LEGE no. 209 209 of 30 June 2005 on the empowerment of the Government to issue ordinances

The Romanian Parliament adopts this law + Article 1 Pursuant to art. 115 115 para. (1) of the Romanian Constitution, republished, the Government is empowered that, from the date of entry into force of this Law, but not before the end of the first ordinary session of 2005, until the resumption of the Parliament's work in the second Ordinary session of 2005, to issue ordinances in areas not subject to organic laws, as follows: I. Regulations needed to fulfil the commitments made in the process of integration into the European Union II. Economy, budget, finance: 1. rectification of the state budget for 2005; 2. rectification of the state social insurance budget for 2005; 3. the regulation of financial measures; 4. establishment within the Romanian financial system of the Fund for the management of radioactive waste and decommissioning; 5. regulations on the reimbursement of capital ratios for the share of the credit granted by the Government of the United States of America under Public Law no. 480/1992 for the purchase of fiber cotton from the U.S.; 6. modification and completion Government Ordinance no. 40/2000 on the accreditation of credit agencies for the administration of funds for the granting of micro-credits, approved with amendments and completions by Law no. 376/2002 ,, as amended; 7. measures to follow the execution of the obligations assumed by the privatization contracts of companies. III. Transport, construction and tourism: 1. modification and completion Government Ordinance no. 82/2000 concerning the authorization of economic agents carrying out repair, adjustment, constructive modification, reconstruction of road vehicles, as well as dismantling of used vehicles, approved with amendments and additions by Law no. 222/2003 ,, as amended; 2. perfecting the legislative framework in the field of transport in order to align with Community legislation, including the organization of the working time of the personnel carrying out mobile road transport activities; 3. arrangement, conservation and sustainable territorial development, relaunching of activity in the construction field; 4. development of activity in the field of housing construction through programs at national level; 5. development of tourism activity at national level; 6. modification and completion Government Ordinance no. 20/1994 on measures to reduce the seismic risk of existing buildings, approved and amended by Law no. 82/1995 , republished, with subsequent amendments and completions; 7. modification and completion Government Ordinance no. 81/2000 on the certification of road vehicles registered in the technical rules on road traffic safety, environmental protection and in the category of use as intended, by regular technical inspection, approved with amendments and additions by Law no. 167/2003 ; 8. modification and completion Government Ordinance no. 78/2000 on the approval of road vehicles and the issuance of their identity card, in order to admit into circulation on public roads in Romania, approved with amendments and additions by Law no. 230/2003 ; 9. modification and completion Government Ordinance no. 80/2000 on the certification or approval of equipment, spare parts and operating materials used in road vehicles and the conditions for their marketing and use, approved with amendments and additions Law no. 671/2002 ; 10. modification Government Ordinance no. 29/1997 on the Air Code, approved by Law no. 130/2000 , republished. IV. Agriculture: 1. organization of milk market; 2. regulations for the realization of the public-private partnership for scientific research in the field of agriculture, forestry and food industry; 3. regulations on investment credit in agriculture; 4. measures to stimulate the absorption of SAPARD funds; 5. regulations on annuity and early retirement; 6. establishment and consolidation of agricultural holdings ("Farmer" programme); 7. regulations on the House of Rural Credit; 8. regulations on the granting of facilities to agricultural producers and livestock farmers during the pre-accession period to the European Union; 9. modification and completion Law no. 277/2004 on the establishment, recognition and operation of producer groups, for the marketing of agricultural products, forestry and fisheries; 10. granting compensation in case of natural calamities; 11. modification and completion Government Ordinance no. 83/2003 on the approval of border inspection posts organised at border crossings established for the import, export and transit of the types of goods subject to veterinary checks and the conditions for the approval of posts of inspection at the border responsible for veterinary checks on live animals and products coming from third countries approved with amendments Law no. 524/2003 ,, as amended; 12. regulation of agricultural market in Romania; 13. organization of breeding and breeding activities in animal husbandry; 14. modification and completion Law no. 1/2004 on the establishment, organization and functioning of the Agency for Payments and Intervention for Agriculture, Food Industry and Rural Development, with subsequent amendments and completions; 15. modification and completion Government Emergency Ordinance no. 142/2000 on the establishment, organization and functioning of the SAPARD Agency for the technical and financial implementation of the Special Instrument for Pre-Accession for Agriculture and Rural Development, approved with amendments and completions by Law no. 309/2001 , with subsequent