334 of 29 November 2005 amending and supplementing art. 1 of Government Emergency Ordinance no. 95/1999 regarding the capitalization of decommissioned under the administration of public institutions of defense, public order and national security

Romanian Parliament adopts this law.
Article 1 of Government Emergency Ordinance no. 95/1999 regarding the capitalization of decommissioned under the administration of public institutions of defense, public order and national security, published in the Official Gazette of Romania, Part I, no. 286 of 22 June 1999, approved with amendments by Law no. 28/2001, as amended, is amended and supplemented as follows:
"Art. 1 - (1) The assets under management of public institutions of defense, public order and national security, decommissioned in compliance with regulations force can be sold in physical condition who are or materials and components resulting from demolition or scrapping them so:
a) auction, selection of bids or direct negotiation by law organized by regulations made by each public defense, public order and national security and approved by the Government;
b) by making direct, without organizing the auction, where the manufacturer or another bidder accepts changing goods other new goods like having at least the same parameters, including goods for services provided by operators in the field of defense industry, or where retail inventory items, construction materials - accommodation or resort feeding, gear sapper, equipment and packaging, according to the regulation adopted by each public defense, public order and national security and approved by the Government, or in other situations approved by the heads of these institutions, the proposal of the chief of General Staff (similar );
C) transmission without charge from other public or religious units recognized religious denominations in Romania, under the law.
(2) For the purposes of this Ordinance, the phrase means goods decommissioned decommissioned fixed assets, fixed assets or surplus atypical, even if they are running and other material in the state is , demoted or dismissed.
(3) movable cultural goods under the law that are decommissioned can be sold by public defense, public order and national security by transmitting only, free of charge, Ministry of Culture, to be distributed specialized agencies or units of worship belonging to religious cults recognized in Romania, as appropriate, based report delivery and taking over.
(4) movable cultural likely to be classified can be sold only after triggering default and termination of filing law.
(5) The dismantling of goods in par. (3) and (4) to shutdown and use of them is forbidden. "
This law was adopted by the Parliament of Romania, in compliance with art. 75 and art. 76 para. (2) of the Romanian Constitution.
