The content of this act is not an official document, being intended to inform users The Romanian Parliament adopts this law + Article 1 The loan agreement between Romania, represented by the Ministry of Economy and Finance, and the International Bank for Reconstruction and Development, amounting to US $180 million, is ratified to finance the Sectoral Support Project Transport, signed in Bucharest on 27 November 2006, hereinafter referred to as the Project. + Article 2 (1) Implementation of the loan agreement provided for in art. 1 will be carried out by the implementing agencies, namely the National Company of Highways and National Roads in Romania-S.A., for the amount of 90 million dollars U.S., and the National Railway Company "C.F.R." -S.A., for the amount of 90 million U.S. dollars (2) Between the Ministry of Economy and Finance, as a representative of the Loan, the Ministry of Transport, as the coordinating ministry of the activity of the Project implementation agencies and principal authorising officer, such as and each of the project implementation agencies, namely the National Highway and National Roads Company of Romania-S.A. and the National Railway Company "C.F.R." -S.A., a subsidiary loan agreement will be concluded, by which the entire authority and responsibility will be delegated to the implementation agencies in the implementation of the Project and in the use of the amounts on the loan. ((3) As of 1 January 2009, the subsidiary loan agreements referred to in par. ((2) is amended as subsidiary agreements and includes the rights and obligations of the parties in the application of the loan agreement according to the provisions art. 14 of Government Emergency Ordinance no. 64/2007 on public debt, approved with amendments and additions by Law no. 109/2008 ,, as amended. ----------- Alin. ((3) of art. 2 2 has been introduced by section 1 1 of art. 43 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 3 (1) The funds necessary for the reimbursement of the external loan, interest payment, commissions and other costs related to the loan will be provided from the state budget, from the amounts provided annually with this destination through the budget of the Ministry Transport. (2) Romania's contribution to the realization of investments financed by the external loan granted by the International Bank for Reconstruction and Development, provided in art. 1, including for the payment of taxes and fees charged on the territory of the country, as well as the value of other local costs, which cannot be paid from the external loan, will be ensured from the state budget, from the amounts provided annually by the budget Transport Ministry. + Article 3 ^ 1 As of January 1, 2009, the expenses related to the project, representing the expenses equivalent to the amounts remaining to be drawn from the loan and of Romania's contribution to the financing of the project, including taxes and fees any other local costs related to the project will be cumulated in the budget of the Ministry of Transport, within the amounts allocated annually with this destination from the state budget. ------------- Art. 3 ^ 1 was introduced by item 1. 2 2 of art. 43 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 4 (1) The Romanian Government is authorized that, through the Ministry of Economy and Finance, in agreement with the International Bank for Reconstruction and Development, to introduce during the use of the external loan, in relation to the concrete conditions of The loan agreement referred to in art. 1, amendments to its content, which concern reallocations of funds, changes of deadlines, as well as any other changes that are not likely to increase Romania's financial obligations to the International Bank for Reconstruction and Development or determine new economic conditionings from those originally agreed between the parties. ((2) Amendments to the loan agreement provided for in art. 1, agreed with the International Bank for Reconstruction and Development according to par. (1) is approved by Government decision.
