The Romanian Parliament adopts this law + Article UNIC Article 1 of Government Emergency Ordinance no. 95/1999 on the valorisation of the goods out of service, under the administration of public defence, public order and national security institutions, published in the Official Gazette of Romania, Part I, no. 286 of 22 June 1999, approved with amendments by Law no. 28/2001 , as amended, amend and supplement as follows: "" Art. 1. -(1) Goods under the administration of public institutions of defense, public order and national security, taken out of service according to the regulations in force, can be capitalized in the physical state in which they are located or as materials and parts results from their demolition or dismantling, as follows: a) by auction, selection of offers of price or direct negotiation, according to the law, organized by the regulation developed by each public institution of defense, public order and national security and approved by the Government; b) by direct exploitation, without tender, if the producer or other bidder accepts the change of goods with other new, similar goods, having at least the same parameters, including goods for services offered by operators economic profile in the defense industry, or in the case of retail sale of inventory items, building materials-accommodation or the resort of feeding, genistic tools, equipment and packaging, according to the regulation drawn up by each public institution of defence, public order and safety national and approved by the Government, or in other situations approved by the heads of these institutions, at the proposal of the Chief of General Staff (similar) c) by transmission without payment to other public institutions or to cult units belonging to recognized religious cults in Romania, under the law. (2) For the purposes of this ordinance, by the phrase goods taken out of service means the fixed assets taken out of service, the atypical fixed or surplus means, even if they are in working order, as well as other material goods in the state which are located, downgraded or closed. (3) The mobile cultural goods classified according to the law, which are out of service, can be capitalized by the public institutions of defense, public order and national security only by transmitting, free of charge, the Ministry of Culture and Cults, in order to be assigned to specialized institutions or cult units belonging to recognized religious cults in Romania, as the case may be, on the basis of minutes of takeover-takeover. (4) Mobile cultural goods which are likely to be classified may be used only after the initiation and completion of the ranking procedure, according to the law. (5) Dismemberment of the goods referred to in ((3) and (4), in order to bring them out of service and to capitalize on them, shall be prohibited.
