LEGE no. 306 306 of 24 December 2008 on the empowerment of the Government to issue ordinances

The Romanian Parliament adopts this law + Article 1 Pursuant to art. 115 115 para. (1) of the Romanian Constitution, republished, the Government is empowered that, from the date of entry into force of this law, but not before the end of the second ordinary session of 2008, until the resumption of the Parliament's work in the first Ordinary session of 2009, to issue ordinances in areas not subject to organic laws, as follows: I. Public Finance and Economy: 1. regulation of financial and fiscal measures applicable in the implementation of the "Transition Facility for Romania" program, provided for in the Decision of the European Commission C (2007) 5.793 of 30 November 2007; 2. establishment of the activity of running and managing the institutional twinning projects financed by the European Union, for which Romania has the status of technical assistance donor; 3. modification and completion Government Emergency Ordinance no. 198/2005 on the establishment, supply and use of the Maintenance, Replacement and Development Fund for projects for the development of public service infrastructure benefiting from non-reimbursable financial assistance from the European Union, approved by Law no. 108/2006 , with subsequent amendments and completions; 4. modification and completion Government Emergency Ordinance no. 214/2000 on certain measures for the execution of the rehabilitation works of Group no. 1 from the Mintia-Deva Thermal Power Plant, approved with modifications by Law no. 449/2001 , with subsequent amendments and completions; 5. modification and completion Government Emergency Ordinance no. 113/2006 on the establishment of the National Development Fund approved by Law no. 186/2008 ; 6. approval of payment of national participation costs for projects under the Technical Cooperation Program with the International Atomic Energy Agency (IAEA); 7. regulations on ensuring the financial resources necessary to support the state pension system; 8. regulation of measures on increasing the financing from the state budget of the thermal rehabilitation of the central and local public administration houses and buildings; 9. measures regarding the reduction of taxes for the registration of marks and patents for inventions; 10. measures to simplify the expropriation procedures for the cause of public utility; 11. ensuring the capitalization of the Export-Import Bank of Romania EXIMBANK-S.A., in order to activate and extend the production support instruments; 12. increase the capital of CEC Bank to finance projects of small and medium-sized enterprises 13. capitalization of the National Credit Guarantee Fund for small and medium-sized enterprises; 14. regulations on some financial-fiscal and budgetary measures, except for areas regulated by organic law. II. Spatial planning, infrastructure and transport: 1. measures regarding the reorganization of the activity of construction and maintenance of road transport infrastructure through the establishment of the National Highway Company and the National Road Company; 2. modification and completion of the legislation on the measures prior to the construction works of roads of national, county and local interest; 3. amending and supplementing the legislation on the authorization of the execution of construction works on transport infrastructure; 4. organization and exercise of the profession of geodes; 5. modification and completion Law no. 350/2001 on spatial planning and urbanism, with subsequent amendments and completions; 6. amending and supplementing the legislation on public procurement, except for areas covered by organic law. III. Justice: 1. modification and completion Government Ordinance no. 2/2000 on the organisation of the activity of judicial and extrajudicial technical expertise, approved by Law no. 156/2002 ; 2. modification and completion Government Ordinance no. 75/2000 concerning the authorisation of forensic experts who may be recommended by the Parties to participate in the conduct of forensic surveys, approved with amendments by Law no. 488/2002 ; 3. regulations on citizenship, except in the situations provided by art. 5 of the Romanian Constitution, republished. IV. Public administration: 1. modification and completion Government Ordinance no. 15/1998 on the establishment, organization and functioning of the European Institute of Romania, approved with amendments Law no. 207/1998 , with subsequent amendments and completions; 2. modification and completion Government Ordinance no. 128/2000 on the establishment of fees for services provided for individuals and legal entities by the Ministry of Interior and Administrative Reform, approved with amendments by Law no. 570/2002 ,, as amended; 3. modification and completion Government Emergency Ordinance no. 97/2005 on the record, domicile, residence and identity documents of Romanian citizens, approved with amendments and completions by Law no. 290/2005 , with subsequent amendments and completions; 4. modification and completion Government Ordinance no. 84/2001 on the establishment, organization and functioning of the Community public records services, approved with amendments and additions