009 for the accession of Romania (hereinafter referred to as the MOU for operations and support), following the request of the Government of the Czech Republic to participate in the AEW and C NATO Force, according to the MOU's provisions for operations and support; and following consultations on the accession of the Government of the Czech Republic, have concluded that, by accepting the detailed conditions in the following Articles, the Government of the Czech Republic shall accede to the MOU for operations and support and agree: + Article I The Government of the Czech Republic, by this document, adheres to the MOU for operations and support and will comply with its provisions and application agreements. + Article II Since 2010, the Government of the Czech Republic will participate in the operations and support of NATO-funded NATO AEW and C Force elements and will participate in the division of operations and support costs of E-3A as set out in Section VIII of the MOU for operations and support. The annual contribution of the Government of the Czech Republic will increase until reaching a fixed contribution of 1,2240% of the budget for operations and support in 2012 (in 2010-0,4080% and in 2011-0,8160% of the budget for operations and support, less DLM contract value). The annual contribution of the Government of the Czech Republic to the NATO Force Command AEW and C will be 0.9790% as of 2010. The percentage contributions of MOU participants for operations and support will be adjusted according to section VIII para. 2. ((a) (2). + Article III The government of the Czech Republic will designate the personnel to work in the NATO AEW and C Force Command and the NATO E-3A Component, in accordance with NATO's policies and procedures. + Article IV This additional agreement at the MOU for operations and support will enter into force on the date of the last signature.