amendments and completions; 16 16. regulations on the neutralization of animal waste. V. Health: 1. modification Government Emergency Ordinance no. 150/2002 on the organization and functioning of the health insurance system, with subsequent amendments and completions; 2. modification and completion Law no. 263/2004 on ensuring the continuity of primary care through permanent centres; 3. modification and completion Government Emergency Ordinance no. 41/1998 on the organization of the medical and psychological assistance activity of transport personnel with duties in the safety of traffic and navigation and the establishment of the Health Insurance House of the Ministry of Public Works, Transport and Home, approved with modifications by Law no. 773/2001 . VI. Work and social solidarity: 1. modification Law no. 203/1999 on work permits, republished, as amended; 2. modification Government Ordinance no. 14/2003 on the establishment, organization and functioning of the National Authority for Persons with Disabilities, approved with amendments and additions by Law no. 239/2003 , with subsequent amendments and completions; 3. modification and completion Government Ordinance no. 137/2000 on the prevention and sanctioning of all forms of discrimination, approved with amendments and additions by Law no. 48/2002 , with subsequent amendments and completions. VII. Education and culture: 1. modification and completion Law no. 157/2004 on the establishment of the special scholarship "Romanian Government" for the training of public sector managers; 2. regulations on the management of public cultural institutions; 3. regulations on cinematography; 4. amendment of para. ((2) art. 86 of the Physical Education and Sports Law no. 69/2000 , with subsequent amendments and completions. VIII. National defence, public order and national security: 1. modification and completion Government Ordinance no. 128/2000 on the establishment of tariffs for services provided as a matter of urgency for individuals and legal entities by the Ministry of Interior, approved with amendments by Law no. 570/2002 ; 2. modification and completion Government Emergency Ordinance no. 144/2001 on the fulfilment by Romanian citizens, when leaving the country, the conditions of entry into the Member States of the European Union and other states, approved with amendments and completions by Law no. 177/2002 , with subsequent additions; 3. modification and completion Government Ordinance no. 65/1997 on the passport regime in Romania, approved with amendments Law no. 216/1998 , with subsequent amendments and completions; 4. modification of some normative acts regarding the establishment, organization and functioning of emergency services; 5. organization and conduct of courier activity for NATO classified materials; 6. modification and completion Government Emergency Ordinance no. 189/2002 on countervailing operations relating to procurement contracts for defence, public order and national security needs, approved with amendments and additions by Law no. 354/2003 ,, as amended; 7. regulations on food rights, equipping and endowment with medicines and sanitary materials of personnel from the national defense system, public order and national security during mobilization, curfew, state of emergency and at war; 8. modification and completion Law no. 138/1999 on the payroll and other rights of military personnel in the public institutions of national defence, public order and national security, as well as the granting of salary rights to civil personnel in these institutions, as amended and subsequent additions. IX. Public administration: 1. modification and completion Government Emergency Ordinance no. 11/2004 on the establishment of reorganisation measures within the central public administration, approved with amendments and additions by Law no. 228/2004 , with subsequent amendments and completions; 2. modification and completion Government Ordinance no. 41/1994 on the authorization of payment of contributions to intergovernmental international organizations to which Romania is a party, approved by Law no. 126/1994 , with subsequent amendments and completions; 3. the extension of some deadlines provided for in normative acts with the force of law; 4. modification and completion Law no. 490/2004 on the financial stimulation of staff managing Community funds; 5. measures to reorganize the Authority for the valorization of State Assets and the Office of State Participations and Privatization in Industry. X. Justice, transparency, human rights: 1. modification of some provisions of Law no. 187/1999 on access to its own file and the disclosure of security as a political police; 2. modification of some provisions of Government Emergency Ordinance no. 177/2002 on the payroll and other rights of magistrates, approved with amendments by Law no. 347/2003 , as amended, as well as the uniformity of the regulations relating to the granting of salary increases established by Law no. 508/2004 on the establishment, organization and functioning within the Public Ministry of the Directorate for the Investigation of Organized Crime and Terrorism, with subsequent amendments and completions and by Law no. 304/2004 on judicial organisation, as amended. + Article 2 According to the provisions of art. 115 115 para. (3) of the Romanian Constitution, republished, the ordinances issued by the Government pursuant to art. 1 will be submitted for approval to the Parliament, according to the legislative procedure, until the resumption of the Parliament's work in the second ordinary session of 2005.