by Law no. 372/2002 , with subsequent amendments and completions; 5. modification and completion Government Ordinance no. 41/2003 on the acquisition and administrative change of the names of individuals, approved with amendments and additions by Law no. 323/2003 ,, as amended; 6. regulations on the reorganization of some institutions and authorities of the specialized central public administration; 7. regulations on the financial decentralization of public administration. V. Health: 1. measures regarding the compensation of at least 90% of the reference price of medicines for pensioners and low-income persons; 2. regulation of insurance of free drugs for children, students, students, pregnant and lauze; 3. measures to stimulate the opening of pharmacies and pharmaceutical points in rural areas; 4. regulations on free flu vaccination of children, pensioners and people at risk or in isolated areas; 5. modification and completion Government Ordinance no. 53/2000 on the obligation to report diseases and carry out vaccinations, approved with amendments Law no. 649/2001 ; 6. regulations on health care reform, except for areas covered by organic law; 7. modification and completion Government Emergency Ordinance no. 162/2008 on the transfer of the assembly of duties and powers exercised by the Ministry of Public Health to the local public administration authorities; 8. economic-financial and organizational measures for carrying out the activity of health facilities within the reform and operationalization process. VI. Culture: 1. modification and completion Law of public forum monuments no. 120/2006 ; 2. modification and completion Law no. 35/1994 on literary, cinematographic, theatrical, musical, folkloric, fine arts, architecture and entertainment timbre, republished; 3. modification and completion Government Ordinance no. 9/1996 on the improvement of the financing system of public cultural institutions financed by extra-budgetary income and allowances from the state budget or local budgets, the staff payroll system in these institutions, and improving the salaries of staff in cultural institutions and activities, approved with amendments and additions Law no. 86/1996 , with subsequent amendments and completions; 4. modification and completion Government Ordinance no. 39/2005 on cinematography, approved with amendments and additions by Law no. 328/2006 , with subsequent amendments and completions; 5. modification and completion Law no. 26/2008 on the protection of intangible cultural heritage; 6. the approval of the Multiannual National Program for the digitization of national cultural resources and the creation of the Digital Library VII. Payroll: 1. regulations on salary increases in the budgetary sector in 2009; 2. modification and completion Government Ordinance no. 64/2006 on the salary and other rights of civil servants with special status in the prison administration system, approved with amendments by Law no. 462/2006 ,, as amended; 3. modification and completion Government Emergency Ordinance no. 115/2004 on the remuneration and other rights of contract staff in public health facilities in the health sector, approved with amendments and additions by Law no. 125/2005 , with subsequent amendments and completions; 4. modification and completion of some normative acts on the salary and other rights of the staff in the bodies of the judicial authority. VIII. Youth and sport: -amending and supplementing Youth law no. 350/2006 ,, as amended. IX. Agriculture: 1. regulation of financial measures to stimulate the absorption of funds allocated for agriculture; 2. modification and completion Law no. 1/2004 on the establishment, organization and functioning of the Agency for Payments and Intervention for Agriculture, with subsequent amendments and completions; 3. modification and completion Government Emergency Ordinance no. 27/2008 on the management of grants from the European Community from the European Fisheries Fund and the co-financing and pre-financing funds allocated from the State budget, approved by Law no. 168/2008 ; 4. modification and completion Government Emergency Ordinance no. 13/2006 on the establishment, organization and functioning of the Agency for Rural Development and Fisheries through the reorganization of the SAPARD Agency, approved with amendments and completions by Law no. 198/2006 , with subsequent amendments and completions. X. Tourism: -amending and supplementing Government Ordinance no. 58/1998 on the organization and conduct of tourism activity in Romania, approved with amendments and completions by Law no. 755/2001 ,, as amended. XI. Education: -regulations in the field of education and research, except for areas regulated by organic law. XII. Environment: -the establishment of measures on pollution tax for motor vehicles. XIII. The extension of some deadlines provided for in normative acts with the force of law. + Article 2 According to the provisions of art. 115 115 para. (3) of the Romanian Constitution, republished, the ordinances issued by the Government pursuant to art. 1 will be submitted for approval to the Parliament, according to the legislative procedure, until the resumption of Parliament's work in the first ordinary session of 2009.
