The Romanian Parliament adopts this law + Article UNIC Approval Government Emergency Ordinance no. 73 73 of 29 June 2005 to amend and supplement Government Emergency Ordinance no. 107/2002 on the establishment of the National Administration "Romanian Waters", published in the Official Gazette of Romania, Part I, no. 607 of 13 July 2005, with the following amendments and additions: 1. In point 1 of Article I, paragraph 2 of Article 1 shall read as follows: "(2) The National Administration" Romanian Waters "is the Romanian legal person and operates on the basis of economic management and autonomy, in the coordination of the central public authority in the field of water, under the conditions of this emergency ordinance." 2. In point 3 of Article I, Article 2 shall read as follows: "" Art. 2. -(1) The patrimony of the National Administration "Romanian Waters", established as a public institution, is taken from the National Administration "Romanian Waters" that functioned as an autonomous direction. (2) The National Administration "Romanian Waters" manages the goods in the public domain of the state, of the nature of those provided in art. 136 136 para. (3) of the Romanian Constitution, republished, the public property provided by Law no. 213/1998 on public property and its legal regime, with subsequent amendments and completions, according to Annex no. 2, as well as its own patrimony established on the basis of the financial statements existing at the end of the month prior to the date of registration as (3) The surrender-takeover of the patrimony between the National Administration "Apele Române", established as a public institution, and the National Administration "Apele Române", which functioned as an autonomous direction, will be made by protocol, based on financial statements existing at the end of the month preceding the date of registration as a public institution with the (4) The functioning of the National Administration "Romanian Waters" as an autonomous direction ceases by right on the date of conclusion of the protocol of surrender-receipt ((5) Goods in the public domain, consisting of: lakes not declared of national public interest, flood defences, which are not constituted in a continuous line of defence, reinforcements and defences of banks and the works of directing, pass, by decision of the Government, in the administration of the beneficiaries who are served by them. " 3. In paragraph 6 of Article I, paragraph 1 of Article 4 shall read as follows: "" Art. 4. --(1) The expenses for the functioning of the National Administration "Romanian Waters" will be ensured from their own income, interest-bearing, resulting from the application of the specific economic mechanism in the field of quantitative and qualitative water management. Own revenue not covered during the financial year shall be carried over to the following financial year. '; 4. In point 7 of Article I, Article 5 shall read as follows: "" Art. 5. -(1) The management of the National Administration "Apele Române" is provided by a management board composed of 11 members. (2) The President of the Governing Board is the Director General of the National Administration "Apele Române", appointed by order of the head of the central public authority in the field of water, credits for funds from the state budget. The heads of units with subordinated legal personality are tertiary authorising officers, in relation to their tasks, according to the law. (. The members of the governing board shall be appointed and revoked by order of the head of the central public authority in the field of water. (4) The powers and powers of the governing council are laid down in the statute on the organization and functioning of the National Administration "Romanian Waters". (5) The salary of the personnel taken over by the National Administration "Romanian Waters" is made in accordance with the legal regulations applicable to public institutions fully financed from their own income. (6) The salary and other salary rights of the Director-General shall be proposed, under the law, by the governing council and shall be approved by order of the head of the central public authority in the field of water. " 5. Annexes no. 1 1-7 to Government Emergency Ordinance no. 73/2005 shall be replaced by Annexes no. 1 1-7 which are an integral part of this law. 6. Article II (2) shall be repealed. 7. In Article II, paragraph 3 shall read as follows: "(3) The financial year of the National Administration" Romanian Waters "as a public institution, begins with the first time of the month in which the tax registration is made." Waters with their potential value, except for living aquatic resources and those that can be used in the public interest, with their minor beds, banks and lakes, with their natural riches, beaches and territorial sea, as well as other goods belonging to the public patrimony of national interest, nominated in Government Decision no. 2.060/2004 for the approval of the inventories of goods in the public domain of the state, with subsequent additions, 13 13, p. 136-396. 