The content of this act is not an official document, being intended to inform users The Romanian Parliament adopts this law + Article 1 The loan agreement between Romania and the International Bank for Reconstruction and Development, worth 29.6 million euros, is ratified to finance the Project on preventing and combating the expansion of avian influenza, signed in Bucharest at 5 October 2006, hereinafter called the Agreement. + Article 2 (1) The project on preventing and combating the expansion of avian influenza, hereinafter referred to as the Project, shall be carried out by the National Veterinary Health and Food Safety Authority and the Ministry of Public Health. In this respect: a) within the National Veterinary Health and Food Safety Authority, the Project Management Unit for the modernization of the information and knowledge system in agriculture and the Project on prevention and combating the expansion of avian influenza, equipped with appropriate personnel, appropriate in number and duties, for the implementation of its part of the Project on the modernization of the information and knowledge system in agriculture and the Project on preventing and combating the spread of avian influenza; b) The Project Management Unit of the Global Fund to Fight AIDS, Tuberculosis and Malaria and the World Bank, established within the Ministry of Public Health, will be completed with appropriate personnel, appropriate in number and duties, for the implementation of its part of the Project on preventing and combating the expansion of avian influenza (2) The Ministry of Public Finance will conclude subsidiary loan agreements with the National Veterinary Health and Food Safety Authority and the Ministry of Public Health, which will delegate to them the entire authority and responsibility in the implementation of the Project and the use of the loan ((3) As of 1 January 2009, the subsidiary loan agreements referred to in par. ((2) is amended as subsidiary agreements and includes the rights and obligations of the parties in the application of the loan agreement according to the provisions art. 14 of Government Emergency Ordinance no. 64/2007 on public debt, approved with amendments and additions by Law no. 109/2008 ,, as amended. ------------ Alin. ((3) of art. 2 2 has been introduced by section 1 1 of art. 42 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 3 The contribution of the Romanian side to the financing of the Project will be ensured, starting with 2006, within the limit of the amount of 7.9 million euros from the state budget, as follows: a) through the budget of the National Veterinary Health and Food Safety Authority-5.1 million euros; b) through the budget of the Ministry of Public Health-2.8 million + Article 3 ^ 1 ((1) As of January 1, 2009, the expenses related to the project, representing the expenses equivalent to the amounts remaining to be drawn from the loan and from the contribution of the Romanian part to the financing of the project related, provided in art. 3, will be cumulated in the budget of the National Veterinary Health and Food Safety Authority and the Ministry of Public Health within the amounts allocated annually with this destination from the state budget. " (2) I take exception to the provisions of par. (1), expenditure in the framework of letters of credit opened by the Ministry of Public Health and operational and after January 1, 2009, which will be included in its budget as amounts allocated from external credit inflows and, respectively, as allocated amounts from the state budget in its own budget, depending on the source of financing of that expenditure. ------------ Art. 3 ^ 1 was introduced by item 1. 2 2 of art. 42 of EMERGENCY ORDINANCE no. 157 157 of 12 November 2008 published in MONITORUL OFFICIAL no. 802 802 of 28 November 2008. + Article 4 The payment of the public debt service related to the loan, namely its reimbursement, the payment of interest, commissions and other costs related to the loan, shall be ensured by the Ministry of Public Health and the National Health Authority Veterinary and Food Safety from the amounts with this destination, allocated annually from the state budget in its own budgets, since 2006. + Article 5 (1) The Ministry of Public Finance is authorized that, at the request of the National Veterinary Health and Food Safety Authority and the Ministry of Public Health, respectively, in agreement with the International Bank for Reconstruction and Development, to introduce during the use of the loan, in relation to the concrete conditions of implementation of the Agreement, amendments to its content, which concern reallocations of funds, changes in the structure on components, as well as other changes that are not likely to increase Romania's financial oblations towards The International Bank for Reconstruction and Development or to determine new economic conditionings from those originally agreed between the parties. (2) Amendments to the Agreement, agreed with the International Bank for Reconstruction and Development according to par. (1), will be approved by Government decision. + Article 6 Alin. ((1) art. 2 2 of Law no. 170/2005 for the ratification of the Loan Agreement between Romania and the International Bank for Reconstruction and Development on the Financing of the Project for the modernization of the information and knowledge system in agriculture, signed in Bucharest on January 28 2005, published in the Official Gazette of Romania, Part I, no. 526 of 21 June 2005, is amended and shall read as follows: "" Art. 2. --(1) The project for the modernization of the information and knowledge system in agriculture, hereinafter referred to as the Project, shall be carried out by the Ministry of Agriculture, Forestry and Rural Development and by the National Health Authority Veterinary and Food Safety. For the purpose of implementing the Project in good conditions, the Project Management Unit "Supporting services in agriculture", within the Ministry of Agriculture, Forestry and Rural Development, will be equipped with appropriate, appropriate personnel in number and duties, and will ensure the implementation of its part of the Project, and within the National Veterinary Health and Food Safety Authority the Project Management Unit for the modernization of the information and knowledge in agriculture and the Project on prevention and combating the expansion of avian influenza, equipped with appropriate personnel, appropriate in number and duties, for the implementation of its part of the Project for the modernization of the information and knowledge system in agriculture and the Project on preventing and combating the expansion of avian influenza. " This law was adopted by the Romanian Parliament, in compliance with the provisions of art. 75 75 and art. 76 76 para. (2) of the Romanian Constitution, republished.