2. National Water Management Data Fund. + Annex 3 SPECIFIC ECONOMIC MECHANISM Sustainable management of water resources + Article 1 (1) The economic mechanism specific to the field of quantitative and qualitative management of water resources includes the system of contributions, payments, bonuses, tariffs and penalties as part of the way of financing the development of the field and ensuring officials of the National Administration "Romanian Waters". ((2) Water is a natural resource of economic value in all its forms of use/exploitation. Conservation, reuse and saving of water are encouraged by the application of economic stimuli, including those who show a constant concern in protecting the quantity and quality of water, as well as by applying penalties to those who waste or pollute water resources. Users of water resources pay the use of it to the National Administration "Romanian Waters", as the sole operator of water resources. (3) I am an exception to the provisions of para. (2) users using raw water under the conditions laid down in art. 81 81 para. ((2) of the Water Law no. 107/1996 , with subsequent amendments and completions. + Article 2 (1) The National Administration "Romanian Waters" applies the system of contributions, payments, bonuses, tariffs and penalties for specific activities and common services for the management of water resources, starting with the first of the month following the entry in force of Government Emergency Ordinance no. 73/2005 . (2) The system of contributions, payments, bonuses, tariffs and penalties, according to the provisions Law no. 107/1996 , with subsequent amendments and completions, is based on the principles of cost recovery for knowledge and management of water resources "user pays" and "polluter pays". (3) The National Administration "Romanian Waters" is the only one in law to apply the system of contributions, payments, bonuses, tariffs and penalties specific to the water management of all water users, regardless of the holder with any title of arrangement, as well as from underground sources, except for those for which there are specific regulations in force. (4) Specific contributions for water management as set out in Annex no. 4, are differentiated, in order to stimulate the economic stimulation of the sustainable use of water resources, by category of sources and groups of users and on polluting substances in wastewater discharged in water resources. (5) Contributions provided in par. (4) shall be charged monthly to all water users. + Article 3 (1) The right to use the resources managed by the National Administration "Romanian Waters", as a public institution, is obtained on the basis of the subscription of use/exploitation concluded with the single operator. (2) The subscription/exploitation framework shall be approved by order of the head of the central public authority in the field of water management and shall be published in the Official Gazette of Romania, Part I. (3) The National Administration "Romanian Waters" will conclude subscription of use/exploitation with water users, according to their request, within the limits of the provisions of the regulations of use in terms of water management. (4) The quality of the raw water provided in the source is classified according to the rules in force. + Article 4 (1) For the common water management services provided by the National Administration "Romanian Waters", provided in Annex no. 4 4 section II, the tariffs are established by direct negotiation between the units subordinated to the National Administration "Romanian Waters" and users. (2) The provision of common water management services shall be made on the basis of contracts concluded with the beneficiaries. + Article 5 Divergences arising at the conclusion of contracts or subscriptions of use/exploitation between the directions of waters or other units under the National Administration "Romanian Waters" and users are negotiated as the final stage of conciliation, at central level of the National Administration "Romanian Waters", in the presence of representatives of the competent authorities + Article 6 (1) The National Administration "Romanian Waters", in relations with users, grants bonuses and applies penalties, as the case may be. (2) Water users who constantly demonstrate particular care for the rational use and for the protection of water quality, while evacuating with wastewater purged contaminants in concentrations lower than those entered in the water management authorization is granted, according to the law, bonuses. The bonuses are granted up to 10% of the annual amount of the contributions settled, based on the methodology established by order of the head of the central public authority in the field of water, within 6 months from the date of entry into force of emergency ordinance. (3) The National Administration "Romanian Waters" is the only one in law to find and propose the cases in which bonuses are granted. The bonuses are approved by order of the head of the central public authority in the field of water. (4) The penalties apply to those users of water to which deviations are found from the regulated provisions both for exceeding the quantities of water used and the concentrations of contaminants discharged in water resources. Their amount is set out in Annex no. 6. (5) The penalties are periodically amended by Government decision, at the proposal of the central public authority in the field of water. (6) Finding the deviations provided in par. (4) shall be made by the personnel with the right of control empowered for this purpose, provided by law, and shall be recorded in the minutes concluded between the parties. (7) The decision and the minutes of finding shall be communicated to the unit penalized by post, with acknowledgement of receipt, within a maximum of 20 working days from the date of its issuance. Against the minutes of finding and establishing the penalties the unit in question may complain, within 15 working days from the receipt of the communication, at the court in whose territorial area the deviation was committed. The decision to resolve the complaint is final. The minutes of penalties, unchallenged in court within the time limit set, constitute an enforceable title. + Article 7 (1) The communal household units that have in administration the water supply and sewerage networks of the localities may apply the penalties provided for in the "System of contributions, payments, bonuses, tariffs and penalties", which is part of the water-specific economic mechanism. (2) The penalties collected by the communal household units are made income and are used for the modernization of the installations and the retrofitting of the wastewater treatment plants, according to the legislation in force. + Article 8 (1) For the obligations of the debtor declared insolvent, interest shall be calculated until the date of conclusion of the minutes of insolvency finding. (2) For the non-paid-forward obligations both before and after the opening of the judicial reorganization procedure, interest and late payment penalties are due until the date of opening of the bankruptcy proceedings, if this has been triggered before the commencement of the enforcement procedure. + Article 9 The interest rate is determined by the subscription of use/exploitation and/or contract, but may not be lower than that charged for the budget receivables, and shall be modified simultaneously with it. + Article 10 (1) Water users have the obligation to conclude, monthly or quarterly, with the single operator, a minutes of adjustment and certain confirmation of outstanding debits, which also constitute the notice of payment from the date of delivery or communication thereof. (2) This minutes concluded between the signatories of the subscription of use/exploitation and/or the contract constitute enforceable title under the law. (3) The provisions on the content and nullity of the fiscal administrative act of the Fiscal Procedure Code shall apply accordingly. (4) Enforcement under the enforceable title provided in par. (2) shall be carried out by the National Administration "Romanian Waters" similar to the legal regulations in force in terms of collection of tax receivables. + Article 11 The suspension of the right of use/exploitation of water resources applies in case of non-payment of the contribution for 6 months, while taking measures to stop the provision of the service. + Article 12 Outstanding claims not recovered by own effort may also be extinguished by the application of the procedure established by Government Decision no. 685/1999 for the approval of the Methodological Norms on the monitoring of the defaulted debts of taxpayers, legal entities, in order to reduce the financial deadlock and losses in the economy, and the non-refundable debts of taxpayers, legal entities, as amended. + Annex 4 SYSTEM of specific household contributions waters and common water management services I. SYSTEM OF SPECIFIC CONTRIBUTION OF WATER MANAGEMENT A. Contribution for the use of water resources, by category of sources and users A. 1. From inland rivers, natural lakes and reservoirs arranged regardless of the holder, for the purpose of use by: 1.1. economic operators (including communal household services), public institutions, cult units, industrial-type agrootechnics and others; 1.2. economic operators electricity and thermal energy producers by thermal power plants; 1.3. economic operators producers of electricity through hydropower plants, regardless of the installed power, in the regime of use; 1.4. irrigation; 1.5. aquaculture. A. 2. From the Danube, for use by: 2.1. economic operators (including communal household services, ship-keeping services on waterways), public institutions, cult units, industrial-type agrootechnics and others; 2.2. economic operators electric and thermal energy producers by thermal power plants, in open circuit mode; 2.3. economic operators electric and thermal energy producers in open circuit nuclear power plants; 2.4. economic operators producers of electricity through hydropower plants, regardless of the installed power, in the regime of use; 2.5. irrigation; 2.6. aquaculture. A. 3. From underground for use by: 3.1. industrial economic operators; 3.2. economic operators of communal household, public institutions, cult units and others who use water for drinking purposes; 3.3. irrigation; 3.4. aquaculture; 3.5. agrootechnical economic operators. B. Contribution for receiving wastewater in water resources *) B. 1. Contribution for the reception of wastewater in surface water resources: a) in suspended matter; b) to substances in solution; c) to pathogenic germs; d) to thermal pollution; e) to oxygen-consuming substances. B. 2. Contribution for receiving wastewater in permeable soils or in depressions with natural insured leakage: a) in suspended matter; b) to substances in solution; c) to pathogenic germs; d) to oxygen-consuming substances. B. 3. Contribution for the reception of industrial, mine or deposit waste water, injected into very deep layers: a) in suspended matter; b) to substances in solution; c) to pathogenic germs. COMMON WATER MANAGEMENT SERVICES (FOR THE PURPOSES OF THEIR PROCESSING AND USE) Service name: 1. water capture, treatment and pumping; 2. water supply for distribution in the public network; 3. water distribution on industrial platforms; 4. water supply for distribution in the irrigation network; 5. water distribution through the network of other units; 6. water transport through pipes and canals; 7. ensuring the use of tourism and leisure potential of rivers, natural lakes, landscaped reservoirs, Danube, beach and territorial sea; 8. practicing recreational recreational fishing in watercourses, lakes and natural puddles; 9. water quality analysis, for third parties; 10. flood defences through water management works; 11. supplementation of debits; 12. ensuring the fall for hydropower purposes, by other economic operators, through its own dams and sockets; 13. pumping water for the protection of therapeutic lakes, as well as from indiguite enclosures; 14. related activities related to the valorization of water and heritage potentials; 15. other services regarding the processing and use of water, with its potentials; 16. maintenance services-construction repairs in the field of water management. + Annex 5 AMOUNT specific household contributions of water resources Name of the contribution UM Level of contribution Lei/UM (RON/UM) 0 1 2 A.
